Benue Gov suspends attorney general for joining states challenging the establishment of EFCC

Benue state governor, Hyacinth Alia has suspended the state’s Attorney General and Commissioner of Justice and Public Order, Fidelis Mnyim.

The justice commissioner was suspended for joining states challenging the establishment of the Economic and Financial Crimes Commission (EFCC) and the Independent Corrupt Practices and Other Related Offences Commission (ICPC).

On Tuesday, the Supreme Court reserved judgment in a suit filed by 19 states challenging the constitutionality of the laws establishing the EFCC.

The 19 states still in the suit are Kogi, Kebbi, Katsina, Sokoto, Jigawa, Enugu, Oyo, Benue, Plateau, Cross River, Ondo, Niger, Edo, Bauchi, Imo, Osun, Nasarawa, Ogun, and Taraba.

The states argued that it was the UN Convention against corruption that was reduced into the EFCC Establishment Act and that in enacting this law in 2004, the provision of Section 12 of the Nigerian constitution was not followed.

They argued that in bringing a convention into the Nigerian law, the provision of Section 12 must be complied with.

Rivers Assembly screen, confirm new Attorney general

Members of the Rivers Assembly have screened and confirmed the appointment of Mr Dagogo Tamunoiboroma as the new Rivers Attorney-General and Commissioner for Justice.

Tamunoiboroma was confirmed at a plenary at the temporary assembly chamber in Government House, Port Harcourt.

Factional Speaker Victor Oko-Jumbo had read the correspondence from Gov. Siminalayi Fubara, requesting the screening and confirmation of the Commissioner-designate.

Responding to the governor’s request, House Leader, Mr Sokari Good-boy and Deputy Speaker, Mr Adolphus Timothy, unanimously adopted the confirmation of the nominee.

They based their confirmation on his track record while also adding that he was “a man of great repute and pedigree”.

According to members, the nominee has all it takes to support the governor in his quest to move the state forward.

Earlier, during a brief screening, Tamunoiboroma had pledged commitment to the government and people of the state.

He also stressed the rule of law which, he said, would prevail at all times.

The prolonged political rift between Gov. Fubara and his predecessor, Chief Nyesom Wike, has torn the Rivers House of Assembly into two.

One of the groups is led by Oko-Jumbo while the other group is led by Martin Amaewhule.

  • Tinubu orders Attorney-General to clear cases on $1.3bn oil block

Tinubu orders Attorney-General to clear cases on $1.3bn oil block

President Bola Tinubu has ordered the Attorney-General of the Federation, Lateef Fagbemi to clear court cases on 1.3 billion dollars deepwater OML 245 oil block in Niger Delta.

Others who received the directive are the Minister of State for Petroleum Resources, Heineken Lokpobiri, and the Economic and Financial Crimes Commission (EFCC).

The rest are the Nigerian Upstream Petroleum Regulatory Commission (NUPRC) and Nigerian National Petroleum Company Limited (NNPC Ltd).

Lokpobiri said this in Abuja on Wednesday while speaking with newsmen.

The Federal Government had in 1998 awarded the Oil Mining Lease (OML) 245 to Malabu Oil and Gas Ltd. for 20 million dollars.

The license covers a defined deep-water offshore area more than 1,000 metres below sea level and approximately 150 km off the Niger Delta.

However, with progress in the awards, this has turned out to be a pain. It has been a constant source of litigation for successive governments due to allegations surrounding fraud and corruption in awarding the licence.

The minister said that parties involved in the deal were currently negotiating to end the more than 28 years crisis and litigations surrounding the prolific oil block located in the southern Niger Delta in the next one month.

“The previous administration initiated most of the cases that we are talking about today, and they took us to court, while we took Eni, Malabu, others to different courts in Europe, Canada, etc, but we didn’t win any of the cases.

“To even shock you, there is one that got us a penalty of over 70 million pounds” he said.

He said that JP Morgan, a financial institution sued the government for trying to dent its image in the saga, adding that the penalty was now binding on Nigeria.

“So we have been fined over 70 million pounds by the court. Who will pay that? You and I will pay that, or our children will pay, because it is a judgement debt.

“And in all the ones that we pursue both in Switzerland and other locations, we have no evidence to get conviction.

“And so it makes sense for this government to come and say that for 28 years, this block has been idle.

“This block is a prolific block that will add so much value to our economy, so let’s see how we can resolve the problem,” he said.

He said they were in talks with Eni and Shell, to see how they can resolve all the problems.

He said that at the last meeting, it was agreed that parties should go on with negotiations and to reconvene within one month to see how we will be able to sort out all the issues so that the investment can continue.

According to him, the parties of the Federal Government interfacing with Eni and Shell, is the Attorney-General of the Federation, which leads the delegation.

It includes NUPRC, EFCC, NNPC Ltd, and the Minister of State for Petroleum

“We are transparent about this process. We have full government in resolving this matter. Everything is being done transparently.

“This process has nothing to benefit the President as an individual, his interest is the welfare of Nigerians and to attract investments to the sector for Nigerians to benefit from God-given natural resources,” the minister said.

  • UPDATED: EFCC arraigns ex-Lagos attorney general, Shasore, gets N50m bail

UPDATED: EFCC arraigns ex-Lagos attorney general, Shasore, gets N50m bail

A former Attorney-General (A-G) of Lagos State, Mr  Olasupo Shashore, on Thursday appeared before a Federal High Court in  Lagos to answer to a money laundering charge preferred against him by the Economic and Financial Crimes Commission (EFCC).

Shasore served as the Attorney-General of Lagos State and the  Commissioner for Justice during the tenure of Mr Babatunde Fashola as the governor.

He was arraigned before Justice Chukwujekwu Aneke on a four-count charge bordering on money laundering.

The prosecution accused the defendant of inducing one Olufolakemi Adetore to accept cash payment without going through a financial institution.

He, however, pleaded not guilty to the charge .

After his plea, the prosecutor, Mr Bala Sanga, urged the court to order a remand of the defendant in custody pending trial.

However,  the defence counsel, Mr C.A Candide-Johnson (SAN) who appeared with Messrs Muiz Banire (SAN), Adesegun Adebola (SAN) and Chijioke Okoki (SAN), prayed the court to allow the defendant bail on his self recognisance.

The defence counsel averred that the defendant personally walked into the court for his arraignment this morning without any reminder, compulsion, or force.

He also informed the court that the defendant had co-operated with the anti-graft agency whenever required, as he had always made himself as well as documents  requested from him available whenever required.

Besides, the  defence counsel added that investigation of the matter had been on since the past  three years, adding that the defendant is not a flight risk

He, therefore, urged the court to exercise its discretion in favour of defence.

The prosecutor on his part said that  he was not opposed to bail; but added that the concern of the prosecution is only for the defendant to be available to stand trial as lawfully required.

Following the submissions by counsel, the court stood down the matter for a while, so as to deliver a rulling on the bail application

In his rulling,  the court later on held: “There is no doubt that the court must strike a balance based on the evidence before it, between the constitutional rights of the defendant to liberty and presumption of innocence and the rights of the state to prosecute its erring citizens.

“Hence,  the overriding need by the court to ensure that the complainant/respondent is not incapacitated in the discharge of its function by not releasing the defendant on bail ,” he said.

The court held that exercising its discretion in granting bail in favour of the applicant, would better serve the course of justice, as an accused is presumed innocent until guilt is proven.

“The defendant’s application for bail suceeds and  the bail is accordingly granted in the following terms:

“Defendant applicant is admitted to bail in the sum of N50 million with one surety in like sum.

“The surety must be a serving director or  a permanent secretary in the service of the federation or the Lagos State Government.

“Surety to produce two copies each of his or her recent passport photograph and evidence of payment of tax or tax clearance.

“The defendant’s international passport with the complainant shall be deposited with the registrar of this court pending trial; This is the rulling of the honourable court,” he said.

Meanwhile, the court did not make any remand orders on the defendant who was already on bail.

The court, however, released him to his lawyers pending the perfection of his bail.

The judge adjourned the case until Nov. 24 for trial.

In the charge, the former A-G was alleged to have made a cash payment of 100,000 dollars to one Olufolakemi Adelore through one Auwalu Habu and Wole Aboderin.

He was alleged to have committed the offences on or about Nov.18, 2014.

The EFCC also alleged that the defendant made a cash payment of 100,000 dollars to one Ikechukwu Oguine without going through a financial institution.

The offences contravene the Provisions of Sections 1(a) 16(1)(d), 18(c) and 78(c) of the Money Laundering (Prohibition) Act, 2011 (as amended).
