Abuja Court Strikes out Suit Seeking to Void Adeleke’s Nomination as Governor-Elect

The Federal High Court, Abuja on Thursday struck out a suit filed by Awoyemi Oluwatayo Lukman, seeking to void the nomination of the Osun State as the governor-elect, Ademola Adeleke, as the governorship candidate of the Peoples Democratic Party (PDP).
Lukman had dragged the Independent National Electoral Commission (INEC), PDP and Adeleke before the court seeking order to void and set aside the submission of Adeleke’s name to INEC on grounds of alleged unlawful action.

Lukman argued that Adeleke’s name was hurriedly submitted by PDP on March 11, 2022, as against between March 14 and 18 provided in the INEC guidelines.

He maintained that having submitted Adeleke’s name before the period fixed by INEC, the court should declare the submission illegal, unlawful, null and void and be set aside.

He also claimed that INEC must be bound by its official guidelines and that anything done outside the guidelines should be considered to be against the provisions of the Electoral Act 2022.

However, Daily Post reports that in his judgment, Justice Obiora Egwuatu struck out the suit on the ground that the said Awoyemi Oluwatayo Lukman lacked locus standi to have instituted the case.

Justice Egwuatu also held that the suit was statute barred having been fixed outside the 14 days stipulated by Section 285 of the 1999 Constitution that all pre-election suits must be filed within 14 days whereas, the instant suit was filed after 28 days.

My victory cannot be stolen through backdoor – Osun governor-elect, Adeleke

The Osun governor-elect, Ademola Adeleke has urged his supporters to keep calm ahead of the election petition tribunal and that his victory cannot be stolen.

Recall that the All Progressives Congress in Osun State and the state governor, Adegboyega Oyetola had on Friday submitted a petition at the Osun State Governorship Election Petition Tribunal in Osogbo to challenge the victory of Senator Ademola Adeleke.

The chairman of the party, Gboyega Famodun, had on Thursday, hinted that the APC was ready to drag the Independent National Electoral Commission (INEC), Peoples Democratic Party (PDP), and its candidate to Election Petition Tribunal.

In a statement issued by his spokesperson, Olawale Rasheed on Saturday, Adeleke declared that the July 16th election was one of the most transparent elections in recent Nigerian history.

Adeleke also assured that the people’s mandate freely given against overwhelming odds will be defended and validated.

The statement revealed that the “PDP legal team is taking appropriate action on the filing. I call on my supporters at home and abroad to remain calm as this divine victory cannot be stolen through the backdoor

“I urge the good people of Osun State who voted massively to reject bad governance to remain calm. We are doing the needful to defend their mandate. We will do all within our powers to ensure judicial validation of our victory as this is an election globally certified as a great advancement in electoral transparency and integrity.

“We also want to reaffirm our faith in the judiciary as a bastion of hope and justice. We have unshakeable trust in God that this election petition shall end in another landmark victory for us and the resilient people of Osun state,” the statement concluded.

  • OSUN ELECTION: Oyetola asks Tribunal to annul Adeleke’s victory over forged certificates

OSUN ELECTION: Oyetola asks Tribunal to annul Adeleke’s victory over forged certificates

Governor of Osun State, Adegboyega Oyetola, has demanded that the election of the governorship candidate of the Peoples Democratic Party, Ademola Adeleke, be annulled over a forged certificate.

Oyetola, in his petition to the Election Petition Tribunal in Osogbo, pointed out that the election was fraught with certain irregularities.

According to him, Adeleke ought not to have been declared winner as he was not qualified to have contested the election in the first place, having submitted forged certificate to the Independent National Electoral Commission, INEC.

TheNewsGuru.com reports that Adeleke was returned elected by the INEC, after defeating his closest challenger, Oyetola, and 13 other candidates, scoring a total of 403, 371.

Oyetola got 375, 027 votes and won in 13 Local Government Areas of the state to come second in the election.

A member of Oyetola’s legal team, Kunle Adegoke (SAN), in an interview, immediately after filing the petition in Osogbo said the governor has assembled 50 lawyers including 10 Senior Advocates of Nigeria, listing 13 grounds on which premises Adeleke should be disqualified.

Other key members of the legal team included Prince Lateef Fagbemi (SAN), Chief Akin Olujumi (SAN), Prince Biodun Layonu (SAN/, Muritala Abdulrasheed (SAN).

Adegoke said the election in many 749 polling units were fraught with irregularities.

The legal team, he said, has established by the petition that the election in those 749 polling units across 10 Local Governments in Osun State was characterized by irregularities pertaining to overvoting.

Adegoke said, “We have nothing less than 50 lawyers, including 10 SANs that we cannot list all of them, so we have listed about 20 lawyers in the petition. We have 13 reliefs.

OSUN: Oyetola asks Election Petition Tribunal to annul Adeleke's victory over forged certificates

“What we are contesting is that the election is fraught with certain irregularities by which the person declared winner ought not to have been declared and the petitioner, Alhaji Isiaka Gboyega Oyetola ought to have been declared the winner on the ground that Nurudeen Ademola Adeleke was not qualified to have contested the election in the first place, having submitted a forged certificate to INEC.

“The second is that the election in 749 polling units was fraught with irregularities and the election in those units ought to have been nullified. All the polling units mentioned are in 10 Local Governments, out of 30.

“So, if the election in those units is nullified and the votes are canceled, then Alhaji Isiaka Gboyega Oyetola will have comfortable requirements of the constitution to be declared winner of the election.”

Asked when the tribunal would commence sitting, Adegoke said he does not know.

In his words: “We don’t know yet but now that we have filed, it is expected that once the PDP is served, their lawyers will file their own defence then we will file a reply to their defence. That is when the tribunal will be able to give a date.

“Except if either of the two parties have an application that requires urgency, only then can the Tribunal have an emergency sitting but as of now nobody knows the date”, he said.

Adegoke had on July 19 noted that Oyetola may line up over 50 lawyers to contest the declaration of Adeleke as winner.

“We are still reviewing documents and the legal team is actually working. In an election of this nature, the documents will be so many; so it is important to look at them critically before we take a decision and that is exactly what we are working on right now.

“Dr Biodun Layonu (SAN), is the leader of the team. The legal team is not complete yet because there are so many others that will still come in.

“In the meantime, the two members of the legal team we can reveal is Dr Biodun Layonu and Kunle Adegoke. Others that may come in are people, we may not know but as soon as we are ready to move, we will notify the press.

“The membership can’t be determined as many lawyers are interested in joining the team. You know election petition is a special case. So, we allow as many lawyers that are interested to come in. We may run into 50 or more membership,” he asserted.

The Chairman, Media Management Team of Osun PDP, Prince Diran Odeyemi, on his part, hinted that the party was not losing sleep over the petition.

He explained that many of APC leaders that were saying that the result of the election should be challenged before the tribunal, lost election in their wards, saying APC should have adopted the spirit of sportsmanship regarding the result of the poll.

“It is so unfortunate that APC did not believe in the spirit of sportsmanship. We would have expected them to congratulate Adeleke. Many of them, who are championing the cause of tribunal lost in their polling units and their wards.

“We wonder what they want to take to the Tribunal now. We are not afraid or losing sleep, Oyetola can’t win. We will meet them at the tribunal. Regarding the allegation of a forged certificate, there is nothing like that.

“They are only looking for an avenue to come back to the government through the backdoor. PDP is thorough political party that looks at all the certificates presented by the candidates,” Odeyemi opined.

Babayemi had lost at the Federal High Court sitting in Osogbo, where he took the governor-elect, seeking to be declared as the PDP candidate for the July 16 governorship election in Osun state, and had gone upstairs after losing the bid.

It was the fallout of the two factions of the party, which had on March 8, 2021, conducted separate governorship primaries with Babayemi winning the primary election held at the Children and Women Development Centre in Osogbo, while Adeleke prevailed over that held at Osogbo City Stadium, which was backed by the PDP National Working Committee and the Independent National Electoral Commission (INEC), leading his being fielded on the ballot for the election.
