  • Kano: 500 private lawyers to defend Gawuna in Supreme Court

Kano: 500 private lawyers to defend Gawuna in Supreme Court

No fewer than 500 private legal practitioners have volunteered to defend Alhaji Nasir Gawuna, the Kano governorship candidate of the All Progressives Congress (APC) at the Supreme Court.

Mr Joseph Onwudiwe, a spokesperson for the lawyers, under the aegis of the Guardians of Democracy and Rule of Law, stated this at a news conference in Abuja on Tuesday.

Onwudiwe said that the gesture was to enhance the country’s democracy.

“Nigerians have observed keenly the situation unfolding in Kano State regarding the March 18 governorship election.

“As a group saddled with the onerous responsibility of safe guarding our democratic ethos and values, we are no longer comfortable with the unwarranted attacks on the judiciary.

“And certain moves to blackmail the Court into giving backing to wanton electoral malfeasance and vote heist.

“We will no longer fold our arms as lawyers and watch the judiciary be continuously harangued and the temple of justice desecrated by a group of people who failed to perfect an electoral heist,” he said.

Onwudiwe applauded the sound reasoning that resonated in the judgments of the tribunal and the Court of Appeal.

He said that the judgments aligned with the yearnings and aspirations of the majority of Kano people as expressed in the valid number of votes cast in the March 18 Kano Governorship election.

He said the group was not surprised that Gov. Abba Yusuf of Kano State and his agents had become insistent in selling propaganda in the name of a contradiction in the CTC of the Appeal Court Judgment.

“Nigerians will have nothing but pity for a party in a suit who finds no premise upon which to launch a successful appeal against a judgment backed by law and fact.

“May we repeat here that the judgment of the Court of Appeal on this case was a very straight forward one which rightly dismissed the appeal of

Abba Yusuf and upheld his sack by the tribunal,” he said.

He said that the courts envisaged clerical errors in judgment and therefore embedded in their handbook and rules, enactments that empowered it to vary its judgement to reflect original intentions.

Onwudiwe urged Nigerians not to cave into the misleading narrative being pushed by the agents of Yusuf who were grasping at the clerical error on page 67 of the CTC of the Court of Appeal judgment.

This, he said, was geared to bring the honourable justices who delivered the sound judgment to public disrepute.

He stressed that the importance of the judiciary in keeping the country’s democracy alive and thriving could never be overemphasized.

“We are with the judiciary and we assure them of our unflinching support as they move to save Nigeria’s democracy from vote riggers and election fraudsters.

“We must sanitise our electoral system now and build a strong democratic wall against vote inflation and other electoral malfeasance,” he said.

He called on peace-loving Nigerians to rise in defense of the country’s democracy.

  • BREAKING: Massive Protests in Kano over A’Court decision to Sack Gov Yusuf

BREAKING: Massive Protests in Kano over A’Court decision to Sack Gov Yusuf

Protests across Kano State following the Appeal Court’s decision to remove Governor Abba Yusuf from office.

The demonstrations, which began on Wednesday, have seen angry residents block roads and set bonfires in a clear display of their disapproval of the court’s ruling.

Unrest in the state intensified following the release of the Certified True Copy of the judgment, which appeared to contradict the initial verdict handed down by the appellate court. The discrepancy fueled tensions among Yusuf’s supporters, who vowed to continue their protests until justice was served.

Prior to the protests, police authorities in Kano had warned against any form of demonstration, citing fears of violence.

Recall that the Independent National Electoral Commission (INEC) had declared Yusuf of the New Nigeria Peoples Party (NNPP) the winner of the 2023 gubernatorial polls in the state. However, the state governorship election petitions tribunal nullified his victory.

In September, the Court of Appeal upheld the tribunal’s decision, ruling that Yusuf’s name was not on the NNPP’s register of members, rendering him ineligible to contest the election. The court consequently declared Nasiru Gawuna of the All Progressives Congress (APC) as the rightful winner of the poll.

Certified copy of Appeal Court judgment reveals Yusuf duly elected gov – Kano AG

A certified copy of the Court of Appeal judgment on Kano State governorship election has affirmed the victory of Kabiru Yusuf as the duly elected governor of Kano state.

The state Attorney-General and Commissioner for Justice, Mr Haruna Isa-Dederi, made the disclosure while addressing newsmen on Tuesday in Kano.

Isa-Dederi said in the fresh revelation as contained in the written judgment, the Court of Appeal set aside the judgment of the Kano election petition tribunal for lacking in merit.

“The evidence contained in page 67 of the the copy of the Appeal Court judgment released on Tuesday and signed by Registrar Jameel Ibrahim Umar, the appellate court upheld the victory of Abba Kabiru Yusuf of the New Nigeria Peoples Party (NNPP) as duly elected Governor of Kano state,” he said.

The three member panel of the Appeal Court on Nov. 17, 2023, had dismissed the appeal filed by Yusuf on the basis of his membership status of NNPP.

The appellate court subsequently affirmed Nasiru Yusuf Gawuna of the All Progressives Congress (APC) as winner of March 25, 2023, governorship poll in Kano.

However, Dederi noted that page 67 of the certified copy of the judgment clearly indicated that the tribunal’s ruling that sacked Yusuf was set aside.

He averred that contrary to what the Judges read to the public in the court room on the 17th November, the written evidence has vindicated Yusuf as the legitimate governor of Kano state.

According to the attorney general, this latest discovery will strengthen their position at the Supreme Court.

Appeal Court Judgement: Police uncover plans to cause violence in Kano

The Police Command in Kano State on Monday alerted the public of plans by some groups of political party supporters to cause violence in the state.

According to the command’s Public Relations Officer, SP Abdullahi Kiyawa, the groups plan to take to the street to protest the Appeal Court’s verdict on the governorship election in the state.

He however said that the command had taken appropriate security measures to prevent escalation of tensions that may lead to breakdown of law and order.

“It is on this note that the police command issue this warning to residents of the state to be extra careful as whoever intends to conduct any protest or procession should do so in accordance with the provisions of the law,” Kiyawa said.

He said that the Commissioner of Police, Usaini Gumel, has urged residents to be calm and avoid any form of unlawful gathering, protest or procession that may trigger violence.

The spokesman said joint security teams have been deployed to strategic locations to safeguard peace and order throughout the state.

“Whoever attempts to disrupt the peace in the state will be arrested and made to face the wrath of the law,” he added, and urged residents to report any suspicious movement, persons or items to security agents for prompt response.

  • Ousted Kano gov, Yusuf heads to Supreme Court

Ousted Kano gov, Yusuf heads to Supreme Court

Gov. Abba Kabir Yusuf of Kano State on Saturday announced his intention to appeal against Friday’s dismissal of his election by the Court of Appeal at the Supreme Court.

“I hereby inform the people of Kano State and well-meaning Nigerians that based on consensus of our stakeholders we have instructed our lawyers to appeal against the judgment at the Supreme Court.

“We are optimistic that the Supreme Court will set aside these miscarriages of justice by the Election Petition Tribunal and the Appeal Court.

“We are also optimistic that the Supreme Court will reaffirm our mandate given by the people of Kano State,’’ he said in a statement issued by his media aide, Mr Bature Dawakin-Tofa.

Yusuf called on Kano State people to go about their legitimate businesses as government had taken necessary measures to ensure the security of their lives and properties as a cardinal responsibility.

He assured that the temporary setback would not deter his administration from its commitment to continue with its laudable projects and programmes to restore the lost glory of the state.

He said he would instead roll out more initiatives to deliver dividends of democracy to citizens and residents of Kano State.

Yusuf also called on people of the state and other well-meaning Nigerians to continue to pray for Kano for God’s mercy and protection to save the state from injustice and from mischief makers.

The Court of Appeal in Abuja nullified Yusuf’s election on Friday in a unanimous ruling by the three-man panel on the ground that he was not a valid candidate in the March 18 gubernatorial election.

The court stated that evidence presented by parties convincingly established that Yusuf was not a member of the New Nigeria Peoples Party (NNPP) at the time of the election.

It held that this made Yusuf ineligible to contest the governorship election under the 1999 Constitution as amended, since he was not validly sponsored by the NNPP.

“A person must be a member of a political party before he can be sponsored for an election.

“Sponsorship without membership is like putting something on nothing, Justice M. U. Adumeh, panel chairman stated while delivering the judgment.

The appellate court consequently affirmed the earlier judgment of the Kano State Governorship Election Petition Tribunal, which had nullified Yusuf’s election.

In a virtual judgment read on Sept. 20, the Election Petition Tribunal ousted Yusuf from office and declared Nasiru Yusuf Gawuna of the All Progressive Congress (APC) as the winner of the election.

The tribunal, led by Justice Oluyemi Akintan-Osadebay, determined that certain ballot papers, pivotal in declaring Yusuf as winner, lacked the necessary INEC signatures and stamps.

Consequently, 165,663 votes credited to the NNPP candidate were declared invalid.

After deducting the invalidated votes, Yusuf who was initially declared winner with 1,019,602 votes, saw his tally reduced to 853,939 votes.

In the turn of events, his closest rival, Gawuna, the APC candidate, emerged as the new winner with 890,705 votes.

Heavy security in Kano ahead of governorship election judgment

Security has been beefed up in Kano following the judgement of the Appeal Court on the state governorship election petition.

The Nigerian police force said that they have deployed adequate personnel and equipment in strategic locations in the state to ensure the security of life and property.

The command also stated that this action is necessary to forestall any attempt to cause disturbance or breakdown of law and order in the state.

This is contained in a statement issued on behalf of the state commissioner of police, Muhammad Usaini Gumel, by the police public relations officer (PPRO) Abdullahi Haruna Kiyawa, yesterday in Kano.

Gumel reiterated that the Police Command, in conjunction with other security agencies in the state, will not give room for any unscrupulous persons trying to jeopardize the security arrangements and as such residents are encouraged to go about their daily activities.

“The police and security agencies are assuring the good people of the state of adequate security before, during and after the declaration of the appeal judgement,” he said.

He added, “Residents of Kano State are also expected to play their part in avoiding to be involved in the breakdown of law and order. In view of this, the following advisories are issued:

“Politically motivated clustering of people at location under whatever guise will not be allowed.

“Engaging in mass actions, suggesting preparation for violent processions, protests or celebrations that may trigger reactions should be avoided.

“Unguarded statements from politicians likely to increase unnecessary tension or undermine the security arrangements and the sanctity of the judicial system should be avoided,”

Recall that the Appeal Court in Abuja has reserved judgement on an appeal filed by the state governor, Abba Kabir Yusuf, over his sack by the Election Petition Tribunal ruling which gave verdict in favour of the governorship candidate of the ruling All Progressives Congress (APC), Nasiru Yusuf Gawuna.
