Your actions point to insensitivity to plight of Nigerians, Obasanjo blasts lawmakers

Former president of the Federal Republic of Nigeria, Olusegun Obasanjo has knocked Nigerian lawmakers for being insensitive to the plights of the masses, TheNewsGuru.com reports.

Obasanjo made this remark on Monday during a speech at the 60th anniversary celebration of legal hero Aare Afe Babalola’s call to the Bar in Ado Ekiti, the Ekiti State Capital.

According to the ex-president, the salary allocation for elected officials is the job of the Revenue Mobilisation distribution and Fiscal Commission (RMAFC), which the lawmakers, he claimed, have abandoned in order to fix their own salaries.

“By the Nigerian constitution, the revenue mobilisation and fiscal commission is supposed to fix the salaries and emoluments of members of the National Assembly. But they set the constitution aside and decided to fix their salaries. Even if it’s constitutional, it is not moral. But it is neither constitutional nor moral.”

“The point in Nigeria which I have seen and which I can attest to is most of the people who are supposed to be operationalising or managing and seeing the constitution and democracy move forward, they are actually the ones who undermine the constitution.

“All elected people, by our constitution, their emolument is supposed to be fixed by the revenue mobilisation commission, but our lawmakers set that aside and they make laws and put any emolument for themselves.

“Even if that is constitutional, it is not moral and, of course, it is neither constitutional nor moral.”

He also stated that many other provisions of the Nigerian Constitution, such as the Federal Character, were “completely ignored,” and that the Federal Character Commission scarcely functioned.

When the constitution is “constantly violated like that,” the former President added that the country’s democracy becomes one in which anything goes.

Lead crusade against corruption in Nigeria, Falana advises Tinubu

Human rights lawyer, Femi Falana, SAN, has advised President Bola Ahmed Tinubu to lead anti-corruption crusade, saying there have been several high-profile politicians with looting cases in court who have been visiting the Presidential Villa.

Falana while speaking as a guest at the 60th anniversary of the call to bar of Aare Afe Babalola in Ekiti State on Monday said in order to promote public accountability, the Office of the Accountant-General should resume the publication of the monthly statutory allocations to the federal, state, and local governments.

TheNewsGuru.com reports that Falana also decried the level of corruption in the country, urging the president to take action.

He said, “The level of corruption in Nigeria has assumed a very dangerous dimension. We have a situation whereby highly placed public officers steal money meant for building hospitals, people are dying on our roads.

“They steal money meant for ecology, to fight erosion, to [re]forest certain parts of the country. So, when a country gets to that stage, corruption is now a crime against humanity.

“President Bola Tinubu must show leadership and lead an anti- corruption crusade. Wrong signal must not be sent to the people and the international community”.

Appealing to the President and his government to “show leadership”, Falana declared that “right now, we’re in trouble as a people”.

“There is somebody here who was our president,” Falana said, “If you were accused of corruption and your case was before the EFCC or the ICPC, you would not be appointed to a position of authority. We must go back to that era.”

Citing First-lady Oluremi Tinubu’s remarks at the 2023 Presidential Inauguration Interdenominational Church Service in May, the senior advocate of Nigeria urged the President to lead an anti-corruption crusade.

“God has blessed my family,” Mrs Tinubu had said. “We don’t need the wealth of Nigeria to survive but to do the right thing.”

Falana argued that with the President at the forefront of an anti-corruption agenda, Nigeria could “take its rightful place in the comity of nations”, as the largest concentration of black people on earth.

He condemned the level of corruption in the country which he described as having assumed a “very dangerous dimension.”

My father’s disciplinary approach contributed tremendously to my success – Tunde Afe-Babalola

A legal practitioner, Mr Tunde Afe-Babalola, SAN, says his father’s disciplinary approach contributed tremendously to his success in his endeavour.

Tunde, son of the legal luminary, Aare Afe Babalola, SAN, made this known on Sunday in an interview with NAN in Abuja

The lawyer, who recalled that his father would be celebrating his 60th anniversary of his call to Bar on July 9, said the legal giant’s attributes had helped him to grow in the profession.

“My father’s attributes include hard work, dedication, generosity, sacrifice, resilience, trust, fear of God, love for mankind, etc.

“These same attributes which he has, are the same things that have helped me over the years.

“Really, the way he disciplined us contributed tremendously to my success today.

“Victor Devlin said, ‘Listen, there is no way any true man is going to let children live around him in his home and not discipline and teach, fight and mould them until they know all he knows. His goal is to make them better than he is. Being their friend is a distant second to this.”

“Barack Obama said, ‘Someone once said that every man is trying to live up to his father’s expectations or make up for their father’s mistakes….’

“In his case, I emulate his great attributes and wonderful achievements,” he said.

He described his father as a simple man despite all the international awards and achievements.

“He is a loving, generous and supportive father,” he added.

Afe-Babalola said his father’s genuine love for the people and the desire to positively impact the society kept him going in the legal profession.

“Absolutely, he is my mentor and I am what I am today because of the Grace of God and my father. I cannot pray for a better father,” he said.

He congratulated his father on his 60 years of law practice.

“Dad, you are a winner, a goal getter and a worthy example to all of us. Indeed, we are so proud of having you among us over these 60 years in the legal profession.

“Your dedication to work is beyond admiration. Having produced innumerable SANs, several judges up to the appellate levels, several Attorney Generals at the federal and state levels, leaders of industry, etc.

“We pray that God will give you many more years of sound health and further impactful contribution to the legal profession worldwide,” he said.

  • Shutting down all Nigeria Varsities over elections illegal, inappropriate – Afe Babalola

Shutting down all Nigeria Varsities over elections illegal, inappropriate – Afe Babalola

Legal luminary and founder of Afe Babalola University, Ado-Ekiti, ABUAD, Chief Afe Babalola, SAN, has condemned the closure of all universities in Nigeria by the Federal Government over the general elections.

Babalola made the remarks on Monday in Ado-Ekiti at the 5th Induction of 123 medical doctors, who just graduated from ABUAD.

The former Pro-Chancellor of the University of Lagos, said the Minister of Education, Mallam Adamu Adamu’s directive, through the Executive Secretary, of the National Universities Commission, NUC, Prof. Abubakar Adamu Rasheed, was not only illegal, but also needless and most inappropriate.

He noted that the education Minister had no statutory power to direct the NUC to close down the nation’s universities, especially without consultations with stakeholders.

Babalola said the forceful closure of the Nigeria’s universities by the Minister and the NUC, had done incalculable damage to students of Nigerian universities.

“Under the NUC Act of 1974 and the Education (National Minimum Standards and Establishment of Institutions) Act of 1985, the Minister has no statutory power to issue a directive to NUC to close down universities. I refer in particular to section 4(2) of the 1974 (NUC) Act”.

“The problems have been worsened by scarcity of money by banks and automated teller machines, ATM, all of which ordinarily make transportation back home, more dangerous than ever before.

“If you want to destroy a nation, you don’t need bayonets, bombs or nuclear warheads. All you need is to destroy the education of the nation.

“The illegal closure has adversely affected the curriculum, particularly in respect of private universities which are reputed for their predictable academic calendar and absence of strike actions,” Babalola said.

According to him, Nigeria has criminal code, while other legislations have provisions which the government and law enforcement agents can evoke to deal with any person, whatever his class, as against, deliberately putting security of staff, students and properties of respective institutions in jeopardy.

On new Constitution, Babalola pointed out that the problem that is causing apprehension among the transactional politicians is the 1999 Constitution.

“It is this constitution that has made politics the only lucrative business in Nigeria today. This is responsible for the orgy of “do or die” politics,” he said.

The News Agency of Nigeria (NAN) reports that earlier on the occasion, the Registrar, Medical and Dental Council of Nigeria, MDCN, Dr. T.A.B. Sanusi,  inducted the 123 medical doctors of the institution into the medical profession.

The induction ceremony is for the 2022 graduating set and the 5th Induction ceremony of the MBBS programme of the institution.

In her speech, the Vice Chancellor of the University, Prof. Smaranda Olarinde, said this year’s induction was particularly significant, as 100 percent pass was recorded for the new brand medical doctors.

She noted that 22 of the doctors had distinctions at various levels of the professional examinations.

“I must sincerely commend Miss Ginika Stephanie Okafor, for her outstanding performance with eight distinctions, out of the available 11, and Miss Ikuabe Mary-Ann with seven distinctions.

“Others were Izunobi Somtochukwu, Modilum Kenechukwu and Okafor Chinaza led their male counterpart with four and two distinctions respectively”.

The VC charged the new doctors to constantly remember that they were ambassadors of the institution, and always uphold the code of conduct of the medical and dental council of Nigeria.

Prof. Olarinde noted that medicine and surgery in the institution, were the most subscribed medical school in the entire country, that it could hardly admit 10 per cent of the applicants who wanted to study medicine in ABUAD annually.

In the Induction lecture, Prof. A.B.O Omotosho, a Consultant Cardiologist, urged the new doctors to enhance the dignity and nobility of the medical profession.

Omotosho urged the new doctors to be guided by the principles of conscious medical practice

  • The Afe Babalola testimonies – By Owei Lakemfa

The Afe Babalola testimonies – By Owei Lakemfa

A lot of hope has been placed on the February 25, 2023 general elections in the country. It actually seems that the country’s continued existence depends on them. Already, some foreign observers have dispatched advanced teams.

However, in the midst of all these, a 93-year-old statesman, scanning the horizon, advises that the elections be postponed by six months if the country were truly to benefit from their outcome.

Aare Afe Babalola is as big as they can come. Sixty years ago, he was called to the English Bar and is a Senior Advocate of Nigeria, SAN. An educationist, 14 years ago, he established the Afe Babalola University, today, one of the best private universities in Africa.

He has been conferred with national honours and is undoubtedly, one of the richest Nigerians. But he says despite his enormous wealth, he cannot afford the bill of running in our elections.

His conclusion is that the elections, if they go ahead, would be won by the highest spender (bidder) and not the best candidates. But that is not his primary reason in calling for a brake rather than an acceleration towards the elections. His contention is that the Constitution is a fat lie suffocating the country and that Nigerians need to be rescued from its stranglehold so they can breathe better.

Hence, his advice that the Federal Government suspends the elections for six months and put a Provisional National Government in place charged with producing a new constitution that would tackle insecurity, economic, political and other primary challenges of the country.

He laments that enough tears and blood have been shed without government coming to the rescue of the populace and that this year appears to be the best opportunity for the country to change direction.

Babalola posits: “The new constitution shall provide for part-time legislators and not full-time and the attendant wasting of resources, who will be collecting allowances and not salaries. Proposes federal system of government rather than presidential system and a parliamentary system with a unicameral legislature”.

The lucid lawyer added: “I insist that unless a new Constitution is established, similar to the good old Constitutions of 1960 and 1963, with the necessary amendments, none of the contenders, and indeed, no angel can save the country from total collapse.”

I am happy we have elders like him speaking to us. Many in his position would simply fold their hands and watch the country slide. I think it is worthy discussing his ideas, and other ideas for that matter even if we do not necessarily agree with them.

First, his idea of postponing the elections would be unpopular because people are fed up with the Buhari entanglement and want to be free. To many, an interim government would be like extending the lifespan of this administration. Secondly, how do you constitute such a government without giving advantage to the out-going government and its cronies many of who may soon become political orphans of an inglorious era?

The formation of such interim government may simply go the way some of the primaries went; hijacked by the rich for the wealthy. Thirdly, it is not the amount of time allotted but the efficiency; a determined government can within a dozen weeks, firmly begin to rewrite the recent narratives of the country.

Aare Babalola’s main headache is that the elections may go to the highest spender. This is likely to be so because the stakes are high. Politics has been reduced to financial investment in which investors are waiting for high returns, and, impunity struts the landscape like a conquering giant. A man or group who ‘invests’ a trillion or more Naira in elections intends to loot in multiple trillions; a proverb says a hunter who sets a trap with a goat does not intend to catch a rabbit; his intention is something far bigger than a goat.

I think the primary reason why the contest for executive positions like the presidency is a gruelling, fratricidal war is because the country is a unitary system where the centre has a stranglehold on the constituents. Were the country a federation with federating units down the line exercising their rights, the centre would not be so attractive. If you are President in Nigeria, you are everything except God.

There are 68 items on the Exclusive legislative list from which states are barred. These include ports, metrology, aviation, finger printing and criminal records, political parties, insurance, monuments, copyright, state creation and so-called federal trunk roads. Despite these, the National Assembly is empowered to load more on any matter it “has power”.

For me, except monetary and foreign policy (excluding trade) there is no other item, including defence, that cannot be on the concurrent list. That was the wise decision of the Aburi Agreement.

It is this unitary, stifling, exploitative and indolence-inducing Constitution Aare Babalola wants us to replace. As a man of ideas, he does not only suggest, but also gives concrete proposals such as the replacement of the current unworkable Constitution with a revised version of the 1960 Independence and 1963 Republican constitutions.

One of the highlights of these constitutions are their emphasis on federalism with the existence of regions. For instance, if the six-eight geo-political structure is accepted, then each region can have the number of states and local governments it can afford.

The Aare also has loads of other suggestions like cutting costs by making parliament part-time. But that is not the primary problem: the issue is that the parliament has been reduced to a money sharing centre with parliamentarians padding budgets and awarding themselves contracts in the name of constituency projects.

He suggests a unicameral system; of course, for equity, seriousness and true democracy, we have no business with two chambers of the National Assembly. For me, the House of Representatives is a mere duplication of the Senate. Unlike the Senate which is based on three Senators per state, the House, apart from being a waste of resources, also has constituencies arbitrarily created with no sense of equity.

Aare Babalola also thinks we should go parliamentary. He might have good reasons for this; however, our challenge is not whether our democracy is presidential or parliamentary, it is about evolving a democratic system based on our needs and culture.

The problem with Afe’s suggestions are not so much their flaws, but the fact that he is uploading so much on an indolent political class that cannot think or refuses to think. When I read some reactions to his suggestions, it is like somebody declaring that: “Afe Babalola is talking nonsense”. When you ask: “What did he say?” and the reply is: “I don’t know. I have not had time to read his nonsense.”

  • 2023: Afe Babalola reveals winner of presidential election

2023: Afe Babalola reveals winner of presidential election

Senior Lawyer, Afe Babalola has revealed who will win the 2023 general elections in the country.

The Ekiti-born legal luminary is of the opinion that the highest spender will eventually emerge the winner of the presidential election, insinuating that it may not reflect the will of Nigerians.

Babalola made this statement while addressing journalists at a press briefing on Thursday.

The legal icon expressed worries that the outcome of the 2023 general elections may not favour ordinary Nigerians.

He said, “It is not who can make a difference that will win this election, I repeat, it is not the person who has all it takes – age, health, education, and patriotism, that will win the election; the winner of this election I can bet it, is going to be the person who has made money in this country.

“It is the person who has the money that will win”.

According to him, the endorsement of the Labour Party presidential candidate, Peter Obi by former president, Olusegun Obasanjo may not yield much results like what other candidates would do with their money.

  • 1999 Constitution won’t guarantee emergence of credible leaders – Afe Babalola

1999 Constitution won’t guarantee emergence of credible leaders – Afe Babalola

Chief Afe Babalola, Senior Advocate of Nigeria (SAN) says the 1999 Constitution will not guarantee the emergence of credible leaders at the February general elections.

“Unless a new Constitution similar to those of 1960 and 1963 Constitutions, with necessary amendments, is put in place, none of the aspirants, and indeed no angel can save Nigeria from total collapse,’’ he said.

The proprietor of Afe Babalola University, Ado-Ekiti, made the declaration on Wednesday at the Ekiti capital at a news conference.

He was reacting to the adoption of Mr. Peter Obi, presidential candidate of the Labour Party (LP) by former President Olusegun Obasanjo.

“On April 18, 2022, I urged the Federal Government to suspend the 2023 general elections and to raise an interim government of six months that will fashion out a new Constitution for the country.

“I still stand by my suggestion that any election conducted under the 1999 Constitution cannot, and will not produce new leaders with new ideas.

“Any election conducted under the 1999 Constitution will merely result in recycling the same people who brought Nigeria to grinding poverty, mass unemployment, underfunded education, insecurity, and huge external debts,’’ Babalola said.

The elder statesman noted that only a moneybag; and not the best-qualified candidates could win the February presidential election under the present constitutional arrangement.

He explained that the LP presidential candidate’s adoption by former President Obasanjo was his right of expression, and might be a result of the contestant’s acclaimed untainted records of character and sound education.

He stressed that the 1999 Constitution was too lopsided and faulty to produce the type of change agent and developmental leader Obasanjo had in mind.

He added that the 1999 Constitution was not what Nigeria needed at a time like this.

“I am an elder statesman, a SAN, the highest taxpayer in old Ondo State, the highest taxpayer in present Ekiti, owner of the best private university in Nigeria and many more.

“If I contest for political office today, I will fail, not because I am not qualified, but because the system will make me not to win.

“I have no sympathy for any Nigerian aspiring to rule Nigeria in any form, whether as a legislator, governor, or president.

“The fact remains that the 1999 Constitution on a large scale is the root cause of economic, social, political, and religious problems in the country today.

“Our experience since 1999 has taught us that we are in urgent need of a new Constitution.

“The new Constitution should provide for stringent conditions in respect of age, academic qualifications, character, and personality, as well as family background of candidates, especially for the presidency and the National Assembly,’’ Babalola said.

He noted also that Nigeria’s external debt had risen to N42.84 trillion as of June 30, 2022, while domestic debt servicing rose to N5.24 trillion in the same period.

He said that any Nigerian aspiring to lead the country ought to be worried about the country’s debt profile and advocated for urgent measures to defray the huge foreign debts.

“In addition, government should emulate Obasanjo’s example by approaching the country’s creditors, either for total debt forgiveness or for substantial reduction of the debts,’’ the legal luminary stressed.

  • Aribisogan’s impeachment as Speaker, irreversible, Ekiti Assembly replies Afe Babalola, Falana

Aribisogan’s impeachment as Speaker, irreversible, Ekiti Assembly replies Afe Babalola, Falana

The Ekiti State House of Assembly says the impeachment of Gboyega Aribisogan, who spent only six days as Speaker is irreversible.

This is contained in a counter statement issued on Thursday night by Adeoye Aribasoye, the new Chairman, House Committee on Media and Publicity, on behalf of the lawmakers.

Aribasoye said that contrary to impression created by the seven Senior Advocates of Nigeria, the removal of Aribisogan had come to stay, and that the new Speaker, Mrs Bunmi Adelugba, shall remain in office.

The seven eminent Ekiti lawyers, who are of Senior Advocates of Nigeria (SAN) rank, led by Aare Afe Babalola, had called for reinstatement of Aribisogan on the ground that his impeachment was “ill-conceived, illegal, null and void”.

Others Chief Wole Olanipekun (SAN); Dele Adesina (SAN); Olu Daramola (SAN); Femi Falana (SAN); Dayo Akinlaja (SAN) and  Gboyega Oyewole (SAN), had on Wednesday night, issued a statement, condemning as unwarranted, Aribisogan’s purported impeachment and calling for his immediate reinstatement.

The senior lawyers also said that Mrs Bunmi Adelugba, elected as Speaker after Aribisogan’s impeachment should stop parading herself as the new Speaker, saying her purported election was irregular.

However, in a swift reaction, Aribasoye said: “The attention of the Ekiti State House of Assembly has been drawn to a letter circulating on the social media written by a combination of Senior Advocates of Nigeria.

“The letter is about the concern of the legal luminaries led by Aare Afe Babalola about the recent change of leadership in the Ekiti State House of Assembly, leading to the impeachment of Rt. Hon Gboyega Aribisogan, who was replaced with Rt. Hon. Olubunmi Adelugba.

“We recognise the right of the legal luminaries, as stakeholders in Ekiti State and we respect their opinions and advice, but that is where it ends.

“We wish to let the reading public know that members of Ekiti State House of Assembly feel a sense of injustice by the one sided opinion and biased intervention of the legal luminaries, who are also elderstatemen.

“The principle of justice all over the world is that all sides to a conflict must be heard and it is only then that justice can be seen to have been done.”

According to him, it is unfortunate that our elderstatemen did not hear from the side of the new Speaker and the remaining 16 members, who impeached the former Speaker, Rt. Hon. Gboyega Aribisogan and elected Rt. Hon. Olubunmi Adelugba.

“For the avoidance of doubt, Rt. Hon. Olubunmi Adelugba remains the validly elected Speaker of the Ekiti State House of Assembly and she enjoys the support of overwhelming majority of the Honourable members, party leadership and the government of Ekiti State.

“Therefore, the advice of the legal luminaries that Rt. Hon. Olubunmi Adelugba, who was duly elected by 17 members  should stop parading herself as the Speaker of the Ekiti State House of Assembly, is unwarranted and we believe this is based on wrong information by the impeached Speaker.”

He said that the House has neither breached any section of the Constitution of the Federal Republic of Nigeria, nor its own Standing Rules concerning the impeachment of Aribisogan, and the election of Adelugba.

Aribasoye further explained that on Monday, Aribisogan was duly served an impeachment notice and was thereafter impeached by two third members of the whole House.

“We, however, wish to remind our legal luminaries that when a serious infraction of the Constitution of the Federal Republic of Nigeria was committed during the PDP  administration of Gov. Ayodele Fayose where seven members, impeached the then Speaker, Adewale Omirin, we didn’t see a convergence of legal luminaries condemning the action.

“This same Aribisogan was equally suspended by the fifth Assembly during the tenure of Gov. Fayose, but there was no whimper from our legal luminaries.

“We wish to reinstate that peace has returned to the Ekiti State House of Assembly. since the inordinately ambitious Speaker was impeached and suspended alongside his cohorts.

“Mrs Adelugba has presided over parliamentaries and plenaries, with majority of members present.

“She has announced appointment of new principal officers and she has constituted all Committees of the House,” he said.

  • Nigerians should embrace farming – Afe Babalola

Nigerians should embrace farming – Afe Babalola

Elder statesman, Chief Afe Babalola (SAN) says every Nigerian citizen should embrace farming, irrespective of profession or status.

Babalola said this on Sunday in Ado-Ekiti, adding that embracing farming is the panacea for the country to make a meaningful impact in evolving alternative economic reliance.

The legal luminary, spoke at the closing ceremony of the 2022 edition of the Annual “Afe Babalola Agricultural Expo”, (ABA-EX) and Youth Development.

The founder of Afe Babalola University Ado-Ekiti, (ABUAD), said he developed interest in farming while in primary school and had never looked back.

Babalola said that he introduced the initiative to return the sector to its rightful place, adding that farming remains one of the best solutions to the country’s myriads of problems.

“These problems include unemployment, poor revenue earnings among others.’’

“I got myself involved in all-round agriculture from the days of my youths because I have undying believe in it as solutions to problems, especially hunger.

“I was born as a farmer and it is not surprising that I still continue to farm till today in spite of all that God has enabled me to attain.

“That is what I expect all Nigerians to do, no matter what you are, or who you are. You just have to be involved in farming.

“If we all do, you can then imagine how many farmlands we would have had by now.

“Every family wants to be great, yet we are not involved in agriculture. We live in a nation where we produce less and consume more.

“Things don’t work like that, except we are waiting for calamity to happen in fact, we are already in the calamity,” he said.

A total of 81 best-performing farmers, made up of five farmers in each of the 16 local government areas of Ekiti, were awarded cash gifts by Babalola.

This, he said was part of his annual contribution towards promoting the sector.

The best farmer from each LGA got a cash sum of N200,000, second, N150,000, third, N100,000, fourth, N75,000, and fifth, N50,000.

The overall best farmer across the state got the star prize of a cash sum of N2 million among other things.

There was also the provision of farm kits for several jobless youths under the Afe Babalola Empowerment Programme totaling N34 million.

The youth empowerment angle of the annual awards saw the unemployed youths also going home with free smoking clean equipment for smoking of fish.

Mr Aladejana Ilesanmi, the overall best farmer in the state, who won the N2 million star prize, thanked Babalola for his philanthropic activities.

He said he worked extra hard on his various farm sites, covering about 30 hecters of land to emerge the best.

Ilesanmi, who is in his 60’s, enjoined both the young and old to complement Babalola’s kind gestures by embracing farming.
