Daddy Freeze reacts to Appeal court N5 million fine for committing adultery

Media personality, Daddy Freeze has reacted following appeal Court ruling upholding a fine imposed on the popular Nigerian On-Air Personality for committing adultery with Benedicta Elechi.

TheNewsGuru.com (TNG) reported in 2021 that a High Court sitting in Port Harcourt, Rivers State, ordered Daddy Freeze to pay N5m for committing adultery with Benedicta Elechi. He was ordered to pay the money to Paul Odekina, who was married to Elechi at the time the adulterous act was committed.

Unsatisfied with the ruling, Daddy Freeze appealed to the Court of Appeal, argued that Odekina did not serve him with court papers personally before applying for substituted service which violated Order 7 Rule 2 of the Rules of the Trial Court.

After 3 years of back and forth, a three-person panel of Justice Abubakar Talba, Danlami Senchi, and Hannatu Balogun dismissed Daddy Freeze’s appeal for lack of merit.

The court ruled that if the appellant wanted to overturn the trial court’s judgment due to non-service, he should have filed a counter-affidavit against the affidavit of service and then sought to set aside the trial court’s judgment.

Reacting to it in an Instagram live video, Daddy stated that he had no problem paying an N5million fine as his watches alone cost over N100million.

He, however, maintained his innocence, adding that he will not lose. He claimed that the incident happened years ago when he was going through serious torment, and so was the lady, and they both linked up years later in a Church.

He said, “I Will Pay The N5Million Adultery Fine; my Watches alone Cost Over N100Million, But I Am Innocent, and I will not lose; I am innocent; this happened Many years ago. I was Going Through serious Torment, so was the lady, and we both Jam many years later in Church; this happened over 12 years ago”.

Daddy Freeze mocked after court upholds N5m Adultery fine against media personality

Controversial media personality, Ifedayo Olarinde, also known as Daddy Freeze have been subjected to ridicule after an appeal Court in Port Harcourt upheld a fine imposed on popular Nigerian On-Air Personality for committing adultery with Benedicta Elechi.

It would be recalled that a High Court in Port Harcourt, Rivers State, on February 18, 2021, ordered Daddy Freeze to pay the sum of N5m to Benedicta’s ex-husband, Paul Odekina, for committing adultery with Benedicta who was married to Odekina at the time.

The High Court’s judgment stated, “The sum of N5,000,000 is awarded against Ifedayo Olarinde (the 2nd Cross Respondent to the Cross Petition) as damages for depriving the Cross Petitioner of the amiable consort of his wife (Petitioner/1st Cross Respondent) and for injury suffered as a result of his adultery with the Petitioner/Cross Respondent.”

Also, the court dissolved the marriage between Odekina and Elechi due to her adulterous relationship with Daddy Freeze.

Unsatisfied with the ruling, Daddy Freeze appealed to the Court of Appeal, arguing that Odekina did not serve him with court papers personally before applying for substituted service.

The OAP claimed that Odekina’s action violated Order 7 Rule 2 of the Rules of the Trial Court.

It partly read, “Affidavit evidence can only be countered by a Counter Affidavit. As such, I found the procedure adopted by the Appellant alien to our jurisprudence.

“Where the Appellant wants the judgment of the trial court to be set aside for non-service, he ought to have approached the trial court by filing a Counter affidavit against the affidavit of service he seeks to set aside and consequently set aside the judgment of the trial court.

“Thus, as it is in the instant appeal there is nothing filed by the Appellant to counter the affidavit of service of the Process Server filed in.

“Hence, therefore I resolved the sole issue for determination against the Appellant and in favour of the Respondents.”

The court further resolved, “The appeal therefore lacks merit and it is hereby dismissed—accordingly, the judgment of the Rivers State High Court in Suit No. PHC/403MC/2012 delivered on the 18th February 2021 by J. Akpughunum, is hereby affirmed. I make no order as to costs.”

The news has elicited mixed reactions as netizens stormed the media personality’s Instagram page to make jest of him.

  • Woman refuses to dance naked in the village after adultery

Mrs Sandra Iyenanye, a trader in Lagos State, has stood her ground and refused to go to the village to dance naked and perform other rites after owning up that she committed adultery.

Mrs Iyenanye rather approached an Igando Customary Court on Tuesday to dissolve her long-distance marriage to her husband Mr Vestus Iyenanye.

The petitioner, a resident of No. 8, Jaiyeoba St., urged the court to grant her a divorce from her husband on grounds of abandonment, cheating and negligence.

“My husband who is based in Austria has since abandoned the home. He has come home a total of four to five times since our marriage in 2019, he has once beat me up with a belt because of another woman.

“I found out he was seeing another woman in 2010 and I confronted him only for him to beat me up with a belt.

“I later ran to my uncle’s house for protection but my uncle mediated and settled our misunderstanding and my husband promised not to lay his hands on me again.

“After settling, he travelled back with a promise to come back a year later but he did not, so due to frustration we exchanged words on the phone. His family held on to what I said and termed it abominable and labelled me a bad wife.

“Unfortunately, the next time he would come back was 2022. But before then he stopped sending money for the upkeep of our children and left all responsibilities to me. All efforts to speak with him proved abortive.

“The one time I called, it was a lady that picked the call and she later told me I was waiting for my husband in vain and that I should better move on. She said all types of spiteful and hurtful words to me which my husband didn’t see any wrong in it,” the petitioner narrated.

She further told the court that throughout the period her mother was sick and later died, her husband did nothing about it neither did he call or check up on her.

“He later sent meagre money after I expressed my displeasure, and in his words, he said I should better be grateful as he didn’t even have money to send to me; that the money he sent was borrowed from his girlfriend.

“When I saw that my husband was not trying to make the marriage work nor even attend to my sexual needs, I had a one-time affair. His family said I must dance naked in the village square as atonement and pay the sum of N100,000. After the whole rites then I can be free to go.

“I asked my husband if he would still accept me, and he said no. Because of this, I want a divorce from him as I do not even intend to perform the rites either. It’s best we both go our separate ways and I be granted custody of the children,” Mrs Iyenanye said.

Standing in for the respondent was his brother, Mr Cobina Iyenanye, who had good things to say about his brother’s wife and sang praises of her.

“I commend her resilience and patience, she’s a good woman, she has tried, she is not a bad person; I only agreed to come to the court because I want them to separate without fights and all dues be given to the woman,” he said.

The Court President, Mr Adeniyi Koledoye, adjourned the case until Aug. 2, for judgment.

BBNaija 2021: I am surprised, didn’t believe that was my wife- Tega’s husband opens up on adultery mess

Husband of BBNaija housemate Tega Dominic has opened up on events involving the housemate and her amorous activities while in the house.

In an Instagram live chat with Tunde Ednut, AJ Money revealed that contrary to Tega’s claims, they never reached an agreement permitting her to get intimate with male housemates.

“I am going to be honest, before she left for the big brother house, she said something like she was going to do everything but she was not going to have sex. I was like ‘I don’t understand. What do you mean like everything? C’mon, if you go in there and act anyhow, we are in Nigeria. If you act anyhow, people will vote you out and judge you. So if you are going there, represent us as a married woman.’ That was what I told her which she agreed with me. So I really don’t understand what I was seeing on TV. I was really broken.”

While acknowledging that he was yet to speak to his wife since her Sunday eviction, the father of one shared that her display on the show was appalling as she had never showed signs of infidelity.

“We are very very responsible. Tega is a very good girl so I wonder why she just went there and did what she did…I feel broken like my ego has been tampered with. I can’t even leave my house ’cause there are a lot of stories on the streets.

“I am surprised and I didn’t believe that was my wife. Tega is a god-fearing woman. She has never for one day disobeyed me or even tried to…Mehn! This is a different Tega I am seeing.”

When asked what the future holds for them? AJ Money said he has no plans of turning his back on his wife as this will be the first time she will be embroiled in such a mess.

“I know she knows what she did was very bad but she needs us more than ever. I don’t think I should abandon her because she needs me. If she comes back and says she is really sorry, I will give her a second chance.”
