NAIRA NOTES: President Buhari cannot overrule the Supreme Court

    1. BY MIKE  OZEKHOME, SAN

Buhari in his broadcast on Thursday, February 16, 2023, unilaterally varied the apex court’s extant order of maintenance of status quo, by directing the CBN Governor to the effect that “the old N200 banknotes be released back into circulatioN, to circulate as legal tender with the new N200, N500 and N1000 bank notes for 60 days.”

The President then issued a dicta, more in the form of a military Decree, that, “in line with section 20 (3) of the CBN Act, 2007, all existing old N1000 and N500 notes remain redeemable at the CBN and designated prints”.

This order is a clear violation of and disobedience to the existing order of the apex court which had already maintained the status quo ante bellum of all parties involved in the Naira re-design dispute.

Buhari’s broadcast to the Nation therefore literally overruled the Supreme Court of the land, in a way and manner only a military tyrant could ever contemplate

The Supreme Court had on Wednesday, 15th February, 2023, after the first interim order, adjourned the suit originally filed by the Attorneys-General of Kano, Kogi and Zamfara States (other interested parties were later joined) to the 22nd of February, to enable it to hear the entire matter holistically.

Without saying so in many words, every person very well knew that this adjournment was a further elongation of its earlier interim order granted against the CBN and the Federal Government, represented by the Attorney-General of the Federation; restraining it from carrying out its directives that the old naira notes would cease to be legal tender by 10th of February, 2023. The order was to have lasted till 15th February, 2023.

Buhari’s imperious order was a frontal call to chaos, anarchy and national upheaval. It was a direct assault on the authority of the Supreme Court

During the proceedings of that day, the matter was again adjourned to 22nd February, for full hearing. Every Nigerian had expected that the Federal Government would respect this apex court’s position. But President Buhari demurred. He made himself Supreme Leader; an Emperor; Potentate, Mikado and Overlord.

Buhari’s broadcast to the Nation therefore literally overruled the Supreme Court of the land, in a way and manner only a military tyrant could ever contemplate. Buhari’s action is a reminder of the apocryphal saying of autocratic and despotic Emperor Louis XIV, who, on 13th April, 1655, stood in front of Parliament and imperiously declared, “L’Etat C’est Moi (I am the State)”.

To have whimsically and capriciously varied the order of the Supreme Court was to pick and choose what order to obey or disobey

This was to underline the fact that he and he alone, had absolute power over his Nation. His father had abdicated the throne due to mass protests. Louis XIV himself met the same fate. His reign over France and Navarre was short lived. It only lasted for 20 minutes, after which he too abdicated the throne.

Buhari’s imperious order was a frontal call to chaos, anarchy and national upheaval. It was a direct assault on the authority of the Supreme Court, the highest court of the land; and also the head of the entire Judiciary, the 3rd arm of government under the doctrine of separation of powers, most ably popularized in 1748 by Baron de Montesque, a great French Philosopher.

To have whimsically and capriciously varied the order of the Supreme Court was to pick and choose what order to obey or disobey. This breaches the supremacy of the 1999 Constitution provided for in section 1(1) thereof. It also frontally assaults the provisions of section 287(1) of the Constitution which provides that “the decisions of the Supreme Court shall be enforced in any part of the Federation by all authorities and persons, and by courts with subordinate jurisdiction to that of the Supreme Court”.

Surely, no one is above the law; not even President Muhammadu Buhari himself

Once given, an order of the court is binding on all. The Apex Court in ROSSEK V. ACB LTD (1993) 8 NWLR (Pt. 312) 382 at 434 re-stated the law to the effect that: “A judgment remains binding until it is set aside by a competent Court… To hold otherwise is to clothe a party against whom a judgment has been obtained with the discretion to decide, in his wisdom that the judgment is invalid and not binding on him. This to my mind, is an invitation to anarchy. I do not understand the law to be so.” – per Ogundare, JSC.

Also, in STATE v. SOLOMON (2020) LPELR-55598(SC), the Supreme Court held thus: “It is the law that a decision of a Court of competent jurisdiction, no matter that it is seems palpably null and void, unattractive or insupportable, remains good law and uncompromisingly binding until set aside by a superior Court of competent jurisdiction.”

Buhari’s broadcast rather than be re-assuring and balming the frayed nerves of a traumatized citizenry and a beleaguered nation, was the exact opposite; a complete anti-climax

The Supreme Court, in the case of ABACHA V. FAWEHINMI (2000) 6 NWLR (Pt. 660) 228 at page 317 E-F, held as follows:- “A Court order must be obeyed and even if it is a nullity, it has to be set aside on appeal against it”. Per NWALI SYLVESTER NGWUTA, JSC (Pp 25 – 25 Paras D – E). See also the locus classicus of GOVERNOR OF LAGOS STATE VS. OJUKWU (1986) 1 NWLR PT. 18, PG. 621.

NAIRA NOTES: President Buhari cannot overrule the Supreme Court

This is one instance where the apex court should bare its teeth and bite. This is more so because President Buhari had himself acknowledged in his speech, the pendency of the matter before the Supreme Court. Surely, no one is above the law; not even President Muhammadu Buhari himself.

Buhari’s broadcast rather than be re-assuring and balming the frayed nerves of a traumatized citizenry and a beleaguered nation, was the exact opposite; a complete anti-climax. It was a clarion call for total disenchantment, disillusionment, despair and desolation.

This is the first time in my life I watch Nigerians buy money with money – buying Naira with Naira – at exorbitant exchange rates

The speech was not only highly unpresidential; but was vividly insensate and insensitive to the suffering of Nigerian citizens, who, due to no fault of theirs, can neither now use the old currency, nor access the new one.

Banks claim not to have the new currency in their vaults. What manner of government would consciously and deliberately throw its country into a spin, and its citizens under the bus, in a policy that could have been handled with better planning and more decency, efficiency and human face?

This is the first time in my life I watch Nigerians buy money with money – buying Naira with Naira – at exorbitant exchange rates.

When Queen Elizabeth II died in September, 2022, the British government set about changing its governance template to reflect the realities of the moment. It decided to change the portrait of Queen Elizabeth II on the British Pound Sterling to that of King Charles III, her son who had succeeded her.

The effective take-off date of the new Pound Sterling was fixed for middle of 2024; nearly two years from the announcement of the change. There were no violent protests or any upheavals because the citizens immediately bought into the historic and laudable project, as it afforded them enough time to put their house in order.

Are we a cursed Nation, that an otherwise beautiful policy whose fiscal, monetary, economic, and development advantages are unquantifiable should be so mishandled and so grossly messed up as to lead to widespread national protests; burning of banks; destruction; mayhem and killings

How many Nigerians know that Queen’s Counsel (QC)(the equivalent of Senior Advocate of Nigeria (SAN) has since been changed to King’s Counsel (KC); and that Queen’s English is now King’s English?

We have seen the ugly scenes of frustrated Nigerians fighting at ATMs; or going completely nude; students and soldiers fighting each other; some POS holders being burnt alive; while Police shot and killed unarmed Nigerians.

Are we a cursed Nation, that an otherwise beautiful policy whose fiscal, monetary, economic, and development advantages are unquantifiable should be so mishandled and so grossly messed up as to lead to widespread national protests; burning of banks; destruction; mayhem and killings. Just what is wrong with us as a Nation? I do not know; or do you?

The Russian Ruble which had been used since the 14th Century is the second-oldest currency in the world, next only to the British Sterling. Following the dissolution and fall of the Soviet Union in 1991, the Soviet Ruble remained the currency of the Russian Federation until 1992, when in 1993; a new set of coins was issued with a new set of banknotes in the name of the Bank of Russia. There were no killings and mayhem.

Some Nigerians, for political exigencies or correctness, are shamelessly celebrating a bare-faced assault on the common man and woman and the authority of the Supreme Court

Chinese currency comes by two names – the Chinese Yuan (CNY) and the People’s Renminbi (RMB). The distinction is subtle: because while the Renminbi is the official currency of China, the Yuan is the principal unit of account for that currency.

Today, the Renminbi is one of the top-five most-used currencies in the world, in addition to the U.S. Dollar, Euro, Yen, and the British Pound. Yet, the Naira which is not even recognised as a legal tender in any part of the world is being used by the government to oppress and torment its citizens.

The Euro is the new ‘single currency’ of the European Monetary Union. Adopted on January 1, 1999, by 11 Member States. Greece became the 12th Member state to adopt the Euro on January 1, 2001. On January 1, 2002, these 12 countries officially introduced the Euro banknotes and coins as legal tender. Slovenia became the 13th member state to adopt the Euro on January 1, 2007.

Venezuela debuted with a new currency in 2018, a currency that featured six fewer zeros. This was a response to years of spirally inflation.

Though having a cashless economy appears quite inviting, appealing, titillating and tantalizing, it must be appreciated that advanced countries such as the UK, US and the EU that have full complement of infrastructure, still use coins

In December, 2019, eight West African countries agreed to change the name of their common currencies to ECO. This effectively severed these countries from the CFA Franc; and therefore, their former colonial masters. The countries are Benin, Burkina – Faso, Guinea Bissau, Ivory Coast, Mali, Niger, Senegal, and Togo.

On January 1, 2023, Croatia joined the Euro Zone, replacing its Kuna with the Euro. When these independent countries changed from their original currency to the new Euro, there was no ruckus; no brouhaha; no wahala, donnybrook or rhubarb.

Yet, some Nigerians, for political exigencies or correctness, are shamelessly celebrating a bare-faced assault on the common man and woman and the authority of the Supreme Court.

This was the same way despotic Hitler of Germany was celebrated, applauded and deified during the third Reich, until it became irredeemably too late to retreat. Read the immortal words of Martin Niemoller (1892 – 1984), a German theologian and Lutheran Pastor who bemoaned Hitler’s atrocities and their debilitating effect on millions of Jews.

Though having a cashless economy appears quite inviting, appealing, titillating and tantalizing, it must be appreciated that advanced countries such as the UK, US and the EU that have full complement of infrastructure, still use coins.

A cent in the US, or penny in the UK are still valued and in wide circulation. When last did you see one Kobo, five Kobo or ten Kobo coins in Nigeria? I have not seen any for years. Or have you?

NAIRA SWAP CRISIS: President Buhari to address Nigerians

President Muhammadu Buhari will make a national broadcast on Thursday, February 16, 2023 at 7am.

This was disclosed by a statement issued by the Special Adviser to the President (Media & Publicity), Femi Adesina, late Wednesday night.

He said Television, radio stations and other electronic media outlets are enjoined to hook up to the network services of the Nigerian Television Authority (NTA) and Radio Nigeria for the broadcast.

NAIRA SWAP CRISIS: President Buhari to address Nigerians

TheNewsGuru.com (TNG) gathered that President Buhari’s address to the nation might not be unconnected to the chaos occasioned by the Naira swap policy of the Central Bank of Nigeria (CBN).

TheNewsGuru.com (TNG) recalls that CBN had accepted culpability for the chaos arising from the redesign of the N200, N500 and N1000 banknotes and the resultant suffering Nigerians are faced with.

Mr Folashodun Shonubi, CBN’s Deputy Governor in charge of Operations said the apex bank did not anticipate the resultant effects of the Naira redesign and cash withdrawal limits policies.

Speaking at the 22nd fellowship conferment lecture and ceremony organised by the Nigerian Society of Engineers (NSE) in Abuja, Mr Shonubi acknowledged that there was an oversight.

The lecture held on Thursday, February 9, 2023, was titled, ‘The intricacies of the naira redesign and its benefit to Nigerians’.

“As you know, Nigerians are very ingenious. And we created a whole new line of business for people that we never envisaged.

“An aspect of that is queuing, where you sell your position on the queue for money. Night crawling, where you wait till night, collect numerous cards from your friends and family and go to an ATM and empty them using different cards and then take the cash to sell.

“So it’s been a bit stressful to be honest because we did not anticipate this kind of behaviour,” he said.

However, Shonubi argued that numerous benefits have been achieved, including the retrieval of N2 trillion to the banking system since implementation commenced.

He vowed that the CBN will do everything within its authority to ensure that it salvages the current situation and make the challenges become a thing of the past as soon as possible.

Council of State gives CBN two options to address Naira scarcity
Meanwhile, the Council of State had presented two options to the CBN with which to address the current shortage of Naira notes in the country.

TheNewsGuru.com (TNG) reports the National Council of State asked the CBN to print more new notes or recirculate the old Naira notes to ease the current hardship being faced by Nigerians.

However, the Council of State expressed support for the Naira redesign policy of the apex bank but stressed that the hardship on Nigerians was too much.

Attorney General of the Federation and Minister of Justice, Abubakar Malami briefed State House reporters on the key issues after the Council of State meeting at the Presidential Villa, Abuja on Friday.

According to Malami, the Council of State advised the CBN to urgently ensure the availability of Naira notes to douse tension and ameliorate the suffering of citizens across the country.

“The two major resolutions that were driven by the deliberations of the Council are: one, that we are on course as far as the election is concerned and we are happy with the level of preparation by INEC and the institutions.

“And then two, relating to the Naira redesign policy, the policy stands but the Council agreed that there is need for aggressive action on the part of the Central Bank of Nigeria (CBN) as it relates to implementation of the policy by way of ensuring adequate provision being made with particular regards to the supply of the Naira in the system,” Malami said.

While corroborating the comments made by the Attorney General, Gov. Darius Ishaku of Taraba State said the INEC and the Inspector General of Police both gave details of their level of preparedness for the 2023 election.

He said the governor of the CBN gave details of the Naira redesign policy as well as the merits and demerits of the policy.

“The Governor of the Central Bank briefed us on the monetary change and issues that have arisen relating to that across the whole States of the Federation.

”He gave us the merits of that policy that is being implemented.

”What took more time was the monetary issue because of the scarcity of money in circulation but generally the view is that principally the policy was accepted.

“But the major issue is that of implementation. So many views were proffered particularly that the CBN governor should look into making sure that the new money is available in quantum.

”And there were suggestions too that if the new money is not enough or printing them could be difficult, the old currency could be recirculated or pumped into circulation to ease the tension, particularly for the poor people in the society who will need a little money to buy their food or drugs on a daily basis,” he said.

Ishaku said all deliberations at the Council were advisory, but the president would take the final decision.

Gov. Babajide Sanwo-Olu, who also briefed newsmen, assured that the president would take the right decision at the end of the day for the benefit of all Nigerians.

“All we said or discussed were advisory and the president will retire back to his office and I think with all of this advice, the executive knows what to do as we move on.

”I’m sure the president will make his thoughts and views known to the nation,” he added.

TNG reports present at the Council of State meeting are former presidents Goodluck Jonathan, Yakubu Gowon and Abdulsalami Abubakar, Olusegun Obasanjo, who joined the meeting virtually.

Chairman of the Independent National Electoral Commission (INEC), Prof Mahmood Yakubu, the CBN Governor, Godwin Emefiele, and the Inspector General of Police, Usman Baba were also present to brief the council.

The Council of State is an organ of the Federal Government of Nigeria that advises the executive on key policy making.

This would be the first Council of State meeting held in 2023, coming 14 days to the presidential elections and amid the twin crisis facing the economy: fuel scarcity and a cash crunch occasioned by the CBN’s Naira redesign policy.

Buhari assents to Defence Research bill and three others

President Muhammadu Buhari has signed into law the Defence Research and Development Bureau Bill, 2022 passed by the National Assembly.

The bill will initiate new scientific, technological and environmental research on defence matters. It also seeks to facilitate collaboration with other national and international institutions in the promotion and transfer of science and technology relating to defence.

Other bills signed by the President are National Commission for Refugees, Migrants and Internally Displaced Persons Act, 2022, the Nigerian Tourism Development Authority Act, 2022 and National Assembly Library Trust Fund (Establishment) Act, 2022.

This was contained in a statement by the Senior Special Assistant to the President on National Assembly Matters (Senate) Babajide Omoworare, on Wednesday, Feb. 15, in Abuja.

TheNewsGuru.com (TNG) reports that last year, the Senate passed a bill seeking to establish a Defence Research and Development Bureau in the Armed Forces of Nigeria.

The Defence Research and Development Bureau (Establishment) Bill seeks to initiate new scientific, technological and environmental research on defence matters.

It also seeks to facilitate collaboration with other national and international institutions in the promotion and transfer of science and technology relating to defence.

Majority Leader of the Senate, Yahaya Abdullahi, moved the motion for re-committal of the bill to the Committee of the Whole for consideration and passage.

Abdullahi, in his presentation, recalled that the bill and two others were passed by the National Assembly and transmitted to the President for assent.

He said, “Some fundamental issues which require fresh legislative action by both chambers of the National Assembly emerged after critical analysis of the bill by Mr President and C-in-C.”

The lawmaker added that against the backdrop of the issues identified, a technical committee of the Senate and House of Representatives as well as the Directorate of Legal Services of the National Assembly met and reworked the bill.

Accordingly, the Senate, relying on order 1(b) and order 52(6) of the Senate Standing Order, 2022 as amended, rescinded its decision on the bill as passed and re-committed the same to the Committee of the Whole for reconsideration and passage.

Buhari canvasses suspension of blanket Visa ban by UAE

President Muhammadu Buhari has called for a lifting of the blanket visa ban clamped down on Nigerians by the Government of the United Arab Emirates (UAE).

Malam Garba Shehu, the President’s spokesman, in a statement on Tuesday, said the president canvassed this position on Monday during a telephone conversation with the President of the United Arab Emirates, Sheikh Mohamed bin Zayed Al Nahyan.

Sheikh Al Nahyan doubles as the Emir of Abu Dhabi.

Buhari had called Sheikh Al Nahyan to condole with him on the death of his mother-in-law, Sheikha Maryam Al Falasi, during which important issues of mutual concern between the two countries came up.

The president requested his UAE counterpart to review the blanket visa ban imposed on Nigerians intending to travel to the UAE.

The Nigerian leader recalled that mutually beneficial excellent relations had subsisted between the two nations over many years, symbolized by robust economic interactions and regular consultations on matters of common interest, including engagements at the highest political levels.

He noted that recent irritants in bilateral relations generated by consular issues relating to the behaviour of some Nigerians in the UAE are being ironed out.

The president further explained that no country including Nigeria would condone criminalities and illegal behaviours.

Buhari, therefore, expressed the readiness of the Government of Nigeria to apply necessary sanctions through appropriate judicial process against anyone identified to have committed criminal acts in the UAE.

He urged that the issue be allowed to be handled by the relevant security/intelligence agencies of the two countries and to come up with lasting solutions to the problems associated with criminalities and illegalities.

The president also requested a resumption of the suspended operations of Emirates Airline in the country.

The Emirates Airline had suspended its operations in Nigeria in 2022 in the wake of its inability to repatriate funds trapped in Nigeria.

President Buhari assured the UAE leader that the issue of the Emirates funds was receiving appropriate attention alongside those of other foreign airlines operating in Nigeria.

He added that the Central Bank of Nigeria had been directed to increase foreign exchange allocation to the airline.

He said: “I believe in Buhari, I still do and I will never stop, but I no longer believe in the circle around him and the quality of decisions and actions coming out of that leadership,” El-Rufai said.

Recalled that El-Rufai on Channels TV last week alleged that some persons in the presidency who backed another aspirant during the APC primary election were using Buhari to actualize their plans.

Buhari, Tinubu to Sultan: We want to win the coming elections

President Muhammadu Buhari and the Presidential candidate of the All Progressives Congress (APC) Asiwaju Bola Tinubu, on Thursday in Sokoto, called for support and blessings of the Sultan of Sokoto, Sa’ad Abubakar III.

Malam Garba Shehu, the President’s spokesman, in a statement quoted Buhari and Tinubu as as saying: “We have come here to ask for your support and blessings; we want to win the coming elections.”

Tinubu, the first to speak and the first to bait the Sultan, said plainly to leader of the Sokoto Caliphate:

“I have come to be presented to you as Candidate. The President and Commander-in-Chief, Muhammadu Buhari is here in person to do that.

”I want to win the election. Is there a way you will decline the request of the President?”

While echoing the same line, President Buhari said: ”My wish is for your support and blessings; we want to win.”

He went on to narrate the qualities of the candidates, including their common belief and commitment to the unity and progress of every section of the country.

Buhari said he had associated with Asiwaju for more than 20 years and did not have any reservations in supporting him as the candidate of the APC.

The president said Tinubu’s greatest strength was in his effective governance of Lagos, the country’s former Capital, a business hub and home to diverse individuals from all over Nigeria for two terms.

He added that Tinubu has deep commitment to democracy and had played great role at the center as Senator.

According to him, his message to Nigerians is that they should trust Tinubu with power to succeed him because the APC candidate, supported by Kashim Shettima, the running mate will build on the successes of his administration.

In his response, the Sultan declared that being an apolitical father of all and custodian of culture, he would continue to receive everyone that sought the blessing of the throne.

He told President Buhari that many had come before him for the same purpose while many more would still come.

“We will continue to pray for our nation. We cannot be tired of praying and will continue to advocate for peaceful and free elections in our fatherland,” the Sultan further said.

He assured the president that the Caliphate was behind him as he sought to ensure free and fair elections.

The Sultan noted that the president’s commitment to be present at the next signing of the Peace Accord by political parties, underscored his desire to bequeath to the nation a credible electoral process.

Speaking before an unprecedented crowd at the Giginya Memorial Stadium, Sokoto, venue of the party’s Presidential and Gubernatorial Campaign rally, Buhari stressed the need for all members to work towards the success of the party in the forthcoming elections at all levels.

He affirmed that the party’s Presidential candidate who had been nominated by the party in a free, fair and democratic primary, deserved the support of all members and supporters of the party.

He remarked that Tinubu and his Vice, Sen. Kashim Shettima, were men who understand the problems of Nigeria, having been in politics as two-time Governors in their respective states.

He assured that they would proffer solutions to the challenges facing Nigeria.

Also present at the rally were the President of the Senate, Ahmed Lawan, Speaker, House of Representatives, Femi Gbajabiamila, former Governor, Aliyu Wamakko, the party leader in the state who got a great deal of attention at the rally, as well as other party stalwarts.
