  • LEGAL ADVICE: There was no link between Kyari and the Hushpuppi gang- Malami SAN

LEGAL ADVICE: There was no link between Kyari and the Hushpuppi gang- Malami SAN

Attorney-General of the Federation and Minister of Justice, Abubakar Malami, SAN, in his latest legal advice dated February 4, 2022, with reference number, DPPA/LA/814/21, has sought to exonerate the former Commander of the Police Intelligence Response Team, Abba Kyari, saying there was no link between Kyari and the Hushpuppi gang.

This advice contradicted his January directive that Kyari should be probed for money laundering and for receiving 33 proceeds of crime.

According to the letter written on behalf of the AGF by the Director of Public Prosecutions, Ministry of Justice, Mohammed Abubakar, the evidence contained in the case diary “was not sufficient to indicate or show that the said monies (N279mn) were laundered directly or indirectly by Kyari to disguise their origin.”

The new position of the attorney-general was contained in a letter titled, ‘Re: Forwarding of the investigation report of the Nigeria Police Force Special Investigation Team and request for legal advice with regards to allegations of criminal conspiracy, aiding and abetting Internet fraud, wire fraud, identity theft and money laundering against DCP Abba Kyari.”

The letter addressed to the IG, read in part, “I am directed to inform you that after a careful study of the said response wherein you stated that ‘the monies have been traced to Zenith Bank account no. 2255416115 belonging to Usman Ibrahim Waziri; Guaranty Trust Bank account no. 0130665392 belonging to Adekoya Sikiru; Zenith Bank account no. 2080537566 belonging to Hussein Ala and other funds went to Sharon Festus. The monies were withdrawn and utilised by the aforementioned account holders and the lady.

“It is our view that the above response has not linked the suspect, DCP Abba Kyari, to the offence of money laundering as the evidence contained in the case diary is not sufficient to indicate or show that the said monies were laundered directly or indirectly by Kyari to disguise their origin, more so that the aforementioned recipients or receivers exonerated him in their statements as having nothing to do with the monies.”

The justice minister said the police might wish to explore their internal disciplinary measures against Kyari through the Police Service Commission for breaching the code of conduct for law enforcement officers by hobnobbing with suspected fraudsters and people of questionable means in his capacity as a senior officer and head of the IRT.

Malami also said Kyari could be sanctioned for violating the social media policy of the police by responding to the Federal Bureau of Investigation’s indictment on Facebook; breaching the Police Code of Professional Ethics by accepting complaints and acting on such without recourse to established protocol and detaining a suspect, Vincent Chibuzor, for over a month without a valid court order and regards to his fundamental human rights.
According to the DPP, the AGF’s new position was based on the police report, noting that the police failed to probe the gaps identified in their investigation by the ministry.

Abubakar insisted that the ministry did not say there was no evidence of money laundering against Kyari.
The DPP stated, “We said in the absence of the evidence, further investigation is needed and they should go ahead to try him on the administrative offences they have identified. We said they (police) should establish linkages – the money trail.

“Instead of them to go and investigate further the gaps we identified, they didn’t. They just wrote back to say ‘check paragraphs so and so’. We are saying no, those paragraphs did not sufficiently establish the things we say you should establish.”

Meanwhile, the police have yet to submit a fresh report on Kyari as directed by the Police Service Commission, PSC.

The commission had rejected the police investigation on Kyari carried out by the SIP led by DIG Joseph Egbunike. It ordered a fresh one, which should have been submitted on February 25.

  • No deadline extension for 2022 UTME registration – JAMB

No deadline extension for 2022 UTME registration – JAMB

The Joint Admissions and Matriculation Board (JAMB) says there may be no extension of registration deadline for candidates, for the 2022 Unified Tertiary Matriculation Examination (UTME).

The Registrar of the board, Prof. Is’haq Oloyede dropped the hint while monitoring the registration exercise in some centres on Friday, in Lagos.

According to him, feelers reaching the board from states across the country reveal that the exercise has been seamless, hence there may be no room for an extension.

Registration started across the country on Saturday, Feb. 19 and will be concluded on March 26.

“We are not expecting any extension. I want to say that we are very happy with the way the exercise has been going, two weeks after it started.

“More than 55,000 have already registered today alone and we had expected at least 50,000 to register as at today, nationwide. But for the few disruptions witnessed in some of these centres, it is possible to register even 100,000 candidates in a day.

“Our target is to make sure that about 100,000 are able to register in a day. Therefore, so far,
I must say I am very satisfied with the registration exercise nationwide.

“The development gladdens my heart because it shows that we are on course, despite the few glitches witnessed in the registration exercise in some centres, there has been a huge progress made,” he stated.

He said that in all, almost 600,000 UTME and Direct Entry (DE) candidates had been registered, noting that with the level of progress made already, coupled with the seamless, process, he did not foresee the need for an extension of the exercise.

“We have hardly had complaint concerning the code 55019, where candidates should send their NIN numbers to, after following the laid down steps.

“We even introduced the 66019, another code, and I must tell you that we have not even used that one; it has been redundant.

“That goes to show you that 55019 is working and is still working. Any candidate having issues with it must be a self-inflicted one, on his or her part.

“It has never been this smooth. So, now, we are having capacity problem, apparently, which started day before yesterday.

“We have spoken with our service providers and Airtel has come on board with expansion. We are expecting MTN to come up with expansion too, so that this disruption will not continue.

“We hope in the next few hours, the few technical hitches currently being experienced will be taken care of and we will be able to have the exercise run smoothly,” he stated.

The JAMB boss attributed some of the challenges to heavy traffic, adding that too many candidates were trying to register at the same time.

“I think the traffic is heavy. What it means is that in the past you will register 25,000 or 30,000 candidates in a day. But here we are, registering over 50,000 candidates in a day.

“Apparently, what is always obvious is that the system is not taking the traffic. That is what I think is responsible for this kind of challenge, which like I said, will be taken care of as we progress.

“The service providers are now working toward expansion, so that it can take as many candidates as possible.

“Traffic is heavier than expected and we have mobilised resources to ensure it is solved. And that is why this kind of thing we are doing is seen as dynamic in nature.

“We have seen what the challenge is and we have been talking to all our service providers; this is just to ensure that each and every one of them expands to accommodate the traffic.

“And we have no problems with that, because as at now, we have registered more than one third of the expected number of candidates,” he said.

On whether the candidates could carry out the registration exercise on their own, the registrar noted that it was quite possible, but that the board was guarding against that for now, in order to avoid more confusion.

“For instance, if we ask these candidates to go and do it on their own, some people would want to take undue advantage of them and in the end, create problems for them.

“It is not like we cannot make it available. If you leave it open, like many people are citing UK and the U.S., they forget to know that it may not be that easy to obtain same here.

“Some persons could want to use it to backmail these candidates, seize their data and continue to manipulate them.

“So, it is not like we like to control all what they are doing, but we must do it in the interest of these candidates, because if you leave it open, of course, there are many fraudsters that may want to take advantage of them, seize their data and continue to change and manipulate things.

“There are so many reasons. You see, when you are not in the field, you are a better player. But when you are in the field, it takes so many other things for you to come out victorious,” Oloyede explained.

According to him, it will be easier for JAMB to ask candidates to do the registration online on their own, but with the the nature of what the board is doing, the candidate may be disadvantaged, as anybody could do anything.

He said that there was therefore no way the board would leave the registration open for the candidates for now, noting that good and attractive as it may sound, there was more to it.

Oloyede commended other service providers such as NIMC for a job well done, noting that so far, it had done well.

“I must also commend NIMC for what it has done so far, especially toward the build up of this registration exercise.

“From what I have seen this year, NIMC has done well. There might be a few problems here and there but definitely I respect the level of improvement in NIMC.

“I must say they have done well and I am proud of them,” he said.

Also speaking, the board Head, Media and Information, Dr Fabian Benjamin, told NAN that only about 200,000 candidates were registered as at this time last year, compared to the 600,000 that had currently registered.

On the number of centres that would be participating in the conduct of the examination proper, Benjamin, who was in company with the registrar, noted that it was not yet certain, as monitoring was ongoing across the country.

“As we speak, we are under monitoring exercise, any centre not found to be fit for the exercise will be delisted.

“So, we do not have the exact number that would participate in this year’s examination, until we are through with the monitoring exercise,” he said.

Benjamin noted, however, that over 700 centres were being used for the registration exercise.

Centres visited in Lagos include WAEC Test and Training Centre, Ogba, JKK centre, on Ikorodu Road, as well as Dalewares on Bode Thomas Street, off Ikorodu Road, among others.

” The Osun Development Association (ODA) a non-partisan and development focused organization made up of eminent indigenes of Osun State from all works of life views with serious concern the current tension and anxiety in the state with regards to political activities preceding the Governorship election planned to hold in the State in July 2022.

“We are justifiably troubled that the evolving situation is creating a major breach of peace and order in our State 2. For all peace loving citizens of the state, the full dividends of democracy can only be enjoyed in an atmosphere of law and order.

“This is the basic requirement for our State in the quest for sustainable development. However unfolding events of the past few weeks seem to suggest that great danger lies ahead. Therefore there are reasonable grounds for apprehension as political thuggery and violence associated with intra party primaries are being presented as an ugly precursor to the mayhem that may characterize the main election.

“This is certainly unfair to the peace-loving people of Osun State, which the politicians are aspiring to serve. 3. The struggle for the control of political party structures, the process of choosing party flag bearers and the election of the State Governor are normal processes that must be part of every electoral cycle.

“Political parties must strengthen their internal structures to ensure that their processes do not create problems for other law- abiding citizens.

“ODA condemns in the strongest terms unnecessary political brigandage that could make intra party and interparty misunderstanding snowball into full bloody crises. The Association offers its platform for conflict resolution which we have deployed to successive State administrations since the Association was founded in 1995 and calls on all people of goodwill within and outside Osun State to broker peace for sustainable development.

“We urge all Stakeholders involved to exercise great restraint in their utterances and conduct to prevent further escalation of a breach of peace.

“The windows of reconciliation must be kept open to keep our State peaceful. 5. ODA welcomes the recent peace pact signed by representatives of the major political parties facilitated by the Osun State police command. Through this instrument the representatives of the parties committed themselves to eschew violence from the electioneering process we urge all party members and their followers to live up to the letters and the spirit of these peace agreements.

  • SEC optimistic of capital market growth in 2022

SEC optimistic of capital market growth in 2022

The Securities and Exchange Commission (SEC) has expressed optimism of the capital market growth in 2022 due to its various initiatives.

The Director-General of SEC, Mr Lamido Yuguda, said this in a statement released by the Commission in Abuja on Sunday.

He expressed hope that as the restrictions of COVID-19 and its variants were eased up, the market would witness renewed confidence expected to introduce investments from domestic and foreign investors.

Yuguda said that SEC would also inaugurate the revised version of the 10-year Capital Market Master Plan during its forthcoming conference.

He said the plan would reflect the dynamism of the market and developments in FinTech among others.

”As we expect improvements in both economic and capital market activities, we must remain committed to developing the market in line with the 10-year Master Plan.

”Some of the key initiatives to be pursued in 2022 are the repeal of the Investment, Securities Act (ISA) 2007 and passing of the Investment and Securities Bill 2021.

“In conjunction with the National Association of Securities Dealers (NASD) platform, we will provide the necessary incentives and support to attract SMEs to get listed.

”Already, rules on crowd-funding to encourage new funding sources for the SMEs have been developed.

”The SEC will continue to enhance the existing regulatory framework guiding the operations of the market by keeping pace with the evolving changes in market practices,” he said.

Yuguda said the Commission would improve coordination with other stakeholders such as the National Assembly, CBN, PENCOM, NAICOM, DMO and FIRS to create synergies toward ensuring that the objectives of the master plan were met.

He added that the SEC would carry out advocacy efforts to relevant government agencies to ensure the listing of their shares.

He explained that policies would also be championed to incentivise companies, like the new Dangote Refineries to offer its shares to the public and list on any of the commission’s registered platforms.

”We also plan to provide extra support to the registered commodities trading platforms to complement government’s renewed diversification efforts in agriculture,” he said.
