  • Court stops EFCC from arresting Ozekhome for criticising Magu

Court stops EFCC from arresting Ozekhome for criticising Magu

The Federal High Court, Abuja, on Thursday, restrained the EFCC from inviting, harassing and threatening to arrest or detain Mr Mike Ozekhome, SAN, for criticising the former Acting Chairman of The commission, Ibrahim Magu.

Delivering judgment, Justice Inyang Ekwo held that serial acts of intimidation and constant invitations the EFCC extended to Ozekhome were illegal, unlawful, wrong and unconstitutional.

The lawyer had told the court that the intimidation, invitations as well as threats to arrest, detain and humiliate him were over publications and speeches he made.

The respect to the “apparent opaqueness and lopsidedness” of the corruption fight of the EFCC under the leadership of Magu.

The court held that the action of the agency constituted a violation of Ozekhome’s fundamental rights as enshrined in sections 35, 37, 39 and 41 of the 1999 Constitution (as amended).

The court said the action of the anti-graft agency also contravened Articles 5, 6, 8, 9, 10, 12 & 14 of the African Charter on Human and Peoples’ Rights Ratification and Enforcement Act, Cap. A9 LFN 2004.

The judgement was sequel to a fundamental rights enforcement suit instituted by Ozekhome in the court.

The EFCC, Magu and one of its lead operatives, Abubakar Madaki were named as the first to third respondents in the suit marked FHC/ABJ/CS/324/2018

Ozekhome had told the court that aside from repeatedly summoning him to appear for questioning, the EFCC froze his bank account after he was paid his legal fees totalling the sum of N75 million, by the former governor of Ekiti, Ayodele Fayose.

The lawyer maintained that one of the reasons the EFCC made him its primary target, was due to the fact that he secured so many legal victories against it in various courts in the country.

He said he did not commit any offence to warrant the incessant invitations and threats to arrest, detain or declare him wanted by the respondents.

He further told the court that the account from which the N75 million was paid to him, belonged to the former governor of Ekiti, who he said had not been convicted by any court to warrant labelling the money as proceed of crime.

Ozekhome averred that it took the intervention of the Federal High Court in Lagos to unfreeze his bank account.

Consequently, he prayed the court to among other things, declare that he was entitled to receive legal fees for professional services he rendered to clients.

He further asked the court to compel the respondents to publish an unreserved apology to him in three prominent dailies for the breach of his right.

He also asked the court for an order directing the respondents to jointly and severally pay the sum of N5 billion to him as damages for the violation of his rights.

However, the EFCC, in a counter-affidavit that was deposed to by one of its operatives, Usman Aliyu, urged the court to dismiss the suit.

The Commission told the court that Ozekhome was being investigated for a lot of cases bordering on money laundering and tax evasion based on intelligence report from the Nigeria Financial Intelligent Unit, (NFIU).

It told the court that Ozekhome received various sums of money at different times from DAAR Investment & Holding Company Limited, Ekiti Government and the Nigeria National Petroleum Corporation, (NNPC) without payment of taxes due to both the Federal and Ekiti state governments.

The EFCC also told the court that further investigation revealed an attempt by the wife of former President Goodluck Jonathan, Patience, to launder money through Ozekhome in the sum of N1 billion.

Justice Ekwo in his judgment said that he was satisfied that Ozekhome established a case of intimidation and harassment by the respondents.

He held that though the court would always restrain itself from interfering with the functions of statutory bodies like the EFCC.

“That is only in so far as such agency is demonstrably shown to be acting pursuant to the veritable spirit of the law.

“Where the act of such statutory body is shown to be manifestly predicated on ill will, malice and animosity, the law will intervene.

” The Court will never allow the law to be used as instrument of vendetta or vindictiveness as established in this case.

“On the whole, I find that the applicant has establish clear case of animus by the respondents in the manner of incessant invitation to him,” the judge said.

The judge, however, declined to either award damages in his favour or compel EFCC to apologise to him.

Fleeing notorious kidnap kingpin arrested by Police in Ogun state

The Ogun State Police Command has arrested a notorious kidnap kingpin said to have escaped from Oyo State after killing a kidnapped victim.

In a statement, the Police Public Relations Officer, Abimbola Oyeyemi, said the suspect, Usman Hassan’s accomplices had earlier been arrested in Oyo State.

He revealed that the suspect allegedly fled after kidnapping a farm owner at Solalu village and subsequently killing him after collecting ransom.

“On getting to Ogun State, he started recruiting other Fulani men to form another kidnap gang in Ogun State, he ran out of luck when detectives of Ogun State Police Command got information about his activity from those Fulanis he had tried to recruit into his kidnap gang,” he said.

To the police spokesman, the suspect was arrested at his hideout in the Imala area in Yewa North Local Government Area of Ogun State.

He added, “On interrogation, he confessed that he conspired with his biological brother one Tahiru Usman and others to kidnap their victim in Akinyele area of Ibadan and that they decided to kill the man after collecting ransom because the man can identify them.”

Meanwhile, the Commissioner of Police, Edward Ajogun, has directed that the suspect be transferred to the Anti-kidnapping Unit of the State Criminal Investigation and Intelligence Department for onward transfer to Oyo State Command where he will be prosecuted.

  • Ugandan main opposition leader, Bobi Wine arrested again

Ugandan main opposition leader, Bobi Wine arrested again

Police arrested Wine near a public square in the capital and then drove him back to his home outside Kampala. “His home is now surrounded by police and the military,” said Wine’s Twitter account.

The Daily Monitor newspaper published a photo of Wine being taken away by police while he held a poster saying “BRING BACK OUR PEOPLE.”

“Don’t fight,” Wine told his supporters when armed police grabbed him and his associates while a charging crowd in the background repeatedly shouted his name, according to footage from the scene in downtown Kampala. “Don’t give them a reason.”

Museveni was declared the winner of the Jan. 14 elections with 58% of the vote while Wine had 35%. Wine called those results fraudulent, citing cases of soldiers allegedly stuffing ballot boxes, casting ballots for people and chasing voters away from polling stations.

Authorities accuse Wine, a 39-year-old singer and lawmaker whose real name is Kyagulanyi Ssentamu, of trying to lead violent protests that could cause the collapse of Museveni’s government. Wine says he is leading a nonviolent movement.

Museveni, a 76-year-old former guerilla leader who took power by force in 1986 and has since been elected six times, is popular among many Ugandans for bringing relative stability and security. Museveni himself has castigated former leaders such as Idi Amin, whose regime was notorious for kidnappings and extrajudicial killings.

But opposition figures such as Wine accuse Museveni of increasingly ruling like his predecessors. They say corruption and alleged abuses by the security forces have become more widespread as Museveni tries to extend his rule.

Museveni recently dismissed allegations that his forces have illegally detained civilians, saying his army “is a disciplined force” and that his party “does not kill” its opponents. But he acknowledged that he had beefed up security ahead of the elections by deploying soldiers from a commando unit previously deployed in Somalia who “killed a few” people he described as terrorists.

Museveni warned in a televised address Sunday night that opposition supporters who allegedly plan to disrupt his inauguration in May face arrest.

  • Police arrest 26-year-old man one year after ‘killing’ foreigner in Lagos

Police arrest 26-year-old man one year after ‘killing’ foreigner in Lagos

A young man, Adelaja Moses, has been arrested for the murder of a foreigner, more than one year after he was alleged to have committed the crime.

The Public Relations Officer of the Lagos State Police Command, Olumuyiwa Adejobi, confirmed the arrest of the suspect in a statement on Friday.

He noted that the 26-year-old suspect was apprehended by security operatives at about 2am on Saturday last week in the Emuren area of Ogun State.

Adejobi explained that Moses was arrested during a sting operation for his alleged involvement in the kidnapping and killing of a Chinese national in February 2020.

“The suspect, a strong member of Aiye Confraternity, and his cohorts kidnapped the Chinese national at Okunowa, Ijebu, in Ogun State but was kept in their hideout at Otta-Agbowa Ikosi, Lagos State.

“They eventually killed the captive and dumped his corpse in Agbowa-Ikosi River. The corpse has not been recovered up to date,” the statement said.

According to the command’s spokesman, the suspect confessed that other members of the gang have been arrested by the Intelligence Responses Team (IRT) of the Force Intelligence Bureau in Abuja.

He stated that the Commissioner of Police in Lagos, Hakeem Odumosu, has ordered the command’s Strike Team which arrested the suspect to work with the IRT on the investigation into the case.

Odumosu assured the residents of Lagos that the state would be hot for criminals and those he tagged as ‘bad boys’ who engage in criminal activities.

In his confession, Moses told the police that he was involved in the abduction of the foreigner but did not receive any ransom.

He also denied his involvement in the killing of the victims, saying his accomplices were responsible for his death.

The suspect confirmed that his remains were dumped in a nearby river, adding that the others have been arrested by the police.

When asked what he wants the police to do, he said, “I don’t have anything to say.”

  • Yakassai: Buhari, El-Rufai, Tinubu, other APC bigwigs once asked Jonathan to resign without arrest, intimidation – Falana

Yakassai: Buhari, El-Rufai, Tinubu, other APC bigwigs once asked Jonathan to resign without arrest, intimidation – Falana

Popular human rights lawyer, Femi Falana (SAN) on Sunday condemned the arrest of Salihu Yakasai, former special adviser on Media to Kano State Governor, Abdullahi Ganduje by operatives of the Department of State Services (DSS).

The legal luminary said it is no crime for any citizen to call for President Muhammadu Buhari’s resignation.

TheNewsGuru.com, TNG reports that the DSS operatives confirmed arresting Yakasai shortly after criticizing President Buhari on Twitter.

Reacting to the arrest, Falana condemned the action of the Department of State Services stating that there is no justification for the arrest and detention of Yakassai.

In a statement titled, ‘Asking Buhari to Resign is Not An Offence’, the rights activist noted that many politicians and activists have continued to call for Buhari resignation due to the deteriorating security situation across the country.

He further argued that in the past those who called for the resignation of former presidents did not get intimidated nor arrested.

“It is on record that the APC and its leaders including General Mohammadu Buhari; National Leader, Asiwaju Bola Tinibu; Malam Nasir El-rufai and Alhaji Lai Mohammed repeatedly called for former President Goodluck Jonathan’s resignation between 2013 and 2014. Yet they were never subjected to any form of intimidation for exercising their freedom of expression at the material time. Since the call for President Buhari’s resignation is likely to continue to be made by other concerned individuals and groups over the virtual collapse of the security architecture.”

Falana demanded the immediate and unconditional release of Mr Tanko-Yankassai from illegal custody.

He however noted that if the State Security Service has evidence that the “political detainee” has committed any criminal offence known to the law, then he should be transferred to the police for proper investigation and possible prosecution.

Below is the right advocate’s full statement regarding Salihu Yakasai’s arrest.

On Friday, February 27, 2021, Mr. Salisu Tanko-Yankassai, the Special Adviser on Media to Governor Abdullahi Umar Ganduje of Kano state called on President Mohammadu Buhari to either guarantee the security of the Nigerian people or resign from office. Even though Mr. Tanko-Yankassai was legitimately exercising his freedom of expression enshrined in section 39 of the Constitution he was sacked by Governor Ganduje and arrested by the State Security Service. ASCAB has confirmed that Mr. Tanko- Yankassai is being held incommunicado in an undisclosed detention facility.

Having regard to the fact that civil rights advocates, retired military officers, and political party leaders including chieftains of the All Progressive Congress have repeatedly asked President Buhari to call it quits due to the worsening insecurity in the country there is no justification whatsoever for the arrest and detention of Mr. Tanko- Yankassai. In both Chambers of the national assembly there have been strident calls by legislators for President Buhari’s resignation or impeachment on the ground that criminal gangs have taken over the monopoly of violence in the country. Since such concerned citizens were never arrested the ongoing harassment of Mr. Tanko- Yankassai is high handed, discriminatory and illegal.

It is on record that the APC and its leaders including General Mohammadu Buhari; National Leader, Asiwaju Bola Tinibu; Malam Nasir El-rufai and Alhaji Lai Mohammed repeatedly called for former President Goodluck Jonathan’s resignation between 2013 and 2014. Yet they were never subjected to any form of intimidation for exercising their freedom of expression at the material time. Since the call for President Buhari’s resignation is likely to continue to be made by other concerned individuals and groups over the virtual collapse of the security architecture of the neocolonial State it is pertinent to draw the attention of the State Security Service to the case of Arthur Nwankwo v The State 1985 6 NCLR 228 where the Court of Appeal charged the Nigerian people to engage in relentless criticism of democratically elected governments. In particular, Olajide Olatawura JCA (as he then was of blessed memory) had this to say:

“The decision of the founding fathers of the present Constitution which guarantees freedom of speech which must include freedom to criticise should be praised and any attempt to derogate from it except as provided by the constitution must be resisted. Those in public office should not be intolerant of criticism in respect of their office so as to ensure that they are accountable to the people. They should not be made to feel that they live in an ivory tower and therefore belong to a different class. They must develop thick skins and where possible, plug their ears with wool if they feel too sensitive or irascible.”

In view of the foregoing, we demand for the immediate and unconditional release of Mr. Tanko-Yankassai from illegal custody. However, if the State Security Service has evidence that the political detainee has committed any criminal offence known to law he should be transferred to the Police for proper investigation and possible prosecution without any delay.

    Interim Chair,

That was how it degenerated.

DSS speaks on alleged attempted arrest of Sunday Igboho

The Department of State Services (DSS) said the service has not made any attempt to arrest Sunday Adeyemo, popularly known as “Igboho”, contrary to publications in some sections of the media.
The Public Relations Officer of the Service, Dr Peter Afunanya, said this in a statement on Friday in Abuja.
Afunanya said the publication that some personnel of the service attempted to arrest Igboho at Ibadan in Oyo State was not true.
According to him, the said news is misinforming and should be taken as fake and therefore be disregarded.
Reports in some sections of the media had alleged that men of the DSS on Friday attacked Igboho in Ibadan.
It said that Igboho told the media he was disappointed that he was attacked by men of DSS without committing any offence.

It also said Igboho had alleged that men of the service were acting on the instruction of unknown authorities who attempted to prevent him to move around in Ibadan and beyond.

The report further said Igboho told the media that in spite of attempts by DSS to stop him, he was able to have his way to his scheduled meeting venue.
