  • Stay off appointment of IGPs – Police IG tells Senate

The Inspector-General of Police, Ibrahim Idris has asked the senate to endeavour to face other businesses and stay off the appointment of police chiefs in the country.

Idris demanded that the lawmakers create provisions of a new bill that requires senate confirmation of an IGP’s appointments.

This, Idris said today, during a public hearing by the senate committee on police affairs on the police reform bill.

The constitution currently requires the president to appoint an IGP subject to the senate’s approval.

But the reform bill is seeking to open the window for other police officers interested in the position to apply.

Its section 3 states: “Interested persons (for the office of the IGP) shall make an open and formal application to the police council; the Nigerian police council shall nominate three applicants from among the pool of applicants using the stipulated criteria for competences and qualification; the president shall appoint the inspector-general of police from the recommended applicants subject to the confirmation of the Senate.”

But addressing the lawmakers, the IGP said such confirmation will “make the police less proficient.”

“The appointment of the inspector-general of police by the president on the advice of the police council without the senate confirmation is the desire of the police and should be made to be in the bill,” he added.

  • 2019: Senate bows to pressure, lifts embargo on Buhari’s appointments

Indications emerged on Tuesday that the Senate has lifted its embargo on the confirmation of executive appointments made by President Muhammadu Buhari.

According to a report by The Punch, the embargo, which lasted over one year, was lifted at a closed-door session held by the lawmakers on October 10, 2018.

The embargo was placed in protest against the retention of Ibrahim Magu as acting Chairman of the Economic and Financial Crimes Commission despite his non-confirmation by the Senate.

The senators were also angered by a statement credited to Vice-President Yemi Osinbajo who was quoted as saying that he agreed with the activist lawyer, Femi Falana (SAN), that Section 171 of the Constitution empowered President Muhammadu Buhari to make certain appointments without recourse to the legislature for approval.

A Peoples Democratic Party (PDP) senator from the South-East geopolitical zone who spoke on condition of anonymity confirmed that the lawmakers resumed from their annual recess to lift the embargo.

He said, “We have lifted that (the embargo). We did it (placed the embargo) based on certain premises and after a while, those issues were resolved. You can see that we are clearing the backlogs and all the outstanding screenings and confirmations. We are doing them. So, it has been lifted.”

When asked why there was no resolution vacating the earlier resolution placing the embargo, the lawmaker said it was done behind closed doors.

It must not necessarily be a resolution as per coming on the floor. It was a resolution we took at a closed session,” the senator said.

Chairman of the Senate Committee on Media and Public Affairs, Senator Aliyu Sabi-Abdullahi, could not be reached on the telephone on Monday to speak on the development. Calls made to his telephone did not connect.

Several calls made to the Majority Leader, Senator Ahmad Lawan, who had on several occasions asked the Senate leadership to lift the embargo, were not picked.

Since the National Assembly resumed from its annual two-month recess on October 9, 2018, the Senate has confirmed series of appointments, some of which were under embargo for over one year.

On October 10, the Senate confirmed a Senior Advocate of Nigeria and former National Legal Adviser of the ruling All Progressives Congress, Dr Muiz Banire as Chairman of the Governing Board of the Assets Management Corporation of Nigeria.

Same day, the chamber confirmed Mr Folashodun Adebisi Shonubi as Deputy Governor of the Central Bank of Nigeria.

On October 24, the Senate confirmed the appointments of the Chairman and 12 Commissioners of the Federal Civil Service Commission.

  • Court dethrones traditional ruler in Adamawa, orders fresh appointment

A Yola High Court presided by Justice Hafsat Abdulrahman on Friday voided the appointment of the District Head of Jalingo-Maiha, Yarima Wakili, by the State Government.

The court ordered Gov. Muhammadu Bindow to approve Mahmud Abubakar, whose name was earlier forwarded to him for approval by Mubi Emirate Council as the selected traditional ruler.

Recall that Mahmud Abubakar (Plaintiff) had earlier dragged the governor, Mubi Emirate Council, Yarima Wakili and Attorney General of the state as 1st, 2nd, 3rd and 4th defendants, respectively, over the appointment of Wakili as the district head of Jalingo-Maiha in Maiha Local Government Area.

In her Judgment, Justice Abdulrahman said the plaintiff has proven that he was eligible and was duly selected among other applicants for the district head stool by village heads in Maiha, who conducted the selection exercise under the supervision of representatives from Mubi Emirate Council.

“That the approval of the 3rd defendant by the governor of Adamawa State as the district head of Jalingo-Maiha district, Maiha Local Government Area who was not the person recommended by the 2nd defendant is wrongful, illegal, null and void.

“That the plaintiff whose name was forwarded to the Governor of Adamawa State for approval by the 2nd defendant, is the proper person to be approved for appointment as the district head of Jalingo-Maiha District.

“It is hereby ordered that the Governor of Adamawa State (1st defendant) should approve the plaintiff as the proper person for appointment as District Head of Jalingo-Maiha District.

“An order of perpetual injunction is hereby given, restraining the 3rd defendant from parading himself as district head of Jalingo-Maiha District, Maiha Local Government Area of Adamawa State,” the court ruled.
