  • PDP suspends eight members for constituting rival caretaker committee

    The Working Committee of the Peoples Democratic Party (PDP) in Plateau has suspended eight members of the party.

    The ‘group of rascals’, as stated by Mr. John Akans, the committee’s head of media, were suspended for constituting a rival State’s Caretaker Committee.

    Akans, in a statement on Saturday, said the decision to suspend the erring members was taken at an emergency meeting on Friday evening.

    “The working committee, an arm of the Plateau Caretaker Committee at its emergency meeting held Friday evening at the party’s secretariat, reviewed the unfortunate incident that took place at the secretariat.

    “Some group of rascals mischievously constituted themselves into a caretaker committee, which is an affront to the national leadership of our party, under the leadership of Prince Uche Secondus.

    “The state leadership of the party frown at these decedents and therefore approved their immediate suspension from the party.

    “Seven of the affected persons are Nandom Penap Exodus, Godwin W. Bedir, Akims Mamot, Mrs Asabe Dareng, Nathaniel Dakas, Jecob Dashe and Alhaji Kabiru Musa,” he said.

    According to Akans, the group’s attempt was not only laughable and mischievous but infantile and an act of lawlessness to the extreme which the party could not condone.

    The head of media announced that a seven-man disciplinary committee was immediately constituted to look into the activities of the suspended members.

    He gave the names of the disciplinary committee members as Mr Monday Agwom as Chairman with Mr Pam Davou Major to serve as Secretary.

    Others members of the committee were Jarusa Gotau, Mr Amos Komtul, Mr Dauda Daiyabu, Hajia Sa,adatu Ado and Wycliffe Wansonh.

    The party called on members across the state to forget the unfortunate incident and continue to work together for the progress and victory of the party.

    AGF writes Makinde, other Govs, demands immediate disbandment of caretaker committees

    Attorney General of the Federation and Minister of Justice Abubakar Malami (SAN) has requested Oyo State Governor Seyi Makinde to abide by the decision of the Supreme Court on the dissolution of local government administration in the state in the overall interest of the rule of law and the nation’s democracy.

    Malami, in a letter with reference number HAGF/OYO/2020/Vol.I/I addressed to the Oyo State Attorney General and Commissioner of Justice, Prof Oyewo Oyewo, said he acted in line with his constitutional role as the chief law officer of the federation under Section 150 (1) of the 1999 constitution( as amended).

    He stated that the need to immediately disband all caretaker committees and restore democratically elected representatives to the local governments had therefore become obligatory.

    Malami in the letter dated January 14, 2020 and entitled: “Unconstitutionality of dissolution of elected government councils and appointment of caretaker committees: The urgent need for compliance with extant judicial decisions,” noted with dismay the continued non-adherence by some state governors and state Houses of Assembly to the provisions of Section 7 (1) of the 1999 constitution as amended as it relates to the existence, administration and control of local government councils in Nigeria.

    He said this unpleasant development, without doubt, was hindering the much-needed grassroots development expected to be put in place by the third tier of government in the country.

    The AGF, in the letter copied the Inspector General of Police, the Director General, Department of State Service (DSS); Acting Chairman , EFCC and the Director, NFIU , asked for immediate disbandment of caretaker arrangement in any state of the federation, in full compliance with Court of Appeal judgments in six states , and the Supreme Court judgment in a case involving Ekiti state governor and others versus Prince Sanmi Olubunmo and 13 others .

    The AGF said in view of the decision of the Supreme Court on the matter that is binding on all 36 States of the Federation “the common practice by some State Governors in dissolving elected local government councils is unconstitutional, null and void. So also any system of local government run by Caretaker Committees are outrightly illegal and unconstitutional.”

    The letter reads further: “To this end, I hereby request all their Excellencies, State Governors and Speakers of State House of Assembly, who are currently acting in breach of the provisions of Section 7(1) of the 1999 Constitution (as amended) and also acting in disobedience of the Supreme Court judgement highlighted above to immediately retrace their step by ensuring compliance with the above in the overall interest of the rule of law and our democracy. The need to immediately disband all caretaker committee and restore democratically elected representatives to man the local governments has therefore become obligatory”.

    Malami also requested the Justice Commissioners to take positive steps to ensure compliance adding: “Mr President and other relevant agencies will be advised further on compliance measures that should be taken in national interest.”

    The Attorney General of the Federation said: “To this end, I hereby request all their excellencies, state governors, and speakers of houses of assembly, who are currently acting in breach of the provisions of Section 7 (1) of the 1999 constitution ( as amended) and also acting in disobedience of the Supreme Court judgment highlighted above , to immediately retrace their steps by ensuring compliance with the above in the overall interest of the rule of law and our democracy . The need to immediately disband all caretaker committees and restore democratically elected representatives to the local governments has therefore become obligatory.”

    Reacting to the development, the Chairman of ALGON, Prince Ayodeji Abass – Aleshinloye, described the decision as a welcome development, saying it had confirmed what they had always stood for that it was wrong for constitutionally elected local government chairmen to be so treated.

  • Ondo Assembly dissolves LG caretaker committees for the second time

    The Ondo State House of Assembly has dissolved the 18 Local Government Caretaker Committee Chairmen in the state.
     
    The dissolution came into effect on Thursday at the plenary of members of the Assembly in Akure.
     
    The News Agency of Nigeria reports that the lawmakers had, on April 18, granted another six-month tenure extension to the 18 caretaker committees.
     
     
    The Deputy Majority Leader of the House, Mr. Oluwasegun Ajimotokin, representing Irele State Constituency, moved the motion for the dissolution of the caretaker committees.
     
    Ajimotokin noted that the tenure of the caretaker chairmen had earlier been elongated for six months, which lapsed on October 17.
     
    He said that since the issue had been extensively debated and resolved at the parliamentary meeting of the members, the House decided that the 18 local government caretaker committees be dissolved.
     
    “The House at its parliamentary meeting has adequately debated the tenure of local government chairmen and resolved that they be dissolved.
     
    “I hereby move a motion for the dissolution of the committees across the 18 local government areas of Ondo State with immediate effect,” he said.
     
    His motion was seconded by the Parliamentary Secretary, Mr Jamiu Maito, representing Akoko South-West Constituency 1.
     
    The Speaker of the House, Mr. Bamidele Oleyelogun, subjected the position of the House into a voice vote and it was unanimously agreed that the 18 caretaker committees should be dissolved.
     
    Following the dissolution, Oleyelogun directed the caretaker committees to hand over the management of the local governments to the Directors of Local Government Administration with immediate effect.

    JUST IN: PDP dissolves Ahmed Makarfi-led caretaker committee

    The Peoples Democratic Party (PDP) has dissolved the Ahmed Makarfi-led national caretaker committee.

    This will now pave way for the election of substantive executive for the opposition party.

    The committee was put in place in 2016 following the leadership crisis that befell the party.

    The convention is still ongoing at the time of filing this report.

    A sizeable number of the candidates have however stepped down. This include; Chief Bode George, Jimi Agbaje, Gbenga Daniel and Rashid Ladoja. Others still in the race are; Prof. Tunde Adeniran, Chief Raymond Dokpesi, Uche Secondus, Prof. Taoheed Adedoja and Olusegun Aderemi.

  • Gov Lalong dissolves LG caretaker committees

    Governor Simon Lalong of Plateau on Thursday dissolved caretaker committees of the 17 local governments of the state.

    Lalong announced the dissolution in a statement by his Director of Press and Public Affairs, Mr Emmanuel Nanle, noting that it was with immediate effect.

    The governor directed the caretaker committee chairmen to handover to directors of personnel management in their respective councils.

    He said, “the chairmen and management committee members are to immediately hand over the affairs of local governments to directors of personnel management pending further actions in line with the provision of law.”

    The governor constituted the management committees in line with his powers under the edict providing for the establishment and administration of Local Government Councils 2005 (as Amended), subject to ratification of the House of Assembly.

    The tenure of the management committees expired on June 28, 2017.

    The governor appreciated members of the dissolved council management committees for their selfless service in the two years of their stewardship.

    He wished them well in their endeavours and hoped they would be available in future for service when called upon.

    Court nullifies appointment of Al-Makura’s LG caretaker committees, orders fresh election

    The High Court sitting in Keffi, Nasarawa State has nullified the appointment of Interim Management Committees (IMCs) in 11 local government councils of the State.

    The court also ordered the state government to conduct elections of chairmen and councilors within 140 days from the when the judgement was pronounced.

    In his ruling, the presiding judge, Justice S. A. Ayiwulu, nullified the 2016 amendment of the Nasarawa State Local Government Law 2009, as amended in 2011 by the state House of Assembly, which paved way for the state government to alter the substantive suit by reappointing the IMCs to run the affairs of LGAs in the state.

    The judge was quoted as saying: “The law was made during the pendency of the substantive suit and is contrary to the interim order of this court.”

    Recall that former gubernatorial candidate of the Independent Democrats (ID), Barr. Haruna Iliyasu, had in April 2015, filed a suit against the state government, the state House of Assembly and the 11 IMC chairmen, challenging the “hurried amendment” of the LGA law and the legality of their composition.

    Continuing, Justice Ayiwulu said, “It is hereby ordered that the Nasarawa State Local Government Amended Law 2016 made by the state assembly is accordingly struck down for being contrary to the provision of Section (7) of the Constitution of the Federal Republic of Nigeria 1999 as amended, and for being made contrary to the interim order of this court.

    “All members of the interim management committee appointed by the state government and the house of assembly during the pendency of the substantive suit No NSD/K23/2016 are hereby perpetually restrained from parading themselves as such or in whatever name or guise.

    “An order is hereby made mandating the state government to conduct election into the local governments in Nasarawa State within 140 days from the date of this judgment,” he said.
