  • Court fixes Feb 6 to continue suit seeking to remove Gov Bagudu from office

    The Federal High Court, Abuja, on Tuesday adjourned until February 6, hearing in a suit filed by the Peoples Democratic Party (PDP) seeking to remove Kebbi State Governor, Abubakar Bagudu.

    The trial Judge, Justice Ahmed Mohammed adjourned the matter after listening to the submission of Mr. Bagudu’s counsel, Yakubu Maikyau, (SAN).

    Mr. Maikyau argued extensively in urging the court not to admit in evidence, some of the documents the plaintiffs sought to tender in the defence of their case.

    He said that some of the documents such as the USA District Court of Columbia document titled Verified Complaint, the Memorandum of Opinion and a receipt sought to be tendered did not meet the required standards stipulated by the law.

    My lord, the three criteria for a document to be admissible are that the document must be pleaded, it must be relevant and must satisfy any requirement of the law for its admissibility.

    The document, sought to be tendered, purports to be the proceeding of a court in the USA.

    That document is a copy of the purported proceedings.

    Under Section 102(a) (iii) of the Evidence Act, it is a public document. This is not the original copy.

    Section 106 Paragraph H of the Act described the manner of proof in documentary evidence of this nature.

    The document does not bear any seal of the court from where it purportedly emanated. There is also no indication on this document of a statement that the court from where the document emanated does not have seal” Mr. Maikyau argued.

    More so, he contended that the document was not certified, saying it did not satisfy requirements of the Evidence Act, insisting it was generated electronically.

    Justice Mohammed adjourned the matter until February 6, for the plaintiffs to respond to the defendant’s objection to admissibility of the documents.

    Other plaintiffs in the suit include, Bello Sarkin Yaki, a retired major general and Anthony Itanyi.

    Mr. Sarkin Yaki, who was the PDP governorship candidate in the 2015 election, asked the court to cancel the Certificate of Return issued to Mr. Bagudu and declare it as null and void.

    He was equally seeking an order of court directing the Independent National Electoral Commission (INEC), to issue him with a fresh Certificate of Return for coming second in the said election.

    The plaintiffs, in the suit, prayed the court to declare that Mr. Bagudu was incompetent to contest the last governorship election in Kebbi.

    They urged the court to sack the governor on the premise that he gave false information in the Affidavit of Personal Particulars he submitted to INEC prior to the 2015 governorship election in the state.

    The plaintiffs told the court that the claim by Mr. Bagudu in his Form CF.001 before INEC, to the effect that he was not under a fine for offence of “involving in dishonesty or fraud or any offence imposed by a court or tribunal”, was false.

    They alleged that contrary to Mr. Bagudu’s claim it was discovered that he was previously fined by a court in the U.S

    They further alleged that he was arrested on May 22, 2003, in Houston, Texas, U.S. based on an extradition warrant that was requested by Britain on behalf of Isle of Jersey.

    They also submitted that he was facing charges for fraudulent transfer of money from Nigeria to the Deutsche bank, making false declarations to open the bank accounts and using Federal Government of Nigeria’s fund to purchase notes that the Federal Government of Nigeria had defaulted on.

    They also said he sold the notes back to the Federal Government for twice the purchase price.

    According to them, while their case was pending before the High Court, INEC conducted the gubernatorial election and declared Mr. Bagudu as the winner.

     

  • 2019: Kebbi local govt chairmen endorse Buhari, Bagudu

    The chairmen of the Association of Local Governments of Nigeria (ALGON), under the platform of the All Progressives Congress (APC) in Kebbi, have endorsed President Muhammadu Buhari for the 2019 presidential election.

    The group also endorsed Gov. Atiku Bagudu of Kebbi for a second term in office in the forthcoming general election.

    The state chairman of the association, who is also the APC Chairman of Maiyama Local Government Area, Abdullahi Andarai, made this disclosure to journalists on Saturday in Birnin Kebbi.

    Mr. Andarai told journalists that the endorsement became necessary, considering the achievements the party had recorded both in the country and at the state level.

    “The leadership of the APC in the state has benefited from the good governance of Gov Atiki Bagudu and President Muhammadu Bahari.

    “We, in Kebbi, are farmers, we support any policy that places high premium on agriculture.

    “APC leadership from the national and state levels came up with the agriculture revolution policy, from which we have benefited immensely.

    “The economic status of farmers in the state has improved and we will ensure the continuation of the APC leadership at the state and the national levels,” he said.

    The APC leader said the association reached the resolution after due consultations with their party supporters at the grassroots.

    He called on the president and the governor to accept the endorsement, adding, “Kebbi people will not be happy if our endorsement is not accepted”.

  • Flood: Bagudu orders relocation of 100 households

    Governor Atiku Bagudu of Kebbi, has directed the state Emergency Management Agency (SEMA) to relocate 100 households affected by flooding in Dole-Kaina Area of Dandi Local Government to a safer place.

    Bagudu gave this directive in a statement signed by Alhaji Abubakar Dakingari, the Chief Press Secretary to the governor in Birnin Kebbi on Tuesday.

    He also directed the agency to provide the victims with food items, potable water, drugs and mattresses as well as to resettle them in a virgin land.

    “Their present settlement is no longer habitable. A permanent settlement should be provided for them on a virgin land so as to avoid a recurrence of the problem,” it said.

    He said that the relocation became necessary following the overflow of the River Niger and the displacement of more than 100 households in the border town of Dole-Kaina in Dandi Local Government Area.

  • Buhari lauds Ambode, Bagudu for partnering to produce LAKE Rice

    President Muhammadu Buhari has commended Governors Akinwunmi Ambode of Lagos State and Atiku Bagudu of Kebbi State for the successful partnership that gave rise to the local production of LAKE Rice (Lagos-Kebbi Rice).

    The president applauded the efforts of the governors in bringing to fruition the Memorandum of Understanding (MoU) signed in March 2016 on substantially meeting the country’s rice requirement.

    In a statement issued by his Special Adviser on Media and Publicity, Mr Femi Adesina, in Abuja on Friday, Buhari expressed delight at the relatively cheaper price of LAKE Rice especially at this period of recession.

    “It gladdens my heart to get reports of our citizens rushing to purchase this cheaper local rice to enable them and their families enjoy the Christmas and New Year celebrations,’’ he added.

    According to the president, what the two states have done is evidence of a new base being laid for the Nigerian economy, founded and propelled by agriculture, away from substantial dependence on oil and gas for national revenue.

    The president recalled that in his 2017 budget presentation before the National Assembly, he said that “a new era is rising in which we must grow what we eat and consume what we make.’’

    According to him, the LAKE Rice achievement is in furtherance of the above goal.

    President Buhari urged other state governments to replicate the laudable example of LAKE Rice in other staple crops and dairy products.

    The president pledged the Federal Government’s readiness to continue to support such initiatives by providing the enabling environment, policies and incentives for agriculture to thrive in order for the nation to achieve food security.

    He expressed optimistic that the country would attain rice sufficiency by 2019.
