SENEGAL: Lawmakers sentenced to prison for assaulting pregnant colleague

A court in Senegal has sentenced two politicians to six months in jail for assaulting a pregnant colleague during a brawl in parliament.

On 1 December, MP Massata Samb attacked his colleague Amy Ndiaye from the gallery over statements she had made against Moustapha Sy, the leader of a member of the main opposition coalition, the Party of Unity and Gathering, who is not a member of parliament but is an influential marabout in Senegal.

The images that have taken the Senegalese social media by storm show Massata Samb and his colleague Mamadou Niang slapping and kicking the pregnant Mrs. Ndiaye in her stomach during assembly.

Amy Ndiaye was hospitalized after the incident and risks losing the baby she is carrying, her lawyer Baboucar CissĂ© said during the trial. She has been released from the hospital, but remains “in an extremely difficult situation”, he added.

The two parliamentarians, imprisoned since 15 December, were tried on 19 December by the court of flagrante delicto in Dakar.

The court also sentenced them on Monday to pay a fine of 100,000 CFA francs (150 euros) each, and “jointly” damages of five million CFA francs (7,625 euros) for “assault and battery” on Amy Ndiaye, a member of the presidential party.

The prosecution had requested two years in prison.

The two deputies were not present Monday when the judgment was read. “They will remain in prison while we appeal,” Abdy Nar Ndiaye, one of their lawyers, told AFP.

Despite the images, they had denied during the trial that they had hit their colleague.

The two MPs’ defense had argued that the trial could not take place because of their clients’ parliamentary immunity, but the court overruled them.

The incident was seen as symptomatic of the tensions between the opposition and the majority, violence against women and the untouchable status of marabouts.

The presidential camp lost its absolute majority in the July legislative elections, which gave a near balance of power in the Assembly in a tense political context.

President Macky Sall, elected in 2012 for seven years and re-elected in 2019 for five years, remains silent on his intentions for the presidential election of 2024.

Autopy report reveals Insp. Orukpe died of multiple injuries

Two autopsies carried out on late police Insp Monday Orukpe of the police command in Lagos State have revealed that the officer died of assault, multiple injuries and blunt force trauma.

The autopsies were conducted by the Lagos State University Teaching Hospital (LASUTH) and the Nigerian Army Cantonment Medical Centre, Ojo.

The reports were made available to newsmen by the widow, Mrs Favour Orukpe on Thursday.

On Aug. 3, some soldiers from Ojo Cantonment allegedly clashed with some policemen controlling traffic in the area, leading to the death of Orukpe.

The autopsy from LASUTH signed on Oct. 27, 2022, by Dr O.O. Onayemi of the Department of Pathology and Forensics revealed that multiple injuries and blunt force trauma caused Insp Orukpe’s death.

Blunt force trauma, also known as non-penetrating trauma refers to injury to the body by forceful impact, falls, or physical attack with a dull object.

The Nigerian Army’s autopsy report signed by Dr I. Agueze revealed that primary cause of death was assault, while secondary cause of death was head injury.

Mrs Orukpe had alleged that her husband had not been buried because of the delay in the release of the autopsy reports and the Nigerian Army’s investigation report.

She said that though the autopsy reports were now released, the Nigerian Army was yet to release its investigation report to determine who the culprits were.

Acting Deputy Director in charge of Public Relations at 81 Division of the Nigerian Army, Maj. Olaniyi Osoba, said the joint committee of the Army and the police investigating the case was still sitting.

Osoba said that the investigating team had gone far in its assignment and was probing all issues surrounding the incident, administratively.

He said the report would be out when the committee concluded its findings.

  • Police Orderly Assault: Professor Zainab gives own account of the incident

Police Orderly Assault: Professor Zainab gives own account of the incident

Professor of Law and human rights activist, Zainab Duke-Abiola, who has been trending for allegedly assaulting a female police officer, corporal  Teju Moses attached to her as orderly, has denied involvement in the assault, saying that the Nigeria Police Force (NPF) authorities framed her up for supporting the endsars protest in 2020.

The viral video where the police woman was seen seated on the bare floor with blood gushing from her head has generated a lot of reactions on social and traditional media.

According to the video, the police officer was seen saying that Professor Zainab ordered her boys to kill her

“She told her boys to kill me,” Moses said incoherently as she spoke to her direct boss on the phone”. She said

Meanwhile, according to Force spokesman, Olumuyiwa Adejobi, the Inspector-general of Police, Usman Baba, has ordered that Professor Zainab and one of her staffers Rebecca Enechido be investigated and prosecuted.

However, in her interview with an online medium, SR, Professor, Zainab denied ever assaulting the woman police officer but agrees that she was her former orderly.

Prof. Zainab noted that she qualifies to be given an orderly to guard her because of her status as the  Chief Legal Consultant of the Nigeria Police Force and also to protect her against attacks from dangerous criminals.

“The truth is that I, Professor Zainab Abiola, widow of Chief MKO Abiola, the winner of June 12 presidential election have been rendering pro-bono services to the Nigeria Police Force free of charge for over 15 years following her appointment as legal representative of the security agency.

“Based on my professional excellence, the police promoted me and appointed me as the Chief Legal Consultant (CLC). As of today, Professor Abiola is the only Chief Legal Consultant of the Nigerian Police Force.

“Orderlies have always been attached to me to protect me against dangerous criminals that the police are prosecuting. Even the present IGP, Alkali Baba approved and revalidated some new orderlies for me as recently as 29th April 2022.

“So, for IGP Alkali Usman to deny any knowledge of the CLC of the police is irresponsible, discrimination, racism, tribalism, ethnicism, bureaucratic corruption and a mischievous attempt to deceive the public. On some occasions, the police would officially approve logistics for my staff to handle office administrative works like photocopying, typing which are yet to be reimbursed.”

Zainab added she became an enemy of the current Inspector General of Police because of her support for #EndSARS victims.

“The IGP was very angry, he reduced the number of cases assigned to me because of my office at the legal department of the police. My office is there, did you not see my letterhead paper? If they (police) have another Chief Legal Consultant in this Nigeria, let them bring the person out. It’s no other person but me, even the senior lawyers listen to me, so I give recommendations.

“That was how I recommended that all these lopsided appointments of Christians by the IGP is wrong, I wrote the President. Intelligent police officers, you decided to retire them, you need these people to fight insecurity. That’s me, thank God that this thing happened, who will know I have been rendering pro bono services to the Nigeria Police Force for years?

“’You said you were supporting #EndSARS people and you called yourself our Chief Legal Consultant. Why would you be supporting those thugs, those criminals, those Lagos boys, those Tinubu’s boys’. Yes, that’s what the IGP said.

“It appeared you are working and supporting Tinubu. Openly, he said so in his office. What do you think? You supporting Tinubu. I kept quiet, I didn’t reply him (IGP), he said so in his office. I think his office has a camera, let them bring the recording of that meeting out.

“Is it wrong to be against police brutality, discrimination against innocent citizens, misuse of guns against Nigerians? I have not done anything, I don’t assault people, my hand is for healing, for good things, it’s not in my character. They were just looking for a way to embarrass me.

“It started after I came back from the United States of America and actually expressed support for #EndSARS freedom fighters openly. The IGP, Alkali Baba Usman was not happy.

“That was where his sons, one Engineer Ibrahim stepped in and offered to take me to see the IGP for a fee. But I refused to pay any bribe and that IGP’s son, Engineer Ibrahim took offence.

“He, Ibrahim now brought his girlfriend, one miss Zara to us. When it was discovered that the girlfriend of the IGP’s son has sickle cell disease, my firm offered to help but Ibrahim travelled out.

“On his return, the IGPs son kept visiting our office and not being able to get any headway, he turned 360 degrees and became an enemy and very hostile. Nobody beat up any orderly. It is not in my character.”

She added that she the woman police wasn’t her orderly as at the time of the alleged assault.

“I rejected her posting after realizing she’s been on a peacekeeping mission to several countries and should be rehabilitated first due to her mental health.

“But she came back that particular night. I wasn’t even the one who attended to her, so how could I have given the order that she should be assaulted?”

However, latest development says that professor Zainab has been remanded in custody pending final investigations and findings of the Nigeria Police force on the matter.
