    Osinbajo should release El-Zakzaky, he needs medical attention like Buhari – Shi’ites

     

    Following the continuous detention and alleged failing health of the leader and founder of the Islamic Movement of Nigeria, widely known as Shi’ite , Sheikh Ibrahim El-Zakzaky and his wife, Malama Zeenat, the Sokoto State leader of the group, Malam Kasim Umar, has called on the federal government to immediately release the incarcerated leader.

    He stated that just like President Muhammad Buhari, who urgently left the country to take care of his health, Zakzaky too was in desperate need of medical attention.

    It is confirmed that Malam’s health is deteriorating by the day,” he told newsmen on Saturday.

    He has lost one eye already and even the second eye is being affected. If left unattended to, he can lose it as well.

    The gunshot injury he sustained on one of his legs during the military clamp down in 2015 is still there.

    I am therefore appealing to the acting President who is a pastor and a renowned lawyer to release Malam as ordered by the Court for him to be properly checked and treated’’, he said.

    On purported plan by the federal government to release Zakzaky to the Kaduna State Government for prosecution, Umar expressed Shi’ites’ fears.

    He stated that their leader would not be given fair trial, with Kaduna government planning to charge Zakzaky based on alleged offences committed over 30 years ago.

    Umar appealed to other nations of the world, local and international human right groups to pressurize the federal government to obey existing court order and release the IMN leader.

    TheNewsGuru.com reports that an Abuja Federal High Court had on January 30 directed the Inspector General of Police, IGP Ibrahim Idris, the Attorney General of the Federation, AGF, and Minister of Justice, Abubakar Malami, SAN, and the Director of the Department of State Services, DSS, Lawal Daura to release El-Zakzaky and his wife, Malama Zeenat or risk going to jail.

    Human rights lawyer, Chief Femi Falana (SAN), has filed a notice of contempt of proceedings against the Inspector General of Police (IGP), the Attorney General of the Federation and Minister of Justice and the Director, Department of State Services, DSS over their refusal to effect the release of the leader of the Islamic Movement in Nigeria (IMN), Ibrahim El-Zakzaky and his wife, Malama Zeenah Ibraheem despite previous court pronouncements.

    The ‘Notice of Consequences of Disobedience of Court Order’ Form 48 was served on January 20.

    It reads: “that unless you obey the direction contained in the order of the Federal High Court of Justice Abuja, delivered on the 2nd December, 2016, which ordered you to release the Applicants in Suit No. FHC/ABJ/CS/281/2016 and its sister case Suit No. FHC/ABJ/CS/282/2016 within forty (40) days, inter alia you will be guilty of contempt of court and will be liable to be committed to prison.”

    No date has been fixed for hearing.

    TheNewsGuru.com recalls that Justice Gabriel Kolawole had on December 2, 2016 awarded a cumulative sum of N50 million to the Zakzakys and ordered the AGF and IGP to provide him a new accommodation and security in any part of Kaduna or Northern region that they prefer within 45 days.


    El-Zakzaky and his wife Malama Zeenah Ibraheem have been locked up without charge for more than a year following a clash between his supporters and the Nigerian military in which hundreds of men, women and children were killed.

    Following the continued detention of the leader of the Shi’ite movement, Ibraheem Zakzaky and his wife, Malama Zeenat despite previous court ruling to release them, an Abuja Federal High Court has directed the Inspector General of Police, IGP Ibrahim Idris, the Attorney General of the Federation, AGF, and Minister of Justice, Abubakar Malami, SAN, and the Director of the Department of State Services, DSS, Lawal Daura to obey its order or go to jail.

    TheNewsGuru.com recalls that El-Zakzaky has been in detention since December 2015, after members of the Islamic Movement of Nigeria, IMN, also known as Shi’ite clashed with the Army in Zaria, Kaduna State.

    TheNewsGuru.com also recalls that the court had In December 2016 ordered the DSS to free El-Zakzaky and his wife but the Shi’ite leader has continued to languish in custody.

    The court also ordered a compensation which was to be paid within 40 days from the day the judgment was delivered.

    However, in a notice of consequence of disobedience to court order, the Federal High court warned the listed officials to release El-Zakzaky or face contempt of court charges which is liable to jail term.

    The notice sent to the trio, reads in part: “Take notice that unless you obey the direction contained in the order of the Federal High Court of Justice Abuja, delivered on the 2nd December, 2016, which ordered you to release the Applicants in Suit No. FHC/ABJ/CS/281/2016 and its sister case Suit No. FHC/ABJ/CS/282/2016 within forty (40) days, inter alia you will be guilty of contempt of court and will be liable to be committed to prison.”

    Frowning at the refusal to release the Shi’ite leader, the court said, “you are yet to comply with the lawful order of this honourable court by refusing to release the following persons namely: Sheikh Ibraheem Zakzaky and Malama Zeenat Ibrahim, in your custody. You are hereby directed to comply with the court order forthwith or you will be guilty of contempt of court.”

    Members of the Islamic Movement in Nigeria (IMN) also known as Shiites, have told the Federal Government to release their leader, Sheikh Ibraheem El-Zakzaky immediately, so he can get medical attention abroad.

    This comes after a Federal High Court, ordered the government to release the cleric.

    The court said Zakzaky should be released within 45 days and further awarded N50million to him and his wife.

    A statement by their spokesman, Mallam Ibrahim Musa, said: “We are calling on the authorities holding Sheikh El-Zakzaky and his wife that they must expedite action to allow them access to their doctors, lawyers and any other person they so wish to see without hindrance.

    They must also be allowed to go wherever they so wish as free people so that they can attend to their medical needs now that the court has set them free.”

    Commending the court’s judgment, he stated: “The judge showed a full grasp of all the issues at stake when he said he views the whole matter as religious intolerance, where a majority Sunnah is oppressing a minority Shi’ah.

    This case pertained to the issues of liberty, freedom and human rights of Sheikh Zakzaky and his wife. The landmark judgment obtained will however certainly impact on the numerous others presently ongoing as well as all other matters yet to be clarified such as the crime of mass grave that government officials disclosed earlier.”

    He added: “It remains to be seen how the Nigerian government is going to react to this judgment. We are not unmindful of the penchant of this government to disregard court orders on spurious excuses. We will continue our peaceful and patient campaign until justice is done in its entirety.”

    BREAKING: Court orders Shiites leader El-Zakzaky’s release

    A Federal High Court in Abuja has ordered the Department of State Services to release the leader of the outlawed Islamic Movement in Nigeria, Sheikh Ibrahim El-Zakzaky, within 45 days.

    In his judgment, Justice Gabriel Kolawole, ordered the Federal Government to provide an accommodation for El-Zakzaky, his wife and family members within Kaduna State or any part of the northern region.

    Recall that some members on of the sect had on Thursday barricaded ‎the National Assembly’s entrance protesting the continued detention of their leader, Sheik Ibrahim El-Zakzaky.

    The court declared the continuous detention of El-Zakzaky since December 14, 2015 as unlawful and illegal since the issue of protective custody was unknown to law or the National Security Agencies Act establishing the DSS.

    The court further awarded the cost of 25 million Naira as general damages to be paid to Ibrahim El-Zakzaky who must be released unconditionally to the Inspector General of Police (IGP) within 45 days.

    The IGP is also ordered to convey El-Zakzaky and his wife to the accommodation provided by the government.

    The court also awarded 25m damages to Mrs Zakzaky, making a cumulative of 50 million Naira as general damages.
