    Supreme Court upholds Diri’s re-election as Bayelsa gov

    The Supreme Court  on Friday upheld the re-election of Sen. Douye Diri as the governor of Bayelsa.

    The apex court in a judgment, dismissed the appeal brought before it by the governorship candidate of the All Progressives Congress APC, Timipre Sylvia and his party.

    The lead judgment delivered by Justice Garba Lawal, held that the appeal by Sylvia and APC was not only lacking merit but a gross abuse of court process.

    The unanimous decision of the apex court upheld the earlier decision of the Court of Appeal and the Election Petition Tribunal.

    The Court of Appeal in Abuja had, on July 18, affirmed the re-election victory of Gov. Diri of Bayelsa in the Nov. 11, 2023 governorship poll.

    The three-member panel of justices led by Justice James Abundaga, in a unanimous judgment, held that the appeal filed by the appellants; Mr Timipre Sylva and the All Progressives Congress (APC), lacked merit.

    The panel held that the tribunal was not in error when it struck several paragraphs of the petitioner’s reply against the governor’s election.

    NAN reports that the election tribunal had, on May 27, dismissed the petition filed by Sylva and APC.

    The three-member tribunal, led by Justice Adekunle Adeleye-led, dismissed the petition for lacking in merit.

    In a unanimous decision, the tribunal held that the petitioners failed to adduce credible evidence to substantiate their allegations against the outcome of the state’s governorship poll.

    It struck out all the additional proof of evidence and statements on oath of some of the witnesses who testified for the petitioners as incompetent.

    According to the tribunal, the law expressly provided that an election petition must be filed no later than 21 days after the election result was declared.

    Gov. Douye Diri of Bayelsa on Monday, swore in 14 new commissioners and the newly-elected chairmen of the eight local government councils in the state.

    The governor also swore in the chairman of the state Board of Internal Revenue, Mr Daniel Iniekezimene.

    The ceremony took place inside the Council Chambers of Government House, Yenagoa.

    Eight of the commissioners served during the first term of the governor.

    They are Biriyai Dambo (Attorney-General and Commissioner for Justice), Moses Teibowei (Works and Infrastructure), Maxwell Ebibai (Finance), Dr Gentle Emelah (Education), Daniel Igali (Sports Development) and Preye Brodricks (Special Duties, Bayelsa East).

    Others who returned but were re-deployed are Dr Ebieri Jones, who was assigned to Trade and Industry from Mineral Resources, and Flint George, who served as Commissioner, Special Duties, Bayelsa Central, but now assigned Budget and Economic Planning.

    The rest of the commissioners are Mrs Ebiwou Koku-Obiyai (Labour and Productivity), Michael Magbisa (Special Duties, Bayelsa West), Elizabeth Bidei (Women Affairs), Peter Afagha (Mineral Resources), and Komuku Kharim (Power).

    Diri said the ceremony marked a pivotal moment in the state’s journey as the administration begins its second term.

    He said during the first tenure, the administration laid the groundwork for a prosperous Bayelsa across various sectors, but there was still much work to be done.

    “As we embark on this journey, let us remember that our success will be judged not by individual accomplishments but by the collective impact we make.

    “Your selection and election among a pool of highly qualified persons inspire confidence in your ability to serve with utmost commitment and distinction, fulfilling the aspirations of all Bayelsans,” Diri said.

    He therefore charged them to initiate legacy projects and programmes in their various ministries to accelerate the development of the state.

    The governor admonished them to be prudent in financial management, ensure efficient utilisation of resources, and foster collaboration to achieve success.

    He said that the administration would come up with indicators for periodic evaluation of the performance of each commissioner.

    Diri advised the commissioners to establish strong connection with people at the grassroots, understand their needs, and incorporate them into government policies.

    To the council chairmen and their vice, the governor pledged to strengthen the local governments to foster development in  communities.

    “I want you to uphold the tenets of transparency, consultation and keep in touch with the people as you are the closest to the grassroots.

    “Ensure that you live a peaceful and quiet life. We want to see peace and development in your local governments.

    “We will not tamper with local government funds, rather we will assist you with your development, and l reiterate that local government chairmen should desist from obtaining loans with interest.”

    The new council chairmen are Lucky Febo (Brass), Isaac Oniye (Ekeremor), Tariye Isaac (Kolokuma/Opokuma ), David Alagoa (Nembe), Golden Jeremiah (Ogbia), Mrs Alice Tangi (Sagbama), Target Segibo  (Southern Ijaw) and Boludisiye Ndiwari (Yenagoa).

    To the revenue board chairman, Diri said the board must evolve strategies to enhance the state’s internally generated revenue.

    “Our revenue falls short of expectations”, the governor said, and challenged the board to block loopholes in the system and partner with relevant agencies to strengthen the tax system and revenue sources.

    Court dismisses suit seeking Diri’s disqualification, awards N500,000 fine

    A Federal High Court, Abuja, has dismissed a suit seeking the disqualification of Gov. Douye Diri of Bayelsa and his deputy, Lawrence Ewhrudjakpo.

    Justice Emeka Nwite, in a judgment, held that the suit lacked merit as the plaintiff had failed to prove the allegations of certificates forgery levelled against Ewhrudjakpo beyond reasonable doubt.

    Justice Nwite also awarded a cost of N500, 000 against the plaintiff and in favour of the Peoples Democratic Party (PDP), the 3rd defendant in the suit.

    NAN reports in 2023 that less than nine days before the Nov. 11, 2023 Bayelsa governorship election, a fresh suit seeking Diri and Ewhrudjakpo’s disqualification commenced before Justice Nwite.

    The plaintiff, a Bayelsan woman, Mrs Blessing Clement Azibanagbal, through her lawyer, Ifeanyi Nsowu, filed the suit marked: FHC/ABJ/CS/1448/23.

    In the affidavit in support of the originating summons deposed to by Yenle Istifanus, a litigation secretary with Compendium Chambers, the lawyer said she knew as a fact that Azibanagbal, who hails from Bayelsa and as a good citizen of Nigeria, had the locus standi (legal right) to institute the action.

    The originating summons was dated Oct. 26, 2023 and filed on Oct. 30, 2023,

    She listed Diri, Ewhrudjakpo, Peoples Democratic Party (PDP), and the Independent National Electoral Commission (INEC) as the 1st to 4th defendants, respectively.

    The suit sought an order of mandatory injunction, directing INEC to remove the names of Diri and Ewhrudjakpo as PDP’s candidates in the November poll.

    It also sought an order of perpetual injunction restraining INEC, its agents, privies, or whosoever called, from further publishing their names as standard bearers for the party in the forthcoming election in Bayelsa.

    It further sought a declaration that Ewhrudjakpo was not qualified to run as deputy governor under the PDP.

    It sought a declaration that Ewhrudjakpo was also not qualified to be a running mate with Diri.

    Besides, she prayed the court to declare that Ewhrudjakpo had multiple names without any evidence to prove “that he is the same person.”

    She, therefore, urged the court to declare that the PDP had no candidate in the poll.

    But the PDP, in a notice of preliminary objection dated Nov. 28 and filed Nov. 30 through its lawyer, Adeyemi Ajibade, SAN, prayed the court to dismiss or strike out the suit for being statue-barred.

    Diri and his deputy also filed their counter affidavit to oppose the application.

    Delivering the judgment on Monday, Justice Nwite observed that Exhibits I attached to the affidavit of the plaintiff’s amended originating summons contained among others, documents which included deed poll for proper arrangement of Ewhrudjakpo’s name.

    “Fair enough, it is the documents exhibited by the plaintiff to prove her case that the 2nd defendant (Ewhrudjakpo)’s certificates have different names, hence he is not qualified on the ground of presentation of false informations,” the judge said.

    He, however, held that the Supreme Court had laid to rest the recognised and legal procedure for a valid change of name.

    Citing a PDP case Vs Degi, 2021, Justice Nwite held that the apex court had decided that “affidavit of change , correction and confirmation of name has to be by deed poll and not by mere deposition.”

    He said in the instant case, it was clear that Ewhrudjakpo had met with the requirements for recognised procedure for correction of name.

    “That is, by making a deed poll and publication in official gazette,” he added.

    He said he agreed with the submission of the learned counsel for Ewhrudjakpo that the plaintiff wass bereft of the law and facts on the issue and her allegations are mere speculations and time wasting assertion intended to embarrass the defendants.

    On whether the plaintiff had sufficiently proved her case on the preponderance of evidence and beyond reasonable doubt as required for a criminal allegation of forgery and false information in a civil suit, the judge said “the law is trite that he who asserts must prove.”

    According to Justice Nwite, in the instant case, the plaintiff failed to prove her allegations that the certificates presented by the 2nd defendant are product of forgery.

    “Also in the instant case, the plaintiff did not prove even on the preponderance let alone beyond reasonable doubt her bogus allegations of forgery and presentation of false information against the 2nd defendant.

    “The allegations against the 2nd defendant is criminal in nature and must be proved in accordance with the standard required by Section 138 of the Evidence Act , 2011.

    “The one million naira question is was that allegations proved beyond reasonable doubt?

    “In view of the foregoing analysis, I resolve the issue in favour of the defendants and against the plaintiff.

    “In summary, I am of the view and I do hold that the suit lacks merit and sane is hereby dismissed.

    “Cost of N500, 000 awarded against the plaintiff in favour of the 3rd defendant,” he declared.

    NAN reports that INEC had declared Diri the winner of the Nov. 11, 2023, poll after he scored the highest votes to defeat other candidates, including Timipre Sylva of the All Progressive Congress (APC).

    A Federal High Court , Abuja, on Monday, adjourned the suit seeking the disqualification of Gov. Douye Diri of Bayelsa and his deputy, Lawrence Ewhrudjakpo, until March 18 for hearing.

    The suit, which was listed on number 14 on the cause list, could not go on due to the volume of work before Justice Emeka Nwite.

    The court, therefore, fixed March 18 for the hearing.

    ustice Nwite had, on Nov. 30, 2023, fixed today for the hearing after the suit was stalled.

    Less than nine days to the Nov. 11 Bayelsa governorship election, a fresh suit seeking Diri and Ewhrudjakpo’s disqualification commenced before Justice Nwite.

    The judge had, on Nov. 3, granted the ex-parte motion moved by plaintiff’s counsel, Ifeanyi Nwosu, seeking a leave to serve Diri and Ewhrudjakpo at the Government House in Bayelsa, through courier service.

    The suit, marked: FHC/ABJ/CS/1448/23 and filed by a Bayelsan woman, Blessing Clement Azibanagbal through her lawyer, Nsowu, listed Diri, Ewhrudjakpo, PDP and Independent National Electoral Commission (INEC) as 1st to 4th defendants respectively.

    But the PDP, in a notice of preliminary objection dated Nov. 28 and filed Nov. 30 through its lawyer, A.K. Ajibade, SAN, prayed the court to dismiss or strike out the suit for being statue-barred.

    It also urged the court to dismiss the suit for not disclosing reasonable cause of action against the defendants.

    Giving five grounds, the PDP argued that Azibanagbal’s case was founded on pre-election matter and the time prescribed by the constitution to initiate such suit had elapsed.

    It argued that the court lacked jurisdiction to hear and determine a suit that was already statute-barred.

    “This honourable court lacks jurisdiction to hear and determine a suit where and when the plaintiff’s suit failed to disclose cause of action and/or reasonable cause of action,” it said.

    Meanwhile, INEC declared Diri the winner of the Nov. 11 poll after he scored the highest votes to defeat other candidates, including Timipre Sylva of the All Progressive Congress (APC).

    Oborevwori hails Diri on assumption for second term

    Delta State Governor, Hon. Sheriff Oborevwori, has congratulated his Bayelsa counterpart, Senator Douye Diri and his Deputy, Senator Lawrence Ewhrudjakpor, on their inauguration for second term on Wednesday.

    Governor Oborevwori in a statement by his Chief Press Secretary, Sir Festus Ahon, in Asaba on Wednesday, said that Diri’s emergence for another term in office was epoch-making.

    He lauded Diri for his Prosperity vision for Bayelsans which, according to him, would engender the sustainable growth and development of the state.

    Oborevwori said that the “overwhelming victory and peaceful conduct of the election” would spur Governor Diri to do more for Bayelsans who massively gave him a resounding mandate.

    He commended Diri for his message of unity and for deepening transparency and accountability in governance.

    “On behalf of the government and people of Delta, I congratulate Governor Douye Diri and his amiable and loyal Deputy, Senator Lawrence Ewhrudjakpor, on their inauguration for second term in office for a second term.

    “The Bayelsa Governorship election of November 11, 2023, testified to your undying and patriotic resolve to put the interest of the people before other primordial ones.

    “I am impressed and encouraged by your call for a united Bayelsa state, going into to your second term in office. The call is germane because no society can develop in an atmosphere of disunity.

    Duoye Diri sworn in as Bayelsa gov for second term

    Duoye Diri has been sworn in for a second term in office as Bayelsa State Governor.

    He took his oath of office at 1:58 pm on Wednesday at Samson Siasia Sports Complex in Yenagoa, the state capital.

    Both Diri and his deputy, Lawrence Ewhrudjakpo, took their oath of office administered by the State Chief Judge, Justice Matilda Ayemieye.

    Dignitaries that graced the occasion included Vice President Kashim Shettima, former Presidents Olusegun Obasanjo and former President Goodluck Jonathan among others.

    Diri polled a total of 175,196 votes to defeat his main rival, Timipre Sylva of the All Progressives Congress.

    Bayelsa: No apology for backing Diri’s re-election – Jonathan

    Former President Goodluck Jonathan says he owes no apology to anybody for supporting the re-election of Gov. Douye Diri of Bayelsa in the November 11, 2023 off-cycle governorship poll.

    Jonathan said his public support for the governor was in line with the aspirations of the the majority of people of the state.

    The former president made this known when he received a high-powered delegation led by the governor who visited him at his residence in Yenagoa.

    Wife of the former president, Dame Patience Jonathan, was also on hand to receive the governor and his entourage.

    According to him, the governor deserved to be re-elected because of his developmental efforts, including ensuring peace and stability in the state.

    “I did what l did during the governorship election and l have no apologies to anybody because l know that the governor and his team were doing very well, especially in the area of peace and stability of the state.

    ”At a time, l became very worried. I have not said others did not do well. After all, l was also governor for a little less than one and a half years and also had my challenges.

    “Since Diri came on board, the excesses of cult groups, particularly in Yenagoa, has reduced reasonably. If we must move forward, first and foremost, we must handle the issue of security in order to attract investors.

    “I saw that the governor and his team have a vision and he needed to be encouraged to do another four-year term,” he said.

    Jonathan charged the governor to do more to meet the high expectations of the people, adding that “to whom much is given, much is expected”.

    In his response, Diri expressed appreciation to the former president for his support, which contributed to the success of the Peoples Democratic Party at the poll.

    “Your endorsement of a sitting governor was more than billions of naira. And so having secured that endorsement, we were very sure of victory. We are here to say a big thank you as that has brought stability in the state.

    “With the kind of peace and security we have in our state, Bayelsa is ready for private investors to come in,” the governor added.

    He also thanked President Bola Tinubu for ensuring peaceful, free and credible election in the state.

    The governor was accompanied by Senators and House of Representatives members from the state, former lawmakers, traditional rulers, political appointees and public servants.

    Bayelsa LP guber candidate seeks disqualification of Diri, Sylva at tribunal

    The Labour Party (LP) Governorship Candidate in Bayelsa, Udengs Eradiri, has approached the election petition tribunal, seeking the disqualifications of the Peoples Democratic Party (PDP) Candidate, Senator Douye Diri, and his APC counterpart, Chief Timipre Sylva.

    Eradiri, who rejected the results of the last governorship polls in the state, on Wednesday, insisted that he was the only eligible candidate who scored the valid votes cast and deserved to be declared as the duly elected governor of the state.

    Addressing stakeholders, ward and local government officials of the party at his Campaign office in Yenagoa, Eradiri said he decided to explore the legal option after thoroughly assessing the outcome of the polls.

    He said: “After the election we said we were going to look at the issues, and I am here to officially inform the leadership of the party that we have gone to court, and we pray the court to declare me winner.

    “The reason is that the PDP and APC produced candidates that were not eligible to contest the elections, and I won the valid votes cast in the election, so I should be declared governor of Bayelsa.

    “There are issues of eligibility of the two candidates, and that is my reason for going to the tribunal. Many people have lost hope in the judiciary but that small thread we held on to is the basis for me to challenge the declaration.

    “After studying the entire process, I have decided to ask the tribunal to declare me governor. With the spread of my 950 votes you will see that in seven out of the eight local governments, I got the  constitutional requirements, so if you invalidate the PDP and APC votes , I should be declared winner”.

    Eradiri said he decided to explore the court options in the interest of the suffering people of Bayelsa, adding that he would continue to raise issues affecting the people.

    He said: “If the court decides they’ll look the other way, we will still challenge it because of that small thread of hope we still believe that there are people of integrity in the judiciary and that is what we are holding on to”.

    On the crisis rocking the party in the state, he said there was no faction, adding that the labour party stakeholders and leadership had decided to appoint an acting chairman in accordance with the constitution.

    Eradiri said the former chairman of the party in the state lacked the constitutional power to suspend him.

    He said: “Some persons decided to leave the party, they voluntarily left. The natural system of discipline in the party kicked him out not me. So there’s no faction.

    “The position of the party is clear, if you participate in anti-party activity, it is expulsion. We have a constitution that dictates our modus operandi. I have demonstrated the principles to put the party together so I can’t at this time destroy it myself”.

    Diri presents N480.9bn 2024 budget for Bayelsa

    Gov. Douye Diri of Bayelsa on Wednesday, presented the 2024 budget of N480.99 billion to the state House of Assembly for approval.

    Presenting the budget christened: “Budget of Sustainable and Shared Prosperity,” Diri said that the figure was made up of N69.120billion recurrent expenditure, representing 14.37 per cent, N54.096billion overhead expenditure, representing 32.04 per cent and N257.777 billion capital expenditure.

    “Mr Speaker, I wish to present the 2024 budget estimates to the House. We are guided by the desire to prepare a realistic, implementable and prioritised budget, which is a reflection of the aspirations and wishes of critical stakeholders, and the economic realities in the country.

    “I hereby present to you the 2024 budget with a total size of ₦480,993,632,369.00,” he said.

    He said the budget would be funded through statutory allocation, Value Added Tax, 13 per cent derivation, internally generated revenue and other capital receipts.

    Giving a breakdown of the sectoral allocation, Diri stated that the Works and Infrastructure Ministry got the lion’s share of N141.837 billion followed by that of Education, which got N49.888 billion.

    Also, the sum of N26.41 billion was earmarked for the Ministry of Health, Environment got N15.554 billion while Agriculture and Natural Resources was allotted N14.886 billion.

    Youths and Sports Ministry got N7.656 billion, Lands and Housing N6.876 billion while the Ministry of Power was allotted N6.49 billion among other ministries.

    Diri also reviewed the 2023 budget performance, which he said achieved considerable success and consistency in critical areas such as, security, education, health, agriculture, human capacity building, infrastructure development among others.

    “We built and upgraded health facilities across all LGAs and health-related tertiary institutions, including completion and furnishing of the first psychiatric hospital in Bayelsa.

    “Also, in partnership with Fly Zipline, we established a health chain distribution system to cater for drug distribution and emergency health matters using drones.

    “The Health Insurance Scheme enrolment is also growing by the day. As at 2020, our mobilisation was limited to the public service. We went further in 2023 to launch the Diri Care programme, which boosted the enrolment of the informal sector.

    “The total enrolment as at November 2023 is 149,067 with civil servant enrollees totaling 118,030, vulnerable population 27,803, and the informal sector 3,134,” he said.
    Diri added: “We have in the past three years ensured that the Civil Service is given the necessary attention (including the prompt payment of salaries and regular promotions) for an effective work force, and to enhance the economic and social development of the state because ours is predominantly a civil service state.

    “In addition, this administration consistently ensured that the entitlement of our senior citizens (by way of pensions and gratuities) are paid promptly. Over N3.3billion was spent on gratuities and N10.8billion for pensions in 2023.

    “Let me assure you that, even in the coming year, we will continue to meet our obligations to the senior citizens within the limits of available resources.”

    In his remarks, Speaker of the House of Assembly, Abraham Ingobere commended the administration for its commitment to development of the state as well as maintaining a harmonious relationship with the three arms of government.

    Ingobere applauded the governor for prudent management of the state’s resources in executing projects.

    Mrs Happiness Godsent, a business woman, on Friday said she would vote for Gov. Douye Diri in the Nov. 11 election “because when he became governor, with His Church heart, he brought peace to Bayelsa”.

    Godsent told NAN on Friday in Yenagoa that “the governor has been there for the people of Bayelsa and has ensured peaceful coexistence among citizens”.

    “This governor is someone that has time for the people. Since he became governor, we have been having peace in the state.

    “Before he came on board, we used to run up and down. Since he came in, we can move around without fear.

    “Now, I can do my business till 11 p.m. with my mind at peace. Before he came, the latest we could stay was 9 p.m. with fear and the street shaking.

    “He has really made things easy for us. As you can see, tomorrow is election day and we are all prepared for it as we move around freely.

    “The people can now move with confidence without being molested.”

    She said that the governor also ensured they had good roads, adding that in the past, one usually found it difficult to walk on the streets as the roads were not tarred.

    “This Azikoro road is a route that vehicles could not move on, but now it is motorable. Cars are plying it. Everywhere looks good.

    “The roads are now tarred with street lights. He really tried. That is why I am going to vote for him.

    “I came to Bayelsa since 2002 and I know how these boys were behaving. We used to run up and down but things have changed now. The running around has stopped.

    “A lot of things were happening in other places, but in Bayelsa, he calmed a lot of things.

    “Even if the boys want to create a scene, he tells them that he is the governor and they usually listen,” she said.

    She also credited Diri with paying salaries regularly.

    “He pays salaries regularly. That makes business to move very fast.
