    Court remands seven suspects with links to Edo Assembly invasion

    Edo State High Court has remanded in police custody, the seven suspects arrested over the August 6 invasion of Edo House of Assembly, pending the determination of the case on September 3.

    The seven suspects who appeared the Court presided over by Justice Efe Ikponmwonba are being prosecuted for illegal possession of firearms and disturbance of public peace.

    The suspects are Festus Agbonrenren (25), Odion Osayande (23), Ogbeiwe Wilfred (52), Morgan Uwaigboe (47), Osayomore Salami (25), Ifeoluwa Oladele (36) and Iginobaro Collins (26).

    They were arrested within the premises of Edo House of Assembly complex with five double-barrel long guns, two single barrel long guns and 10 live cartridges.

    Police sources indicated that the seven suspects confessed to being mobilised to Edo House of Assembly by Governor Godwin Obaseki’s aides: Kabiru Adjoto and Osaigbovo Iyoha, in order to deny entry to the Assembly complex to 17 All Progressives Congress’ (APC’s) elected lawmakers, who are opposed to Obaseki of the People’s Democratic Party (PDP).

    The seven suspects allegedly provided cover for other thugs who removed the roof of the Edo House of Assembly complex, vandalised its chambers and tipped heaps of sand and granite at its entrance, in violent chaos that was supervised by Obaseki and his deputy/running mate, Philip Shaibu.

    The Speaker, Edo Assembly, Francis Okiye, says the 14 members-elect not yet inaugurated, no longer have seats to occupy in the assembly, following the declaration of their seats as vacant.

    Okiye who made the assertion during the assembly’s Tuesday plenary in Benin, called on the public to disregard the 14 elected lawmakers whom he said were “parading themselves as members of the Edo assembly.”

    According to him, the affected members-elect have lost their status and rights, following their refusal to be inaugurated.

    The speaker said that their purported inauguration in private residence was illegal.

    He named the members as Victor Edoror (Esan Central Constituency), Washington Osifo (Uhumwode), Vincent Uwadiae (Ovia North East), Kingsley Ugabi (Etsako East) and Michael Ohio-Ezomo (Owan West).

    Others were Sunday Aghedo (Ovia South West), Chris Okaeben (Oredo West), Crosby Eribo (Egor), Aliyu Oshiomhole (Etsako West 11) and Oshomah Ahmed (Etsako Central).

    Also listed were Ganiyu Audu (Etsako West 1), Ugiagbe Dumez (Ovia North East 1) Uyi Ekhosuehi (Oredo East) and Eric Okaka (Owan East).

    He said: “The Governor, following the provisions of the Constitution of the Federal Republic of Nigeria, issued a proclamation for the first session of the assembly on June 14, 2019.

    “The Clerk of the House issued a notice to all members-elect to attend the first session on June 17, 2019 and the house was duly convened and inaugurated.

    “But the above-mentioned members refused to present their certificates of return and also refused to present themselves at any sitting of the house to subscribe to the oath of office as members.”

    The speaker further said that after several sittings by the house since June 17, 2019, Uyi Ekhosuehi (Oredo East ) and Eric Okaka (Owan East) deliberately stayed away from the sittings of the ssembly.

    He said that the said members-elect, instead of presenting themselves to subscribe to the oath of office, filed a suit at the Edo High Court, challenging the inauguration of the house.

    Okiye added: “Some members of this house approached the Federal High Court in Port Harcourt to stop the unconstitutional threat of the National Assembly to take over the house.

    “The court restrained the governor from issuing another proclamation and ruled that the house was constitutionally constituted to carry out its duties.

    “Following the continued absence of the members-elect, their seats were declared vacant on December 4, 2019.

    “The members-elect again approached the Federal High sittings in Abuja, challenging the resolution of the house declaring their seats vacant.

    “It is therefore shocking to hear that they converged in a private residenc and purportedly inaugurated themselves as members of the Edo House of assembly.”

    The Peoples Democratic Party (PDP) caucus in the House of Representatives has frowned at the roles allegedly played by the police in the crisis rocking the Edo State House of Assembly.

    The caucus in a statement by its leader, Kingsley Chinda, on Sunday, wondered why the police would allegedly escort some members -elect of the Edo Assembly to meet in an undisclosed location, where they purportedly impeached the speaker, Frank Okiye

    The caucus noted that the attempt to impeach Okiye “through the back door”, as a desecration of the institution of the legislature and as affront on the people of the state.

    According to the opposition lawmakers, “the men who were accompanied by the policemen are believed to be members elect whose seats were declared vacant and the action is still a subject of ligation.

    “By the provisions of Section 52 and 53 of the Constitution, a member-elect must first be sworn in by the Speaker at a properly convened seating of the House and only the presiding officer is vested with the powers to convene the House.”

    The caucus added that “without going into the merit of the matter in litigation, we simply state that no proper seating of any Assembly can be convened, except by the Presiding Officer through the Clerk of the House.

    “Thus the purported seating of the Edo State House of Assembly under the protection and supervision of the Nigerian Police is an act of political desperation and a call to anarchy.

    “This action is very likely to push Nigeria to the pristine old days, whereby the military and anti democratic forces held sway, and lead to serious crisis that could cause the collapse of democracy in the country.”

    We will resist attempt to illegally take over Edo Assembly, says Obaseki

    Gov. Godwin Obaseki of Edo said on Thursday that the state would resist any attempt by anybody to forcefully take over the state House of Assembly.

    Addressing newsmen at the assembly complex in Benin, Obaseki said he would do everything within his constitutional powers to protect the sovereignty of the house and the state.

    The governor’s statement was not unconnected with media reports credited to the Speaker of the house, Francis Okiye.

    Okiye had alleged that Gov. Hope Uzodinmm of Imo and the impeached Deputy Speaker of the house, Yekini Idiaye, had planned to import a fake mace to violently take over control of the assembly.

    “Nigeria is governed by the constitution and President Muhammadu Buhari has always said we must follow the rules of law and do things according to the law.

    “For us as the executive, we will use the instrument available to us constitutionally to protect the house and the state,” Obaseki said.

    The governor, however, urged the house to go about its normal duties as a parliament as prescribed by the constitution.

    Also, the Deputy Governor, Philip Shaibu, said the state government would not allow other members of the assembly whose seat had been declared vacant to take over the house.

    According to him, the affected elected legislators have yet to be constitutionally inaugurated.

    He also called on the president to intervene in the alleged plot to destabilise the state assembly.

    Meanwhile, the entrance and exit gates of the assembly complex have been barricaded with sand and gravel, while some people have seen removing the roof of the building.

    The speaker said the house was currently under renovation and the presence of security operatives at the entrance of the complex, scared the contractor and workers away.

    “We are going to keep vigil here to forestall the alleged illegal invasion of the house by anybody,” Okiye said.

    Idiaye was impeached on Wednesday during a plenary session of the Assembly in Benin City, the Edo State capital.

    Idiaye’s Impeachment is coming a few days after after openly declaring his decision to back Pastor Osagie Ize-Iyamu, the All Progressives Congress (APC) governorship candidate in the September 19 gubernatorial election in the state.

    PDP rejects committee to reconcile 14 Edo Assembly members-elect

    The Peoples Democratic Party (PDP) in Edo has rejected the committee set up by Gov. Godwin Obaseki to reconcile members-elect in the state House of Assembly.

    Mr Chris Nehikhare, PDP’s Publicity Secretary in Edo, said in a statement in Benin on Friday that the reason for such committee was baseless.

    He said that the 14 persons to reconcile with could no longer be described as lawmakers-elect because their seats had long been declared vacant.

    Nehikhare said that by law, the seats which were declared vacant ought to be occupied by PDP members who came runners up in the election.

    “Their refusal to subscribe to the oath of membership and allegiance all through the first session and first quarter of the 7th Assembly was tantamount to abdication of office.

    “The governor should know that the seats are no longer available to them. Those 14 seats belong to PDP candidates who are also already in court,” he said.

    According to the PDP publicity secretary, it is wrong to describe people whose seats were declared vacant for failing to report for duty as lawmakers-elect.

    He further stated that the 14 concerned persons were already in court seeking to restrain the Independent National Electoral Commission from conducting by-elections into the seats.

    “As a party, the PDP has approached the court seeking to be joined as a defendant in that suit.

    “We did so believing that our rights may be affected,” he said.

    The Edo State Governor, Mr. Godwin Obaseki, has named the Chairman of Northern Governors’ Forum and Governor of Plateau State, Simon Lalong; Governor of Lagos State, Mr. Babajide Sanwo-Olu and Senator Ehigie Uzamere, to reconcile members-elect in the Edo State House of Assembly.

    In a statement, the governor said the constitution of the reconciliation committee is part of moves to restore harmony and peace in the state chapter of the All Progressives Congress (APC) and the state at large.

    The governor insisted that he is committed to peace and that a united front would make the party stronger, more cohesive and help to foster more development in the state.

    He added that the committee, which commences work with immediate effect, would reach out to all parties in the dispute and ensure that all grey areas are addressed to make for peaceful resolution of the matter.

    Crisis rocking the Edo State House of Assembly took another twist on Wednesday as Speaker Francis Okiye declared 14 seats vacant.

    The 14 seats declared vacant are those of the 12 members-elect that are yet to present themselves for inauguration and two lawmakers that allegedly absconded after being inaugurated.

    Those whose seats were declared vacant were Chris Okaeben (Oredo West), Crosby Eribo (Egor) Washington Osifo (Uhunmwode) Ugiagbe Dumez (Ovia North East 1) Vincent Uwadiae ( Ovia North East 11) Sunday Aghedo (Ovia South West) Victor Edoror (Esan Central) Emmanuel Agbaje (Akoko-Edo 11) Eric Okaka (Owan East) Micheal Ohio-Ezo (Owan West) Oshoma Ahmed (Estako Central) Kingsley Ugabi (Estako East) and Ehi Ekhosuehi (Oredo West).

    Okaka and Ekhosuehi were the two lawmakers whose seats were declared vacant for not meeting mandatory sitting requirement to continue as members of the House.

    The 12 members-elect and the two other lawmakers have been in Abuja since June and they have been demanding for a fresh proclamation to be issued and a proposed inauguration conducted.

    Making the announcement during an emergency plenary session Wednesday, Speaker Okiye urged the Independent National Electoral Commission to conduct bye-elections for the affected constituencies within 90 days.

    Deputy Speaker of the House, Hon. Yekini Idiaye, representing Akoko Edo State Constituency I, who spoke to newsmen, explained that two of those affected from Oredo East and Owan East, were sworn-in but failed to meet the mandatory 181-day sitting requirement for a member in a calendar year.

    He said, “For others, who hadn’t been inaugurated since the proclamation of House, their constituents have been complaining and have come to us that they want their voices and concerns to be heard at the House.

    “So, people who are willing to provide quality representation have to be elected to bring the matters of the distraught constituents to the floor for debate and legislation, where necessary.”

    Reacting to the declaration of seats vacant, Okaeben said Okiye has no powers to make such pronouncement or asked INEC to conduct bye-elections.

    Okaeben stated that Edo, currently, has no House of Assembly as spelt out by the Nigeria Constitution.

    He said the House did not also form a quorum.

    His words, “They want us to toe the path of violence but we have said nobody’s blood is worth a seat in the Assembly. We will pursue our case in a constitutional way. We have no problem with Governor Obaseki since he said he has issued a proclamation.

    “The Clerk did not invite us to any inauguration. A proper inauguration is what we will attend. Okiye has said nothing today.”

    On what they would do if INEC decided to conduct bye-elections, Okaeben said Prof. Mahmoud is not a dull person not to know the truth.

    A former Speaker of the Edo Assembly, Hon Victor Edoror, said his constituents are happy with his decision to stay away from what he termed illegal Assembly.

    Edoror said, “Okiye is not a Speaker. He is a member-elect like us. The Constitution is clear on how many members should be in an Assembly.

    “Okiye has no powers to declare our seats vacant. All what is happening in the Edo Assembly are illegal and they will be swept out. My people are happy with me.”

    The leadership of the National Assembly and the Edo State Government are seriously battling over the crisis rocking the Edo State House of Assembly, it emerged on Monday.

    Speaker of the House of Representatives, Femi Gbajabiamila, has vowed that the leadership of the National Assembly would challenge a Federal High Court ruling that restrained it from taking over the legislative functions of the Edo State House of Assembly

    Gbajabiamila gave this indication in his remarks during a visit by the Progressive Governors’ Forum to the leadership of the National Assembly in Abuja.

    Also, the Governor of Katsina State and the Chairman of the Progressive Governors’ Forum’s subcommittee on Legislative Matters, Aminu Bello Masari, lamented that absence of coordination has brought distrust in the APC and it’s capable of destroying the party.

    Before the meeting went into a closed door session, Gbajabiamila said that the leadership of the National Assembly was surprised that it could resolve the crisis in the Bauchi State House of Assembly “which is an opposition state” but could not resolve that of Edo which an APC state.

    He said it was surprising that the Edo State House of Assembly has decided to “test an exclusive constitutional role of the National Assembly in court.”

    It could be recalled that both chambers of the National Assembly had in June resolved to take over the legislative duties of the Edo State House of Assembly following the crisis that emanated when nine lawmakers loyal to Governor Godwin Obaseki were secretly inaugurated by the Governor on June 17, while others were left out.

    A Federal High Court in Port Harcourt had restrained the National Assembly from interfering in the affairs of the Edo State House of Assembly.

    Justice Kolawole Omotosho had also ruled that the National Assembly could not compel Governor Obaseki to issue another proclamation within the lifespan of an existing proclamation for inauguration of Edo House of Assembly.

    The court gave the order when it delivered judgement in a suit brought by Yekini Idiaye, the Deputy Speaker of the Edo State House of Assembly, and Henry Okhuarobo, the member representing Ikpoba-Okha State Constituency.

    Omotosho had said: “There is nothing before the court to show that the Edo State House of Assembly is unable to sit.

    “Some elected members have been inaugurated. The House has been carrying out its legislative duties.

    “The National Assembly lacks the power to take over the Edo State House of Assembly.

    “It amounts to taking over the functions of the Edo State House of Assembly.

    “The House of Assembly is not an appendage of the National Assembly.”

    Reacting to the ruling, Gbajabiamila said: “While addressing the issue of one party and one government, I and my big brother the Senate President will want to draw our attention to the issue of the crisis in Bauchi and Edo states.

    “Whilst we were able to successfully resolve the issue in Bauchi State, which is an opposition state, unfortunately, we are unable to resolve that of Edo State.

    “I think this is what we have to look at and prioritise. We should consider how to constitutionally address the issue.

    “For those of us on this side, the National Assembly, we are surprised that the exclusive constitutional roles given to us as prescribed in Section 12 of the Constitution, which is written unambiguously clear was being tested.

    “We are a bit concerned about that. Of course we have three arms of government and on the basis of that, we will be going to court on this matter to resolve not just the judgement but to ensure that any other related issues like that do not come up again.

    “The House of Representatives have adopted a theme, “The nation building is a joint task”, that is how we are operating in the National Assembly irrespective of our political party divides.

    “We have resolved to come together when it comes to national issues. We believe that since there is one government, there should be a symbiotic relationship between the governors and the legislators,” he said.

    It was learnt that after this outburst by Gbajabiamila in the presence of Obaseki, the President of the Senate, Ahmad Lawan, spent a substantial part of the closed door session in calming frayed nerves.

    The Progressive Governors’ Forum was led to the meeting by its Chairman and Governor of Kebbi State, Atiku Abubakar Bagudu.

    The Governors of the All Progressives Congress (APC) at the meeting include Governor Aminu Bello Masari (Katsina), Chairman of the Nigeria Governor’s Forum and Governor of Ekiti State, Dr. Kayode Fayemi, Mallam Nasir Elrufai (Kaduna), and Babagana Zulum (Borno).

    Others include Mohammed Yahaya (Gombe), Abdullahi Ganduje (Kano), Sani Bello (Niger), Mai Mala Buni (Yobe), Abdulrahaman Abdulrazak (Kwara) and Godwin Obaseki (Edo). The Deputy Governor of Nasarawa State, Dr. Emmanuel Akabe, represented the Governor.

    Also Monday, the Governor of Katsina State and Chairman of the Progressive Governors’ Forum’s subcommittee on Legislative Matters, Aminu Bello Masari, lamented that the absence of coordination has brought distrust in the APC, capable of destroying the party.

    He urged the leaders of the APC to make “amends” in the management of political relations.

    Masari said: “The Progressive Governors’ Forum has a standing subcommittee on Legislative Matters that started in the last Assembly. But unfortunately, no success came out for obvious reasons.

    “So we thought that we should contact you early enough so that we put machinery in motion in making sure that this time around, we are on the same page – the Progressive Governors’ Forum and the National Assembly.

    “In doing so we want to use this opportunity to address some fundamental issues that does not only affect the APC alone as a political party but the whole nation.

    “We can recall that President Muhammadu Buhari recently reminded us of our responsibilities in providing leadership to ensure that all of us as elected representatives which is a collective body that should prioritize building strong relationships between all elected representatives both in the executive and legislative arms of government, as well as our party leaders.

    “The absence of coordination has produced crisis of trust which if care is not taken can destroy our party and the political process.

    “So as leaders, we need to make amends especially in the area of management of political relations among all the party stakeholders.

    “We need not remind ourselves of what happened between 2015 and 2019 when we unfortunately allowed avoidable circumstances to give new life to our political opponents, especially parties in opposition to APC, like PDP.

    “We have not managed our personal aspiration to contest elections through the inability of our party leadership to painstakingly ensure broad consultations leading to collective decision that were recorded on most of these avoidable circumstances.

    “We know what happened in the build up to 2019, the crisis we have in so many states within our own political party.

    “I am referring to those crisis that could have been avoided, recognizing that conflicting demands from all stakeholders would not be easy to manage.

    “Compliance with the provisions of our party constitution and the relevant laws of Nigeria…..”

    Masari could however not continue with his speech as he was interrupted by the master of ceremony who announced that the rest of the speech would be given during during the closed door session.

    In his part, Bagudu said the meeting the federal lawmakers was to enable the Governors partake and support executive legislation and delivery of the constitutional amendment promised Nigerians.

    Bagudu said: “We continue with the engagement with legislators, so that we can participate and support more executive legislation, delivery of constitutional amendments and other legislative agenda that Nigerians have been promised.”

    On his part, President of the Senate, Ahmad Lawan, described the meeting as a special moment for the National Assembly.

    Lawan said: “This is a special moment for us. This is the first meeting between the leadership of the National Assembly of the APC stock and the Progressive Governors.

    “It is a fact and a truism that our party, particularly our Governors, did so well, they work so hard and assiduously to ensure that the leadership of the National Assembly emerged with little or no hitch in the 2019 leadership contest. We thank you for that show of trust.

    “We believe that you have done your part by giving us all the support that we needed. The ball is now in our court to take this leadership in trust and we intend to remain resolute, we intend to remain very loyal to the party and the principles that we stand for.

    “We intend to remain committed and dedicated to the Nigerian ideals of making sure that the country provides all the necessary services to citizens especially when it comes to the area of ensuring security, safety and welfare of citizens.

    “When we emerged without any doubt, we were very bipartisan in the way and manner our election took place. The APC provided the platform.

    “Almost all the APC members voted along the line that this time around the party produces the leadership without any adulteration so to speak.

    “The opposition parties in the Senate especially the PDP and the YPP have done so much to ensure that they gave us that type of support. I want to take this opportunity to be extremely practical.

    “We have been working in a very bipartisan manner and all those things that we felt are very necessary to achieve in the national interest we have done so across party lines.

    “I believe that this kind of partnership will continue. It is necessary that all the levels of Government work together.

    “We have certain issues that we cannot do alone at the National Assembly when we have up to 14million children out of school in the streets.

    “We cannot do it alone. This is something the States and the Federal Government would have to work together and partner with the National Assembly we believe that we can do more working together.

    “We are here representing the States. All of us belong to States. We don’t belong to just the Federal. There is need for us to have this type of interaction more often.”

    The Peoples Democratic Party (PDP) says the order by the House of Representatives asking the Police and the Department of State Services (DSS) to shut down the Edo State House of Assembly is unconstitutional.
    The party in a statement issued by its National Publicity Secretary, Kola Ologbondiyan on Thursday in Abuja also described the order as provocative, saying it has no place in a democratic dispensation.
    Ologbondiyan cautioned the leadership of House of Representatives to desist from actions that violate the provisions of the 1999 Constitution (as amended) and could trigger a constitutional crisis in Edo and the nation at large.
    “The PDP states that no section of the 1999 Constitution confers the House of Representatives with the powers to issue orders to a state governor or direct the shutdown of a sitting State House of Assembly.
    “Whether in language or action, such is only obtainable in a military system.
    “The PDP hereby invites Nigerians to note that section 11 of the 1999 Constitution, upon which the House of Representatives anchored its decision, does not in any way empower the House of Representatives to shutdown a functioning state legislature.’’
    Ologbondiyan also cautioned the federal legislature to note that such imperial stance against a legislative house; a symbol of the sovereignty of the people was self-destruct.
    He added that it also opened the fundamentals of the nation’s democracy to unwarranted attacks.
    Ologbondiyan said that was particularly as there were already apprehensions across the country that the shutdown order was a prelude to an autocratic.
    “The PDP, therefore, counsels against any arm of government overreaching itself to take actions that undermine our constitution.
    “It encourages dictatorial tendencies against our institutions of democracy and the essentials of personal freedom and rights of citizens in our nation,’’ he said.
    He also expressed concern that the All Progressives Congress (APC) leadership for its inability to manage its “avarice and internal strife” playing out in Edo.
