    FIRS announces new TCC regime

    The Federal Inland Revenue Service (FIRS) has announced a new Tax Clearance Certificate (TCC) regime.

    This was announced in a public notice by Mr. Muhammad Nami, Chairman of FIRS.

    The Service also announced it is offering a 30- day window to enable taxpayers obtain TCC.

    The new TCC regime, according to the notice, will make it easier for taxpayers to obtain TCC.

    The FIRS Chairman noted that the offer to ease issuance of TCC is in accordance with the provisions of Section 101 (1) of CITA LFN 2004 and in conformity with Self-Assessment Regulation, 2011.

    He warned that the Service will not fail to invoke the provisions of the law, including enforcement and imposition of lieu if it is apparent that a taxpayer has misled the FIRS to issue a TCC.

    “Following the numerous complaints received from our esteemed taxpayers with respect to difficulties encountered before obtaining Tax Clearance Certificate (TCC) and the fact that taxpayers need TCC to enable them to, inter alia, seek and obtain contracts and loans, renew permits, registrations, franchises, agreements and/or licenses that will invariably generate revenue from which taxes will be paid, Management has looked into the above complaints and has taken steps to ease the process of obtaining TCC.

    “Consequently, notice is hereby given that the Service has put in place machinery to issue 2020 TCC for all eligible taxpayers from 2nd January to 31st January, 2020.

    “The Service may not hesitate to use enforcement activities including imposition of lien on bank accounts of such defaulting companies to recover any outstanding debts when it discovers that the taxpayer has misled the Service in her duty to observe tax compliance.

    “The issuance of TCC to ease the burden of taxpayers is in line with the provisions of Section 101 (1) of CITA LFN 2004 and in conformity with Self-Assessment Regulation, 2011.

    “Taxpayers are therefore encouraged to take advantage of this initiative and apply for their 2020 TCC, as soon as possible,” the notice read.

  • Senate confirms Nami as FIRS chairman

    Muhammed Mamman Nami has been confirmed by the Senate as the executive chairman of the Federal Inland Revenue Service (FIRS).

    He succeeds Babatunde Fowler whose four year- term of office expired on 9 December.

    The confirmation followed the consideration and approval of the report of the Senate Committee on Finance, presented at plenary by the panel chairman, Senator Solomon Adeola.

    Other members of the board, James Yakwen Ayuba, Ado Danjuma, Adam Baba Mohammed, Ikeme Osakwe, Adewale Ogunyomade and Ehile Adetola Aibangbee were similarly confirmed.

    President Muhammadu Buhari had on December 9, asked the Senate to confirm the appointment of Muhammad Nami as FIRS chairman, along with other board members.

    FIRS begins nationwide crackdown on tax defaulters

    Nigeria’s Federal Inland Revenue Service (FIRS) is set to begin massive crackdown on tax defaulters nationwide on Wednesday.

    Wahab Gbadamosi, FIRS spokesman said the body had served a seven-day notice to tax defaulters, with a warning that it would soon begin a nationwide tax enforcement to bring tax defaulters to book.

    The Acting Executive Chairman of FIRS, Abiodun Aina in a notification to taxpayers on Tuesday informed them of the plan by the Service to begin tax enforcement against such defaulters should they continue to fail in fulfilling their tax obligations.

    The FIRS boss advised defaulting taxpayers to “settle their tax liabilities within Seven days of the publication to avoid any inconveniences or interruptions in their operations.

    “The FIRS hereby informs all taxpayers (individuals, partnerships, Enterprises, Corporate organisations, Ministries, Departments and Agencies) who are in default of payment of taxes arising from self-assessment, tax audit, tax investigation, transfer pricing audit, demand notices and any other liabilities, that the Service will commence a NATIONWIDE TAX ENFORCEMENT EXERCISE from 18th December, 2019 with a view to prosecuting defaulters and recovering all outstanding tax liabilities,”, the notice read.

    He stated that the enforcement was pursuant to the provisions of Section 8, 26 (2), 33 and 35 of the Federal Inland Revenue Service (Establishment Act, 2007)., adding that the taxes referred to were Petroleum Profits Tax, Companies Income Tax, Value Added Tax, Withholding Tax, Tertiary Education Tax, NITDA Levy, Stamp Duty and Capital Gains Tax.

    The Nation quoted him as advising taxpayers to settle their tax liabilities within seven days to avoid any inconveniences or interruptions in your operations.

  • FIRS reacts to report of giving Osinbajo N90bn, N40bn for APC campaigns

    The Federal Inland Revenue Services, FIRS, has reacted to a report widely published in the media yesterday that the agency supported Nigeria’s presidency with the sum of N40bn during the last concluded presidential report.

    According to FIRS, the speculation was said to have been fueled by careless allegations raised by former spokesperson of the All Progressives Congress, APC, Timi Frank.

    The FIRS said that Frank accused it of supporting APC campaigns with the sum of N40bn and N90bn at different periods through Vice President, Yemi Osinbajo.

    The nations revenue service, however, described Frank’s allegation as “wicked, malicious and a calculated attempt” to smear its image and that of the Vice President.

    In a statement signed by Head, Communications and Servicom Department, Wahab Gbadamosi, FIRS insisted that Frank’s allegation was a campaign of “calumny, vilifying, libellous, unfounded in fact, irresponsible and a brazen assault on the integrity of the Service.”

    The statement reads: “First it was N90B, but now N40B. Which is which? It took a disgruntled politician to convey the fake news of N90B, now it is the services of an unquestioning PR newswire that is passing on the unsupported, baseless N40B bogus allegation. Whichever way whoever is behind this, a lie is a lie’’.

    The FIRS in defence of itself said the last four years since Mr. Tunde Fowler has supervised operations at the FIRS, the agency had not received up to N100 billion, per annum, as Cost of Collection from the Federation Accounts Allocation Committee, FAAC. FAAC is a public institution, whose records are open to the public.

    “That it is from the remittances from FAAC—which had never grossed up to N100 billion, PER ANNUM, that FIRS pays the salary and emoluments and trains it’s over 8000 staff, runs over 150 offices and provides for other needs of the Service.

    FIRS maintains that it was not possible for it to commit all its resources to a phantom campaign of N90 billion as suggested by Mr. Timi Frank given that it barely has enough for its operations.

    “That FIRS is a creation of statute and its activities are governed by the laws of the Federal Republic of Nigeria and financial regulations and thus, IT IS NOT PLAUSIBLE, that its funds could be expended in such a cavalier manner as suggested by Mr. Timi Frank.

    “That FIRS Budget and expenditure approval processes pass through the Budget Office and the Ministry of Finance before such is presented to the National Assembly for Appropriation into Law. The National Assembly committees, consisting of all parties and inclinations exercise oversight function on all agencies of the Federal Government to ensure agencies keep to the letters of the Appropriation Act. Thus FIRS’ operations are subjected to Scrutiny and close monitoring by the National Assembly, the Federation Accounts Allocation Committee and the Ministry of Finance.

    “It is therefore unthinkable, malicious and irresponsible for the said Frank to insinuate or infer that N90 billion or any part thereof could be spent illegally and without budgetary approval.

    Fowler: FIRS ‘N40bn election campaign fund’ sparked new crisis in Nigeria’s presidency

    The Presidency (comprising of the office of the President and Vice President) is again battling an internal war over alleged misappropriation of N40 billion from the Federal Inland Revenue Service (FIRS) under the immediate past Chairman, Mr Babatunde Fowler.

    Recall that earlier this week Fowler who was appointed to superintendent Nigeria’s apex tax office was replaced on December 9, 2019, by a tax consultant, Muhammad M. Nami.

    On Sunday, PRNigeria, relying on strong sources within the presidency, reported that the ‘misappropriated’ money, which was purportedly used for ‘political campaign funding’ for 2019 did not go down well with the seat of power which has ordered investigation and prosecution of culprits.

    Officials are said to be angry and unsatisfied with Folwer’s explanations on how the fund was ‘shared,’ and have vowed to punish other collaborators, including a very powerful figure within the presidency.

    Also connected to the N40 billion sharing bazaar is a political gladiator in the Southwest who was said to have received N3 billion which is less than 10 percent of the ‘campaign fund.’

    Already, some top management staff of FIRS have been quietly arrested and are being interrogated on corruption allegations by anti-graft agencies.

    A presidential source told PRNigeria: “Some senior FIRS staff, about nine of them who were arrested in connection with the money are being interrogated by an anti-corruption agency.

    “Some are accused of being involved in a multi-billion naira fraudulent actions and contract awards. This is added to the extravagant lifestyle of these stooges and aides, poor governance structure, audit reports and general mismanagement at FIRS”.

    Recall that the Chief of Staff to the President, Abba Kyari, had on August 8, 2019 queried the former top man of the Lagos State Internal Revenue Service (LIRS) for what the presidency called dwindling tax revenue since 2015 when the Buhari’s administration took the helm of governance.

    Kyari ordered Fowler to explain why in 2015, FIRS set N4.7 trillion target but was only able to make N3.7 trillion in the actual collection. In 2016, 2017 and 2018, the target collections were N4.2 trillion, N4.8 trillion and N6.7 trillion but the actual collections were N3.3 trillion, N4.0 trillion and N5.3 trillion, respectively.

    “You are kindly invited to submit a comprehensive variance analysis explaining the reasons for the variances between the budgeted collections and actual collections for each main tax item for each of the years 2015 to 2018,” Kyari demanded in the query.

    Fowler, in his response, defended the performance of FIRS under him citing the fact that what was considered a fall in revenue was not as a result of misappropriated funds but a reflection of the state of the economy during the years under review.

    However, President Muhammadu Buhari, in an apparent signal, fully backed his Chief of Staff’s actions against Fowler in his October 1, 2019 Independence Anniversary Speech.

    Buhari said: “Our revenue-generating and reporting agencies will come under much greater scrutiny, going forward, as the new performance management framework will reward exceptional revenue performance, while severe consequences will attend failures to achieve agreed revenue targets.”

    Also, more damaging to Fowler and his benefactors who are said to be on the brink of complete humiliation were the allegations by the former Deputy National Publicity Secretary of the All Progressives Congress (APC), Comrade Timi Frank.

    Sources confirmed that the allegations, which are still being investigated, combined to stack up against Fowler whose fate was officially sealed by Buhari on December 9.

    “Mind you that Fowler’s sack has not closed this chapter. Expect more casualties as more revelations are unravelled. More heads may roll including very top figures who are already roped in and cornered by the scandals,” the source said.

    Also, the presidency was said to have been amazed by Fowler’s letter to the Secretary to the Government of the Federation (SGF) seeking his tenure renewal.

    The letter with reference number FIRS/EC/CWOSGF/0476/19/006, read in part: “I wish to present myself for re-appointment for a second term. This is consistent with provisions of the FIRS Establishment Act 2007 and would grant me the opportunity to consolidate and build on the achievements we have recorded in the past four years.

    “Please find attached the highlight of my achievements during my first tenure in office. I would like to put on record my gratitude to Mr. President for the opportunity to serve the nation. I am also thankful for your support in the course of the discharge of my duties,” part of the letter read.

    But the appeal for reappointment was immediately rejected because of the gravity of the allegations against Fowler. The letter was believed to have been leaked to embarrass Fowler.

    The source further disclosed that not only were the allegations being taken seriously by the Presidency but there are “concerns on how to recover the money”.

    “Recovering the embezzled money is of top priority and believe me those found culpable will eventually pay the price,” the source added.

  • FIRS: Senate shift vacation date to approve appointment of Fowler’s replacement

    …now to vacate for Christmas break next Thursday

    The Senate scheduled to embark on Christmas break tomorrow (Thursday) had to shift it forward to enable it consider and confirm the appointment of a new Chairman for the Federal Inland Revenue Service, FIRS.

    Recall that the former Chairman Babatunde Fowler was removed last Monday by the Presidency and replaced by Mr Mohammed Nami.

    Fowler’s tenure had expired last Monday and it was renewed by the Presidency.

    This came to fore when the Senate suddenly during plenary had asked the committee on Finance to screen the appointee and report back next week.

    But the Senate President, Ahmad Lawan was quickly reminded that the Senate was vacating on Thursday.

    It was resolved immediately that the break should be shifted till next week Thursday to enable the Senate approve the appointment.

  • Trouble looms in FIRS as workers demand handover to senior director

    Twenty-four hours after the change of leadership at the Federal Inland Revenue Service (FIRS), members of staff of the Service have given the authorities till Friday for the most senior director to take over as acting chairman.

    Mr. Babatunde Fowler handed over to Abiodun Aina, Coordinating Director, Domestic Taxes Group after President Muhammadu Buhari named Muhammad M. Nami to replace him as chairman and sent his name to the Senate for confirmation.

    According to a communique sent to the Acting Executive Chairman, the workers, under the aegis of the Joint Union Council of FIRS, threatened that they cannot guarantee industrial harmony after Friday if Aina continues to act as chairman.

    The FIRS claimed that Aina, “does not have the basic qualification/requirement (HND or BSc) to be employed into the Service.”

    Besides, the union said Aina’s appointment to the position of Coordinating Director “was against the provision of Section 2.19 of FIRS Human Resource Policies and Processes which states as follows: Appointment to the post of Coordinating Director shall be made by the Board on the recommendation of the Executive Chairman.”

    Aina’s appointment they claim should “be open to all confirmed Directors of the Service and it shall be competitive based on experience, competence and seniority, as he was never a director in the Service rather a Senior Special Assistant to the erstwhile Chairman of FIRS.”

    They also claimed that “his name is not on the seniority list of confirmed FIRS staff and FIRS directors on the staff nominal roll rather on the list of Contract Staff of FIRS.”

    At the end of the emergency meeting, union members resolved that “in accordance with the Presidential Directive, the seniority list should be followed and the appropriate person be directed to act, pending assumption of duty of the New FIRS executive chairman.

    “That if by close of work on Friday, 13th December 2019, no action is taken to this effect, Union will no longer guaranty further industrial harmony in the system.”

  • Some say it’s big surprise but getting second term to lead FIRS isn’t automatic – Folwer

    The immediate past Executive Chairman of the Federal Inland Revenue Service (FIRS), Tunde Fowler, Monday thanked President Muhammadu Buhari for the privilege he had to serve the nation and for what he was able to do with the support of all Staff.

    Change, he noted is constant. It is normal that people will always resist change, he noted.

    He spoke at arbour 6:35 p.m. (yesterday) as he handed over to the Coordinating Director Domestic Taxes Group, Abiodun Aina, who promised to steady the ship of the FIRS.

    Mr Fowler in a handover over ceremony at the Boardroom of the FIRS said: “Let me thank all of you who are here for what we have been able to do for our country. From the driver to the senior staff, everybody played a role. But with change, sometimes there is resistance. People will not understand the vision, will not understand the reason for the
    change. But hope in leaving FIRS, I’ve left behind something, something, positive, that each and every one of you can build on.

    “We have got a mandate. That mandate is not just to collect revenue. It’s a mandate to collect the maximum amount of revenue for all concerned for the benefit of all Nigerians.

    “There is nothing automatic about having a second term. Some of you might say it’s a big surprise. It a privileged to serve one’s country. And if you have the privilege of serving your country for one term and you believe you have done your best, you have to thank God for that.

    “For those of you we are leaving behind, Ï do not want to get too scriptural. But I believe that anything that you do, that helps your fellow human being, your neighbour is a blessing. And I believe that this job that we have been given is a job that will continue to help all Nigerians and all people residing in Nigeria.

    “We have the opportunity to show the world that Nigeria has a lot to offer. It was during this period that we had a top Director, representing Nigeria and the world at the OECD. It was within this period that Nigeria, for the first time chaired ATAF (African Tax
    Administration Forum), for two years running. It was within this period that Nigeria through your support, was appointed as the 1st Vice Chairman of the United Nations Committee of Tax Experts. So we have a lot going for us.

    “I like you to keep the flag flying, But I hope that sometime, when I visit, my picture will be somewhere on the wall.

    “One thing, for people who have known me for a while, is that some of them refer to me as a shark. I like to keep people on their toes. Some of you might have thought that I don’t appreciate your contribution. But some of you… might have been able to do things better. And part of my role is to bring out that potential in you. And I hope I have been able to do that. I am content.

    “I like to thank the President for giving me this opportunity of service. It’s a privilege of service to your country. But at the same time, I believe I leave behind a good crop of directors that can move this organisation forward.

    “I will say that for the incoming Chairman, for the incoming Board of Directors, give them the support. The vision, I believe, is the same vision that we have. But how to go about it may differ. Open yourselves up to change. At this point, it gives me extreme privilege,
    to hand over the running of this organisation until the Senate approves the new Board, to someone who has been here, to someone who understands the working of the FIRS, to someone who has been part of the change. And I believe that you will give him the support, not even the support you have given me. But more support. So that when he
    hands over the organisation to the new board, they will see that this organisation is one that shares the same vision, and of course believes in his mandate. With these few words, I like to say it’s a pleasure working with all of you.

    “Some of you might have thought that don’t like you. But I assure you it was work. But I believe in this room, we have got a lot of talent regardless of what happens, keep the flag flying.

    “On this note, Mr Aina, I have the privilege of handing over FIRS to you. God bless FIRS. Long live the Republic of Nigeria.”

    The Acting Executive Chairman, FIRS, Abiodun Aina, spoke in glowing terms about Mr Fowler.

    Mr Aina said: “Thank you very much Mr, Chairman, my boss, my brother, and my good friend Sir. As you hand over to me I say what I’m I running. YO have fought a good fight. You laid a very u solid foundation…

    “Within the intervening period that I will be holding forte, I promise you to steady the ship, by the grace of God. You have done a lot within the space of four years. You have transformed FIRS. You have modernised it. There has been a lot of innovations. And under you we have achieved great heights. When we look back in 2015, collection was about N3.3 trillion. At the end of 2018, with your leadership, we were able to move to N5.32 Trillion. That was the highest collection ever, in the annals FIRS. You brought dynamism to FIRS.

    “You introduced so many programmes that repositioned FIRS: Tax Amnesty Programme, implemented VAIDS, increased the no of taxpayers nationwide to over 20 million in a spate of four years, began placing lien on the account of taxpayers to ensure that each capable corporate taxpayers pay his/her dues, fostered collaboration amongst the states through the Joint Tax Board, began robust information sharing amongst states, launched the JTB TIN so that states might have access to data for tax purposes, deepened FIRS’ embrace of technology for tax purposes and many more.

    “But like you also mentioned in your speech, change is usually resisted. And so you stepped on toes. That is normal. Leadership is not a popularity contest. And I’m sure you know that very well. And that was why you were focused on carrying out the mandate that was given to you. I can tell you on behalf of my colleagues here that we will miss you. You have left a very big shoe behind. We will do all we can to ensure that we will keep the flag flying.

    “Thank you very much for what you have done for us.

    As Mr Aina ended his brief remarks, directors and heads of department in attendance, held hands and sang ‘For he’s a jolly good fellow, chorus” for the outgoing executive chairman. Many pumped hands and thanked Mr Fowler for his contribution to the service.

  • Meet the newly appointed FIRS chairman, Muhammad Nami

    President Muhammadu Buhari on Monday nominated a renowned tax consultant, Muhammad Nami, as the new chairman of the Federal Inland Revenue Service (FIRS).

    Mr Buhari also named a new board for the tax agency.

    The board is composed of a member representing each of the six geographical zones and statutory representatives from a select number of ministries and government agencies.

    The outgone chairman of FIRS, Babatunde Fowler, whose term of office expired on Monday, is expected to hand over to the most senior director on the board, who will take charge, pending the Senate confirmation of the new board.

    Mr Buhari’s spokesperson, Garba Shehu, provided a profile of the new FIRS chairman.

    According to Mr Shehu, Mr Nami is a well-trained Tax, Accounting and Management professional with highly rated qualifications and professional practice and licenses from relevant professional bodies. He has almost three decades of practical working experience in Auditing, Tax Management and Advisory and Management services to clients in the banking, manufacturing, services and public sectors as well as non- profit organizations.

    He is an expert in rendering advisory support services to investors in respect of new business start-ups and management of existing businesses. He has also continuously rendered outsourced services to clients in trading, service and manufacturing sectors of the nation’s economy.

    Mr Nami attended Bayero University Kano and Ahmadu Bello University, Zaria where he obtained a Bachelor’s Degree in Sociology (1991) and a Masters of Business degree (2004) respectively. He is a fellow of the Chartered Institute of Taxation of Nigeria, Institute of Debt Recovery Practitioners of Nigeria and Associate Member of Nigerian Institute of Management (Chartered) and Association of National Accountants of Nigeria.

    He started his career with PFK in 1993 and rose to the position of a senior consultant in charge of tax management and advisory services. He is currently the managing consultant of Manam Professional Services (Chartered Tax Practitioners and Business Advisers) based in Kaduna, Abuja, Niger State.

    Mr Muhammad has served and is still serving, on many companies’ Board and Statutory Board Audit Committees. He was appointed as a member, Presidential Committee on Audit of Recovered Stolen Assets in November, 2017 by President Buhari.

    He is married with children.

  • FIRS targets 45m tax payers by December – Fowler

    Federal Inland Revenue Service (FIRS) says about 45 million Nigerians will be captured as taxpayers before December 2019.

    Mr Babatunde Fowler, Chairman, Joint Tax Board (JTB), said this on Thursday in Ilorin at the flag-off of the new Tax Identification Number (TIN) registration system and consolidated National Taxpayers’ Database for North Central zone.

    “Over the last four years, the economic policies of the current administration have focused on establishing a stable foundation for socio-economic growth and development.

    “With the astute leadership of Mr President, the milestones achieved bears ample testimony on the impact that has been made, not only in tax-revenue administration, but in the environment of doing business in Nigeria,” he said.

    Fowler listed the accomplishments to include expansion of tax base from 10 million to 20 million taxpayers with the potential for an increase of up to 45 million before year end.

    Fowler, who is also FIRS Chairman, said Internally Generated Revenue (IGR) collection at the sub-national level grew exponentially by 46.11 per cent from N800.02 billion in 2016 to N1.16 trillion in 2018.

    He also said FIRS tax collections grew by 53.9 per cent from N3.3 trillion in 2016 to N5.32 trillion being the highest collection ever in the history of FIRS.

    Fowler added that N2.85 trillion was collected as Non- Oil Revenue which accounted for 54 per cent of total revenue collection.

    The JTB chairman said the federal government paid a total of N135.8 billion as outstanding PAYE tax liabilities owed by Federal MDAs to states from 2002 to 2016 with a total of N31.08 billion paid to the states in the North Central.

    “We are confident that this gesture by the federal government will encourage State Governments to also reciprocate and promptly remit all withholding Taxes and VAT due to the Federation Account.

    “A positive movement during the same period is Nigeria moving up 25 points in Tax Administration Section of World Bank ‘Ease of Doing Business’.

    “This positive progression is also reinforced by the recent listing of Nigeria as one of the ‘top 20 reformers in Doing Business for the year 2020 by the World Bank.

    “We expect that more positive country reports will be released by the time the full report by the World Bank is released on Oct. 24, 2019,” Fowler said.

    He said the new TIN Registration System would improve on the efficiency and output of the entire tax administration process.

    “It is also meant to provide enhanced convenience to the taxpayers as well as the tax administrators while guaranteeing that each taxpayer’s details are readily available to them at their fingertips at all times and anywhere,” Fowler added.

    According to him, the new system possesses the capability to integrate data from all relevant agencies by leveraging on already captured data.

    He added that the new system also will also reduce the burden of taxpayer information management and cost of collection.

    “The new system maintains the identification of an individual taxpayer via assigning of a unique and universal TIN.
