    Court annuls Ebonyi Cybercrime law, declares it unconstitutional

    A Federal High Court sitting in Abakaliki, on Tuesday declared the controversial Ebonyi Cybercrimes Law No 12 of 2021 unconstitutional, null, void and of no effect.

    The Court ruling followed a suit filed by one Mr Pascal Etu, who had sued the governor of Ebonyi, Chief Dave Umahi, the state of House of Assembly, the Commissioner for Justice and Attorney General, Commissioner of Police and others over the controversial law.

    Recall that Ebonyi government had in September 2021 enacted the controversial law in an equally controversial circumstances.

    Apart from the House of Assembly members, journalists were not present when the law was enacted even as there was no proof of the law going through public hearing before being passed.

    It was also quickly and secretly assented to by the governor.

    The public only became aware of the existence of the law when in October, a social critic, Mr Godfrey Chikwere, was arrested by the police for allegedly flouting some sections of the law.

    The police were about to charge him to court when he suddenly slumped and was rushed to the hospital.

    Meanwhile, earlier this year, Mr Etu was arrested for allegedly flouting the law, so also was the spokesperson of the People’s Democratic Party (PDP) in the state, Mr Chika Nwoba.

    The duo were remanded in custody of the Correctional Centre in Abakaliki by the state Magistrate Court pending the determination of the allegations against them.

    Nwoba was later granted bail by the court following outcry and condemnations that greeted his arrest.

    But, Etu still remained incarcerated till date with his matter suffering several adjournments.

    While the case against Mr Etu was on at the State High Court, he instituted the matter against the state government and four others at the federal high court in Abakaliki challenging the constitutionality of the law.

    In the suit, FCAI/CS/6/2022, Etu through his lawyers, prayed the court to declare that the Ebonyi House of Assembly had no powers to make such laws.

    He also argued that the law was unconstitutional, null and void as it ran contrary to the Cybercrimes Act passed by the National Assembly in 2015.

    In his ruling, the presiding Judge, Justice Fatun Riman, granted all the prayers of the plaintiff.

    The judge while declaring the Ebonyi cybercrimes law 2021 unconstitutional, null and void, also issued an order of injunction restraining the state government from continuing to enforce the law.

    Riman held that the Ebonyi State House of Assembly had no constitutional powers to make such laws because the National Assembly had enacted the cybercrimes act in 2015 which was applicable in all states of the federation.

    The court also held that by virtue of cybercrimes being an item in the exclusive legislative list, only the National Assembly could enact laws on it.

    The court also set aside all steps, actions, proceedings howsoever, taken by the Ebonyi government in furtherance of or in the implementation of the said Ebonyi cybercrimes law 2021.

    Reacting, Etu’s Lawyer, Mr Mike Odoh, said that the court, through the judgement had reaffirmed the constitutional right to fair hearing and freedom of expression of every individual.

    He noted that people had the right to express themselves and push information to the general public within the ambit of the law.

    He expressed confidence that with the judgement, the State High Court would free his client at the next adjourned date for the matter.

    “The implication of the judgement is that the law abinitio never existed, no government institution or its privy can enforce the cybercrime law anywhere in the state.

    “The decision of the Ebonyi government or state House of Assembly to go and enact cybercrime law was totally unconstitutional.

    “Cybercrime is an item in the exclusive legislative list and only the federal government can enact laws on it,” Odoh said.

    The All Progressives Grand Alliance (APGA) Ebonyi chapter, says it will hold its ward delegates congresses across the 171 wards of the 13 local government areas in the state on May 10.

    Mr Ricky Okorouka, APGA’s Chairman in the state told newsmen in Abakaliki on Monday that the party was ready to conduct a peaceful and transparent congress.

    Okorouka noted that the three-man delegate would elect adhoc delegates that would vote during the party primaries ahead of the 2023 poll.

    According to him, they are to vote at the party’s primaries ranging from the gubernatorial, National (senate and House of Representative and the state House of Assembly.

    “We have invited the Independent National Electoral Commission (INEC), who is going to witness the exercise.

    “We have held stakeholders meeting ahead of the Tuesday ward congress and preparations for a peaceful exercise have been made and we have urged all the aspirants to conduct themselves.

    “On security, we have informed the DSS and police. All our members have been advised to stay out of violence.

    “I pray there will be no rancour and I believe that our dear party is one united type for the interest of Ebonyi and the nation at large.

    “I am assuring you that the outcome will be credible and during the party primaries, the best candidate will emerge,” he added.

    The Peoples Democratic Party (PDP) Ebonyi chapter, said it had held its ward delegates congresses across the 171 wards in the state.

    Mr Chika Nwoba, PDP’s Public Relations Officer in Ebonyi, who briefed newsmen in Abakaliki, said the exercise was held in all the wards of the 13 local government areas, adding the preparation for a seamless exercise had been perfected by the party.

    He said that the local government returning officers sent from the National Secretariat of the PDP arrived in the state late and moved down to the various LGAs for the conduct of the exercise.

    “Officials from the national party secretariat who came for the conduct of the three-man delegate congress arrived the state an hour or two ago.

    “They briefed the party members who were at the party secretariat to receive them where they displayed the result sheets and materials for conduct of the exercise before leaving for the respective LGAs.

    “The exercise is ongoing as I brief you now; it is our wish that may be in few hours from now they must have concluded and returned the outcome to the party’s national secretariat,” Nwoba said.

    He dismissed alleged conduct of parallel ward congresses in the state, adding that the party was ‘one big family.’

    He said that the officials who came to conduct the exercise were duly accredited by the national leadership before coming to Ebonyi.

    He said: ” I’m not aware that anybody distributed any material that is different from the one that was just displayed a few hours ago; so, if anybody is in possession of material before now, I may not be aware.

    “But, the ones who came and displayed the materials they came with are the authentic ones and each of the 13 returning officers came with result sheets for an LGA of coverage.”

    He added that the 13 returning officers interfaced with the five-man state ad hoc Electoral Committee before departing to their respective LGAs, adding that the party was confident that all officials involved in the exercise were working to achieve resounding success.

    He came, He saw, He commissioned – By Chooks Oko

    An epochal visit has just been rounded off. The visit of President Muhammadu Buhari to Ebonyi state. A visit that is as memorable as it is impactful. It was a fait accompli for the young state and the apogee of a well laid package fitted neatly to precision.

    From Akanu Ibiam airport to Uburu, from the Onueke airport site to the new government house, the visitors marveled at sheer engineering prowess ensconced in the array of courageous projects that certainly took some audacious guts to start, in the first place.

    Commissioning the now King David Federal University of Medical Sciences, Uburu, the apparently overawed President enthused that the quality of the project is quite glaring even to a non engineer like himself. Truly, the project is mind blowing! What with a cancer centre, a kidney transplant centre, liver transplant centre, heart transplant centre and above all, a dialyzer production factory, the only such in black Africa. What is more, most of the equipment are already in place while the remaining ones are in the high seas sailing majestically to base. The university is surely a task force against medical trips abroad, a sure precursor to medical tourism boom in the country. Its taken-over by the federal government is a laudable feat both for the governor and the president. The speed, quality and finesse deployed in the execution of the project could have been compromised had it not had a direct supervision from the governor, a federal government contractor could have cut corners possibly rendering a less qualitative project. It is thus a blessing to the nation that it is receiving a bespoke masterpiece.

    The Muhammadu Buhari Airport was the next port of call. With its longest and concrete runway almost completed, the airport will host a lot of firsts in the aviation history of the country. The presidential wing was commissioned amid fanfare while the other ongoing structures will ensure the President’s third visit to Ebonyi state, to commission the airport for full business.

    The twin flyovers in Ebonyi are legendary studies in user friendly dynamics. They are wide, solid and beautiful, purpose built and futuristic. The president commissioned some to the elation of both the guests and visitors.

    At St. Margaret Umahi international market, the president was confronted with one of the largest markets in West Africa with super solid structures and a beevy of grateful traders and buyers. This radiated in their smiles of satisfaction and waves of love, a most touching sight!

    Next was the virgin presidential lodge domiciled in the centenary city which the president commissioned and moved in. A mere look at the building will trigger your relaxation senses, moving in will give you dreaming ideas, and lying down activates your rest nerves; the lodge is a befitting stopover for presidents, only. Next to it is the new government house, lodge and Aisha Buhari Wife of the Governor’s office which were all commissioned.

    Rest over, the shopping mall, aptly referred to as the”Dubai” of Africa was the next port of call. But the twin light tunnel flyovers named after the president had to be commissioned first. A most alluring sight to behold at night, nothing will suggest to you that you are in the heart of Southern Nigeria. What with the adjoining exquisite shopping mall and the enchanting ecumenical centre all awash with lightings that force a serene ambience on even the most troubled spirit.

    The icing on the cake was the new executive council chambers. Modeled after the United Nations meeting chambers, the edifice is a wonder. Big, bold and beautiful, the building stands as one of the most beautiful meeting venues in the country. The president commissioned and commended, it was a satisfying trip for both the visitors and their hosts. Presidential spokesman, Femi Adesina sums up the visit thus ” A splendid outing from a splendid Governor. Seeing is really believing”.

    President Buhari lauds Gov. Umahi on quality projects in Ebonyi

    President Muhammadu Buhari has commended Gov. Dave Umahi of Ebonyi on the quality of projects in the State.

    Buhari expressed satisfaction with his performance saying he was not surprised at the standard of work because the two-time governor is an engineer of repute.

    Thenewsguru.com reports that the president began his two-day visit to the State with the inauguration of projects at the state-owned King David University of Medical Sciences, Uburu.

    The projects included a twin flyover, 12-kilometre dualised Federal Road, from Mbu, Enugu State to Uburu, the University Building and the University Medical Hospital, Facilities and Equipment.

    At his first stop in the State for the inauguration of the 700-metre length twin-flyover (also called King David’s University flyover), constructed at the cost of N2 billion by the State government, President Buhari said:

    ”I am not an Engineer by discipline but my eyes are very clear, even through my eyeglasses.

    ”I am impressed with this performance and I know the projects will last. I congratulate the Governor on this feat and I am pleased to be associated with it.”

    While in Uburu, Ohaozara Local Government Area of the State, the president also inaugurated the Cancer Centre at the King David University of Medical Sciences, built and equipped by the Federal Government under TETFUND.

    Umahi, who thanked the president for approving the funding of the Centre, said the facility could rank with other centres around the world.

    ”It is in the same standard as Lagos University Teaching Hospital (LUTH) and the State government also contributed to the project to bring it to completion,” he said.

    At the inauguration of the hospital section of the university, the governor thanked the president for acceding to the request of the State government on the Federal Government to take over the running of the teaching hospital.

    ”This hospital is beyond the scope of any State government to run and we have been celebrating your approval of our request and are very proud that you are here to commission it yourself.

    ”You have left a lot of indelible marks in the development of this centre of excellence and it will never be forgotten,” he said.

    At the inauguration of the Presidential Lodge at the Muhammadu Buhari International Airport, Onueke, the governor announced that the tarmac and runway of the airport, built with concrete, had attained over 70 per cent completion, and would be ready by the end of next month.

    The president also inaugurated the five kilometres dualised airport road in Onueke, built by the State government as well as the reconstructed St Margaret Umahi International Market complex and a 750-metre length twin-flyover near the market.

    The Muhammadu Buhari Presidential Lodge, Abakaliki, was also inaugurated by the president on Thursday.

    Police confirm death of gang raped lady in Ebonyi

    The Police Command in Ebonyi State, has vowed to arrest and prosecute killers of a 26-year-old lady, Miss Ugochukwu Nworie.

    The Police Public Relations Officer, DSP Loveth Odah, on behalf of the Commissioner of Police, Aliyu Garba, disclosed this on Wednesday in Abakaliki.

    Odah revealed that efforts were on top gear to arrest and prosecute the perpetrators accordingly to serve as a deterrent to possible offenders.

    She stated that investigation confirmed that the Lady was gang raped, as more than 12 used condoms was discovered in the room.

    She added that investigation is still ongoing and would provide other information needed.

    The police Spokesperson said the Divisional Police Officer (DPO) of Kpirikpiri Police Division in the state, indicated that the incident happened in Hope-in hotel, situated at Nine Ngbowo street, Abakaliki.

    “The DPO reported that the incident happened while on a routine check on the hotel. A room not accounted for was discovered.

    “So the DPO decided to enquire from the receptionist, who told him that the guests in the room were unknown to him.

    “Efforts to open the room proved abortive, until he requested for the spare key to open the door, only to discover a lifeless body of the lady, naked and her legs, hands with mouth were tied to the bed in the room,” Odah said.

    She said the corpse has been deposited at a morgue.

    She described the incident as unfortunate and an offence against humanity.

    Odah warned the general public, especially young ladies, to be careful.

    2023: INEC trains staff on election management in Ebonyi

    The Independent National Electoral Commission (INEC) has embarked on a two-day skills development training aimed at boosting capacity of 60 members of staff of the commission in Ebony

    The training was aimed at enhancing service delivery by members of staff of the commission ahead of the 2023 general elections.

    Dr Joseph Chukwuemeka, INEC’s Resident Electoral Commissioner (REC) in Ebonyi while declaring the workshop open on Tuesday in Abakaliki, said the exercise was part of conscious efforts by the commission to enhance the operational efficiency of members of its staff.

    According to him, the training will equip the officers with new skills and knowledge to cope with the new technologies in use by the commission for the conduct of modern elections.

    He further noted that the skills development training would also enhance communication abilities and staff approach to work-related engagements.

    He said: ‘Administratively, our staff should be competent in the management of men and materials as electoral umpires.

    “Movement of files, communications amongst one another will be highly enhanced if the necessary capacity is built and people learn every day as they grow in an organisation.

    “Failure to learn will keep a worker redundant, unproductive and unuseful in the organisation; and to avoid redundancy you need constant training and retraining to remain relevant in the job.

    “Today, we have moved into a technologically-driven election in the history of Nigeria, though, not that our elections have not been technologically-driven but, there is an advance in our application of technology in the electoral process.

    “So, when we got a letter from the Industrial Training Fund (ITF), Abakaliki office for the training to inculcate in us performance in communication strategies, human relations management and in skills development, I considered it eminently necessary.

    “I did because the training will help the staff manage materials and men involved in the entire electoral process.”

    The REC noted that capacity building training would enable participants add more value to themselves.

    Chukwuemeka charged participants to pay rapt attention to the teachings and every other activity incorporated in the training.

    He said the state and Nigerians were looking up to the commission to conduct transparent, credible, free and fair elections in 2023, adding that the commission would not disappoint the people.

    Earlier, Mr Amadi Onyekwere, INEC training officer in Ebonyi said that the two-day workshop was designed to train Electoral Officers (EOs), Assistant Electoral Officers (AEOs), Heads of Units and other relevant staff.

    He said that more than 60 officials of the commission were taking part in the exercise slated to hold on April 26 and 27 at the commission’s state headquarters in Ebonyi.

    “This training intends to improve professionalism among staff and build their capacity.

    “The training content has been designed to help the staff of the commission improve in the activities we all carry out,” Onyekwere said.

    Gov. David Umahi of Ebonyi has endorsed the Speaker of the state House of Assembly, Chief Francis Nwifuru as his successor.

    The endorsement was contained in a statement signed by the Special Assistant to the Governor on Media and Publicity, Francis Nwaze and made available to newsmen on Saturday.

    Umahi according to the statement, made the endorsement during the burial of the father to the state Commissioner for Trade and Investment, Mrs Chioma Nweze at Okposi, Ohaozara Local Government Area of the state.

    “The governor assured that the speaker will consolidate on the divine mandate leadership in the state.

    “He appealed to the people of Ebonyi south senatorial zone and all Ebonyi people to support the candidacy of the speaker for the sake of equity, justice, and fairness,” the statement read.

    The statement indicated that the governor presented the speaker to Okposi people reminding them that the those of Ebonyi north zone offered their support when the southern zone sought such to produce the governor in 2015.

    “The governor implored that it was time to pay back
    and promised that the divine mandate platform upon which the government came into office will continue.

    “He urged the people not to fear as there was no one annointed by God that is not criticised by people.

    “2023 elections will be based on ticking the ballot boxes and not about promises.

    “It is a fact that my performance in office and that of others would be used by the APC for campaigns.

    “The next president of the country should come from the south for equity, justice, and fairness.

    “The All Progressives Congress (APC) and the Peoples Democratic Party (PDP) should offer explanations to the people if they fail to allot the position to the south east zone,” the statement read.

    The statement also indicated that the governor reacted to the recent outbursts of Gov. Nyesom Wike of Rivers on him and challenged the latter to a debate.

    “We both want to be president so the debate will enable people assess the deployment of our intellectual properties,” the statement read.

    APC governorship aspirant promises to reverse Ebonyi poverty index

    Chief Elias Mbam, an All Progressives Congress (APC) Ebonyi governorship aspirant on Thursday says he has developed a blueprint to reverse the poverty index of the state.

    Mbam, also Chairman of the Revenue Mobilisation Allocation and Fiscal Commission told newsmen in Abakaliki that he would reverse the index if elected governor in 2023.
    He said that the 2019 National Bureau of Statistics (NBC) poverty index indicated that Ebonyi scored 87.02 per cent with poor citizens revealed a startling reality of the state’s poverty level.

    “Our state is put below Jigawa; Taraba and Sokoto states, as the states with the highest level of poverty per head in Nigeria and the only state in southern Nigeria with the highest number of poor citizens.
    “I’ll reverse this trend if I become governor in 2023,” Mbam said.

    The one time Minister of State for Finance said that he has developed an economic blueprint that set out step by step approach towards reversing the ugly narrative and promised to drastically reduce poverty in two years as Ebonyi governor.

    He said that he would leverage on his vast knowledge in micro-economics and skills in revenue diversification having served for nearly 10 years as the chairman of RMAFC to turn around the economy of the state.
    “As chairman of RMFAC, I instituted diverse and radical campaign on revenue diversification, leading Nigeria and many states into the non-oil sector, especially mining and agriculture to reduce the over dependence in oil.
    “This has helped boost government revenues at the time of inflation orchestrated by the global COVID-19 pandemic and insecurity.

    “This knowledge will be best deployed into ensuring that Ebonyi’s revenue regime is critically evaluated by enhancing and exploring other revenue sources without dependence on federal allocation, over taxation of citizens and small businesses,” he said.

    The aspirant said that conscious effort and plans would be made to explore other critical sectors of the economy to boost revenue generation.

    He said that challenges militating effective public water supply in Abakaliki and other cities in the state would be addressed to enhance revenue generation.
    “We will leverage modern waste management system, industralisation and improved mechanised agriculture to boost the state’s economy and its revenue while reducing taxation from local markets, petty businesses and commerce,” he said.

    He assured that he would lean on his knowledge of resource distribution to ensure that resources generated locally; nationally from foreign investments and grants would be efficiently distributed to target priority areas and interventions.

    “Diversification and resource distribution will reduce poverty in Ebonyi, make households happy and economically buoyant as well as increase the amount of money in pockets of citizens.
    “Our initiative when implemented will drastically reduce rural-urban migration with its attendant migration of teeming youths to hawk in other cities in Nigeria.

    “We will prioritise basic education to increase enrollment; revitalise our teacher training colleges to build capacity of our teachers and reintroduce local and overseas scholarships to build capacities,” he said.
    On the ongoing Continuous Voters Registration which has entered the fourth quarter, Mbam charged Ebonyi indigenes who have attained 18 years and above and were yet to register to go and get registered.

    He advised those who were yet to collect their Permanent Voter Cards (PVCs)to get them to be able to exercise their civic franchise.
    “According to report released by the electoral body recently, as at March 15, about 127,424 PVCs were still unclaimed in Ebonyi.

    “The voter card is our only power to effect the change we all desire in political leadership, so, I enjoin our people to arm themselves with their voter’s card,” he said.

    Sustain synergy for economic enhancement – Yemi Osinbajo

    Vice-President Yemi Osinbajo on Friday in Abakaliki urged the three tiers of government to sustain the existing synergy between them to enhance national economy.

    He gave the charge while closing the 21st edition of the Joint Planning Board and the National Council on Development Planning meeting which began on April 6.

    The vice-president said that such synergy would assist in surmounting challenges hindering economic enhancement.

    “These challenges include corruption, recovery from the onslaught of the COVID-19 pandemic and the economic effects of the invasion of Ukraine by Russia.

    “The invasion has led to price and supply shocks in the food and fuel markets and we should collectively brace for its inevitable economic challenges,’’ he said.

    The vice-president commended the National Council on Development Planning for sustaining the meeting, noting that it remained an important platform to set the tone for the nation’s economic recovery.

    “President Muhammadu Buhari strongly believes that national councils such as this play an important role in boosting economic and related cooperation between states.

    “This ensures better coordination of economic policies to ensure poverty reduction and sustainable economic development,’’ he stressed.

    Osinbajo commended the Ebonyi government for ensuring the successful organisation of the event and its infrastructural strides which had enhanced its people’s wellbeing.

    In his remarks, Ebonyi’s Gov. David Umahi thanked the vice-president for the visit and the National Council on Development Planning for choosing Ebonyi to host the meeting.

    “I specifically commend the vice-president for his commitment and loyalty to President Muhammadu Buhari and their doggedness in confronting the nation’s daily challenges.

    “The challenges facing the country are not peculiar but global with the country only having its fair share of such challenges.

    “I believe strongly that with God, patriotism and commitment, the efforts of both leaders would see us through the challenges,’’ Gov. Umahi said.

    The governor advised Nigerians that the call for states and local government councils to control Value Added Tax was an invitation to anarchy as it should be left for the Federal Government to control.

    Also addressing the close of the meeting, Minister of Finance, Budget and National Planning, Mrs Zainab Ahmed, noted that recommendations from the meeting would enhance development planning.
