    PDP’s candidate can’t be sworn in as Bayelsa Gov – Oshiomhole

    National Chairman of the All Progressives Congress(APC), Comrade Adams Oshiomhole has declared candidate of the Peoples Democratic Party (PDP) Senator Douye Diri cannot be sworn in on Friday as Bayelsa Governor because he did not meet the requirements of the Supreme Court.

    Oshiomhole pointed out the judgement of the Supreme Court said the certificate of return should be issued to the candidate, who has the required spread in the election aside from David Lyon.

    He said there was no candidate in the election that met the requirement apart from Lyon, adding that the implication is that from Friday Bayelsa will be without a Governor.

    BREAKING: Supreme Court sacks Bayelsa governor-elect, Lyon

    The Supreme Court has sacked the governor-elect of Bayelsa State, David Lyon, and his Deputy, Biobarakuma Degi-Eremieoyo.

    A five-man panel of the apex court led by Justice Mary Peter-Odili ordered the Independent National Electoral Commission to withdraw the Certificate of Return issued to the All Progressives Congress’ candidates as the winners of the November 16, 2019 governorship election in the state.

    The apex court ordered INEC to issue fresh certificates to the candidates of the party with the next highest votes and with the required constitutional spread of votes in the results of the election, which are the Peoples Democratic Party’s candidates.

    Justice Ejembi Ekwo, who read the lead judgment of the apex, made the orders after disqualifying the APC’s deputy governorship candidate, Degi-Eremienyo, as a candidate in the election.

    The court upheld the November 12, 2019 judgment of the Federal High Court in Abuja which had disqualified Degi-Eremienyo in the election for submitting forged certificates to INEC.

    The court ruled Degi-Eremienyo’s disqualification had infected the joint ticket with which he and the governorship candidate, Lyon, ran for and won the November 16, 2019 election.

    Supreme Court affirms Lyon as Bayelsa APC candidate

    The Supreme Court has upheld the choice of the All Progressives Congress (APC) in Bayelsa State to field Lyon David as the party’s candidate for the last governorship election in the state.

    A five-man panel of the court, led by Justice Mary Odili, in a judgment a moment ago, dismiss the appeal marked: SC/35/2020, by former Minister of State for Agriculture, Heineken Lokpobiri against the nomination of Lyon as the APC’s governorship candidate.

    Lokpobiri, had queried the APC’s decision to submit Lyon’s name to the Independent National Electoral Commission (INEC) as its candidate.

    Justice John Inyang Okoro, who read the Supreme Court’s lead judgment on Monday, held that Lokpobiri’s case was statute barred, having not been filed within the. 14 days allowed under the 4th Alteration Act as contained in Section 285 of the Constitution.

    Justice Okoro affirmed a similar judgment earlier given by the Court of Appeal on the issue.

  • Bayelsa appeals judgement ceding Soku Oil Wells to Rivers

    The Bayelsa Government on Monday said it has appealed the judgment of the Federal High Court, Abuja, which ceded the disputed Soku oil wells between Rivers and Bayelsa to Rivers.

    Solicitor General of the state, Mr Preye Agada, disclosed this during an interaction with newsmen in Yenagoa.

    Agada, who led the state’s legal team to file the appeal on behalf of the state Attorney General, said that the state is seeking a stay of execution of the judgment pending determination of the appeal.

    The judgment was delivered by Justice Inyang Ekwo on December 26, 2019.

    Agada said that the lower court delivered judgment against the state without joining it as a party in the suit.

    He noted that in the motion on notice in the suit no: FHC/ABJ/CS/984/2019, Bayelsa was not served the processes in the suit before the lower court delivered the said judgment.

    He said that the state government had also sought an order of the court to appeal the judgment as an interested party in the suit between the Attorney General of Rivers State and the National Boundaries Commission.

    The solicitor general said that the state had written all relevant federal agencies to stay action on the enforcement of the judgment.

    The agencies include the Attorney General and Minister of Justice; the Minister of Finance; the Accountant General of the Federation; the Chairman, Revenue Mobilisation, Allocation, and Fiscal Commission; and the National Boundary Commission.

    He added that the contested oil wells, which Rivers described as Soku Oil Wells are in Oluasiri in Bayelsa, stressing that Bayelsa had been receiving the 13 per cent derivation accruing from the oil wells for a long time.

    He explained that Bayelsa government had been waiting for Rivers and the National Boundaries Commission to cooperate with the Supreme Court directive to properly delineate the disputed areas in the affected areas once and for all.

    The Solicitor General said that it was regrettable that Rivers government, which pulled out of the boundary delineation exercise in 2013, surreptitiously filed the action after years of inactivity.

    He appealed to the people of the affected communities who are all Ijaw people to await proper delineation of the boundaries, which he said did not have any effect on the historical ties and relationship between them.

    Police rescue kidnapped 6-yr-old son of Bayelsa Commissioner

    The police in Bayelsa State have rescued a kidnapped victim, Master Antonio, the six-year-old son of the State Commissioner for Water Resources Nengi Talbot.

    The little boy was abducted on December 22 by four gunmen, who stormed the commissioner’s residence at the New Commissioners’ Quarters in Yenagoa.

    The gunmen broke into the house of Talbot at the quarters located in Opolo and demanded money from the commissioner.

    The assailants seized the boy and whisked him away to an unknown place when the commissioner insisted he had no money.

    It was, however, gathered that following investigation by the special police crack team, Operation Puff Adder, the boy was freed from the kidnappers’ den.

    The Commissioner of Police, Uche Anozia, received the abducted victim at the command’s headquarters in Yenagoa.

    He said the boy regained his freedom following sustained efforts of the police, who were on the trail of the kidnappers.

    Anozia said the kidnappers were moving the victim from one creek to another adding that the police adopted high level of intelligence and professionalism to free the boy unhurt.

    He said all the suspects involved in the crime were arrested and would undergo further investigations for prosecution.

    Talbot, the father of the victim, thanked the police for their efforts adding that the police demanded no money from him throughout the operation.

    Talbot, who beamed with smiles, said through the efforts of the police he paid no ransom to get his son back.

    Describing the experience as traumatic he said the kidnappers initially demanded N50m but the police ensured no ransom was paid.

    The Nigerian Navy has commenced manhunt for gunmen, who killed four Naval ratings and abducted two foreigners at Agge coastal areas in Bayelsa State.

    It was gathered that the incident occurred when the gunmen seized a dredger escorted by the operatives of the Nigerian Navy Ship (NNS) Delta at the weekend.

  • One killed, others injured in Bayelsa communal clash

    At least one person was killed at the weekend in a communal clash between Oruma and Otu-Asiga communities in Ogbia Local Government Area, Bayelsa State.

    It was learnt that the youths from both communities engaged in a free-for-all using machetes and other weapons in the clash that unsettled the leadership of both communities.

    JTF, Navy visit Jonathan in Otuoke to ascertain level of damage

    The Joint Task Force (JFT), code named Operation Delta Safe, and the Nigerian Navy on Monday visited former President Goodluck Jonathan’s residence in Otuoke, Ogbia Local Government Area of Bayelsa.

    The visit was to ascertain the level of damage following attack on the former president’s residence by unknown gunmen on Christmas eve.

    They said the visit was also to find necessary solution to prevent reoccurrence of such attacks.

    In attendance were the JTF Commander, Rear Admiral Akinjide Akinrinade, the Flag Officer Commanding Central Naval Command, Rear Admiral Saidu Garba, the Commander Nigerian Navy Ship Soroh, Commodore Felix Esekhile amongst others.

    In his remarks, Jonathan urged them to be thorough in their investigations.

    “Be thorough as you seek to bring the perpetrators to book and ensure that such mindless attack do not happen again in any part of the country,” Jonathan said.

    My attackers must be arrested, prosecuted – Jonathan

    Nigeria’s former President, Dr. Goodluck Jonathan has called for the arrest and prosecution of gunmen who attacked his home in Otuoke, Bayelsa, South South Nigeria.

    Jonathan also thanked Nigerians for the continuing show of solidarity and sympathy following the Christmas eve attack by unknown gunmen in his country home in Otuoke, Bayelsa State.

    The former President who stated this while conducting sympathisers round the scene of the attack on Friday also commended the Nigerian military for their gallantry in repelling the attack by engaging the assailants in a fierce gun duel that unfortunately claimed the life of a soldier.

    Jonathan noted that since the assailants attacked his marine security post on December 24, 2019 many Nigerians of different social status, including President Muhammadu Buhari, state Governors and political party leaders as well as foreigners had either visited him or called to express their heartfelt sympathy over the unfortunate attack in his house.

    The former President also reiterated his call on the concerned security authorities to expose and bring the criminals to book as a means of ensuring that such dare-devil criminality did not happen again in his community or any other place in the country.

    On December 24, 019, the assailants had stormed Jonathan’s country home in about five engine boats and attacked the marine security post located within the periphery of the residence at about 1:30 am on Tuesday and sought to take control of a gunboat belonging to the military.

    They were however resisted by gallant soldiers who engaged them in a firefight. The gunmen who couldn’t stand the firepower of the military were forced to beat a retreat.

  • Why court judgement ceding Soku Oil Wells to Rivers cannot stand – Bayelsa Govt.

    The Federal High Court judgment transferring Soku oil wells in Oluasiri, a disputed boundary, to Rivers State, cannot stand, Bayelsa State government said on Thursday.

    The state said the ownership of the land on which the oil fields are located is yet to be determined.

    Besides, it said the judgment was contrary to a Supreme Court verdict that the National Boundary Commission (NBC) should be allowed to determine the land ownership.

    In a statement by its Attorney-General and Commissioner for Justice, Arthur Andrew, the state said the high court judgement cannot stand.

    Andrew said that despite the Supreme Court verdict, the Rivers government instituted an action against the NBC to justify its “false” claims on the Soku oilfields, which he said are located in Nembe Local Government Area.

    He said: “From Monday, 16th December 2019, the media had been awash with reports that the Federal High Court, sitting at Abuja, had delivered a judgment awarding the ownership of the said Oluasiri Oilfields/Oil wells to Rivers State purportedly pursuant to the judgment of the Supreme Court in Suit No. CS/106/2009 between Attorney-General, Rivers State v. Attorney-General, Bayelsa State & Anor.

    “It was also reported that the judgment of the Federal High Court was made to give effect to the decision of the Supreme Court, and purporting to direct the NBC to fix the boundary between Rivers and Bayelsa State at Santa Barbara River.

    “It is worthy of note that the Supreme Court in Suit No. CS/106/2009 struck out the action on the ground that it was futile and premature to determine the boundaries of the two states insofar as the NBC had not delineated the boundary between Rivers State and Bayelsa State.

    “The Supreme Court never made a specific order directing the NBC to delineate the disputed boundaries.

    “Albeit, it is part of the statutory function of the NBC to deal with, determine and intervene in any boundary dispute that may arise between any two states of the federation with a view to settling such dispute”.

    Andrew quoted the Supreme Court as saying: “It is on account of the foregoing and because of the technical nature of the dispute and the claims of the parties that this court finds that the NBC as an authority vested with authorities and expert know-how in dealing with this matter should have once and for all conducted an exhaustive exercise of delineating the disputed boundary.

    “Hence, the long-awaited 12th edition of the administrative map, when completed soonest, would have been of tremendous assistance in settling this lingering dispute.

    “In the light of the observations I have clearly expressed above, I do not feel comfortable to grant the declarations sought until the NBC concludes its exercise of delineation of disputed boundary to finality.

    “It will be futile and premature to determine the boundary of the two parties states in the present circumstances.

    “However, the appropriate order to be made in the prevailing circumstance is that of striking out the plaintiff’s suit, and I so order accordingly. Each party to bear its costs.”

    Andrew said following the judgement, the NBC constituted a Joint Technical Committee on the Bayelsa/Rivers Interstate Boundary.

    The statement adds: “After a couple of meetings of the aforesaid committee, on the 30th of January, 2013, the Rivers State delegation led by the then Deputy Governor, Engr. Tele Ikuru, formally announced the withdrawal of the state’s delegation from further deliberation and participation in the joint delimitation and demarcation exercises until certain conditions articulated by the deputy governor of Rivers State are met, which amongst others, included the payments of all revenue from the disputed oil wells into an Escrow Account under the Accountant-General of the Federation.

    “It is, therefore, surprising that Rivers State could resort to instituting the action at the Federal High Court, Abuja against the NBC and without the knowledge and participation of Bayelsa State, and proceeding to obtain a judgment to the effect that the Oluasiri Oilfields/Oil wells belong to Rivers State on the same unchanged facts and issues as was the case before the Supreme Court in Suit No. SC/106/2009.

    “This, to say the least, is highly unusual, curious, and clearly untenable and cannot be allowed to stand despite the media frenzy orchestrated and sponsored by the government of Rivers State.

    “Bayelsa State is confident of its historical claim of ownership over the lands on which the Oilfields/Oil wells in issue are situated and had always expressed its willingness to fully participate in any joint delimitation and demarcation exercise in respect of the disputed boundary.”
