    Defection: You can’t join Matawalle in the suit, APC tells PDP

    The All Progressives Congress (APC), on Tuesday, told the Peoples Democratic Party (PDP) that Gov. Bello Matawalle of Zamfara cannot be joined in the suit filed before a Federal High Court, Abuja, seeking his removal from office.

    The APC, through his counsel, Peter Nwatu, told Justice Inyang Ekwo that joining Matawalle would have amounted to setting the law against itself.

    Nwatu, who argued that the party sought to be joined was unknown to law, urged the court to refuse the application.

    “The applicant PDP) has sought to join a person that is unknown to law in the person of Governor Matawalle.

    “I urge you to refuse this application in the sense that the 1st person sought to be joined ought not to be joined,” he said.

    Corroborating Nwatu’s statement, counsel to the governor, Chief Mike Ozekhome, SAN, said based on Section 308 of the 1999 Constitution, Matawalle is immune to being sued.

    He said the section named those persons, who are shielded against such suits as governor, deputy governor, president and the vice president.

    “In this case, the person they want to join is Governor Bello Mohammed Matawalle,” he said.

    They are not suing him in his nominal capacity Ozekhome, who argued that Sections 180 and 188 had already provided how a governor could be removed from office, said this could either be as a result of death, resignation, impeachment or at the expiration of the period of his office.

    “No criminal or civil proceeding can be instituted against any person holding the positions of governors, deputy governor, president and vice president

    “So whether they call him (Matawalle) governor or not, apart from being a non-juristic person, he cannot be sued as a person,” he said.

    Counsel to PDP, James Onoja, SAN, disagreed with the defence counsel.

    He said most of the issues they raised had already been countered in their processes.

    The senior lawyer argued that the suit was not a pre-election matter but a post-election case.

    He insisted that in post-election matter, a governor can be sued.

    “My lord, we also know that it is not only Matawalle we want to join.

    “And when a statue of the governor is being challenged , the immunity of the governor is also called to question.

    “This is a post-election issue that we are questioning whether he has the right to continue as governor after his defection,” he said.

    Onoja argued that if immunity covers governors after their election, then there would be no need for the setting g up of an election petition tribunal.

    On his part, counsel to the Independent Nations Electoral Commission (INEC), Anthony Onyeri, said the commission did not file any counter affidavit regarding the suit.

    Justice Ekwo adjourned the matter until Feb. 24 for ruling on whether Governor Matawalle is to be joined in the suit or not.

    The News Agency of Nigeria (NAN) reports that the opposition party had, previously, sued INEC, APC, President of the Senate, Speaker of the House of Representatives, Governor of Zamfara and Chief Justice of Zamfara as the 1st to 7th defendants. respectively.

    The party had in a motion for joinder marked: FHC/ABJ /CS /650/2021 on Oct. 30, 2021, asked court to join Matawalle, the three Zamfara senators and 27 other lawmakers who defected from the party to the APC in the lawsuit.

    The PDP is specifically asking the court to sack Matawalle, the three senators, six members of the House of Representatives and all state House of Assembly lawmakers who dumped the party for the APC.

    NAN reports that Matawalle, alongside the three senators, six members of the House of Representatives and the 24 members of the Zamfara House of Assembly had, on June 29, defected from the ruling party.

    While the governor defected from APC, the deputy governor, Mahdi Gusau, did not.

    Against this development, the PDP had sought the court order, joining Matawalle as the 8th defendant since only his office had been sued in the earlier request.

    The party, which urged the court to join its deputy, Gusau, as the second plaintiff, also called on the court to join the senators, members of the House and the 24 state lawmakers as the 7th to 38th defendants.

    The PDP, in an originating summons dated and filed on July 8, requested the court’s interpretation of Articles 1 (2), 188, 287, 221, 177 (c), 106 (d) and 65 ( 2) (b), among other provisions of the 1999 Constitution as amended for the determination of four main issues as set out in the petition.

    It asked the court to determine whether Matawalle and all lawmakers are eligible to continue to hold the various political offices in which they were elected on the plaintiff’s platform.

    “This part of the plaintiff’s complaint in the originating summons also concerns the attempts of the 5th to 7th defendants to initiate and initiate impeachment proceedings against the 2nd party (Gusau) sought to be joined, which is member of the requesting political group. party and was elected to the post of deputy governor of Zamfara State on the platform of the complainant.

    “That the parties requested to be joined have been named in the originating summons and that their actions and inactions form part of the material facts which gave rise to the cause of action and to the object of the originating summons proceedings and are therefore persons whose interests may be affected by the
    outcome of this case ”, among others.

    The party stated that the request was made in the interests of justice to join said persons as co-plaintiff and defendant in order to enable the court to examine and resolve in an efficient and effective manner all the issues in dispute. in the matter once and for all and to avoid a multiplicity of actions on the same subject.

    It said the ruling was intended to ensure that “the ends of justice are not overcome by mere technical objections to the joinder of the parties.”

    Mr. Matawalle became governor of the state, following a Supreme Court ruling on March 24, 2019, which overturned the CPA primaries in the state.

    The reported defection of the Anambra state’s deputy governorship candidate of the Accord Party, Chief Kenneth Ifeatu Obi has been denied as mere political rumour made up by idle minds of the opponents.

    Addressing a world press conference at the party’s Governorship flagbearer -Dr Godwin Maduka’s Campaign Headquarters in Awka late night Friday, the state chairman of Accord, Chief Bartho Igwedibia who flanked Maduka alongside the Director General -Barrister Bright Nnebedum denied the story of Chief Obi’s departure.

    Chief Igwedibia pointed out that as the party’s Anambra helmsman with all the records of its members especially a person of Obi’s status, no letter or information conveying any such intention was received from him or any other person.

    According to the party chairman, “Accord Party is going to produce the next governor of Anambra state, come November 6,2021. No amount of distraction from any quarter would stop it.

    “Chief Obi is merely on assignment and I spoke with him less than an hour ago. It’s part of our strategic political diplomacy. That was why in the face of all the speculations he didn’t tender any resignation letter. He’s on an official errand and we are okay with that…”, the chairman stated.

    Dr Maduka in his assessment of the campaign tour of the 326 electoral wards of the state’s 21 Councils, which he started and concluded with his running mate admitted the experience was rewarding and enriching as it availed them opportunity to appreciate the extensive decay and neglect by the successive state government.

    The candidate vowed to use his 10-point agenda aimed at transforming the state to international standard and class.

    Dr Maduka who prides himself as the global number One pain doctor noted that “some say they will build Dubai in Africa; but I have already built Dubai out of my Umuchukwu community. I have built a first Of it’s kind Medical research center where experts from overseas will come to treat patients, particularly tropical ailments, etc.

    He disclosed that having toured all the 326 wards in Anambra state, where the citizens welcomed and embraced us with joy and hope swearing to work relentlessly till victory was achieved come November 6,2021 at the polls.

    All the workers, traders, artisans and villagers, especially the poor, neglected and dejected have adopted us and our message of hope as we have now commenced door to door, one-on-one visitation campaign. We therefore commend them for believing in us because they said that having seen all that I did in Umuchukwu, where I singlehandedly built schools, hospitals, High Court, Magistrate court as well as the judges’ quarters and other such facilities. They noted that they want me to win as governor so as to replicate all the life changing facilities in the state.

    Edo State Governor, Godwin Obaseki, has again said that he has no intention of returning to the All Progressives Congress (APC), where he was pushed out.

    Governor Obaseki gave the reassurance on Wednesday while addressing State House correspondents after a meeting with President Muhammadu Buhari at the Presidential Villa, Abuja.

    The governor stated that as a politician of repute, his conscience would not allow him betray those who gave him shelter when there was a political storm.

    He explained that he did not leave the APC on his own terms, but was forced out, an action which he says will not allow him to leave the People’s Democratic Party where he got support in his time of need.

    “I think I’ve shown that I’m a politician with integrity and I have made it very clear that I didn’t leave the other party on my own, I was pushed out of the party, and someone else gave me cover, gave me an opportunity.

    “It will not be the right thing to do to now leave who helped you, who gave you the umbrella in your storm, and then go back to the person who pushed you out.”

    Reacting to the Senate’s decision to reverse its earlier resolution on electronic transmission of election results, Governor Obaseki said he remains a proponent of the course.

    According to Obaseki, PDP would not have won the last election in Edo State, but for the deployment of technology by the Independent National Electoral Commission (INEC).

    “If not for the technology utilised by INEC, and God, I may not be governor today. So, I am one of those people who believe that we cannot and should not have elections in this country, going into the future, without transmitting results electronically from the polling units, because for elections to be credible, they have to be seen as transparent and once you have voted, you should be assured that your vote will count.

    “With technology today, it is possible and INEC has shown it from my elections, that as soon as you voted, and the results have been counted in the polling units, then that result should be made available, such that you already know what you expect to be collated at the ward collation points.

    “What has happened in many cases in the past is that people go and vote, the votes are counted in the polling units, they know, but by the time it gets to the collation point, it changes.

    “But this time around, because of the transparency, everybody will see and know what they are expecting to be collated from the polling units. That is what happened in my election.

    “So, I am a very strong advocate for electronic transmission of results from elections and I want to also note that from my personal experience, INEC has the capacity, INEC has the technology, and also the understanding of how these things should work. So, they should be encouraged. I hope and pray that the President will assent to that bill,” the governor declared

    However, in a swift reaction, Fayose clarified that despite his visit to the former Lagos State governor, he remained a Peoples Democratic Party (PDP) chieftain.

    He said:” was at Bourdillon today to wish Asiwaju Ahmed Bola Tinubu a quick recovery. Health issues know no party. Majority don’t celebrate people when they are alive, but likes to sign condolence register. That is not the best way of life.

    “Politics should not be a disadvantage, but an advantage and we should have love for each other. Again I wish Asiwaju, like every Nigerian leader, sound and robust health.

    The Governor of Ebonyi State Engr. David Umahi has dispelled rumours making the rounds that he has plans to defect to the ruling All Progressives Congress, APC in Ebonyi State.

    Governor Umahi, made the announcement Tuesday at the Government House, Abakaliki while briefing journalists.

    His declaration came barley 24 hours after Governor Samuel Ortom of Benue State declared his intention to quit his party, All Progressives Congress, APC.

    Umahi said he cannot join the kind of APC with failed leaders in Ebonyi State.
    According to him, he had benefited immensely from the PDP as chairman, deputy governor, and ultimately state governor.

    He said he was focused on how to attract democratic dividends to the people of the state and not dirty politics.

    “The clarification is that my relationship with Mr. President is because he is Mr. President, and he is my boss and the relationship is personal.

    “Mr. President or any APC person has never asked me to come to APC, and they will never ask me, and there is no reason for me to leave my party PDP of which I am the party chairman,deputy governor and now governor.
    “I have always insisted in character.

    People that jumps from one party to the other should examine their characters, except if there is any problem within your party.

    “As for today ,till tomorrow until Christ comes, there is no crisis in PDP. Even if there is a need for me to leave PDP, I can never leave PDP to the kind of APC in Ebonyi State.

    “Because with the kind of leaders in Ebonyi APC, leaders that have failed Ebonyi State. I can never be on the same political platform with them.

    “I am focused to do my job. I am focused in governance. I have always insisted that we should leave party politics to our party men and women, while as soon as you are elected, you should focus on your job.

    Sequel to his claims that he facilitated the defection of Governors Dave Umahi (Ebonyi), Bello Matawalle (Zamfara) and Ben Ayade (Cross River) from the Peoples Democratic Party (PDP) to the ruling party, former minister, Femi Fani-Kayode appears to have beaten more than he can chew.

    “I think he needs to withdraw that statement, he’s my good friend but, it was an insult on my person and the other governors,” Governor Umahi said on a monitored Channels Television programme on Thursday.

    “The man did not know when I moved, but incidentally he visited me and we discussed, and he said he was coming to join me with the other governors to declare.

    “How will somebody in the PDP be instrumental to my moving?,” Umahi asked.

    “A whole Governor of the state and then, not even a small governor, an experienced Governor.

    “So, he has to withdraw the statement, he was never part of any discussion of my movement”.

    The governor explained that one of the reasons was to move the southeast to the center of administration.

    “So, for somebody to come and say that a whole chairman of the southeast governor’s forum, he was instrumental to that, it’s a bitter insult to my person and with all due respect, he has to withdraw the statement.

    “He remains my friend and a good one for that matter, but he played no role in my movement and I’m sure he didn’t play no role in the movement of the rest of us,” Governor Umahi stressed.

    The comments come on the same day that Fani-Kayode officially defected from the Peoples Democratic Party (PDP) to the APC.

    The former PDP chieftain was introduced to President Muhammadu Buhari as the newest member of the ruling party during a visit to the Presidential Villa in Abuja.

    He was led to the meeting with the President by the APC National Caretaker Committee Chairman and Yobe State Governor, Mai Mala Buni, as well as Governor Bello Matawalle of Zamfara State.

    Alhaji Audu Babale, a former Member of Yobe State House of Assembly, has defected along with hundreds of his supporters to the All Progressives Congress (APC) in Damaturu.

    Babale represented Goya/Ngeji Constituency in Fika Local Government.

    A statement issued by Hussaini Mai-Suleh, the Press Secretary to Yobe State Deputy Governor on Tuesday said “the defectors’ decision was due to the exemplary leadership of Gov. Mai Mala Buni’’.

    “Babale said he defected to APC because of the leadership style of Mai Mala Buni, the Chairman, APC Caretaker and Extraordinary Convention Planning Committee.”

    The statement also quoted the Yobe Deputy Governor, Alhaji Idi Gubana as “assuring the new entrants of equal and fair treatment to take the party to greater heights’’.

    Gubana also said that the governor was capable of carrying everyone along, irrespective of any political differences.

    The Peoples’ Democratic Party (PDP) has asked a Federal High Court in Abuja to sack Zamfara Governor Bello Muhammad Matawalle over his defection from the party to the All Progressives Congress (APC).

    The request forms part of the reliefs being sought in a suit, marked: FHC/ABJ/CS/489/2021 filed in the names of two PDP members from Zamfara State – Sani Kaura Ahmed and Abubakar Muhammed.

    The plaintiffs are contending that, in view of an earlier judgment of the Supreme Court, to the effect that the APC had no candidates in the 2019 governorship election in Zamfara State, having not conducted valid primaries, it would be unlawful for Matawalle to retain his office while defecting from the PDP to the APC, and thereby transfer PDP’s victory to the APC.

    They want the court to,among others,declare that Matawalle must resign from his office before his defection to allow the Independent National Electoral Commission (INEC) to conduct fresh election, within three months, for the PDP to replace him.

    On Monday after listening to plaintiffs’ lawyer, Kanu Agabi (SAN) moved his ex-parte motion, Justice Inyang Ekwo granted an order of substituted service of the originating processes on the Governor.

    All Progressives Congress (APC) supporters in Zamfara took over the streets of Gusau on Tuesday to witness the defection of Governor Bello Matawalle from the Peoples Democratic Peoples (PDP) to APC.

    Roads leading to Gusau Trade Fair Ground, venue of the event where APC National Caretaker Committee chairman of the APC, Yobe’s Gov. Mai-Mala Buni would receive Matawalle, were jam packed by the supporters.

    The courts declared Matawalle, PDP candidate, winner of the 2019 governorship election in the state, since the APC that got the highest number of votes did not produce a valid candidate from its primaries.

    According to reports, Zamfara has been wearing a new look since preparations for the governor’s defection began.

    As at Monday, PDP billboards had been changed and replaced with those of the APC with the governor’s pictures spread all over.

    Similarly, vehicles which bore PDP campaign posters have completely disappeared while new ones with APC markings have taken over the roads blaring praise songs of Matawalle and the APC.

    Security operatives had difficulties in controlling traffic, especially at the venue of the event even as the guests were yet to arrive.

    Many people were seen trekking to the venue.

    Gov. Matawalle is defecting to the APC alongside all 24 members of the state’s House of Assembly, 11 National Assembly members, all political appointees and their supporters.

    All state executive members of the PDP at all levels in the state are also in tow.

    The national body of the PDP, however, dissolved all the executive committees of the party in the state on Monday.

    Meanwhile, APC leader in the state and immediate past governor, Alhaji Abdulaziz Yari, had welcomed the governor into the party.

    Yari announced at a press briefing after holding meeting with some of the state’s APC chieftains in Kaduna that the APC had welcomed the governor with open arms.

    The Peoples Democratic Party (PDP) has kicked against the decision of Zamfara State Governor Bello Matawalle to defect to the All Progressives Congress (APC).

    The party warned that the law only allows defection in a situation of crisis in the party the defector belonged to.

    Governor Matawalle and some federal and state lawmakers in the state are expected to be received into the APC fold on Tuesday (today) in Gusau, the state capital.

    The APC caretaker chair and Yobe State Governor Mai Mala Buni, will lead the team to receive Matawalle. He will be supported by other APC governors.

    TheNewsGuru.com, TNG reports that Matawalle lost the 2019 election to APC candidate Muktar Idris but was sworn in after the Supreme Court ruled that the APC ran foul of its Constitution in picking its standard bearer.

    The situation affected many House of Assembly members elected on the APC platform, who also lost their seats to the PDP opponents.

    Matawalle is the second PDP governor to defect to the APC this year.

    On May 20, Cross River State Governor Ben Ayade dumped the PDP. Ebonyi State Governor, Dave Umahi had late last year after months of denying speculations defected to the APC.

    With Matawalle’s defection, APC now has 22 governors to PDP’s 13. The All Progressives Grand Alliance (APGA) controls the 36th state, Anambra.

    PDP spokesman Kola Ologbodiyan, told reporters at a news conference in Abuja yesterday that Governor Matawalle and the Zamfara State lawmakers would be running afoul of the party constitution if the defection moves come true. He also said the PDP was yet to receive official notification of the governor’s proposed defection to the APC.

    His words: “A combined reading of Section 221 of the 1999 Constitution as the pronouncements of the Supreme Court in Faleke v. INEC (2016) is clear in holding that it is the political party that stands for election, that votes scored in election belong to the political party and that the candidate nominated to contest at an election by his party acts only as the agent of his party.

    “The PDP hopes that Bello Matawalle as well as members of the National and State Assembly from Zamfara State will take caution.”

    Meanwhile, former Governor Abdulaziz Yari, who is the APC leader in Zamfara State, said members were set to receive Matawalle.

    Yari, told reporters that a meeting of stakeholders of the APC in the 14 Local Government Areas of the state had been convened ahead of the reception ceremony.

    The former governor, who was in company with another former governor, Mahmoud Shinkafi, explained that the meeting was to inform them of the development and to see how every member of the party would be treated fairly.

    Yari welcomed Matawalle’s decision to join the APC, saying the party members in the state believed that it would benefit the ruling party.

    He said: “We hope Matawalle’s coming into APC will be of benefit as well as add value to the party in the state.

    “We will not take any position without our people’s consent, and that is why we invited all the stakeholders to take a stand. We will not decide on anything that will not be of benefit to the party as well as the state.

    “We agreed that the governor is coming with authority while we have the population in the state. So, we hope and pray that his coming to our party will be beneficial and will add value to the party in the state. So, we welcome Matawalle to the APC.

    “As a party, we need as many people as possible to make us bigger. We called the meeting to inform our people of our decision to accept the governor in our party.

    “I kicked against his joining the party initially because of the nature and way the information reached us. Some of our people were also against his joining our party because they believe it would affect the oneness.

    “We are welcoming him because it shows that we are doing the right thing and APC is well built in Zamfara State. We hope it would come with a success for the party in future elections.”
