    BREAKING: Appeal Court affirms Adeleke winner of Osun gov election

    The Court of Appeal sitting in Abuja has affirmed the election of Gov.  Ademola Adeleke of Osun.

    The appelate court set aside the verdict of the Osun State Governorship Election Petition Tribunal, which sacked him from office.

    Delivering judgment in the appeal filed by Adeleke on Friday, a three-member panel of Justices led by Justice Mohammed Shuaibu, held that the Tribunal erred when it ruled that the 1st and 2nd respondents (Gboyega Oyetola and the All Progressives Congress) proved their allegation of over-voting in the July 2022 election.

    The Osun Governorship Election Petition Tribunal in January held that Oyetola was able to prove that there was over-voting in some of the polling units.

    Consequently, the majority judgment of the Tribunal ordered INEC to withdraw the certificate of return issued to Adeleke and issue a fresh one to Oyetola as the duly elected governor of Osun instead.

    Osun to enact disability protection law – Adeleke

    Gov. Ademola Adeleke of Osun on Tuesday said that the state will soon enact disability law to cater for the needs of people living with disabilities.

    Adeleke said this during the distribution of support materials to people with disabilities in Osogbo.

    The governor said his administration would review the legal framework as it affects the people with disabilities within state.

    He said that all the needed legislative and executive actions toward the enactment of law would be launched without further delay.

    “Our administration is committed to supporting this segment of the citizenry. We will work to comply with local and international best practices.

    “More specifically, our administration will review the legal framework as it affects the people with disabilities within Osun state.

    “Osun must get a disability law in due course to cater for the needs of this class of our society.

    “To our people with special needs, this administration will ensure that the final law addresses all your concerns.

    “Once the legal framework is formalised, be rest assured of full implementation as may be prescribed,” he said.

    Adeleke, who noted that government had the responsibility to support all categories of its citizenry, said the distribution of the support materials programme was designed to strengthen people with special needs.

    The governor, while commending the people of the state for the success of the Saturday’s house of assembly election, also sympathised with victims of political violence in the state.

    “While we celebrate the successes of the poll, we equally sympathise with victims of political violence across the state.

    “We are saddened by deliberate acts of thuggery in some parts of the state. I will repeat here that election is not war but choice making.

    “Now that elections are over, I call on all Osun people to get back to work and focus on the urgent task of building a better Osun state.

    “Now is the time to support the government’s efforts to address our developmental challenges.

    “We need all hands on deck to improve the growth of the various sectors of the society,” he said.

    Oyetola asks Appeal Court to declare Adeleke unqualified over alleged certificate forgery

    Mr. Gboyega Oyetola of the All Progressives Congress (APC), on Monday, asked the Court of Appeal, Abuja to declared Gov. Ademola Adeleke of Osun unqualified to have contested the July 16, 2022  poll in which he emerged as winner over alleged certificate forgery.

    Oyetola, whose candidacy in the poll was affirmed by a tribunal, made the prayer in a cross appeal marked: CA/AK/EPT/GOV/03/2023 filed before the three-member panel headed by Justice Mohammed Shuaibu.

    The 1st and 2nd cross appellants in the case are Oyetola and the APC respectively.

    In the matter, the Independent National Electoral Commission (INEC), Adeleke, and the PDP are the 1st to 3rd cross respondents respectively.

    NAN also reports that Adeleke had, in an appeal marked: CA/AK/EPT/GOV/01/2023, prayed the court to set aside the judgment of the Osun tribunal delivered on Jan. 27 which upturned his victory at the poll.

    Adeleke, who dragged Oyetola, APC, and INEC before the appellate court as 1st to 3rd respondents respectively, urged the panel to dismiss the tribunal’s judgment.

    Onyechi Ikpeazu, SAN, who was counsel to Adeleke, challenged the decision of the tribunal which nullified the victory of his client in the governorship election.

    Ikpeazu, argued that a member of the tribunal, who was also a chief magistrate, did not air her opinion during the judgement delivery.

    Rather, he said she only appended her signature and the constitution mandated her to have aired her views about the suit.

    But Oyetola’s counsel, Lateef Fagbemi, SAN, disagreed with Ikpeazu.

    The senior lawyer submitted that mere signing of the judgment, and not making any comment could not have rendered the judgment invalid.

    He further argued that Justice Terste Kume, who headed the tribunal, in the open court, made a pronouncement while delivering the judgment using the expression, “We, members of the tribunal…,” to imply that the decision was unanimous.

    He also argued that there was over-voting in 744 polling units across the state.

    Fagbemi urged the court to dismiss Adeleke’s appeal.

    Arguing the cross appeal, Akin Olujimi, SAN, who appeared for Oyetola, prayed the court to declare Adeleke unqualified to have contested the election, in the first instance, over allegations bordering on certificate forgery.

    INEC had, on July 17, 2022, declared Adeleke the winner of the governorship election conducted on July 16, 2022 after polling a total of 403,371 votes.

    He was said to have won in 17 of the 30 local government areas in the state.

    But Oyetola and his party, the APC, approached the court to challenge the victory on the grounds that there was over-voting and that Adeleke was not eligible to run at the time.

    The Osun State Governorship Election Petition Tribunal had, on Jan.  27, voided the July 16, 2022 election that produced Adeleke of PDP as the elected governor.

    The panel led by Justice Kume, in its judgment, invalidated the election and declared Mr Gboyega Oyetola of APC as the valid winner of the poll.

    The tribunal directed INEC to withdraw the certificate of return issued to Adeleke and his deputy, Kola Adewusi, both of whom had been sworn in.

    It, however, directed that the certificate of return should instead be issued to Oyetola.

    Justice Kume held that the governorship election was not held in compliance with Nigeria’s Electoral Act.

    The tribunal also held that the governorship election was characterised by over-voting.

    The tribunal, thus, ordered that Oyetola should be returned as governor of Osun State.

    Olujimi, in his argument on Monday, said that that they were able to prove a case of forgery against Adeleke but the tribunal failed to make a consequential order in that regard.

    He said the development led to the filing of the cross appeal.

    He said Adeleke, who vied for the governorship position, submitted a forged certificate to INEC.

    He stated that besides the issue of over-voting established by the tribunal, the cross respondents erroneously thought Adeleke was eligible to contest in the poll even with the controversy surrounding the certificate forgery.

    Olujimi argued that having found that the case of forgery was proved by the petitioners (Oyetola and APC) against the 2nd cross respondent (Adeleke) in regard to his Exhibit EC9 and FILE D, the tribunal ought to have held pursuant to Section 182(1)(j) that Adeleke was not qualified to have vied for the July 16, 2022 Osun governorship election.

    He also submitted that Adeleke failed to call evidence to disprove a case of forgery against him, saying that “an evidence tendered in one case cannot be relied on in another case.”

    He urged the court to uphold the cross appeal.

    Counsel to INEC, Paul Ananaba, SAN, said the cross appeal was hollow, praying the court to dismiss it

    Also, Adeleke’s lawyer, Ikpeazu, urged the court to dismiss the cross appeal.

    He argued that since Oyetola and APC were the petitioners before the tribunal, they ought to have called evidence to prove their case, and not the respondents.

    Alex Iziyon, SAN, lawyer to the PDP, also aligned with Ikpeazu’s submission.

    After taking arguments from counsel to the parties, Justice Shuaibu reserved judgment in the case.

    Bank should stop issuing old notes to customers – Gov. Adeleke

    Gov. Ademola Adeleke of Osun, has warned commercial banks in the state to stop issuing old naira notes to customers, if they will not accept it back as deposits.

    This is contained in a statement by his spokesperson, Malam Olawale Rasheed, on Monday in Osogbo.

    The governor said that the maltreatment of residents of the state by commercial banks refusing to collect old currency notes, even after paying customers with such notes, is worrisome.

    Adeleke said that he had received many complaints from bank customers, who accused the banks of refusing deposits of old notes as well as the attendant negative consequences on the populace.

    “I have received several calls from Bank customers across the state. The deliberate refusal of banks to collect old notes is creating serious economic complications for residents of the state.

    “For the banks to issue old notes and refuse to accept old notes as deposit is highly unacceptable.

    The governor, however, called on the Central Bank of Nigeria to direct the banks operating in the state to correct the anomalies.

    “The state director of the CBN is specifically requested to direct the banks to halt this unhealthy practice.

    “If banks will not accept old notes as deposits, they must stop issuing old notes for withdrawal. The current pain being inflicted on our people must stop,” he said.

    Appeal Court begins hearing in Adeleke’s appeal against Osun tribunal judgment

    The Court of Appeal, Abuja, on Monday, commenced sitting in an appeal filed by Mr. Ademola Adeleke of the Peoples Democratic Party (PDP) against a judgment of the tribunal which invalidated his election as governor of Osun.

    The three-member panel of justices led by Justice M.F. Shuaibu, began sitting in the appeal at about 10am.

    While Adeleke is the appellant, Oyetola and the All Progressives Congress (APC) are 1st and 2nd respondents in the appeal marked: CA/AK/EPT/GOV/01/2023.

    The Independent National Electoral Commission (INEC) and the PDP are also joined as 3rd respondent and 4th respondents respectively.

    The News Agency of Nigeria (NAN) reports that the Osun State Governorship Election Petition Tribunal had, on Jan. 27, voided the July 16, 2022 election that produced Adeleke of PDP as the elected governor.

    INEC had declared Adeleke the winner of the election after polling a total of 403,371 votes.

    He was said to have won in 17 of the 30 local government areas in the state.

    But the panel led by Justice Terste Kume, in its judgment, invalidated the election and declared Mr Gboyega Oyetola of APC as the valid winner of the poll.

    It said after deducting the excessive votes, the figure Oyetola polled at the election was 314, 921.

    The tribunal, thus, ordered that Oyetola should be returned as governor of Osun State.

    INEC, in its earlier results, said Oyetola won in 13 LGAs with 375,027 votes in the July 16, 2022 governorship election.

    Fifteen candidates contested for the poll which was keenly contested between Adeleke and Oyetola.

    In his petition, Oyetola, the immediate-past governor of the state, had alleged that the election was characterised by over-voting in 749 polling units.

    He also argued that Adeleke forged the academic credentials he submitted to NEC to contest for the election.

    The tribunal had commenced sitting in August 2022, a few weeks after the governorship election.

    Oyetola and the APC were petitioners in the case with Lateef Fagbemi, SAN, and Akin Olujimi, SAN, as their lead counsel.

    INEC was the 1st defendant, Adeleke the 2nd defendant, and PDP as 3rd defendant.

    The hearing was still ongoing as at the time of filing the report.

    Gov. Ademola Adeleke of Osun said that his administration, in its first 100 days, had redirected the government’s efforts toward meeting the needs of the people.

    Adeleke, who was sworn in on Nov. 27, 2022 as the sixth executive governor of the state, said this on Tuesday at a news conference in Osogbo, while rolling out the administration’s achievements in the period.

    The governor said he had made provision for potable water in each of 333 wards in the state and constructed 20-kilometre roads across the state.

    He said that the administration had presented the sum of N518 million to 40 communities for infrastructure development.

    In the area of health, Adeleke said under the Imole surgical and medical outreach, 2000 persons in each of the nine federal constituencies in the state would benefit from free medical care.

    He said this was in addition to the enrollment of 3000 indigenes on the Osun Health Insurance Scheme (OHIS).

    The governor also said that since his assumption of office, he had made provision for transformers and other electrical materials in communities without electricity in an ongoing project.

    Adeleke said he had started the payment of salaries and pension arrears from January 2016,  owed by the past administration.

    On infrastructure development, the governor said he had embarked on the rehabilitation and construction of roads across the state.

    He said in a bid to ensure food security in the state, he had approved subsidies on fertilisers and other farm inputs for farmers in the state.

    The governor also revealed that he would be giving bond cheques to the contributory pensioners in the state on March 10.

    He promised that in the next few months, he would embark on robust delivery of services in the area of climate change action plans for job creation.

    Adeleke said that he would also focus on tourism and entrainment, and application of telemedicine to expand healthcare access for artisans, among others.

    “To that end, Osun people should expect more robust delivery of services as well as new initiatives,” he said.

    WAHALA in Delta: INEC offcials, Adeleke, others held hostage in Warri

    Apparently disappointed for disenfranchising them, some voters in Warri south local government area of Delta State in Saturday presidential poll, are holding hostage three ad-hoc staff of the Independent National Electoral Commission (INEC).

    The trio of Adeleke Balikiz Yetunde, Udoh Stephanie and Theresa Igein, were reportedly held hostage at Oki Street, Okere Road, Ward 4 Polling Unit 19 after the Bimodal Voters Accreditation System (BIVAS) brought for the rescheduled presidential and National Assembly elections in the area allegedly crashed.

    The angry voters had waited endlessly to exercise their civic duty since Saturday with no success as INEC staff had reneged in bringing the election materials to the area.

    Following the disclosure that the BVAS machine weren’t working, the voters ordered the three ad-hoc staff not to move an inch or pay the price.

    It was learnt at the INEC Secretariat at Esisi road from an official of INEC who was intimating the Electoral Officer, Mr Kingsley Ogboe, in company of DSS officials in Warri South of the hostage saga.

    The INEC official reported that the three ad-hoc staff were in danger and needed urgent rescue, but couldn’t render help as they were overpowered.

    The angry voters protested and argued that the Electoral Officer in Warri South, Mr. Ogboe, appeared to have already compromised the elections in the council area, accusing him of trying to subvert the rights and will of the vote.

    One of the voters alleged that the adhoc staff incurred the wrath of the people when she switched over to start administering manual voting against the acceptable norm of Bimodal Voters Accreditation System (BIVAS) before voting.

    Lamenting her ordeal, Adeleke Balikiz Yetunde, one of ad-hoc staff said; “The BVAS crashed when were trying to reboot it. We call the RAC because they said it was a technology problem.

    “They said they didn’t reconfigure it to read today (Sunday) because it was till reading yesterday (Saturday).

    “So we became stuck as a result. Now they’re accusing me of collecting N50,000, I don’t know anyone here and I didn’t collect any money.

    The two other adhoc staff, Udoh Stephanie and Theresa Igein, lamented that the Supervisory Polling Officers (SPO’s) dumped them at the polling units and left without security when they knew the BIVAS was not configured properly.

    “We’re supposed to do the work since yesterday but because of no voting took place here, they moved the exercise to today. Alot of our colleagues pulled out and now I am regretting not pulling out, Adeleke added.

    One of the community leaders, said it is unfortunate that the machine clashed saying “I can assure you that anything will happen to her.”

    Another angry voter, Rev. Charles, lamented, “We have been here since yesterday when the rain started falling. We waited till night and nothing happened.

    “To me the INEC officials are not been sincere to us, this is the not the way to treat citizens. Are they saying that we should leave here without voting,” he queried.

    As of 6:45p.m, the three hostages were still in custody of their captors, the Yoruba lady among them, Yetunde was reportedly regretting not rejecting the casual INEC job.

    Meanwhile, when contacted at about 11:16p.m, Bukola Ojeme Head, INEC’s Voter Education & Publicity, Asaba⁩, said “security agencies, at the instance of the Hon. REC, are making efforts to free the adhoc staff.”

    Gov Adeleke dissolves Osun Youth Empowerment Scheme

    Gov. Ademola Adeleke of Osun has dissolved the Osun Youth Empowerment Scheme (O-YES), and replaced it with ‘Imole Youth Corps’.

    This is contained in a circular issued by the Secretary to the State Government, Mr Teslim Igbalaye, on Thursday in Osogbo.

    It said that the decision was taken to reposition the youth empowerment programme inherited from the previous government for effective functionality, sustainability and dignity of labour.

    The circular noted that the replacement was in fulfilment of one of the governor’s electoral promises in ensuring meaningful and proper youth engagement in the state.

    “A new scheme code named Imole Youth Corps is hereby put in place to engage our teeming youths in the state.

    “Application forms will be available for prospective youths in all the 30 Local Governments, including Ife East Area Office of the State FREE of charge beginning from Friday, 17th February, 2023,” the circular reads.

    OYES was established by former governor of the state, Rauf Aregbesola, which was sustained by his successor, Gboyega Oyetola, for youth empowerment.

    Gov. Ademola Adeleke, of Osun says he has faith, trust and confidence in the judiciary to right the wrong as chamber of justice and remedy.

    A statement by Mallam Rasheed Olawale, spokesperson to the governor, issued on Friday in Osogbo, said Adeleke made the remarks while receiving Unit-to Unit Ambassadors of Peoples Democratic Party (PDP), from Osun West Senatorial District.

    Adeleke, who noted that the judiciary plays an important role in strengthening democracy, said the various judicial interventions had helped to stabilise the nation.

    ” Democracy revolves around the wheel of justice. Justice dispensation is the realm of the judiciary.

    “All democrats must therefore have unshaken faith in the judiciary. I have that trust and confidence in the judiciary to right the wrong and deepen our democracy.

    “I am a beneficiary of judicial intervention. I cannot forget how the judiciary cleared me of forgery allegations.

    ” You can’t have a strong democracy unless we all hold the judiciary as the indispensable arbiter”, he said.

    On the tribunal judgement that nullified his victory at the last governorship election in the state, Adeleke said he would appeal the judgement, and expressed the optimism that his mandate would be revalidated.

    ” So we are going on appeal and we trust we are going to get justice. I urge all of us to be calm and go about our daily activities peacefully.

    “I understand how hard and emotional the judgement is to the people of Osun state, but we must vent our disagreement only through the judicial process.

    “That is why there is an appeal process. We have all the grounds to appeal and we are doing that.

    ” So continue your campaign unit to unit. We are running Osun state to deliver on the will and aspirations of the people.

    “By God and man, our mandate will be revalidated through the same judicial process”, he said.

    Recall that the election petition tribunal had nullified the election of Adeleke.

    The Chairman of the three-man panel, Justice Tertsea Kume,  while reading the judgement, said the July 16, 2022 governorship election was not conducted in compliance with the electoral act.

    The Election Petition Tribunal chaired by Justice Tertsea Kume has sacked Osun Governor, Senator Ademola Adeleke.

    Tertsea said the July 16, 2022 governorship election did not comply with the Electoral Act.

    The majority judgement of two judges against one ordered that Certificate of Return should be withdrawn from Adeleke and issued to Adegboyega Oyetola.

    The Tribunal chairman said that there was indeed over-voting in six local government areas in the state.
