    BREAKING: Again Court admits Emefiele to N300m bail

    An FCT High Court on Wednesday admitted the suspended Central Bank of Nigeria (CBN) Godwin  Emefiele to bail in the sum of N300 million.

    Justice Hamza Muazu also ordered Emefiele to produce two sureties in like sum.

    Muazu ordered that the sureties must have certificates of occupancy and titles of properties within the Maitama District.

    Emefiele is mandated to deposit all his travel documents with the registrar of the court and must remain within the Abuja Municipal Council.

    He is expected to remain in Kuje Correctional Centre pending when he meets the bail conditions.

    This comes four months after the Federal High Court Sitting in Lagos admitted Emefiele to bail in the sum of N20 million.

    BREAKING: Court remands ex-CBN gov, Emefiele in Kuje prison

    An Abuja High Court on Friday ordered that the former Central Bank Governor, Godwin Emefiele be remanded in Kuje correctional centre until Nov 22.

    Justice Hamza Muazu gave the order and adjourned until Nov. 22 when Emefiele’s bail application will be heard.

    Emefiele was arraigned on six count charges before Justice Muazu.

    His lead counsel, Mathew Burkaa SAN, moved the application for bail which Rotimi Oyedepo vehemently opposed on behalf of the Federal Government.

    After taking arguments for and against the application, Justice Muazu said a bench ruling could not be delivered in view of the plethora of authorities cited by the two parties.

    The Judge said he needed a little time to study the authorities and peruse through the exhibits supplied by Emefiele to support his request for bail.

    The Federal Capital Territory High Court on Wednesday admitted the embattled former Central Bank Governor, Godwin Emefiele, to bail.

    The court ordered that he should be released to his counsel and must be produced in court when needed.

    The presiding judge, Justice Adeniyi, also ordered him to deposit all his travel documents with the court’s registrar

    JUST IN: Shortly after DSS frees Emefiele, EFCC detains him

    The embattled former Governor of the Central Bank of Nigeria (CBN), Godwin Emefiel is currently being detained in the custody of the Economic and Financial Crimes Commission (EFCC)

    He was reportedly released yesterday and subsequently picked up by the EFCC.

    According to PUNCH, the anti-graft agency is probing Emefiele over alleged impropriety during his term as the head of the apex bank.

    “Yes, Emefiele is currently in our (EFCC) custody; he was arrested last night less than an hour after the DSS freed him. He’s currently being interrogated at the headquarters, as he’s being investigated for alleged misappropriation of funds amongst other things during his term as CBN governor,” a source said.

    Justice minister, Fagbemi distances FG from Emefiele’s N50bn plea bargain

    Justice Minister Lateef Fagbemi has distanced the Federal Government from the N50 billion planned non prosecution plea bargain with the embattled former Central Bank of Nigeria governor Godwin Emefiele.

    This is contained in a statement signed by the Director of Information in the Federal Ministry of Justice Mrs Modupe Ogundoro on Sunday in Abuja.

    Emefiele was reported to have entered a plea bargain with government on condition of surrendering N50 billion to facilitate his early release from the custody of the Department of the State Service (DSS).

    The plea bargain was also said to be aimed at cancelling the trial of the former CBN Chief on series of charges comprising money laundering, breach of Public Procurement Act and abuse of office.

    Fagbemi, a Senior Advocate of Nigeria SAN said that neither his office or the Presidency have had anything of such nature with Emefiele.

    “The attention of the Office of the Attorney General of the Federation and Minister of Justice has been drawn to a report by Sahara Reporters alleging that the former Governor of the Central Bank of Nigeria, Godwin Emefiele and the Federal Government of Nigeria, have agreed to a non-prosecution plea bargain arrangement.

    “The report further alleges that Emefiele and the Federal Government of Nigeria, represented by the Attorney General of the Federation and Minister of Justice, have signed a non-prosecution plea bargain agreement and that the agreement is awaiting the signature of President Bola Ahmed Tinubu,

    “The Office of the Attorney General of the Federation and Minister of Justice hereby states clearly that these reports are completely false.

    “It would be noted that the legal team representing Mr. Godwin Emefiele had expressed their intention in court at the last hearing to initiate a plea bargain
    arrangement.

    “However, no such arrangement has been reached with Emefiele or his representatives.

    “We wish to advise the media and members of the public to kindly disregard the said false report.

    “The Office of the Attorney General of the Federation and Minister of Justice will continue to take all actions in the interest of the Nigerian public”, the statement said.

    Just In: Emefiele’s siblings withdraw case against AGF, DSS

    Justice E Okpe of the Federal Capital Territory (FCT) High Court, Abuja, has struck out a joint case against the Department of State Services (DSS) and the Attorney General of the Federation (AGF) by Emefiele‘s siblings, George and Okanta.

    This followed the withdrawal of the case by two after filling a notice of discountenance of the case.

    The Emefiele siblings took the AGF and the DSS to court over the infringement on their fundamental human rights on account of issues surrounding the embattled suspended CBN governor.

    The AGF and the DSS did not oppose the withdrawal of the case.

    DSS arrests NIRSAL boss for ‘conspiring with Emefiele’ to loot printing and minting firm

    The Department of State Services (DSS) has arrested Abbas Umar Masanawa, the chief executive officer of Nigeria Incentive-Based Risk Sharing System for Agricultural Lending (NIRSAL), for his alleged role in the ongoing corruption probe of Godwin Emefiele, the ousted governor of the Central Bank of Nigeria (CBN).

    It was learnt that Masanawa was taken into custody three weeks ago and has remained there while an investigation into the allegation is underway.

    Masanawa’s arrest stemmed from his role as the managing director of Nigerian Security Printing and Minting Company (NSPMC).

    He resigned from NSPMC after it was reported that he was seeking a governorship election as a member of the All Progressives Congress (APC) while still in office as the firm’s boss.

    The NSPMC, a subsidiary of the CBN, is responsible for printing and minting the nation’s currency notes, coins and high-level security documents.

    The DSS insider, who spoke only on conditions of anonymity, said:
    “He was conspiring with Godwin Emefiele to loot the printing and minting agency. We are still tracing billions they stole.”

    The spokesperson for the SSS declined to speak on Mr Masanawa’s detention, which stood at 22 days as of Friday morning.

    “No comment,” Peter Afunaya said in a message to The Gazette Friday morning.

    Court strikes out charges of illegal arm possession against Emefiele

    A Federal High Court in Lagos on Thursday struck out charges of illegal possession of firearm and ammunition preferred against suspended Governor of Central Bank of Nigeria, Godwin Emefiele.

    Justice Nicholas Oweibo struck out the charges for lack of diligent prosecution, following an application by the Federal Government to withdraw the charges.

    The oral application was made on Tuesday by Mr. Mohammed Abubakar, the Director of Public Prosecutions in the Federal Ministry of Justice.

    Abubakar had said that the application was informed by emerging facts that needed further investigations.

    He had prayed to the court to grant the application.

    Emefiele’s counsel, Mr. Joseph Daudu (SAN), had, however, opposed the application.

    Daudu argued that the government was in disobedience of the court’s order granting Emefiele’s bail and, therefore, should not have its application entertained by the court.

    “We have an application that the government has flouted the court’s order which says the respondent/ defendant should be remanded at the Nigeria Correctional Service,” he submitted.

    He added that the application for withdrawal of charges must be in writing.

    The court, on July 25, admitted Emefiele to N20 million bail after he was arraigned on a two-count charge of illegal possession of firearms and ammunition.

    The government said the decision is informed by emerging facts and circumstances of the case which requires closer investigation.

    Custody: Court to hear FG, Emefiele’s applications Aug. 15

    A Federal High Court sitting in Lagos, on Thursday, adjourned until Aug. 15 for hearing of an application seeking to stop prosecution of the suspended Governor of the Central Bank of Nigeria, Godwin Emefiele.

    The court will also, on the same day, entertain an application by the Federal Government seeking to appeal the bail granted Emefiele by the court on July 25.

    Justice Nicholas Oweibo gave the date to enable defence to reply to prosecution’s further counter-affidavit to its application.

    The counter-affidavit was served on defence just before Thursday’s proceedings.

    Oweibo held that prosecution’s application was ripe for hearing but defence had yet  to respond to the further counter-affidavit served it in court on Thursday.

    The judge, therefore, said that the two applications would be taken jointly on Aug. 15.

    Earlier, prosecution counsel, Mrs K. A. Fagbemi, told the court that prosecution’s application filed on Aug. 3 had been served on the defence which, she said, had responded.

    However, defence counsel, Mr Victor Opara (SAN), submitted that the application was not ripe for hearing.

    “Our conception is that, by reason of principle of priority of applications, our application is superior,’’ he said.

    Opara also lleged that prosecution had consistency disobeyed the order of the court and should not be allowed to move its application.

    Fagbemi then said that, by the principle of priority, the prosecution’s application came first and was ripe for hearing.

    She urged the court to hear the application.

    After listening to the arguments, Oweibo held that both applications would be taken on the same day.

    The News Agency of Nigeria (NAN) reports that in its application filed on Aug. 3, the Federal Government is seeking leave to appeal against the July 25 ruling by Oweibo in which he granted Emefiele bail.

    The Federal Government also asked the court to stay execution of its order remanding Emefiele in the custody of the Nigerian Correctional Service and to make an order remanding him, instead, in the custody of the State Security Service.

    In his application dated Aug. 7 and filed on Aug. 8, Emefiele is praying the court to stop the Federal Government from further prosecuting him on the charge of illegal possession of a firearm and ammunition or any other charge.

    Emefiele’s application is also seeking an order of the court discharging him of all charges brought against him by the government.

    He claimed that the government was disobeying a subsisting order of the court granting him bail on July 25 and, therefore, could not lawfully prosecute him.

    The application filed through his lawyers led by Mr Joseph Daudu (SAN) is pursuant to Section 6(6)(a) of the 1999 Constitution (as amended) and some sections of the Administration of Criminal Justice Act, 2015.
