    Judge vacates order suspending Ganduje as APC National Chairman

    A Kano State High Court presided by Justice Usman  Na’Abba on Monday vacated the order he earlier gave suspending Dr Abdullahi  Ganduje as a member of the All Progressive Congress (APC).

    The applicants Haladu Gwanjo and Laminu Sani Barguma who claimed to be the Chairman and Secretary respectively of the APC Ganduje Ward in Dawakin Tofa Local Government area of the State, had secured an order suspending Ganduje as the Chairman of the Party.

    The respondents in the suit are the APC, the National Working Committee (APC), The State Executive Committee APC Kano Chapter and Ganduje.

    Justice Na’Abba,granted the order upon reading a Motion Ex-Parte together with 27 paragraph affidavit dated April 22  sworn to by one Glory Adah a litigation secretary in the 4th respondent solicitors law firm.

    “After hearing, Mr L. O. Oyewoo, A. Falana Esq and J. Essiet , counsel of the 4th Respondent/Applicant, an order of interim injunction is hereby granted,” he held.

    The Interim Injunction order is for staying of the execution of the order of interim injunction contained in the ruling of the court delivered on April 17,  directing parties to maintain status qou ante as at April 15, in relation to the suspension of Ganduje from the APC by the Ganduje Ward Executive Committee pending the hearing and determination of the 4th respondent/applicant Motion on Notice..

    The Judge then adjourned the matter until April 30 for hearing of the case.

    The All Progressives Congress (APC), Kano State chapter, has urged the public to ignore the purported suspension of the national chairman of the party, Dr Abdullahi Ganduje.

    The secretary of the party in the state, Alhaji Zakari Sarina, told NAN on Monday in Kano that the supposed suspension of Ganduje by any group of individuals was null and void.

    He said the suspension, which was announced on Sunday by a faction of the party, came from non-members of the party.

    “It is impracticable for non-members to slam a national officer with suspension without recourse to laid down procedures as enshrined in the party’s constitution.

    “I must make it clear, that we are undeterred by the activities of these impostors because.

    Their style lacks finesse and sophistication and has further exposed their political naivety where Dr Abdullahi Umar Ganduje is an acclaimed master.

    “From available records, those behind the latest oddity are political jobbers who have offered themselves for pecuniary benefits at behest of dignity“, Sarina alleged.

    According to him, they don’t belong to progressive because a good thing party member will not work towards destroying a legitimate member who was governor for 8 years and rose to become a national chairman.

    “It is because they are outsiders, they are simply not aware of the internal workings, or ground rules of the APC on disciplinary actions, hence they resort to poor strategy that cannot stand logic, and reasons.

    “We from ward, local government level and state are solidly behind our leader who has contribute positively towards the political growth of our party’’, he told NAN.

    Sarina alleged that leader of the group who announced the purported Ganduje’s suspension was a member of New Nigeria People’s Party who contested but lost the counselorship election in Ganduje ward.

    He advised the media to be cautious of those who seek to use their platforms to promote falsehood.

    “The media should, as a matter of fact, scrutinise issues that are of paramount to the growth of democracy by being the driver of democracy’’, he said.

    Another faction of All Progressives Congress (APC) in Ganduje Ward, Dawakin Tofa Local Government Area, Kano State, on Sunday announced the suspension of Dr Abdullahi Ganduje, its national chairman, from the party.

    Recall that Malam Haladu Gwanjo, the Legal Adviser of another APC faction in Ganduje Ward, last week announced the suspension of Ganduje.

    Gwanjo, who cited alleged corruption and other vices as reasons for the suspension, said that the decision was taken by nine executive members of party in Ganduje ward.

    Also, another faction, represented by the Ward Chairman, Malam Ahmad Ganduje, came out to declare support for Ganduje, saying the ward officials were satisfied with his leadership style.

    In passing the vote of confidence on Ganduje, factional ward chairman urged all party members in the ward and across the state to remain calm and law abiding.

    However, in a new twist in the early hours of Sunday, another group, which claimed to be the legitimate exco, yet again announced the suspension of Ganduje.

    Addressing newsmen secretary of the faction, Malam Ja’afar Ganduje, who spoke on behalf of 11 other executive members, hinged the suspension on alleged anti-party activities by Ganduje.

    He said this was particularly during the last general election.

    He also alleged that the APC national chairman had failed to pay his statutory dues to the party.

    He further blamed Ganduje for contributing to the factionalisation of the party at the ward level, which he said had brought the party to disrepute.

    “We are the authentic executives of Ganduje ward and we have passed a vote of no confidence and imposed a new suspension on Dr. Abdullahi Umar Ganduje for series of reasons.

    “First, we have suspended Dr. Ganduje’s membership for creating internal conflict among party members at the ward level.

    “Another major reason why the authentic executives resolved to suspend Ganduje is the issue of anti-party activities he generated during the 2023 elections which resulted to the party’s failure in the state,” he said.

    Abdullahi Ganduje, former governor of Kano State has bragged about being the national chairman of the All Progressives Congress, APC, following the reversal of his purported suspension by his ward executives.

    Recall that Justice A. M Liman of the Federal High Court in Kano stopped Ganduje’s suspension on Thursday.

    It was gathered that the  court also barred all the respondents and their agents from implementing the decisions reached at the executive meeting of the APC held at the Ganduje Ward of Dawakin Tofa Local Government Area on April 15 2024, pending the determination and hearing of a suit filed by Ganduje for the enforcement of his fundamental rights.

    The judge also asked the parties to maintain the status quo before the purported emergency meeting of the alleged executive members of the APC ward.

    Justice Liman gave the order while ruling on a motion ex parte filed by Ganduje for the enforcement of his fundamental right to fair hearing.

    In his reaction, Ganduje thanked  the party executive members and ward officials from Ganduje Ward for distancing themselves from the purported plot to remove him from the party’s leadership and membership.

    He attributed the development to the plan of Governor Abba Yusuf of the New Nigeria Peoples Party, NNPP, to weaken the APC in the state ahead of the 2027 general election and other electoral contests.

    Ganduje said , “In fact, what is happening is that it is an incursion into our political party by the NNPP government of Kano in order to destroy our party.

    “They are so concerned that in their first year in office, they have seen their failures right from the destruction of the economy of Kano State to increased political violence in and also destruction of political morality in Kano State.”

    The suspension of the national chairman of the All Progressives Congress, APC, Abdullahi Umar Ganduje has been halted by a Federal high court in Kano.

    The suspension was halted today, in Kano after the former governor filed an ex parte motion seeking to enforce his fundamental right to fair hearing.

    The respondents in the application are the Police, Department of State Services, DSS, Nigeria Security and Civil Defence Corps, NSCDC, and nine others.

    On April 16, APC executives in Dawakin Ward, Tofa LGA of Kano State, suspended Ganduje over alleged corruption.

    However, the State Working Committee, SWC, of the APC in Kano nullified the suspension and punished the ward executives.

    But a Kano High Court presided by Justice Usman Na’Abba upheld the suspension.

    In the ex parte order delivered on Wednesday by the Federal High Court and made available to newsmen on Thursday, a Kano High Court presided by Justice A. M Liman ruled that the suspension should not be implemented until the case filed by Ganduje is heard and determined.

    “All the respondents, their servants, agents or privies are hereby restrained from implementing and/or giving effect to the purported decision reached during the purported emergency meeting of the alleged executive members of APC Ganduje Ward, held at Ganduje Ward of Dawakin Tofa Local.

    “All the parties are hereby mandated to maintain status quo before the purported emergency meeting of the alleged executive members of APC Ganduje Ward, and to stay action in respect of this matter pending the hearing and determination of the substantive application,” Justice Liman said.

    The judge subsequently fixed April 30 to hear Ganduje’s suit.

    The All Progressives Congress (APC) on Wednesday petitioned the National Judicial Council (NJC) asking for the immediate review of court order issued by Justice Usman Na’abba of Kano state High Court ordering the national chairman of the party, Abdulahi Ganduje.

    Recall that Na’abba had earlier stopped Ganduje from parading himself as the chairman.

    But in a petition in a petition dated April 17 and signed by the Chairman of Ganduje’s ward, Mahmud Ganduje and 26 others, the NJC has been told to evaluate the adherence with judicial guidelines and the constitution in the context of non-interference and political party affairs.

    The Petition reads:  “We, the Executive Committee members of Ganduje Ward, Dawakin-Tofa Local Government Area of Kano State, write to formally bring to your attention and seek intervention concerning the actions of Hon Justice Usman Mallamm Na‘abba, presiding over Court 4 of the High Court of Kano State, in a ruling involving our Party, the All Progressives Congress (APC).

    “Hon. Justice Usman Mallam Na‘abba granted an Ex-parte Order suspending H.E. Dr. Abdullahi Umar Ganduje as a member of the All Progressives Congress (APC) and further restrained him from performing his role as the National Chairman.”

    It stated categorically that the decision to intervene in internal party affairs without clear and compelling reasons to circumvent the party’s own mechanisms appears to constitute judicial overreach.

    It noted: “This action sets a concerning precedent regarding the impartiality and scope of judicial intervention in political Party governance.

    ‘In light of the above concerns, we respectfully request the National Judicial Council to: Conduct a thorough review of the circumstances and justification behind the decision of Hon. Justice Usman Mallam Na’abba to issue such Orders ‘against H.E. Dr. Abdullahi Umar Ganduje and the APC

    “Evaluate the adherence with judicial guidelines and the Nigerian Constitution in the context of non-interference and political Party affairs.

    “Assess potential disciplinary measures if it is found that Hon. Justice Usman Mallam Na‘abba acted beyond his jurisdiction or displayed conduct unbecoming of a judicial officer.

    “This petition is submitted in the interest of upholding the integrity of the judiciary and ensuring that political Party rights are not unduly infringed upon by premature judicial intervention.”

    The arraignment of the All Progressive Congress(APC) National Chairman, Dr Abdullahi Ganduje, was on Wednesday stalled due to the inability of the Kano State Government to serve him with court papers.

    Ganduje,alongside his wife,Hafsat Umar, Abubakar Bawuro, Umar Abdullahi Umar, Jibrilla Muhammad, Lamash properties Limited,Safari Textiles Limited and Lasage General Enterprises Limited were to be arraigned eight counts of  bribery allegations, Misappropriation and division of public funds running into billions of Niara against the defendants.

    When the case was mentioned for arraignment, the Prosecution Counsel, Mr Y A Adamu, told the court that all attempts made to serve the respondents, failed.

    ”My lord we were only able to serve the 6th defendant Lamash Properties Limited”

    The Prosecution attempted to move an exparte motion application seeking to serve the respondents through substituted means.

    Counsel to the 6th defendant, Nureini Jimoh SAN, told the court that the prosecution did not personally serve his client.

    “There is no provision for exparte motion in a criminal matter , it is only valid in civil cases”

    He raised an objected to the motion exparte by the Prosecution seeking to serve the respondents through substituted means.

    Justice Usman Na’abba, said that the respondents should be put on notice and adjourned the matter until April 29, for hearing on motion on notice.

    NAN reports that the 1st, 2nd, 3rd, 4th, 5th, 7th and 8th respondents were absent in court.

    A Kano State High Court has restrained the National Chairman of the All Progressives Congress (APC), Dr Abdullahi Umar Ganduje, from parading himself as a member of the party.

    Justice Usman Malam Na’abba, on Wednesday, made the order, following an exparte motion filed by Dr Ibrahim Sa’ad on behalf of two APC executive members of Ganduje ward, Dawakin-Tofa Local Government Area.

    The plaintiffs are the party’s Assistant Secretary, Laminu Sani, and its Legal Adviser, Haladu Gwanjo.

    The duo are among the nine ward executive members who suspended Ganduje from the party at the ward level, two days ago.

    The respondents in the case include, All Progressives Congress (APC), APC National Working Committee (NWC), APC Kano State Working Committee (KSWC), and Dr Abdullahi Umar Ganduje.

    Granting the motion, Na’abba made an order restraining Ganduje from parading himself as APC National Chairman.

    The court further made an order directing Ganduje to henceforth, desist from presiding over all affairs of the APC National Working Committee (NWC).

    The court directed the respondents to henceforth maintain status quo ante belum as from April 15, pending the hearing and determination of the substantive suit on April, 30.

    Justice Na’abba also granted the plaintiff’s prayer which ordered the APC SWC, from interfering with the legally and validly considered decision of executives of Ganduje ward, essentially on action endorsed by two thirds majority of the executives as provided by the party constitution.

    “An order is hereby granted directing all parties in the suit APC (1st), APC National Working Committee (2nd), Kano State Working Committee APC (3rd), Dr. Abdullah Umar Ganduje (4th), to maintain status quo ante belum as of 15th April, 2024.

    “The order thereby restraining the 1st respondent (APC) from recognizing the 4th respondent (Ganduje) as member of APC and prohibiting the 4th respondent (Ganduje) from presiding over any affairs of the NWC and restraining the state Working Committee from interfering with the legal and valid decision of the ward executives of Ganduje ward.

    “That the 4th respondent (Ganduje) is prohibited from parading himself as member of APC or doing any act that may portray him or seem to be a member of APC, pending the hearing and determination of the substantive suit”.

    It will be recalled that nine members of the Ganduje ward proclaimed the suspension of the National Chairman of APC over the allegation of corruption slammed on him by the Kano state government.

    The nine APC executives said they were prompted to act following a petition written by one Ja’afaru Adamu, a member of APC from Ganduje’s polling unit.

    In the petition, Adamu made allegations of corruption charges against the former governor just as he urged the ward leaders to investigate the matter to redeem the dented image of the party against the backdrop of President Bola Tinubu’s fight against corruption.

    Following the failure of the Ward Chairman and Secretary to act on the petition, nine members of the executives, led by the legal adviser, acted and took the decision that led to the suspension Ganduje.

    Kano State Anti-Corruption and Public Complaints Commission on Monday  filed fresh charges of corruption and maladministration against an ex-governor of the state, Abdullahi Ganduje.

    This was made known by the anti-graft commission, Muhuyi Magaji on Channels Television’s Sunrise Daily programme on Tuesday.

    He said, “What is happening now is a tip of the iceberg.

    According to Magaji  Ganduje government took N1bn from the state coffers a month to the expiration of the administration’s tenure in May 2023 but the money was sent to Bureau de Change operators and not used for road renovation as earmarked.

    “We have filed a series of cases. We have a case whereby N1bn in April last year (2023) was removed from government coffers under the allocation of renovating 30 roads in the metropolis and it was taken away, sent to Bureau de Change.

    “We have a case of N4bn whereby it was sent from the consolidated revenue account of Kano State to an agricultural company. All these cases are before the court,” he said.

    The Kano anti-graft chairman, who said he was being viewed as a “stubborn person” in some quarters, insisted that the court ruled that money laundering was a federal offence but the commission has the right to probe alleged corruption and maladministration by the Ganduje administration

    Gov. Hyacinth Alia of Benue has denied calling for the resignation of Alhaji Abdullahi Ganduje, the All Progressives Congress (APC) National Chairman.

    This was contained in a press statement issued on Wednesday in Makurdi by his Chief Press Secretary (CPS), Mr Tersoo Kula.

    The CPS was reacting to some media reports that the governor has called for the resignation of the APC national chairman.

    The Kula said the governor at no time called for the resignation of the APC national chairman.

    He said the governor enjoyed a good relationship with the Ganduje-led leadership of APC.

    “It is imperative to clarify that at no point did Governor Alia assembled, attended and sent a representative or participated in any meeting to discuss the removal or call for resignation of Alhaji. Abdullahi Umar Ganduje.

    “The Benue State governor remains firm in his support and allegiance to the leadership of the National Working Committee of the APC, under the leadership of Alhaji Ganduje.

    “Furthermore, at no point, whether publicly or privately, has the governor advocated or expressed any desire for the resignation of the National party chairman”, he said.

    He said the governor was focused positively changing the fortunes of the state.

    “He is alive to his responsibilities as the leader of APC in Benue State and is doing everything legitimate to reposition the party for future victories.” Kula said.
