    Supreme Court dismisses PDP’s suit, upholds Aiyedatiwa’s victory

    The Supreme Court has dismissed an appeal by the Peoples Democratic Party (PDP) and its governorship candidate, Agboola Ajayi, challenging the legitimacy of Gov. Lucky Aiyedatiwa’s election as Ondo State governor.

    In the lead judgment delivered by Justice Garba Lawal, the apex court threw out the appeal for being baseless, frivolous and lacking in merit.

    It, therefore, upheld the concurrent judgments of the Federal High Court and the Court of Appeal on the disputed qualifications matter.

    Ajayi had sought to nullify Aiyedatiwa’s victory, accusing the governor’s deputy, Owolabi Adelami of forgery, impersonation, and using a false identity.

    However, both the Federal High Court and the Court of Appeal dismissed Ajayi’s case on procedural grounds, upholding Aiyedatiwa’s win.

    Ajayi’s legal challenge, filed on June 7, 2024, claimed that Adelami’s eligibility was compromised due to the alleged falsification of documents.

    In the initial proceedings, the defendants, including Aiyedatiwa, Adelami, the APC, and INEC, argued that Ajayi lacked the legal standing to bring the suit and that the filing exceeded the 14-day window for such cases.

    On December 2, 2024, the Federal High Court dismissed Ajayi’s case, ruling that the criminal accusations of forgery required more substantial evidence, which could not be presented through an originating summons.

    The court also deemed the petition “statute-barred” as it was filed after the constitutionally mandated deadline.

    This decision was unanimously upheld by the Court of Appeal on January 18, 2025, with a N500,000 fine imposed on Ajayi.

    The latest apex court verdict has put to rest the long drawn legal battle over the Ondo State governorship poll.

    The Ondo State PDP Governorship Candidate, Mr Agboola Ajayi, says  the state and its people have  not fared well under the  ruling All Progressives Congress (APC) in the last eight years.

    The PDP candidate  said this  at a media parley on Friday in Lagos.

    He said  that Gov. Lucky Ayedatiwa and APC governorship candidate for Nov. 16 gubernatorial election had not delivered on promises.

    Ajayi, a former deputy governor in the state, said: “The primary objective of governance is the safety and welfare of the people.

    “Any political party that deviates from this avowed principle of governance will definitely get it wrong and become a liability on the people.  I have a clear vision on how to make it works.”

    He said late Gov. Oluwarotimi Akeredolu left many problems behind ,and that those problems had worsened  under Ayedatiwa, the former late governor’s deputy,who took over after his demise.

    “The Nov. 16 governorship election in the State therefore calls for serious consideration as this will determine, shapen or mar the fortune of the State in the next four years,” he said.

    Expressing disappointment in the conduct and outcome of the Sept. 21 governorship election in Edo, Ajayi said that democracy would not thrive where a simple exercise of election turned to imposition.

    According to him, those who are constitutionally empowered to protect Nigerians and ensure that the right things are done during election at every given time must not disappoint voters.

    He urged the Independent National Electoral Commission (INEC) and security agencies to allow vote of the people to count in the forthcoming election in Ondo.

    Highlighting his agenda if elected, Ajayi said his vision was to transform Ondo State into a beacon of sustainable economic development.

    Ajayi said that his intervention would cover modern infrastructure, efficient transportation, vibrant marine and blue economy, striving agriculture, robust industrialisation, quality education and affordable health care.

    Ajayi said that his vision would capture comprehensive human development, adequate security, and other components of fundamental objectives and direct principles of state policy as captured in the 1999 Constitution  of the Federal Republic of Nigeria (as amended).

    “It is therefore, my mission to harness the state human and material resources to actualise this vision and thereby rescue and redeem the people of the Sunshine State.

    “We will rescue the state from the shackles of poverty, oppression, deprivation and insecurity and set them on the path of sustainable development so that the sun will shine again in the State,” he said.

    Ajayi listed his agenda  for the state would focus on  Security, Agriculture, Education, Health, Infrastructure, Industry and Marine Economic Development,rural Development and Environment,  Youth, Sports, Social, Women Development and Civil Service.

    On education, Ajayi said that primary and secondary education would be fully free and tuition in tertiary institution would be reduced by 30 per cent.

    “We will ensure quality education for economic development, social equity, technological advancement and cultural preservation for sustainable development.

    “We shall address this ugly trend in health sector by providing, at least, one primary health centre in each of the 203 wards in the state which will be staffed with trained and dedicated medical personnel.

    “The huge infrastructural deficit and poor industrial output in the state is a call for concern.

    “We will pay attention to rehabilitation of roads, construction of waterways, provision of rural and urban electrification, enhancement and improvement in clean and pipe borne water delivery for the benefit of our people.

    “There will be improvement of rural road network. We will also embark on Rural Housing Scheme. My government will improve tourism development in the state,” he said.

    Ajayi ,who is a former council boss, said that his administration would grant full autonomy to local government areas both in finance and governance.

    Ajayi said that the new PDP administration in the state would prioritise programmes that would ensure the accelerated development of youths and women.

    “What is sacrosanct in developing a state like Ondo is the political will of the sitting governor.

    “On my own part, the required political will to develop Ondo State is inherent in me and it is already activated.

    “We will ensure our people live a better life. We enjoyed it. We must build a system that can give our people a future that they deserve.

    “I can assure you, our four year government would be like  12 years,” he said.

    Speaking, Dr Eddy Olafeso, Director General of Agboola Ajayi Governorship Campaign Organisation, described the PDP candidate as general in the battle against poverty, denial and hopelessness.

    The PDP Chairman in Ondo State, Mr Bakita Bello said that the party had bounced back  and had received many defectors from ruling APC, to win the election.

    The three major candidates in today’s governorship election in Ondo State have all won their individual polling units.

    TheNewsGuru.com, TNG reports that as at the time of filing this report, voting has ended in most of the polling units.

    Governor Rotimi Akeredolu, who is seeking reelection on the platform of the All Progressives Congress, won the election held in his Polling Unit 6, Ward 5, Isokun, Ijebu Owo. He scored 413 votes to defeat Peoples Democratic Party’s Eyitayo Jegede, who polled 12 votes; and the candidate of the Zenith Labour Party, Agboola Ajayi, who scored zero.

    Also, Jegede won his Igbogin/Isikan Ward 2, unit 9, polling 220 votes against 60 recorded by Akeredolu while Ajayi got seven votes.

    At home, Ajayi, the deputy governor of the state, also won in his polling unit in Kiribo in the Ese Odo Local Government Area of the state.

    According to the result pasted at the unit by the officials of the Independent National Electoral Commission, titled ‘Publication of Reault of Poll’, Agboola won the Apoi Ward II, Unit 004, Idumado Quarters, Kiribo with a wide margin having garnered 395 votes.

    His closest contestant, Akeredolu, scored 13 votes while Jegede secured five votes.

    Sorting of votes and counting is still ongoing at different polling units in the state as of the time of filing this report.

    Zenith Labour Party (ZLP) governorship candidate, Agboola Ajayi has advised the Independent National Electoral Commission, INEC to use riverine people to transport electoral materials in future elections because they understand the riverine area better.
    Agboola revealed this in a chat with journalists after casting his vote at his unit 009 in his local government area.
    Agboola said” you will always hear about boats capsizing during elections why not use stakeholders in the riverine areas to carry the materials because they understand the river and they are good swimmers.
    ” Thank God nobody died this time around”, the ZLP candidate added.

    Deputy Governor Agboola Ajayi, the Zenith Labour candidate has denied stepping down from the Ondo governorship election.

    A statement credited to him went viral on Saturday morning as voters streamed out for #OndoDecides2020..

    Babatope Okeowo, the spokesperson for the ZLP candidate described the statement as fake‎.

    Ajayi is considered one of the three main candidates among the 17 that are on the ballot on the ongoing election.

    The others are the incumbent Rotimi Akeredolu of the All Progressives Congress and Eyitayo Jegede of the Peoples Democratic Party.

    The ‘D’ is here for electorates in Ondo State to either renew the mandate of their sitting governor or choose another person that will lead them for the next four years.

    The Ondo State Government had on Thursday declared Friday a work- free day to enable workers, especially civil servants, get ready for the performance of their civic responsibility.

    As expected, the hotels have been fully booked since Thursday evening, with security operatives, observer groups, media personnel, politicians and staff of the Independent National Electoral Commission, INEC as the guests.

    About 1,478,460 are on the register to vote in the election which will hold across 203 electoral wards and across 18 local government councils of the state.

    Though there will be 17 party logos on the ballot, the three major candidates who are expected to earn most of the votes are Incumbent Governor Rotimi Akeredolu (SAN) of the ruling All Progressives Congress (APC), who is seeking re-election, Eyitayo Jegede of the Peoples Democratic Party (PDP) and Deputy Governor Agboola Ajayi of Zenith Labour Party.

    Meanwhile, there are fears that politicians may have imported hundreds of thugs into the capital city. And there are fears that the clashes among political thugs which characterised the campaign may repeat itself during the election, thus leading to the disenfranchisement of many.

    Police partner sister agencies for improved security

    However, to demonstrate their capacities to rein in any untoward activity, well kitted security operatives made up of soldiers, the police and officers of Nigeria Security and Civil Defence Corps, NSCDC, paraded the city in what is described as ‘show of force’ on Friday afternoon.

    The police had earlier indicated that it will deploy 30,933 conventional police personnel and 2,850 special agents for the election. The police deployment would be complemented by an additional 3,500 manpower to be drawn from other security agencies while the military will be engaged for the purpose of securing the state’s borders.

    In addition, the Nigeria Police Air Wing will provide air surveillance, according to Mohammed Adamu, the Inspector General of Police who announced the measures.

    He said added that security deployment was intended to protect the personnel and assets of the INEC, the electorate and residents of Ondo State in general before, during and after the election.

    Adamu said that the rationale for the deployment was drawn from the experience garnered at the recently-concluded governorship election in Edo State and proactive response to the outcome of intelligence analyses gathered on Ondo State’s governorship elections.

    On Friday, the Inspector-General of Police had also ordered the restriction of vehicular movement from 11:59 pm on Friday to 6 pm on Saturday, in Ondo State.

    In a statement by the Force Public Relations Officer, DCP Frank Mba, on Friday, the order is part of efforts by the Force to ensure effective coordination of public order and safety during the gubernatorial election. ​

    “The IGP reiterates that the vehicular restriction order, among other things, is aimed at preventing political actors and trouble-makers from freely engaging in unpatriotic acts – circulation and use of illicit arms and hard drugs, movement of political thugs from contiguous States to Ondo State and disruption of the electoral processes, etc – which are inimical to the dictates of the electoral laws,” Mba said in the statement.

    INEC insists election will be free, fair and credible

    INEC was fine-tuning its preparations for the election with the movement of electoral materials on Friday. But speaking on Monday in Abuja, INEC Chairman, Prof. Mahmood Yakubu told members of staff of the Commission to consolidate on the INEC’s recent achievement Edo by ensuring that every single vote cast in the election is accounted for.

    Yakubu said, “We must consolidate on our recent achievement and account for every single vote cast on Oct. 10, in a transparent manner which will ensure that only the choice of the electorate prevails.” “I implore all of you to resist any form of temptation and let your individual actions be guided by the extant laws and good conscience.

    Mr Eyitayo Jedege, the PDP governorship candidate in Ondo State, says he is still in the race, contrary to reports that he has stepped down for another candidate.

    Jegede made the clarification in a statement made available to newsmen by the Spokesman of his campaign organisation, Mr. Gbenga Akinmoyo, on Thursday in Akure.

    TheNewsGuru.com, TNG, reports that the governorship election in Ondo State is scheduled for Oct. 10.

    The governorship candidate told his supporters to disregard the rumour that he had collapsed his structure with that of the Zenith Labour Party (ZLP) candidate, Mr Agboola Ajayi.

    He described the rumour as part of the desperate move by his detractors to deceive the general public and distract his supporters.

    Jegede said that he had meticulously worked to complete his campaign tour across the length and breadth of the state and held the closing rally at a colourful ceremony in Ondo West Local Government area on Wednesday.

    “Thousands of supporters joined me at the ceremony to receive the PDP national officers from Abuja, led by the National Chairman, Uche Secondus.

    “Several PDP governors and former governors, led by the Chairman of PDP Governors’ Forum, Alhaji Aminu

    Tambuwal and other party chieftains were also present at the rally,” he said.

    Jegede added that in spite the tight campaign schedule, he was able to honour the invitations of the organisers of the two governorship debates to answer questions and address the electorate on his party’s manifestoes.

    Jegede said he had also signed a peace accord to confirm his commitment to a violence-free election and plea to relevant authorities on the need to enjoy free, fair, transparent and credible election in the state, come Oct. 10.

    Recall that INEC had earlier published the names of 17 governorship candidates and their running mates alongside their political parties.

    The parties include the ruling All Progressives Congress (APC), the Peoples Democratic Party (PDP) and 15 other political parties.

    Meanwhile out of the 17 candidates vying for the governorship position on Saturday, 16 are males and one female.

    All Progressives Congress (APC) candidate Governor Rotimi Akeredolu and those of the People’s Democratic Party (PDP), Eyitayo Jegede, the Zenith Labour Party (ZLP) and Akeredolu’s deputy, Agboola Ajayi and thirteen other candidates signed the Accord facilitated by the National Peace Committee.

    The signing was witnessed by National Chairman of the Independent National Electoral Commission (INEC) Prof. Yakubu Mahmood; Sultan of Sokoto Abukabar Saa’d; Bishop of Sokoto Diocese Hassan Kukah; former Bishop of Abuja Diocese John Onaiyekan and traditional rulers, among others.

    The Ondo State Deputy Governor, Mr. Agoola Ajayi, has replied Governor Oluwarotimi Akeredolu over claims that he (Ajayi) is highest earning deputy governor in Nigeria.

    Ajayi, who is the governorship candidate of Zenith Labour Party (ZLP) argued that he earns N12 million naira, noting that the governor gets a security vote of N750million naira and an imprest of about N150 million monthly.

    He was reacting to an earlier comment by Akeredolu claiming he (Ajayi) gets the highest running grant of N13m monthly.

    Ajayi in a statement signed by his media aide, Allen Sowore, expressed surprise that Akeredolu could announce to the world the sum of N13m as what Ajayi gets as if it was a gift.

    He said what he receives until the Governor stopped releasing same was 12million naira per month.

    According to him, this includes the imprest of Deputy Governor’s office, allowances of staff, fuelling of vehicles, care of his residence and welfare of his aides.

    “Huge as the amount may appear, it amounts to not so much when the heads and number of individuals it caters for are considered,” he added.

    “The governor gets a security vote of N750million naira every month. He, Akeredolu, also gets an imprest of about N150 million”

    The Deputy Governor further alleged that Akeredolu’s wife and son also collect millions of naira as imprest on monthly basis without occupying any constitutionally recognised positions.

    Lady alleges leaked WASSCE answers were circulated on Nigerian WhatsApp groups

    A certain Rosemary Ajayi, digital forensic researcher, has claimed that leaked answers to some subjects at the ongoing West African Senior School Certificate Examination (WASSCE) were being distributed across some Nigerian WhatsApp groups.

     

    Ajayi is a research director at Digital Africa Research Lab.

    In a thread on Twitter on Wednesday, the researcher said she decided to join some random Nigerian WhatsApp groups to determine people’s usage of the platform.

     

    According to her, in one of such groups, the administrators shared prepared answers to Agriculture Science as well as Economics, two subjects taken by candidates on Wednesday.

     

    She said the Agricultural Science examination — which was taken at 2pm — had barely started when “the first set of answers to the essay questions were in the WhatsApp group at 2:01pm.”

     

    “In an attempt to better understand how Nigerians use WhatsApp, I began joining random open WhatsApp groups today, 27 minutes before the start of the WASSCE Agricultural science exam, the group’s admin posted question papers,” she wrote.

     

    Ajayi also revealed that members of the group were not allowed to ask questions as the group was constituted in a manner that only admins could share messages.

    “No questions can be asked as non-admin are blocked from posting to group. Earlier, they posted photos of handwritten questions and answers for today’s economics exam. I don’t understand what the motivation is,” she wrote.

    Ajayi said such a situation inspired blockage of access to the internet during exams in Ethiopia.

    “We’re not being asked to pay to be in group. This is how the Ethiopian government justifies switching off the country’s internet during exams,” she added.

    TheNewsGuru recalls that back in 2019, the Ethiopian government blocked internet access during national examinations to restrain cheating.
