    Oyo Attorney General advocates effective implementation of multi door court law

    Oyo State Attorney General and Commissioner for Justice, Mr Oluseun Abimbola has advocated an effective implementation of multi door Court law recently accented to in the State by the Executive Governor of Oyo State, Senator Abiola Ajimobi.

    He stated this while receiving the new Executive Members of Nigeria Bar Association, Ibadan branch who paid a courtesy call to his Office, Ministry of Justice, Secretariat, Ibadan.

    Commissioner explained that the Multi-door Court will afford other courts in the State the opportunity to settle the convict of minor offences and ensure speedy administration of Justice.

    He assured members of the bar the support and assistance of the Government towards achieving optimum level of operation standard in the State, adding that the recruitment exercise for more State Counsel shall be concluded soonest.

    In his remark, the State solicitor General and Permanent Secretary, Mr Wasiu Gbadegesin charged the bar and the the law enforcement agencies to be involved in the Multi-door Court Law to ensure Compliance with the provision of this act for the realization of it purpose.

    Earlier, the Chairman NBA, Ibadan branch, Dr Oluwole Akintayo ,urged the State Government to continue to build synergies among the statekeholder in the area of good governance, promotion and social development. He implored the government to speed up the promise of recruitment of more legal counsels in the State.

    The Commissioner for Justice and Attorney-General of Rivers State, Emmanuel Chinwenwo Aguma SAN, is dead.

    Impeccable sources said the senior advocate died of an undisclosed ailment abroad.

    However, as at the time of filing this report, the Rivers State Government is yet to issue an official statement on the Attorney General’s passing.

  • Why Attorney General & Minister of Justice should protect the constitution from breaches – Akpojotor Agaga

    One of the constitutional duties of the minister of justice is enforcing the laws and guide them from being broken. This responsibility is not limited to individuals but extends to organs and institutions of government. We do not expect the Attorney General to take any preventive measures on issues that are still recondite. But when an issue has been pronounced upon by several courts to the extent that it has become trite, the minister of justice is beholden to the nation to take steps from preventing reoccurrence of such breaches in the interest of the integrity of the country.

    The recent suspension of Senator Ovie Omo-Agege on Thursday, the 12th day of April, 2018 which has been looming for several weeks over a statement made by him, on the sequencing of elections in the Electoral Act amendment bill could have been stopped by the minister of justice, if indeed he took his responsibility of protecting the laws of the country seriously.

    For as long as the minister of justice does not rise to the occasion to proactively stop the constitution from being desecrated and shredded so long shall we have this regime of impunity that has now become the forte of the leadership of the Senate and House of Representatives as a cog in the wheel to the growth of democratic culture, governance and development of the country.

    But now that we are having on our hands a repeat too many to condone, in the latest imperial action of the Senate, in suspending an elected senator who is the voice and mouthpiece of more than two million people of delta central senatorial district with a backlash that could debilitate the weak fabric of our federation especially with the perception of constituents hard hit by the suspension order that they are being technically excised from Nigeria, there cannot be a more apposite time than this for the minister to rise up to the challenge by initiating legal measures to arrest the ugly and disgusting situation with a view to reassuring the people of Delta central senatorial district who have vowed to protect their rights recognized by the constitution of the Federal Republic of Nigeria and Africa Charter on Human & people’s right that they are valued and recognized as an integral part of the Federal Republic of Nigeria.

    In the past, that was the trend that helped grow democratic culture and values as witnessed by instituting of court cases by state governments against the federal government and vice versa on issues they considered as encroachment on constitutional provisions.

    This is the time to go back to the regime of deploying legal measures to curb the excesses of people and organs/ institutions of government. This option is far more rewarding than the Gestapo approach of using anti-corruption agencies to harass and intimidate people the hallmark of President Obasanjo’s government still flickering in this government with little success to show for it because president Muhammadu Buhari is not gifted with a sadistic temperament for such abusive actions. Nigerians can still remember the number of Senate presidents, governors and PDP national chairmen illegally removed from office by Obasanjo’s barbaric practices. We, therefore, call on the Attorney General to always do the needful to protect our democracy and restrain people from advocating and calling for autocratic measures of Obasanjo that should be trashed forever.

     

  • Lagos DNA/Forensic Centre records over 350 cases in 6 months – Attorney General

    The Lagos State Attorney-General and Commissioner for Justice, Mr Adeniji Kazeem, on Monday said the state DNA/Forensic Centre received over 350 applications covering different cases since inception.

    Kazeem disclosed the statistics during the opening of the 5th Crime Scene Management Training for some police personnel at the Lagos State DNA/Forensic Centre on Lagos Island.

    The commissioner said that over 50 of the cases had been resolved while others were still undergoing forensic analysis.

    He said that owing to the high incidence of alcohol and drug related accidents and deaths in the state, Gov. Akinwunmi Ambode approved the inclusion of a toxicology unit as an additional forensic section.

    The News Agency of Nigeria (NAN) reports that Gov. Akinwunmi Ambode of Lagos State, had on Sept. 27, 2017, inaugurated the Lagos State DNA/Forensic Centre (LSD&FC) at Odunlami Street on Lagos Island.

    The commissioner said that training police officers on forensic matter was important and apt.

    He said that the results from the training would bring about better equipped and well informed personnel that would understand how to manage crime scenes.

    “All over the world, crime scene management requires effective recognition and identification of physical and biological evidence.

    “It also includes the collection and proper preservation of evidence, documents, and the scientific analysis of evidence and the presentation of impartial facts in the court of law.’’

    Kazeem said that the Ministry of Justice had developed a close partnership with the Nigeria Police and the LSD&FC.

    They had jointly conducted several trainings and seminars for police investigators and prosecutors, he said.

    “The evolving partnership between the German Development Cooperation (GIZ),the Nigeria Police Forensic Team and the LSD&FC is significant and indeed a welcome development,” he said.

    Earlier, the Deputy Inspector-General of Police (DIG) in charge of Training and Development, Mr Emmanuel Inyang highlighted what was required to fight crimes.

    He said that crime fighting, prevention and prosecution required special skills, tactics and training to succeed.

    Inyang noted that for modern-day crime investigators to perform their duties effectively, they must undergo sufficient training on regular basis to sharpen their skills.

    He said that crime scene investigation was very critical in the duties of the police.

    He stressed that the basic raw materials for forensic analysis in crime investigation were usually obtained at the scenes of crime.

    “Effective and timely crime scene management and investigation will in most cases result in a positive outcome.

    “Whereas, a shoddy crime scene investigation will often produce unresolved cases by the police which normally leads to failure of criminal charges in court,’’ he said.

    The DIG commended the German Development Cooperation office in the country and other partners for the capacity building.

    He urged the participants drawn from Oyo,Osun,Ondo,Lagos States as well as from Zone 11 to pay serious attention to the training.

    The Deputy Project Manager of German Development Cooperation in Nigeria, Mr Hartmut Xander said the training was special.

    He said that forensic analysis was the overall law process in any case.

    Xander said he was happy to witness the joint training with the active involvement of the Lagos State Government.

    He said he was optimistic that the participants would be taken through all the major forensic processes, including disaster management within the duration of the programme.

     

  • Aregbesola orders Attorney General to appeal court verdict on ‘State of Osun’

    Governor Rauf Aregbesola of Osun State has directed the Attorney General of the state to file a notice of appeal against the verdict of a State High Court which invalidated the change of name carried out by his administration from ‘Osun State’ to ‘State of Osun.’

    TheNewsGuru.com reports that an Osun State High Court sitting in Ilesa last Thursday declared the change of the name of the state to the “State of Osun” as illegal, null and void.

    One of the media aides of the governor, Mrs. Bukola Aderibigbe, who said this at a press conference in Osogbo on Thursday, also stated that the state government would begin free train ride from Lagos to Osun State at Ido Terminus on Saturday, December 23 by 10:am.

    She said the government rejected the court judgment in its entirety, while stressing that the chairman of Ilesa branch of the Nigerian Bar Association, Mr. Kanmi Ajibola, who instituted the case, did so “with the intention of crippling the finances of the state.”

    Justice Yinka Afolabi of the Osun State High Court, Ilesa, had, on Monday, held that the change of name of Osun State to State of Osun by the Aregbesola administration was illegal.

    But Aderibigbe said her principal had also directed the attorney general to not only file an appeal against the verdict, but to also file a stay of execution of the judgment.

    She said, “We have asked the Attorney General/Commissioner for Justice to file an appeal against the judgment and to file a stay of execution against the judgment.”

    The plaintiff, Ajibola, had sought for an order setting aside the “State of Osun Land Use Charge Law, 2016,” having been enacted by the legislative body that is not known to the Constitution and for the state not known to the 1999 Constitution of the Federal Republic of Nigeria (as amended); saying the law is not enforceable in Osun State.

    The judge, Afolabi, said, “The executive governor of the state changed the name in 2011. The renaming of a state goes further and deeper for anyone to single-handedly do. To re-order the name of Osun State as “State of Osun” is hereby declared illegal, null and void.

    “On the oath of allegiance, I want to state that the Seventh Schedule is part of the law. It is not a mere draft or a mere oath.

    “It does not give room for any alteration. After deposing to an oath of office, you cannot turn around to do otherwise.”

    Attempted Murder: Wike directs Attorney General to prosecute former Rivers Majority Leader

    Swears in 13 Local Government Caretaker Committee Chairmen

    Rivers State Governor, Nyesom Ezenwo Wike has directed the re-appointed Rivers State Attorney General and Commissioner of Justice, Mr Emmanuel Aguma (SAN) to ensure the conclusive prosecution of Former Majority Leader of the Rivers State House of Assembly, Mr Chidi Lloyd over the attempted murder of a member of the State Assembly, Mr Michael Chinda.

    Governor Wike also directed the Attorney General and Commissioner of Justice to ensure the conclusive prosecution of Mr Ojukaye Flag Amachree who is standing trial for the murder of a citizen of Asari Toru Local Government Area during one of the rerun elections.

    According to him, anybody who commits crime in the state must face the full weight of the law.

    Governor Wike spoke on Saturday after swearing-in the reappointed State Attorney General and Commissioner and 13 Caretaker Committee Chairman of Local Government Areas.

    He said: “The Attempted Murder of a member of the Rivers State House of Assembly must be conclusively prosecuted by the office of the Attorney General.

    “Also, the person involved in the murder of a citizen of Asari Toru Local Government Area during the rerun elections must be conclusively prosecuted. Nobody is above the law.

    “I don’t know how the person who was almost killed on the floor of the Rivers House of Assembly will feel seeing his assailant moving around freely? How will the family of the murdered Asari Toru Local Government Area citizen feel knowing that the alleged murder suspect is roaming freely without conclusive prosecution “.

    The governor charged the Attorney General and Commissioner of Justice to ensure that all the victims get justice in accordance with the tenets of the law.

    He advised the Attorney General to sustain the enthronement of the rule of law to avoid a situation where people resort to self help on account that the state cannot prosecute criminal offenders.

    On the newly sworn-in Chairmen of Caretaker Committees of Local Government Areas , Governor Wike advised them to concentrate on the maintenance of security and environmental sanitation.

    He advised the Local Government Chairmen to work with security agencies to address security challenges in their respective local government areas.

    He warned them against the mismanagement of council funds for personal benefits or to influence top government officials or their families.
