    Peter Obi to clear Dele Farotimi’s ₦30 million bail fee

    The presidential candidate of the Labour party(LP) in the 2023 general elections, Peter Obi, has offered to meet the bail conditions of human rights lawyer, Dele Farotimi.

    TheNewsGuru.com(TNG) reported that Farotimi, in his alleged defamation case against Afe Babalola, was granted bail by Ekiti Magistrate Court on Friday.

    The bail conditions include ₦30 million bond, 2 sureties (one shall be a house owner), submit his passport and shall not grant any media interview.

    Former spokesman of his presidential campaign organization, in 2023, Tanko Yunusa, disclosed  Peter Obi‘s decision to meet Farotimi’s bail condition via a brief statement on his X handle, on Friday.

    According to him, the former governor of Anambra State wanted the allegation against the former member of his campaign organization to be resolved in the best interest of all concerned.

    I consulted His Excellency, Peter Obi, as the leader of the Obidient Movement. As a respecter of rule of law, due process, and order he offered to take Dele Farontimi on the bail conditions.

    “He thanked our courts and all concerned on this matter. His concern is that situation be resolved to the best interest of all concerned as well as our legal system.

    “He extended his sincere appreciation to all concerned,” Obi’s aide stated.

    UPDATE: Ekiti court orders Dele Farotimi to drop his passport

    The Magistrate Court hearing the bail application of Dele Farotimi in Ekiti State on Friday ordered the human rights activist and lawyer to drop his international passport with the court.

    TheNewsGuru.com (TNG) reports Farotimi is facing charges of defamation of Chief Afe Babalola, a Senior Advocate of Nigeria, in his book, titled, “Nigeria and Its Criminal Justice System” at the court.

    The Magistrate Court ordered  Farotimi to drop his international passport with the court as part of the conditions that must be met for his bail.

    The Chief Magistrate, Abayomi Adeosun had denied Farotimi bail and adjourned the case on December 10th to hear the bail application today.

    The police counsel, Mr Samson Osobu had submitted that a Senior Advocate of Nigeria (SAN), under the law, could not represent a defendant at the Magistrate’s Court.

    This came, as Mr Osobu, opposed the appearance of Mr Adeyinka Olumide-Fasuka SAN for the defence of Farotimi at the Ado Magistrate’s Court.

    He cited a recent judgement of a court of Appeal in Ibadan, Oyo State, delivered on July 16, where the court ruled that a SAN could not appear before the magistrate court.

    However, Adeyinka Olumide-Fasuka SAN, explained that the Ekiti Magistrate Court Law, enacted by the state House of Assembly, allowed lawyers, irrespective of status and title, to appear in the court, especially in criminal matters as it related to the suit against the defendant.

    He urged the court to reject the argument of the prosecution lawyer, noting that the judgement cited, might not have put into consideration all magistrate court laws across the country.

    Responding on the matter, the Chief Magistrate said he would step down his ruling on the matter, in order for him to read the judgement, cited by the prosecutor.

    He consequently ordered the Senior Advocate of Nigeria to step down, and allow the most senior lawyer in the defendant’s team to continue the case, pending his ruling on the matter.

    A lawyer, Taiwo Adedeji, subsequently took over the case from Fasuka as the legal representative of Farotimi.

    At the resumed hearing on the bail application today, Adeosun, before granting Farotimi bail, ruled that Olumide Fusika, SAN, is prohibited from appearing before the court, citing Section 9 of the Magistrate’s Courts Law, 2014.

    Granting Farotimi bail, the Chief Magistrate ruled that other conditions of the bail include: a 30 million bond, two sureties (one of whom must be a property owner) and a prohibition on granting media interviews.

    Human rights activist and lawyer, Dele Farotimi has been granted bail by a magistrate’s court sitting in Ado-Ekiti in Ekiti State.

    TheNewsGuru.com (TNG) reports Farotimi had been remanded in a correctional centre after he was first granted bail by a Federal High Court sitting in Ado-Ekiti in another case of cyberbullying and defamation.

    Facing charges of defamation of Chief Afe Babalola, a Senior Advocate of Nigeria, in his book, titled, “Nigeria and Its Criminal Justice System”, Farotimi was granted bail by the magistrate court on Friday.

    According to the Ekiti magistrate court, the bail is subject to the following conditions: a 30 million bond, two sureties (one of whom must be a property owner), submission of his passport, and a prohibition on granting media interviews.

    As a Social Worker and Researcher, I feel for the soul of any country that oppresses its people. Therefore, I must lend my voice in condemnation of the unjust incarceration of Mr. Dele Farotimi, an activist lawyer and advocate for justice and human rights.

    His plight exemplifies the fragility of individual freedom in the face of institutional power and exposes the deep imbalance in Nigeria’s social justice system. I never met Farotimi except through his works. So, I write this as a duty to Nigeria, my beloved country.

    Barr. Farotimi’s arrest and subsequent prison detention are a chilling reminder of the systemic flaws that plague Nigeria. Here is a man whose life’s work has been a relentless pursuit of equity and accountability, yet he has become a victim of the very system he seeks to sanitise. His incarceration is emblematic of a broader issue: the silencing of dissent and the weaponisation of legal frameworks to stifle voices of reason and resistance.

    The Chief Magistrate’s Court in Ado-Ekiti denied bail to Farotimi, in the suit filed by the Inspector-General of Police, Mr Kayode Egbetokun, for alleged cybercrime, including defaming the founder of Afe Babalola University, Ado-Ekiti, Chief Afe Babalola, SAN. The presiding magistrate, Abayomi Adeosun, adjourned the ruling on the bail application to December 20. The police counsel, Samson Osobu, had earlier flawed the bail application as incomplete and not properly filed.

    Farotimi’s arrest sparked public outrage. The 2023 presidential candidate of the African Action Congress, Omoyele Sowore, called for his immediate release in a tweet on his X handle.

    “It is pertinent that the Nigerian police are notified that the institution cannot continue to be used to settle personal scores, and we, the citizens of Nigeria, would no longer tolerate such a situation,” Sowore stated. In the same vein, Femi Falana, SAN, condemned the arrest, describing it as illegal. He urged Farotimi’s unconditional release.

    Farotimi’s plight is a tragic chapter in the narrative of injustice in Nigeria. In a society where power dynamics dictate access to justice, the scales are invariably tipped against those who dare to challenge the status quo. His incarceration is not just an attack on his person; it is an affront to the principles of democracy and the rule of law. When a nation’s legal and social institutions are co-opted to serve the interests of the powerful few, the very fabric of society begins to unravel.

    I am committed to the dignity and worth of every individual. My profession encourages advocacy for the disenfranchised and oppressed. The treatment of Barr. Farotimi compels us to question: What does justice mean in a system where the powerful can manipulate outcomes to their favour? And what is our responsibility in the face of such systemic injustice?

    The imprisonment of a crusader like Barr. Farotimi is a stark call to action. It highlights the need for comprehensive reform of Nigeria’s justice system, starting with measures to ensure transparency, accountability, and the independence of the judiciary. Advocacy organisations, civil society groups, and international bodies must join forces to demand his immediate release and the establishment of safeguards to prevent similar abuses in the future.

    Moreover, we must challenge the cultural acceptance of oppression and silence. Farotimi’s incarceration is a litmus test for all Nigerians: Do we remain silent and complicit, or do we rise to defend the fundamental rights that underpin our humanity?

    The soul of a nation is reflected in how it treats its people, especially those who speak truth to power. Today, Nigeria stands at a crossroads. Our choice will determine whether justice remains a fleeting ideal or becomes a tangible reality for all. As Barr. Farotimi endures this injustice, let us not allow his voice [and those of countless others] to be silenced. Let us, instead, amplify these voices in a united call for equity, justice, and the restoration of our collective dignity.

    Injustice anywhere is a threat to justice everywhere; the world is watching. May we rise to the occasion and ensure that the soul of Nigeria is not lost to the darkness of oppression but shines brightly as a beacon of hope and justice for generations to come.

    On Friday, the Yoruba sociopolitical group’s national caucus leaders, Afenifere, paid a solidarity visit to embattled human rights lawyer and activist Dele Farotimi.

    Recall that Farotimi, a member of the national caucus of Afenefere, is currently being detained in the Correctional Center on an allegation of defaming a Senior Advocate of Nigeria (SAN), Afe Babalola.

    On behalf of their national leader, Chief Adebanjo, the group visited the Ado-Ekiti Correctional Centre to deliver a private message and enquire about his wellbeing.

    According to a statement by the Deputy Secretary General, Alade Rotimi-John, the Afenifere leaders expressed their disappointment at “the travesty occasioned by the chief magistrate who presided over the case on Tuesday when he declined to see the need to give urgent attention to an application for bail for a bailable offence, particularly since it is already a deeply disturbing miscarriage of justice for Mr Farotimi to have been remanded in the correctional centre in the first place.”

    The statement said, “Afenifere will wait to consider its next line of action after the ruling of the chief magistrate on December 20.

    “The national caucus leaders of Afenifere in attendance at the correctional centre today (Friday) included Chief Supo Shonibare, Basorun Segun Sanni, Mrs Nike Olujembola, Mrs Toyin Falade, Pastor Olayemi Olajuyinnu and Mr Tunde Babarinde, among others.”

    Veteran Nollywood actor and former spokesman of the Labour Party (LP) presidential campaign council, Kenneth Okonkwo has raised an alarm that the life of human rights lawyer, Dele Farotimi, may be in danger.

    According to Okonkwo via the microblogging platform, X the author of ‘Nigeria and Its Criminal Justice System’ stance on what he wrote in his book, may force the corrupt elites to take extreme measures.

    Recall, the human rights lawyer Farotimi was detained in the Correctional Center on an allegation of defaming a Senior Advocate of Nigeria (SAN), Afe Babalola.

    Now that Dele Farotimi is sticking to his guns on the purported defamation matter, his life must be protected at all costs in prison. Nobody should come and tell us he had a cardiac arrest or something happened to him after a brief illness.

    “Dele Farotimi was hale and hearty when he was unjustly arrested. He must be healthier whenever he comes out since the government that is holding him unjustly is wealthier than him.

    “My guess is that these corrupt elites may settle this matter through another means if Dele Farotimi resists all their attempts at intimidating him,” Okonkwo wrote on his X handle on Saturday.

    He called on authorities to allow the law to take its course. “The authorities must be aware that the whole world is watching. They have chosen the legal option, and must not resort to anything funny. Let the law be allowed to run its full course,” he added.

    Afe Babalola files fresh petition seeking Dele Farotimi’s removal from Nigerian bar

    The law firm of Afe Babalola has submitted a petition to the Legal Practitioners Disciplinary Committee (LPDC) requesting  the removal of Dele Farotimi, from the roll of Nigerian legal practitioners.

    The petition accuses Farotimi of breaching rules of professional conduct rules governing lawyers. The 90-page document, dated December 6, 2024, was signed by Ola Faro, a partner at the firm.

    Notably,  Faro was also referenced in Farotimi’s book, “Nigeria and Its Criminal Justice System.”

    The petition was titled “Petition against Tomilola Titus Farotimi (also known as Dele Farotimi esq), a Nigerian lawyer called to the Nigerian bar with his name on the roll of legal practitioners kept by the Supreme Court for violation of the extant Rules of Professional Conduct for Legal Practitioners Rules 1, 15(1), 15(2b), 15(3a), 15(3g), 15(3i), 15(3j), 26(1), 27(1), 30, 31(1), (2) and (4) of the Rules of Professional Conduct 2023 by bringing the entire judiciary in Nigeria into disrepute with his unfounded allegations of corruption against eminent justices of the supreme court of Nigeria, judges of high court of Lagos state, Aare Afe Babalola san, Olu Deramola, SAN, Ola Faro esq, and the entire chambers of Afe Babalola & co in his book titled ‘Nigeria and its criminal justice system.”

    Faro, who clarified that he was writing both in his capacity and “on behalf of the law firm of Afe Babalola & Co.”, outlined the case’s background and detailed the alleged violations of the Rules of Professional Conduct by Farotimi.

    According to the petition, the popular human lawyer was accused of engaging in conduct unbecoming of a legal practitioner by making false accusations against the Supreme Court and the legal profession.

    The petitioners further alleged that Farotimi participated in unlawful conduct by bribing judicial officers and gaining illegal access to a judicial officer.

    Faro stated, “He joined his clients in committing misconduct and breach of law with reference to judicial officers by having unlawful access to a judicial officer. He gave service to his client which he knows is capable of causing a breach of law and disrespect and corrupting a judicial officer. He knowingly made a false statement of law and facts with respect to a case already decided by the Supreme Court.

    A magistrate’s court sitting in Ado-Ekiti, on Tuesday, refused the bail application of human rights activist and lawyer, Dele Farotimi, and ordered that he be remanded in the Correctional Centre.

    Recall that the defendant was on Monday granted bail in another case of cyberbullying and defamation before a Federal High Court sitting in Ado-Ekiti. The court admitted Farotimi to bail in the sum of N50 million, and a surety in like sum.

    Farotimi is facing charges of defamation of Chief Afe Babalola, a Senior Advocate of Nigeria, in his book, titled, “Nigeria and Its Criminal Justice System”.

    The court adjourned the case till December 20, to again hear the bail application of the defendant.

    The 2023 presidential candidate of the Action Alliance Congress (AAC), Omoyele Sowore, has slammed former presidential candidate of the Labour Party (LP), Peter Obi,  for meeting with Nigerian Senior Advocate, Afe Babalola, SAN, in Ado-Ekiti, Ekiti State.

    TheNewsGuru.com(TNG) understands that the former governor of Anambra State met with the Nigerian legal luminary on Monday concerning human rights lawyer, Dele Farotimi, currently at the Ekiti prison.

    Social activist, Moses Paul, who shared video and photos of the visit via his X handle, said Peter Obi and Afe Babalola reportedly had in-depth discussions, including on Farotimi’s matter.

    Moses wrote, “Today, Mr. @PeterObi travelled from Lagos to Ekiti State, dedicating the entire day to meaningful engagements. He visited Aare Afe Babalola at his office within the Afe Babalola University, where they had in-depth discussions on critical issues, including the situation of activists and lawyer @DeleFarotimi.

    “Following this, Mr. @PeterObi proceeded to the prison facility where @DeleFarotimi is being held. In a private meeting, he expressed solidarity and engaged in a candid exchange aimed at addressing the prevailing challenges.”

    Sources also at the meeting confirmed that Peter Obi begged Afe Babalola on behalf of Farotimi.

    In reacting to the development, Sowore via his Facebook page on Monday criticised the former Anambra governor for begging Afe Babalola regarding the unjust detention of the popular human activist.

    According to Sowore, the LP candidate have committed a despicable injustice in the fight against judicial corruption in our country.

    He wrote: “I strongly condemn those who went to ”beg” Chief Afe Bablola today regarding the unjust detention and persecution of Dele Farotimi. The delegation led by Mr Peter Obi has committed an unspeakable and despicable injustice in the fight against judicial corruption in our country. Obi’s action feels like forcing Rosa Parks to return to the back of the bus(of raical injustice) during the Civil Rights era in the United States. The struggle continues.”

    The viral photo of human rights lawyer, Dele Farotimi, appearing at the Ekiti State High Court in handcuffs has sparked outrage amongst Nigerians on social media.

    TheNewsGuru.com(TNG) reports that Farotimi’s arrest followed a defamation lawsuit filed by a Senior Advocate of Nigeria, Afe Babalola.

    The popular activist is accused of damaging the reputation of Afe Babalola through statements made in his recently released book, ‘Nigeria and Its Criminal Justice System.’

    Farotimi, who was arraigned last Wednesday, pleaded not guilty to all sixteen charges against him.

    However, during his appearance in court on Monday, the Federal High Court in Ado-Ekiti, Ekiti State, granted the human rights lawyer, ₦50 million bail.

    The 2023 presidential candidate of the Action Alliance Congress (AAC), Omoyele Sowore, made this known in a post on X where he revealed that Farotimi had been granted ₦50 million.

    He wrote, “BREAKING: The first hurdle was crossed. @DeleFarotimi was granted bail of N50 million naira surety in the like sum with someone with landed property. The Case was Adjourned to 29 January 2025.”

    Farotimi, was also escorted out of the court premises by the operatives of the Nigerian police force in handcuffs.

    Reacting to the development, Nigerians via social media, slammed the police for handcuffing Farotimi, while the likes of former governor of Kogi State, Yahaya Adoza Bello strolled out of court free, despite been arraigned for fraud to the tune of N110.4billion.

    Former Minister of Education, Oby Ezekwesili wrote, “So the gross absurdity of handcuffing @DeleFarotimi was lost on the Prisons Service? “What crime is the @NigeriaGov @PoliceNG really prosecuting @DeleFarotimi for at this stage because how did a civil matter between Dele Farotimi and Chief Babalola morph into the strongest evidence of why Citizens now sadly lack trust in and believe that our Judiciary is fully captured by Nigeria’s irresponsible political class?

    “This reckless desecration of all public institutions under this administration of @officialABAT will not sustain. Never.

    “The Minister of Interior- Olubunmi Tunde-Ojo @BTOofficial who is in charge of @CorrectionsNg – The Prisons – has to explain the basis of those handcuffs on Mr Farotimi and immediately take steps to correct repeat of such anomaly by overzealous officers.

    “Those pushing this gross violation of Citizen-Farotimi’s constitutional rights should advise themselves now and cease pushing forward the shenanigans playing out on this matter. Enough is Enough!
