    Some lawmakers in Ebonyi State were affected by the court ruling that sacked the Governor of the State, Dave Umahi, and his Deputy, Dr Eric Kelechi Igwe.

    TheNewsGuru.com (TNG) reports Governor Umahi, his Deputy and the lawmakers were fired from office by a Federal High Court sitting in Abuja, Nigeria’s capital.

    They were sacked on account of their unlawful defection from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC).

    The court declared their defection unlawful, unconstitutional, null and void and ordered them to immediately vacate their offices.

    Justice Inyang Ekwo, in a separate judgment in a suit by the PDP on Tuesday, ordered the Speaker of the House of Assembly and his co-defectors to immediately stop parading themselves as members of the Ebonyi State House of Assembly.

    He held that the votes that brought them to office belonged to the PDP and that the legislators cannot hold on to the votes having elected to defect from the party that nominated them.

    Justice Ekwo also held that the votes cast for PDP in the 2019 election are not transferable to the APC that failed in the election.

    It restrained the Independent National Electoral Commission (INEC) from recognizing or according any recognition to them as elected members of the House of Assembly.

    Justice Ekwo ordered that all monies collected from the top period of their defection to the judgment date must be recovered from them.

    TNG reports some of the lawmakers affected include Odefa Obasi Odefa, Victor Chukwu, Kingsley Ikoro, Joseph Ununu, Nkemka Okoro, among others.

    Justice Ekwo had, on Jan. 19, fixed today for the judgment in the suit filed by the PDP against the governor and his deputy.

    Sixteen (16) lawmakers, including the Speaker of the Ebonyi State House of Assembly were affected.

    The Governor of Ebonyi State, David Umahi and his Deputy, Dr Eric Kelechi Igwe have been sacked from office, following their defection to the ruling All Progressive Congress (APC).

    TheNewsGuru.com (TNG) reports the Federal High Court sitting in Abuja on Tuesday sacked Umahi and his Deputy following their defection from the Peoples Democratic Party (PDP).

    The court, in a judgement that was delivered by Justice Inyang Ekwo, held that the total number of 393, 042 votes governor Umahi secured during the March 9, 2019 governorship election in Ebonyi state, belonged to the PDP and same could not be legally transferred to the APC.

    According to the court, having defected to the APC, both Umahi and his deputy, not only jettisoned the PDP, but also the votes that belonged to it.

    It held that going by the outcome of the governorship election, the office of the governor and deputy governor in Ebonyi state, “belong to the Plaintiff and no other politcal party”.

    “There is no constitutional provision that made the ballot transferrable from one party to the other”.

    It held that the PDP is bound to retain the votes and mandate that was given to it by electorates in Ebonyi state, as both governor Umahi and his Deputy could not validly transfer same to APC.

    The court therefore ordered both Umahi and Igwe to immediately vacate their positions.

    It ordered the Independent National Electoral Commission, INEC, to immediately receive from the PDP, names of persons to replace Umahi and his Deputy, or in the alternative, conduct fresh gubernatorial election in Ebonyi state in line with section 177(c) of the 1999 Constitution, as amended.

    The court further restraining both Umahi and Igwe from further parading themselves as governor or deputy governor of Ebonyi state.

    The judgement followed a suit the PDP ldged before the court.

    Presidential aspirant under the Peoples Democratic Party, PDP, former Senate President, Anyim Pius Anyim has declared that there will soon be massive defection from the ruling party, APC to the PDP in the Ebonyi State Assembly.

    The former SGF, made this declaration with optimism while he was addressing members of the party in a meeting in Abakaliki. He further stated that PDP would soon take over the leadership of the house of assembly.

    The PDP bigwig noted that “without the nine lawmakers, you won’t be able to get 2/3rd majority in the Ebonyi house of assembly to do anything.

    Anyim Pius who had held top echelon positions at the Federal level currently parades the most intimidating political credentials among those that had made their intentions known to take over from President Muhammadu Buhari in ,2023.

    He accused fifteen lawmakers of the APC of trying to control everything that happened in the house. He further urged PDP to remain committed to the sole agenda of the party.

    Confusion as Ebonyi Assembly elects new deputy speaker while former denies resignation

    Controversy stirred on Monday at the Ebonyi House of Assembly as 15 of the 24-member assembly, elected a new deputy speaker after the purported resignation of the substantive one.

    Chief Francis Nwifuru, Speaker of the House read a letter purportedly written by Chief Obasi Odefa, Deputy Speaker of the House indicating that he (Odefa) had resigned his position as a House member and subsequently, the Deputy Speaker.

    Nwifuru quoted Odefa as writing that after due consultations with his family, selected stakeholders and political associates, the resignation would give him time to pursue other engagements.

    Mr Onu Nwonye (APC-Ohaozara West) moved a motion for Odefa’s replacement and subsequently nominated Mr Kingsley Ikoro (Afikpo North-West) to replace him.

    Mr Anthony Nwegede (APC–Izzi East) seconded the motion for Ikoro’s election into the position as the members overwhelmingly voted for his election.

    Nwifuru congratulated Ikoro and urged him to discharge his duties equitably.

    “It gives me joy that Ikoro has assumed this position because when I was the Deputy whip of the House in 2011, he was the Chief Whip.

    “The House is united and once you discharge your duties to the people whatever anyone says will not affect you,” he said.

    Odefa, in a swift reaction, while briefing newsmen in the company of other Peoples Democratic Party (PDP) members of the House, denied ever resigning his House membership or writing any letter to that effect.

    “The whole scenario is the desperate ambition of some people who felt uncomfortable that I refused to defect to the APC with them.

    “The question is why should I resign my membership of the House of Assembly when those people are not my constituents who elected me into office,” he said.

    He swore never to had defected to the APC, insisting that he never attended any meeting, rally or other form of gathering convened by the party.

    “I will use all legal means to seek redress on the issue and since I affirmed my membership of the PDP, I have received all forms of threats even on my family members,” he said.

    Mr Oliver Osi (PDP-Ivo) also used the ocassion to deny ever defecting from the PDP to the APC, noting that he had no reason to leave his party.

    Recall that political tension heightened in the state since Feb.19 when Odefa affirmed his PDP membership and raised alarm over planned impeachment on him in the House.

    Gov. David Umahi of Ebonyi says the state House of Assembly is always critical of his policies, hence cannot be described as a rubber stamp.
    Umahi said this on Thursday in Abakaliki while signing the 2022 appropriation bill into law.
    He said that the house is knowledgeable in the art of lawmaking, contrary to the views held by some pepple.
    He said: “Anyone who thinks otherwise can go and try them and get floored.
    “The members are committed to moving the state forward and prepared at all times to make sacrifices, including calling off their recess anytime their attention was needed.
    Umahi said the state government would ensure the completion of its mega projects in 2022.
    Newsmen reports that the projects included the airport, stadium, flyovers and roads, amongst others.
    “We intend to make the state university move to a one campus structure to enable the new University of Aeronautics to use the Presco campus as a temporary site.
    “The new University for Information Communication Technology will also use the College of Agricultural Sciences campus as temporary site,” the governor said.
    Umahi also said that the government would employ at least 5,000 civil servants and empower 10,000 citizens from various sectors of the state.
    The Speaker of the house, Francis Nwifuru, commended the governor for ensuring the prudent management of the state’s resources.
    “We are happy to report that the 2021 budget had over70 per cent implementation, which had helped in the overall development of the state.
    “We interfaced with relevant government agencies in reviewing the budget and would always collaborate with other arms of government to make the state better,” Nwifuru said.
    Newsmen reports that the state government appropriated N145.4 billilion for the fiscal year.

    The federal government is duty-bound to unravel the whereabouts of the missing five engineers handling the rehabilitation of the Ring Road in Ebonyi state as consultants of the $150 million African Development Bank (AfDB) project.

    To be modest, the heart is bleeding on the presumption of their deaths having been missing since 3rd November, 2021. These hardworking professionals who went for a legitimate job for economic growth of the state cannot end their lives in such a tragic manner. Reports from diverse quarters accused the state government of being hostile to the consultants prior to their abduction for reasons best known to the actors. Nigeria is not an abattoir where animals are recklessly killed without explanations.

    Section 14(b) of the 1999 Constitution, Federal Republic of Nigeria as amended protects all citizens from brutality. It provides” …the security and welfare of the people shall be the primary purpose of government”. These consultants namely; Engr. Nelson Onyemeh (lead consultant/Chief Executive Officer of NELAN Engineering Ltd) from Ihiala in Anambra State; Engr. Ernest Edeani from Nkanu in Enugu State; Ikechukwu Ejiofor from Umunya in Oyi LGA of Anambra State; Engr. Samuel Aneke from Nkanu in Enugu-East LGA of Enugu State and Engr. Stanley Nwazulum from Amawbia in Awka-South LGA of Anambra State; all from the South-East as citizens are supposedly protected by this provision.

    But shockingly, during a security meeting in Ebonyi on 30th November, 2021, Governor Dave Umahi disclosed that the abducted five engineers were killed and buried in the state by the Ezza Warriors. The saddest in the episodes is that none of the abducted consultants hailed from Ebonyi state, and therefore raises a serious question why their bodies were buried in Ebonyi as stated by the governor considering that Igbos by tradition rarely yield to interment in foreign land. If they were truly killed as Umahi announced, this is madness of the highest degree. To worsen it, a source alleged that the consultants were burnt like criminals perhaps as a cover up, their burnt corpses were hurriedly, secretly buried in Ebonyi thereby depriving their families access to even see their bodies. Their families shouldn’t be left in unending trauma. Till date, they still pray, fast and hope for the return of their loved ones not knowing their true situation. What an unending trauma!

    This ugly and barbaric incident can trigger communal crises if not diligently handled. Thus, President Muhammadu Buhari pursuant to his statutory duty to protect lives and property in the Constitution must ensure that justice is done to these citizens. No amount of concealment will succeed. The defence that security operatives were attacked on their way to locate the locus is flimsy and fallacious. If sustained, it then suggests that the felons have taken full control of an area statutorily designated as part of the federation. So, the government should address the predicaments in the area.

    A source had revealed, “Specifically, those close to the murdered civil engineer who spoke to the television’s reporter, insisted that the relationship between Governor Umahi and NELAN had remained very frosty to a point that some of the vehicles assigned to them for the execution of the project were allegedly withdrawn, leaving them with only one Toyota Hilux for their routine operations”.

    Furthermore, in Daily Sun of 21 December 2021, their colleague that luckily escaped also narrated; “We are saying that it was a planned thing; it wasn’t a spontaneous issue because they have been going to that community. One thing we understand is that that community doesn’t hurt foreigners.… There is a foul play, but we can’t place our finger on it …. In fact, the Toyota Hilux with registration number, ERR-001-EB they traveled in also disappeared with them till this moment”.

    These disclosures are weighty. As alleged, many investors that showed up in the state couldn’t stay due to overbearingness. The AfDB project is targeted for development but rather than embrace the revolution, non-indigenous contractors are being murdered like animals. The Ebonyi incident is nearly what transpired recently in Imo state where the Police recklessly acted as thugs and kidnappers, and put the vulnerable masses including elderly people and children during a church service into severe fear in the facade of arrest of Uche Nwosu, former candidate of Action Alliance (AA) in Imo governorship election. These are uncivilized acts.

    The cruelty against the five NELAN consultants is very disgusting. The question for these groups of lopsided, myopic actors and wannabes that don’t think of repercussions over actions is the impact they target with these irascibilities in the name of supremacy battle. Ridiculously, this is a time people earnestly yearn for foreign investors to stimulate the economy, yet, mindless people kept unleashing terror on key actors and stakeholders. It was during the military era that such barbaric acts thrived. This particular episode has blacklisted the administration the most and portrayed the governor as insensitive for not even considering it vital to show the family where their breadwinners were hacked to death and buried. The Ihiala Progressive Union (IPU), has demanded for the whereabouts of Engr. Nelson Onyemeh and his associate engineers from the Umahi-led government.

    Commendably, the Association of Ebonyi State Indigenes in Diaspora (AESID) has lent its voice calling for a thorough investigation on the disappearance of the five engineers working for the economic development of the state. Similarly, the House of Representatives has also mandated IGP Usman Baba Alkali to urgently, thoroughly investigate the matter as moved by Hon Ifeanyi Momah representing Ihiala federal Constituency in the lower chamber. To sum up, the alleged coldblooded killing of these innocent professionals without any sensible cause is agonizing, traumatic and the height of stupidity in recent times, and portrays the masterminds as irrational beings. Thus, the culprits must be brought to book straightaway. The Police must ensure that the needful is done and not swept under the carpet.

    How we spent our Christmas, New Year in pain, grief – Wives of missing engineers

    Wives of the five engineers declared missing in Effium Community of Ebonyi State said they marked the Christmas and New Year in grief and pain over the fate of their husbands, who went missing about two months ago.

    An Enugu-based engineering firm, Nelan Consultants, had on Nov. 3, 2021, deployed the five engineers on a supervision of the ongoing Abakaliki Ring Road project at Effium in Ohaukwu Local Government Area of the state.

    The project is funded by the African Development Bank.

    It was learnt that the engineers were allegedly abducted from the site by unknown armed men, who also took away their project vehicle.

    That was the last their families, friends, colleagues and relatives heard from them in the community, which has been enmeshed in protracted communal crisis with its neighbouring Ezza Community.

    The missing engineers include Messrs Nelson Onyemeh, a Director and partner to Nelan Consultants, Stanley Nwazulum, Ernest Edeani, Ikechukwu Ejiofor and Samuel Aneke.

    Onyemeh’s wife, Patricia, 58, told NAN in Enugu on Friday that she and the wives of the other four engineers, along with their children, spent the Yuletide praying and hoping that their husbands and breadwinners would return alive.

    According to her, this is the worst Christmas I ever spent without my dear husband.

    “We were indoors grieving and praying that my husband will come back alive.

    “Nobody is telling us anything. We have petitioned the unbearable for them, adding that their children kept asking for their father’s whereabouts since he left the house in November 2021.

    The families of Nwazulum, Ejiofor and Aneke said they were still traumatized by the incident and that all their efforts to find the missing engineers had not yielded any positive result.

    They appealed to the Ebonyi Government, the Nigerian Police and other concerned individuals and groups to assist them in finding their husbands.

    Meanwhile, the Ebonyi government had in its reaction on Dec. 20, 2021 exonerated itself from any involvement in the incident.

    The Commissioner for Information, Mr Uchenna Orji, had said at a news conference in Abakaliki that the government had no hand in the disappearance of the engineers.

    Orji said, “It has become imperative to put the records straight on the allegations and misrepresentation of facts conveyed to the public from certain quarters over the unfortunate incident that befell Engr. Nelson Onyemeh and other four engineers.

    “Based on the report of police investigation on the incident, we view as disheartening, the unfortunate circumstances that led to the sad news.

    “We, therefore, extend our heartfelt condolences to all the families and the Nelan Company for this dastardly act by criminal elements, while hoping for a comprehensive crackdown on the perpetrators.”

    Ebonyi PDP Spokesman slumps in court

    The Peoples Democratic Party (PDP) Publicity Secretary in Ebonyi, Mr Chika Nwoba, on Wednesday slumped when he was arraigned in a Chief Magistrates Court in Abakaliki.

    Nwoba could not respond to the charges levelled against him due to illness.

    The Defence Counsel, Mr Luke Nkwoagu, urged the court to direct that Nwoba be taken to the hospital for medical attention.

    According to Nkwoagu, it is not proper for a person who is ill to be arraigned.

    “I have not seen where an accused person is being held by two people in the bar.

    “No court of competent jurisdiction can try an unconscious or a dead person. With his health, I pray he should be taken to the hospital for treatment.

    “My application is to allow him to be treated in the hospital; he can be brought to the court when he is strong enough, he cannot talk now,“ Nkwoagu urged the magistrate.

    The Prosecutor, ASP Mattias Eze, said the application for the accused person to receive medical attention was a welcome development.

    Magistrate Blessing Chukwu admitted the accused to bail.

    Chukwu ordered that he should be taken to a police hospital and adjourned the matter until Jan. 14.

    Recall that the PDP Publicity Secretary was arrested on Jan. 9 by some operatives of Ebubeagu Security Network, Ebonyi Chapter, over an alleged online publication which criticised the activities of the Ebonyi government.

    He was later rescued by operatives of Anti-kidnapping Unit of the police command on Enugu -Abakaliki Expressway, who kept him in their custody.

    Gunmen kill Ebubeagu operative, set body ablaze in Ebonyi

    The Police Command in Ebonyi on Sunday confirmed killing of a member of Ebubeagu Security Network (ESN).

    The victim, Ifeanyi Orogbo, 32, was murdered and partially burnt by the assailants.

    The Police spokesman, Ebonyi Command, DSP Loveth Odah, said the incident occurred on Saturday night in Igweledeoha, Amagu, in Ikwo Local Government Area.

    According to her, the DPO of Ikwo Police Division said that he received a phone call from one source at Igweledeoha that one ESN operative had been murdered.

    “He was partially burnt by the unknown persons in his beer parlour shop on Agubia Road.

    “The DPO said that he quickly mobilised a team of police operatives to the area but the culprits had deserted the place when they got there.

    “He said the corpse has been taken to the General Hospital for preservation and autopsy,” the police spokesperson said.

    Odah said that two suspects had been arrested in connection with the crime.

    She said the Commissioner of Police, Mr Garba Aliyu, has expressed dismay over the killing and promised to bring the perpetrators to book.

    Gov. David Umahi of Ebonyi has approved a minor cabinet reshuffle which affected two ministries.

    This is contained in a statement issued on Saturday in Abakaliki by Dr Ugbala Igwe, Secretary to the State Government and Coordinating Commissioner.

    According to the statement, Mr Frank Ngwu, Special Assistant(SA) on Road Maintenance, is now SA on Infrastructural Development for Concession and Maintenance.

    “Dr Stephen Odo, Commissioner for Commerce, Industry and Business Development, now Commissioner for Commerce and Industry.

    “Mr Oluchukwu Ezeali, Commissioner for Infrastructural Development for Concession, is now Commissioner for Business Development.

    “Mr Kerian Ofoke, SA on Airport Project is now SA on Attitudinal Change,” the statement said.

    It noted that the reshuffling was with immediate effect, and all handover and taking over must be completed before 12.00p.m on Monday, Jan. 10.

    “All the affected Commissioners and the SAs are to take note and ensure strict compliance to this directive,” the statement added.
