The incident, according to them, happened at Akwa village in Ihiala during a clash between IPOB and unknown gunmen.

  • Court dismisses Nnamdi Kanu’s fundamental rights suit against DSS

Court dismisses Nnamdi Kanu’s fundamental rights suit against DSS

A Federal High Court, Abuja, on Friday, dismissed the fundamental rights enforcement suit filed by the leader of the prosrcibed Indigenous People of Biafra (IPOB), Nnamdi Kanu against the Department of States Services (DSS).

Justice Taiwo Taiwo, in a judgment, dismissed the suit for lacking in merit and substance.

Kanu, through his lawyer, Maxwell Opara, had, in a fundamental rights enforcement suit marked: FHC/ABJ/CS/1585/2021, sued the Director-General (DG) of DSS and the office as 1st and 2nd respondents respectively.

He also joined the Attorney-General of the Federation (AGF) as 3rd respondent in the suit dated and filed Dec. 13, 2021.

Kanu had alleged that his health was deteriorating in the DSS custody, while also alleging that the medical personnel assigned to attend to him by the DSS were unqualified, among others.

But the DSS, through its counsel, Idowu Awo, disagreed with Opara.

He argued that Kanu’s lawyer had not shown how the doctors attending to his client were doing “quack” work.

He further argued that merely stating that the medical doctors his office assigned to attend to Kanu were quacks did not amount to conflict, adding that Opara had not shown any material evidence to prove that the listed medical practitioners were quacks.

He prayed the court to discountenance the application.

The AGF’s lawyer, Simon Enoch, also corroborated Awo’s submission, praying the court to reject Opara’s application.

Delivering the judgment, Justice Taiwo held that Kanu had not provided sufficient evidence that his fundamental rights were infringed upon by the security outfit “as there is no proof of torture before the court.”

On Kanu’s right to practise his religion, the judge said that while the applicant (Kanu) had the constitutional right to practice his religion in custody, he agreed with the position of the respondent (DSS) that a suspect in custody cannot be allowed to practise his religion in such a way that would disturb the peace of other suspects in custody.

On the allegation that the IPOB leader was receiving inadequate treatments from DSS’ doctors whom he had referred to as quacks, Taiwo said that “the applicants fails to lead evidence by calling a medical practitioner to convince the court that based on the medical report, the treatment giving to Kanu is inadequate.”

Consequently, the judge dismissed the suit for lacking in merit and substance.

Reacting shortly after the ruling, Oprara, in a chat with NAN, said the judgment would be appealed against at the Court of Appeal.

He said the motion he filed praying the court for the DG of DSS and Kanu to give oral evidence in court to ascertain the fact of the matter was rejected by the judge.

Justice Taiwo had, on March 16, dismissed the motion filed by Opara, asking the court to summon the DG of DSS and Kanu to give evidence.

Taiwo, in the ruling, held that fundamental rights cases are special cases (sui generis) which mode of commencement are affidavit evidence as prescribed under Order 2, Rule 2 of the Fundamental Human Right Enforcement Procedure Rules, 2009.

Justice Taiwo said that though there were various modes of commencement of action, including fundamental right cases, he said Kanu (applicant) chose to commence his “under the Fundamental Right Enforcement Procedure Rules that stipulates affidavit evidence.”

He ruled that after carefully perusing all the affidavits of the applicant and the respondents before him, he was of the view that there was no irreconcilable conflicts in the affidavits.

The judge, therefore, declined to grant Kanu’s application and was accordingly dismissed.

  • I will consider a political solution for Nnamdi Kanu if… – APGA candidate, Umeadi

The presidential candidate of the All Progressives Grand Alliance (APGA) Prof. Peter Umeadi has said he will consider a political solution for the leader of the Indigenous People of Biafra, IPOB, Nnamdi Kanu, if he becomes Nigerian President in 2023.

Umeadi disclosed this on Channels Television on how to resolve the issues surrounding Nnamdi Kanu.

The IPOB leader, who is also a British citizen, has been held by the Nigerian government since last year after he was arrested in Kenya and is being tried for treasonable felony.

And Umeadi, a former Chief Judge of Anambra State, said a political solution, which he likened to amnesty, can resolve the matter.

“I will consider a political solution. When you consider a political solution, you don’t just release him,” he said.

“You have to put everything into place, after all, we had the issue of amnesty and you know how much Nigeria spent on amnesty. That’s a political solution. We will fashion something akin to that,” he added.

  • IPOB/ESN’s IEDs blows up own members in Enugu – Army

In a statement contained by the Director, Nigerian Army Public Relations, Brig.-Gen. Onyema Nwachukwu, the Army disclosed that an Improvised Explosive Device (IED) planted by members of the Indigenous People of Biafra (IPOB) and its armed wing, Eastern Security Network (ESN) has exploded, inflicting injuries to its members.

Nwachukwu made the disclosure on Thursday in Enugu stating that the exploded IED inflicted injuries to two members of the outlawed group.

He said that the incident occurred along Eke Ututu – Orsu Road in Orsu Local Government Area of Imo on June 1.

“The dissidents inadvertently stepped on the IED which they had earlier planted along several routes in Orlu, Orsu Local Government Area, while they were attempting to evade troops’ onslaught against terrorists in the area.

“The outlawed group has severally planted IEDs along troops’ patrol routes in a failed effort to bring harm to the troops.

“We urge all peace-loving people of the South-East to please inform troops of possible areas where these explosives have been buried for proper evacuation and disposal,” he said.

  • Whatever the cost, we’ll achieve BiafraI cause – IPOB

The Indigenous People of Biafra, IPOB, says it remains committed to the liberation and restoration of the Sovereign States of Biafra.

The group noted no amount of intimidation will dissuade it from such a noble cause.

The secessionist group stressed that although the Federal Republic of Nigeria had tagged it a terrorist organisation, its modus operandi and demands do not in any way suggest it subscribes to the tenets and ideals of terrorism.

IPOB Director of Media and Publicity, Emma Powerful, stated this in a statement on Wednesday, where it thanked Biafrans for painstakingly participating in the annual May 31st ‘Biafra Day.’

The statement reads, in part; “The global movement and family of the Indigenous People of Biafra under the command and leadership of our great leader Mazi Nnamdi Kanu, wish to congratulate Biafrans, friends of Biafra and lovers of freedom across the world who made out time to grace the epoch event and remembrance of our fallen heroes and heroines who paid the ultimate price for the freedom of Biafra between 1967-1970 and till date.

“We commend Biafrans both home and in the diaspora over their resilience, tenacity and effort in ensuring that our celebration of Biafran Heroes and Heroines was very successful and had a beautiful global outlook in all countries in the world.

“IPOB leadership brings to you a message of encouragement and hope from our great leader Mazi Nnamdi Kanu who is joyful over the committed participation by IPOB families worldwide who demonstrated to the global community that we are ready to go and to manage our destiny in a free and Independent Biafran Nation.

“In line with fully charged emotions and agonising memories, we appeal to the conscience and conscious considerations of the International community to extend to West Africa and precisely the Biafrans that all important and widely preached and consistently published ‘United Nations Universal Declaration of Human Rights’, which includes but not limited to freedom to choose our POLITICAL, ECONOMIC AND SOCIAL SYSTEMS, SELF DETERMINATION, among others.

“It is also unheard of that we are by the stipulated policies of the Nigerian government not allowed self-motivated, community effort/financed regional infrastructural development in compliance with Sustainable Development Goals.

“We equally thank IPOB families amongst us whose effort on this year’s Heroes Remembrance Day programme of events attracted distinguished diplomats and dignitaries of high repute, especially from their host countries.

“The indoor program yielded more opportunities for the tenacious pursuit of Biafra freedom and for our people to be re-educated by knowledgeable Biafrans and friends of Biafra on the need for us to remain peaceful and focused no matter the height of mountains of distractions and provocation from agent provocateurs working against our collective interest but working in collaboration with the Nigerian Fulani government.

“Therefore, everyone must endeavour to focus on the ball ‘the larger picture’ is our struggle to liberate our land from the distasteful forcible union called Nigeria.

“We are Biafrans of over 75 million in population. We are no terrorists, we are no criminals as our oppressor Nigeria wished to tag us. Every country and nation of the world’s police, immigration, foreign affairs and competent courts can attest to our good conduct, which is contrary to deliberate character assassination of a race by the Nigerian government police, armed forces and their media disinformation.”

  • Insecurity: IPOB, ESN deny killing Fatima, four kids in Anambra

The Indigenous People of Biafra, (IPOB), has said that the operatives of the Eastern Security Network, (ESN) do not have a hand in the murder of Fatima and her four children in Anambra state.

Recall that a pregnant Hausa woman named Fatima and her four kids were murdered in cold blood in Anambra state

IPOB made it known that it’s an abomination to kill a pregnant woman in Igboland, saying ESN has no connection with the murder of the Hausa woman and her kids.

Emma Powerful, the spokesman of IPOB, alleged that Fulanis murdered Fatima in a bid to cause disaffection between Igbos and Hausas.

In a statement, Powerful warned that those behind her murder must pay for their abominable act.

The statement by Powerful reads partly: “We the global family and movement of the Indigenous People of Biafra (IPOB) ably led by our great leader Mazi Nnamdi Kanu wish to state unequivocally that we have no hands in the killing of Hausa woman and her children in Agulu, Anambra State. We strongly condemn that abominable act. In Igbo land it’s an abomination to kill a pregnant woman. The perpetrators of this heinous crime are certainly not IPOB and could never have been IPOB.

“We have always said it that terrorists were imported into Biafra land to commit the ongoing atrocities all in an attempt to discredit our struggle, demonise IPOB and proscribe it then lobby and bribe Britain to tag us a terror group with the hope to stop our march to freedom but the doubters who already have a predetermined belief will not listen.

“The husband said he ran away from his home state Adamawa because of terrorists pursuing him and his family members. How are we sure that those pursuing him from his place were not behind to this wicked murder of this pregnant woman and her children? The people pursuing him can come here and kill them to give the impression that Igbos and IPOB killed them. We can’t kill pregnant women and children is an abomination in our land.

“Those involved in the barbarity of killing the Hausa woman and children in Agulu should wait for the repercussions of the evil they committed against the innocent woman and children. The criminals behind this barbarity should be prepared to pay for their heinous crimes.

“IPOB has severally called these criminals to allow Hausa citizens to do their legitimate business in our land because Hausa suffer the same fate we are facing in the hands of Fulani terrorists claiming they are herdsmen in Nigeria

“Fulani people decided to kill the woman and her children and blame it on IPOB so that Hausa people can help them start killing Igbo people living in the North because they know they can’t do it again. The Hausas leaders must not fall for this Fulani gimmick. We assure them that the Hausa community in Biafraland are safe and should continue to live their normal life amongst our people and go about their legitimate businesses.”

I”ll fish out killers of Northern woman – Soludo

As condemnations trail the brutal killing of a Northern Woman and her children in Anambra State, Governor Charles Soludo, has vowed to fish out the killers.

The woman and her children were allegedly killed by IPOB militants in the state.

Gov Soludo described the May 20 killing as “barbaric and unacceptable without naming the killers.

In a Statement signed by Christian Aburime, his Chief Press Secretary, Soludo vowed to fish out the perpetrators and ensured they were dealt with according to law.

He said that all law-abiding Nigerians, irrespective of tribe or religion, were entitled to reside and or do business in any part of the country, including the Southeast and in Anambra without fear of unlawful harassment, molestation or attack of any kind, under any guise by anyone or group.

He said “no group or Nigerian is justified to harass, attack or kill any citizen of Nigeria or anyone resident in Nigeria under any guise whatsoever unless in lawful execution of a court sentence.

“Perpetrators of these heinous atrocities and their sponsors are testing the resolve of the Government and people of Anambra State, but I assure you that efforts are underway to fish out and bring to justice whoever is behind the criminal activities.

“All Nigerians living or doing business in Anambra are assured, of the resolve of the State government to ensure adequate protection of their lives and properties at all times,” he stated.

In a related development, the Arewa Youths Consultative Forum, AYCF, has alleged an ethnic cleansing agenda against Northerners residing in the Southeast.

  • Garba advises Northerners to leave Anambra immediately

A former All Progressives Congress (APC) presidential aspirant, Adamu Garba, has called on Northerners living in Anambra State to leave with immediate effect.

Garba, a presidential aspirant on the platform of the Young Progressives Party (YPP), said this on his verified Twitter account, @adamugarba while reacting to the killing of a woman and her four children identified to have hailed from the North.

They were killed by gunmen in Anambra State last Sunday. Garba identified the woman as Fatima from Adamawa State in the Northeast region. The outlawed separatist group in the Southeast, the Indigenous People of Biafra (IPOB) has been accused of being behind the murder of the woman and her children, but the group has denied the allegation.

In his tweet, Garba said, “In the whole world, there’s never a terrorist organization that is as cowardly as IPOB. More so, there are no ones (sic) given unto self-destruction than their silent supporters

“The gruesomely murdered Fatima & her kids are from my state, Adamawa. I mean are we really in same country? “The double standard is unimaginable. It seems like lives in Nigeria have two grades.

“The whole media went silent, the whole online so-called hypocritical agitation and fake-minded Human right fighters were nowhere to be found.

“Worst is, the govt can’t & won’t do nothing about it.n“The faster we realize that Nigeria need complete political decentralization and everyone should take care of their regions, the better for us.

“Why can’t people like Fatima and other people endangered in Anambra come back home since the govt won’t protect or even care about them?

“We should stop pretending or trying to be politically correct. This country is not designed for equality and fairness to all citizens.

“The concept of everyone can live everywhere is constantly attack by terrorist (sic) like IPOB & their silent supporters, while our people keep dying.

“Until & unless a strong government is put in place, which will guarantee the protection of lives & properties of Nigeria anywhere they are, citizens have right to vacate where they are endangered.

“Hence the need for the likes of late Fatima to come back home where they are valued. “Let all the people of Northern Nigeria vacate Anambra state with immediate effect. Retweet if you agree.”

  • IPOB cancels Thursday sit-at-home in all Southeast states

The Indigenous People of Biafra (IPOB) says it has cancelled the May 26th sit-at-home it earlier announced.

The group said the cancellation was as a result of the postponement of the court case of its leader Nnamdi Kanu, initially scheduled to come up on Thursday.

This  was contained in a statement signed and released to pressmen  by IPOB Media and Publicity Secretary, Emma Powerful.

Powerful urged the people of the Southeast to maintain restraint and keep their eyes on the ball

He said the announcement became necessary in order to notify their members both home and abroad that Kanu’s court case in Abuja on May 26, has been postponed to June 28.

He added  that IPOB was informed by the Federal High Court’s registrar, through its legal counsel, Ifeanyi Ejiofor, that the case was postponed because Justice Binta Nyako was indisposed.

The statement read in part, “IPOB has been informed why and what caused the sudden change of date and we accepted it, we just received the communication from the Federal High Court’s Registrar, through our legal counsel, Ifeanyi Ejiofor, notifying us that the court will no longer be sitting tomorrow, May 26, 2022, on our leader’s case.

“Therefore, there will be no sit-at-home in regard to tomorrow’s case instead sit-at-home will hold on  June 28, 2022.

“According to the registrar, this is because Justice Binta Nyako is indisposed, and as such, the matter is now adjourned to June 28, 2022 for ruling and hearing.

“We most respectfully, urge you all to maintain restraint, as you have always done. Keep your eyes on the ball, which is the freedom of Mazi Nnamdi Kanu.

“Also, please note that justice delayed is not justice denied. We are aggressively cruising to victory of our leader, it is only a matter of time. There is no sit-at-home again tomorrow. Biafrans should bear with us.

“We profoundly appreciate your solidarity, unflinching support and prayers, which have been sustaining us thus far. Please do not relent in your prayers, we do not take them for granted. We shall continue to keep you all informed as events unfold.”

Killing of non-indigenes in South East: Presidency warns against retaliation

The Presidency has cautioned against retaliatory violence, following the viral videos of the alleged killings of non-indigenes by the Eastern Security Network (ESN) and the Indigenous People of Biafra (IPOB).

TheNewsGuru.com (TNG) reports the presidency also cautioned the general public against the indiscriminate sharing of posts on social media, to deny vested interests who seek to divide the country the chance to do so.

In a statement released on Wednesday in Abuja by President Muhammadu Buhari’s Senior Special Assistant on Media and Publicity, Malam Garba Shehu, the presidency also cautioned against any knee-jerk reactions, the creation of panic, and disruption of lives and livelihoods.

Shehu stated, “While expert agencies are now verifying the factuality and veracity of the claims that accompany the horrid pictures being circulated, we call on all citizens to avoid hasty steps or conclusions that could exacerbate the situation, and on the contrary keep to a line of conduct that will help the law to take its proper course.’’

The presidential aide quoted President Buhari as condemning the “wild, barbarous and wanton killings of innocent people” in the South-East as well as the other parts of the country, describing it as “deeply distressing.”

The president warned the perpetrators of the acts to expect tough response from the security forces.
