    Seriously, this minister needs lectures on telecom regulation – By Okoh Aihe

    Nobody expects perfection in relationships among the various stakeholders in a deregulated market environment, like the telecommunications industry. Such perfection, should it ever be made possible, could signify conspiratorial acquiescence by some groups in the relationship to gain on the other party, or simply to enjoy the benefits of some loose lines.

    Nobody expects perfection. So, management of dissonance is the name of the game, and this is done in such a way as to achieve a delicate balance that could appease the health of the industry. There is hardly any perfection. Instead, there is sustained stakeholders management and engagement to create a level of industry harmony that is redeeming to all the parties.

    Global bodies and industry associations like the ITU and GSMA recognise this point of reality and have always provided platforms for knowledge incubation to the various parties. The messages are always subtle; the need for the stakeholders to understand their nexus of relationships and the benefits arising therefrom, the fickle patience of investment funds and how to create a resting environment for such funds, and the need to sheathe the sword of envy, because in some instances, the operator in an environment could become richer than the host country. Then, some countries of the world would begin to see the operators as low hanging fruits that could be preyed on for needed funds, or just throw things up for a ruin in moments of rage. Global bodies incubate government delegations to prevent such strolling disasters.

    Sometimes the areas of intervention could be in the facilitation and development of telecom policies and laws to help protect the industry. At some other points, it is in the area of training to help build the needed human capital for the regulatory agencies. Often, there are developments to help test the degree of growth and commitment to standard industry practice.

    Have the results always been good? Or is there perfection? No direct answer but let’s do a little bit of recall and then gravitate to the present.

    Test case one. Mid 2009, the Nigerian Communications Commission (NCC), in furtherance of its regulatory activities, sold three 2.3GHz licenses for WiMAX operations to three operators, namely: Mobitel, Spectranet and Multilinks. Before the joy of celebrations could abate following the success of such licensing, the exercise was cancelled by the Minister of Information and Communications, Prof Dora Akunyili, who claimed not to be properly briefed or carried along. There was something close to a dirge across the industry because such an audacious external intervention had never been witnessed in an industry, acclaimed all over the world as exemplary.

    The telecoms industry had been built on peoples’ credibility, knowledge, sweat and investment, and the NCC wasn’t going to let that go down easily. Engr Ernest Ndukwe who was the Executive Vice Chairman (EVC) wrote to Madam Minister immediately, pointing her attention to the section of the Nigerian Communications Act 2003 which confined her involvement in the industry to only policy matters. Prof Akunyili of blessed memory wouldn’t stomach what resembled an affront.

    Both Akunyili and Ndukwe who hailed from the same end of Anambra State were very strong personalities. They knew their job but they also didn’t want anybody to breathe their air. There was outrage stoked by what would turn out to be a media war between a sister and a brother just to be able to do a damn good job for the industry and prove fidelity to the nation. Both the Communications Policy and the Telecommunications Act were under scrutiny and went through an acid test. In the end the regulator won.

    Test case two. This is more like back to the future and not a recall. This writer gathered that there  is a document making the rounds at the NCC, titled: Request for Information on the Commission’s Public Programmes for 2022, which is concomitant to a request by the Communications and Digital Economy Minister, Dr Isa Ali Pantami, who seeks to be apprised with the goings-on at the Commission; you may call it day-to day operations. The information must be collated and forwarded to his office pronto.

    As a journalist I have tried to search for a reason behind this kind of document, I couldn’t find one. As a former regulator I have tried to ascribed reasonableness to the request but all that returns to my face by way of justification is anathema. There is something that is not right. In as much as one can attribute overzealousness to some of the actions of the minister, there are some that hover on the fringes of obtrusive interception or disguised confiscation of a regulatory process by embedding himself into a process that has little to do with his office.

    There was always a fight between the Ministry of Communications irrespective of its nuanced nature, and the Nigerian Communications Commission. While it is commonplace to suggest that some of the activities of the regulator were before 1992, carried out by the Ministry, it makes more sense to suggest that the loss of such responsibilities and all the overwhelming benefits, created a dangerous rift that nothing has been able to heal. More often the target of the ministry is to use the minister to stymie the wings of the regulator and, where the minister has his own agenda, like Pantami, the ministry takes over the operations of the regulator or engage in full obnoxious regulatory capture using the minister as a shield. While it is human to be overzealous, it is only professional for a regulator to be daring enough to use the law to trim such overzealousness.

    So there was 2009. And there is 2022. While one was a total cancellation of a licensing process, the current one is a stealth hijack of the entire regulatory process with effects that are too subtle now to exhibit their dangerous aftermath. Yet the law remains the same and that is what all stakeholders should subscribe to, that is what protects the industry from those who view the world from only  their point of view.

    Those who framed the Act were futuristic in projecting the ambitions of men, knowing that some day some government officials may come into office with a mindset that does not accommodate structure or law or Act. Therefore, for the sake of the industry and nation, for the health of those who have brought their money into a nation as investments, Section 23 to 25 of the Nigerian Communications Act 2003, should be a manual for sustained pedagogy, especially for new government officials, including the minister.

    It is the responsibility of the President of the nation to appoint a minister to superintend the telecommunications industry but every such appointment is steeped in law for the well-being of the industry and the nation. In concluding the functions of the minister which include a general policy direction for the industry, the Act says, “In the execution of his functions and relationship with the Commission, the Minister shall at all times ensure that the independence of the Commission, in regard to the discharge of its functions and operations under this Act, is protected and not compromised in any manner whatsoever.”

    They are words on marble that obviously don’t recognise or accommodate a daily briefing by the Commission of its day-to-day operations to any Minister.

    Governor of Anambra State, Willie Obiano, has placed a ₦20 million bounty on the perpetrators of the gruesome killing of Dr. Chike Akunyili, the husband of the late former minister and Director-General of the National Agency for Food and Drug Administration and Control (NAFDAC), Dora Akunyili, and others in the state.

    The Governor said that the sum will be awarded to anyone who is able to provide useful information to track the killers.

    He said this in a special broadcast after an emergency State Security Council meeting at the Governor’s lodge in Amawbia on Wednesday, while condoling with the Akunyili family, as well as families of others who were killed in the attack.

    Governor Obiano condemned the attack, calling on residents to join forces with security agencies to confront the common enemy and protect the state.

    Speaking further, he lamented that between Sunday, September 26 to date, over 10 persons have been killed in various areas of the state.

    TheNewsGuru.com, TNG reports that Dr. Chike Akunyili was killed by the gunmen on Tuesday alongside his driver and a police escort around the Nkpor junction in Idemili North, Anambra State.

    The late Chike was said to have been returning from an event where he received a posthumous award of excellence for his late wife when he ran into the hoodlums at Nkpor and was murdered in cold blood.

    Meanwhile, the Police have visited the scene, as investigations into the incident and several other recent killings are now ongoing.

    It is on a very sad note that I address the State today to condemn in very strong terms, the violence that has been witnessed in Anambra in the past few days.
    Since last weekend, some armed persons have unleashed terror with sporadic attacks on innocent citizens in various parts of the State.

    From the briefings I have received from Security Commanders, Offices of some political parties, branded campaign vehicles and individuals occupying them have been attacked with killings and burning of vehicles observed. Other innocent road users have become victims of this menace with many losing their lives and others, their properties.

    Between Sunday 26th and yesterday 28th September, 2021 attacks on citizens at Oko, Agulu, Obosi, Nkpor, Nnobi, Nnewi and other places have left about ten (10) people dead including an illustrious son of this State, Dr Chike Akunyili, husband of late Prof Dora Akunyili who was reportedly gunned down yesterday around Nkpor.

    These are our own people dying every day and for what reason?

    Ndi Anambra, these attacks and accompanying deaths cannot be justified and must stop now.

    I have therefore conducted an extensive security meeting and have directed all Security Agencies to step up and confront this monster ravaging our land. I charge everyone involved in the security architecture of Anambra State to take very seriously, this threat to our livelihood and boldly rise to confront same. Everything that needs to be done will be done and no stone will be left unturned in this effort. My directive to this effect is clear and i urge every security personnel on duty in Anambra State to do his utmost best to secure our people.

    To all citizens of Anambra State and every person living and doing business in our State, I urge you now to join forces with us to confront this common enemy.

    We cannot condone this savagery for any reason whatsoever. I therefore call on all our youths in the State to rise up and protect our communities. Traditional Rulers, Presidents General, Clergy men, Vigilante Groups and all leadership structures must now take responsibility and in conjunction with the Police, Military and other Law Enforcement Agencies, work to restore order immediately.

    To reinforce our commitment and seriousness on this issue, I on behalf of the State Government, wish to announce a twenty million Naira (N20,000,000.00) reward for any useful information leading to the arrest of the perpetrators of these heinous attacks on our State. The people behind this must be unmasked and brought to book. I urge Citizens to report to us, anybody bearing firearm who is not a Security or Vigilante personnel, so we can deal with this monster, once and for all.     At this point, I wish to most heartily condole with the families of all those who have lost their loved ones in the course of these senseless attacks. I promise you that we will leave no stone unturned in getting justice for them. May their souls rest in peace.

    Finally, I urge all citizens of the State to unite in this fight against all forms of terror, intimidation and tyranny. We will not succumb to invaders as I am convinced that no Anambra son will indulge in this kind of heartlessness. I warn all those promoting and participating in these violent attacks to leave our State or pay a high price as we will definitely catch up with them.

    To all law abiding citizens and persons living in our State, I urge you to go about your lawful businesses but we must now ALL go to work and take back our State. This is Anambra, the Light of the Nation, where darkness has no place. The events of the last one week will not be allowed to fester and by God’s grace, we shall overcome.

    IPOB denies involvement in Chike Akunyili’s assassination, says killings in Anambra State politically motivated

    The Indigenous People of Biafra (IPOB) has denied being responsible for the murder of Dr Chike Akunyili, husband of late Prof Dora Akunyili; a former Minister of Information.

    TheNewsGuru.com, TNG reports that the late Akunyili was shot at close range of Tuesday in Anambra State along with his driver and escort.

    Akunyili’s younger brother, Cyril later accused IPOB of masterminding the attack on his brother.

    However, in a swift response on Wednesday, the outlawed group distanced themselves from the ‘senseless’ killings in the South-East geopolitical zone of the country.

    This is as the group claimed that the ‘senseless’ killings were politically motivated, stating that masterminds were taking advantage of the current situation in the region to unleash mayhem on their political opponents.

    The group also noted that it did not at any point issue a statement on the forthcoming governorship elections in Anambra State, to the effect, that the election will not hold.

    The Director of Media and Publicity of the secessionist group, Emma Powerful, aired the group’s view in a statement, on Wednesday.

    The statement read in part, “We the great family of the Indigenous People of Biafra ably led by our great leader Mazi Nnamdi Okwuchukkwu Kanu, wish to dissociate ourselves from the senseless killing of innocent citizens in Anambra State. We have no hands in the political killings going on in Biafra land. We have at several times raised the alarm that some cruel politicians are hiding under the cloak of the situation in Biafra land to eliminate their political enemies and blame it on IPOB.

    “We also wish to clarify that IPOB has never issued an official statement that there would be no governorship election in Anambra State. Those peddling such rumour are not our members and should be ignored. Our position on the Anambra election will be made public at the right time through our normal channels of information dissemination. Anything to the contrary should be disregarded.

    IPOB further claimed that those who killed Prof Dora Akunyili were responsible for the death of her husband.

    “Those who killed Dora Akunyili husband killed his wife with poison because she exposed the death of Yar’Adua for Goodluck Ebele Jonathan to take over as President of Nigeria, they know themselves, they conspired to poison Prof. Dora Akunyili.”

    It added, “We have no issues with Chike Akunyili and we don’t know him, those behind this act must stop this and stop using IPOB’s name, we don’t want anybody to blame IPOB because we must get them, this is purely a political assassination going on in Anambra State now.

    “It is obvious that those that burnt Anambra Government House and other parts of the state some years back are back to use intimidations and killings to subdue their opponents ahead of the governorship election in Anambra State.”

    More information have emerged on how Dr. Chike Akunyili, husband of late information minister, Dora Akunyili was brutally murdered in Anambra State on Tuesday.

    TheNewsGuru.com, TNG gathered that Dr Akunyili was killed at Umuoji in Idemili North LGA of Anambra State on Tuesday evening.

    A source close to the family said the deceased was still at the University of Nigeria Nsukka Alumni Association (UNAA) where the late Dora was honoured some hours before he was killed.

    His brother, Cyril Akunyili on Wednesday confirmed the attack in a Facebook post while accusing members of the proscribed Indigenous People of Biafra (IPOB) of being behind the dastardly attack on his brother.

    Meanwhile, an 11 seconds video obtained by TNG on Wednesday morning saw the deceased still grasping for life after being shot by the gunmen at close range while some passersby watch in bewilderment.

    BREAKING: Gunmen shoot late Dora Akunyili’s husband dead in Anambra

    Dr. Chike Akunyili, husband to late former Information Minister, Prof. Dora Akunyili, has been reportedly murdered by gunmen.

    According to reports, he was killed at Umuoji in Idemili North LGA of Anambra State on Tuesday evening.

    Though details of the incident are still sketchy, a source close to the family said the deceased was still at the University of Nigeria Nsukka Alumni Association (UNAA) where the late Dora was honoured some hours before he was killed.

    The source said: “God, please render the devil and his agents powerless and useless.

    “I was with this man yesterday same yesterday at Sharon Hall, All Saints Cathedral, Onitsha. It was an occasion of University of Nigeria Nsukka Alumni Association (UNAA), Onitsha branch event where they honoured late Dora Akunyili.

    “He spoke glowingly about Dora and made a donation of 500k to the association.
    He was there with his son ,Obum now working with Anambra state government.

    “We saw them off to the car and it was emotional when Obum hugged him tight as both of them separated to join their respective vehicles.

    “Obum was in a white Hilux while the man was in a big Jeep (i think Prado). God have mercy!”

    Confirming the sad incident, the deceased brother, Cyril Akunyili on Wednesday accused members of the proscribed Indigenous People of Biafra (IPOB) of being behind the dastardly attack in a Facebook post.
