  • We are taking steps to secure Fayose’s release – Ozekhome

    Human rights lawyer, Chief Mike Ozekhome (SAN), said efforts had begun to secure release of former Governor of Ekiti State, Mr Ayodele Fayose, from Economic and Financial Crimes Commission (EFCC) custody.
    Ozekhome said this in an interview with the News Agency of Nigeria in Abuja on Thursday.
    Fayose, whose tenure as governor ended on Monday, had on Tuesday reported at the EFCC office in Abuja to answer to some allegations levelled against him while in office as governor.
    Ozekhome said “Fayose’s lawyers are already taking steps to enforce his fundamental human rights by getting him released.
    “Yes, his lawyers will go to court to enforce his fundamental human rights.
    “The EFCC has no right to keep him for over 24 hours.
    “If they have done that by obtaining a Magistrate Court’s Order that will be in the form of “holding charge” which has been declared unconstitutional and illegal by the Supreme Court.
    “Holding charge is illegal. It is unconstitutional.’’
    Ozekhome said that the section of the Administration of Criminal Justice Act (ACJA) permitting a magistrate to detain a suspect for 14 days was illegal.
    According to him, any action outside the provisions of Section 35 of the Constitution which specifically provides for 24 hours, is illegal and unconstitutional.
    He explained that the ACJA allowed for detention of a suspect for 14 days, but that Section 35 of the Constitution made it clear that a person could only be detained for 24 hours.
    “So, when there is a clash between the statute, like the ACJA, and the Constitution, the Constitution prevails by virtue of Section 1(3).
    “If they have gotten an order for two weeks from the magistrate court, it is unconstitutional,” Ozekhome stressed.

  • N1.3bn fraud: EFCC disowns tweet, says Fayose’s fate to be determined by FHC

    The Economic and Financial Crimes Commission (EFCC) has disowned a recent gloating tweet that announced the imminent revival of a criminal case against outgoing Governor of Ekiti, Ayo Fayose.

    In a statement on Monday night, spokesman of the commission, Mr Wilson Uwujaren, said the “purported tweet does not represent the views of the EFCC”.

    The tweet, which appeared on the EFCC’s verified Twitter handle, @officialEFCC on Sunday afternoon, said the commission had dusted a N1.3 billion fraud case file against Fayose.

    It came few hours after the Independent National Electoral Commission (INEC) announced the results of Saturday’s governorship election in Ekiti.

    Fayose’s protege, Prof. Kolapo Olushola-Eleka of the Peoples Democratic Party (PDP), lost the election to Mr Kayode Fayemi of the All Progressives Congress (APC).

    The tweet read: “The parri (party) is over, the cloak of immunity torn apart, and the staff broken.

    “Ekiti Integrated Poultry Project/Biologival concepts Limited N1.3 billion fraud case file dusted off the shelves. See you soon.”

    The post, accompanied with the photograph of what looks like a dilapidated poultry structure, was deleted about three hours later.

    But before then it had gone viral online, eliciting criticisms from many Nigerians who interpreted it as a reflection of the commission’s partisanship.

    Uwujaren said, “In the opinion of most commentators, the tweet betrayed the partisanship of the EFCC in the political contest in Ekiti State.

    “Against the background, the commission is constrained to state that the purported tweet does not represent the views of the EFCC.

    “As a law enforcement organisation the commission is apolitical and was not involved in the recent Ekiti election.

    “It, therefore, has no reason to gloat over the political misfortune of any candidate or political god-father.”

    He said although there was a subsisting criminal charge against Fayose, the fate of the charge would be determined by the Federal High Court, Ado Ekiti, at the expiration of his tenure, not the EFCC.

    Out-going Ekiti State Governor Ayodele Fayose has vowed to challenge the victory of incoming Governor Kayode Fayemi at the election tribunal.

    TheNewsGuru reports Fayose describes Fayemi’s victory at the just concluded Ekiti state governorship election as “pyrrhic”.

    “If APC truly won, why was it that there was no jubilation in Ekiti? That victory of Kayode Fayemi is pyrrhic, we will reclaim the stolen mandate in the court by the power of God,” he stated.

    On this Ekiti election, President Buhari demonstrated truly that he is not a democrat, but a dictator and fascist per excellence.

    It is only Buhari that will pride himself with the security shooting sporadically at polling centres , scaring people to pave the way for the APC thugs to snatch ballot boxes.

    The President should bury his head in shame for using the police, army, Nigeria Security and Civil Defence Corps and INEC to snatch the mandate given to Olusola and deliver it to Fayemi “whom Ekiti people rejected.”

    What Buhari won as referendum from Ekiti people , Nigerians, and international community is shame, big shame.

    If APC truly won, why was it that there was no jubilation in Ekiti ?

    The President should note what the Bible says which applies to him: “He that wears the armour should not boast as he that removes it.”

    On Garba Shehu, that fellow is not to be accorded any attention. Being a fair weather friend, he would soon desert his current pay masters.

    Garba Shehu was in the Presidency courtesy Atiku Abubakar for eight years and came back for this current dispensation still courtesy Abubakar. Now, he has abandoned the person who brought him to the limelight.

    The Economic and Financial Crimes Commission (EFCC) has said it is set to soon arraign outgoing Ekiti State Governor Ayodele Fayose before a court of law over an alleged fraud case involving N1.3bn project money.

    TheNewsGuru reports the EFCC made this known on its Twitter handle on Sunday following the defeat of Prof. Kalapo Olusola, Fayose’s anointed candidate at the just concluded governorship election of the State.

    TheNewsGuru reports Fayose lost the bid to install his deputy as governor of Ekiti after Dr Kayode Fayemi, the All Progressives Congress (APC) candidate, foiled his political antics and several political prophecies to emerge victorious.

    Fayemi won the election after securing 197,459 votes to defeat Olusola, who got 178, 121 votes.

    Result of the poll, which held on Saturday, was announced by Independent National Electoral Commission (INEC) on Sunday.

    Shortly after the INEC announced the result, the EFCC made the tweet.

    Rivers State Governor, Nyesom Ezenwo Wike has condemned the brazen attack on Ekiti State by the Nigeria Police, saying that the attack was an affront on the inalienable rights of the people of Ekiti State to a peaceful, free, fair and credible election.

    In a press conference on Wednesday night at the Government House Port Harcourt , Governor Wike said that the Ekiti State Governor, Ayo Fayose was lucky to escape with his life after he was battered by the policemen on the orders of the Presidency.

    He called on Rivers people to be prepared to defend their mandate in 2019 as the Buhari administration will apply the same technique on all the states.

    He said: “I therefore join well-meaning Nigerians to condemn this brazen attack on the inalienable rights of the people of Ekiti State to a peaceful, free, fair and credible elections in the strongest possible terms and warn the perpetrators of the grave danger such actions pose to the survival of our democracy.

    “I wish to also draw the attention of the people of Rivers State to the fact that what is happening at Ekiti State is clearly a foretaste of what the APC-led Federal Government has planned to unleash in our State and in deed, the entire country, in their desperate attempt to rig 2019 general elections and retain or return to power having performed woefully and lost the support of the generality of Nigerians.

    “As a matter of fact, people did not quite believe me when I told the world that the APC-led Federal Government has plans to assassinate me to enable them capture Rivers State because they know they have no electoral foothold in the State.

    “Today, the whole world has seen how Governor Ayo Fayose was barely lucky to have escaped the State-sponsored attempt at his life with a fractured hand and bruised face because, with him around, hale and hearty, they will never win the Saturday elections free and fair in Ekiti.

    “In the face of these challenges therefore, I wish to call on the people of Rivers State to be prepared to fight and defend their rights to freely and democratically elect their leaders in the 2019 general elections.”

    He assured the people of Rivers State that he will never surrender their mandate, saying that he will defend the interest of the state with his life.

    He said: ” As your Governor I will never surrender your mandate and abiding interest of our State to our enemies who seek to keep us enslaved and plundered even at the pain of death.

    “I wish to commend and congratulate the irrepressible Governor Ayo Fayose and the people of Ekiti State for standing up and standing firm in defence of their rights to freedom, democracy and good governance.

    “I want to assure you of the support of the Government and people of Rivers State at these trying times. You need not fear as God will surely defeat your enemies and grant you a resounding victory come Saturday 14th July 2018.”

    Governor Wike said that the reasons adduced by the Police High Command is infantile and shameful. He said that no permission is required for a peace rally.

    He said: “In explaining the attack, the Deputy Inspector General of Police (Operations), Habila Joshak shamelessly claimed that they acted to brutalize the Governor and his people because the rally and peaceful road walk he was to address and lead was not authorized by the police. This claim is totally rubbish and should be told to the marines.

    “Knowing that it cannot defeat the PDP in a free and fair electoral contest, the APC had earlier threatened to cage the Governor and takeover Ekiti State Government House by brutal force.

    “Today’s brutal action was therefore carried out in furtherance of the deliberate plan to intimidate the people of Ekiti State in order to facilitate the actualization of the devilish intentions of the enemies of democracy.”

    Governor Ayodele Fayose wept on Wednesday following alleged brutalization of him by security operatives attached to the Ekiti State Government House.

    Fayose made the allegation in Ado-Ekiti, the Ekiti State capital at a rally organised by the Peoples Democratic Party (PDP).

    TheNewsGuru reports Governor Fayose had raised alarm of heavy shooting in front of the government house, following which, he was reportedly teargased and manhandled by the security operatives.

    “They (the police) are beating anybody who has any sign of PDP on them. They are not picking our calls; they’ve made up their minds to do this evil.

    “I am in pain, I am in severe pain. I can’t turn this neck anymore. If anything happens to me, the Inspector General of Police should be held responsible,” he wept while addressing newsmen at the rally.

    The road to the Ekiti State gubernatorial election is getting messier as Governor Ayodele Fayose has been severely brutalized by security operatives attached to the State’s government house.

    TheNewsGuru reports Governor Fayose had earlier raised alarm of heavy shooting in front of the government house before his manhandling by the security operative.

    According to a statement by the Peoples’ Democratic Party (PDP), the security operatives acted at the dictate of the All Progressives Congress (APC)-led federal government.

    Fayose had shared photos of armed mobile policemen, he alleged were brought by the APC, barricading entrance to the government house.

    Ekiti State Governor Ayodele Fayose has thanked President Muhammadu Buhari’s Minister of Labour and Employment, Dr. Chris Ngige, for campaigning for his governorship candidate.

    TheNewsGuru reports the Minister of Labour and Employment got himself into a big mess on Tuesday at the All Progressives Congress (APC) mega rally held at the Oluyemi Kayode Stadium in Ado Ekiti.

    Ngige, instead of campaigning for the APC party he represents, he faltered and campaigned for the Peoples’ Democratic Party (PDP) and Governor Fayose instead, in the presence of his boss and the mammoth crowd present at the rally.

    Reacting to the development, Fayose called the Minister his good friend, and thanked him for campaigning for him, saying the Minister is not afraid to say the truth.

    “I thank my good friend, Dr Chris Ngige for campaigning for me at the APC rally in Ado Ekiti yesterday.

    “Dr. Ngige is a man who is not always afraid to say the truth and that’s what he demonstrated yesterday even in the presence of the President and other APC leaders,” he said.

    Ngige at the rally, turning to President Buhari, said, “Mr President, the leaders of our party, our people are ready, they are ready and on Saturday it will happen.

    “Especially those from the South west for the mistake they made in 2014, so they won’t make that mistake again”.

    “If you marry two wives, you go know which one wey better. Fayose is the better Wife, he dey cook, he dey give him husband better food, he no dey give am trouble, so you must bring back Fayose on Saturday,” he said to the amazement of the crowd.
