JUST IN: Kuje prison medical doctor in trouble over Binance exec’s health status

A Federal High Court, Abuja, on Tuesday, issued a bench warrant for the arrest of Dr Abraham Ehizojie, the Medical Doctor at the health facility of Kuje Correctional Centre.

The warrant was issued over alleged refusal to produce the medical report of Tigran Gambaryan, the detained executive of Binance Holdings Ltd.

Justice Emeka Nwite gave the order following an application by Gambaryan’s lawyer, Mark Mordi, SAN.

Gambaryan was whisked into Court 9 of the high-rise building in a wheelchair earlier in the morning.

Gambaryan, alongside the cryptocurrency firm, is facing a money laundering charge preferred against them by the Economic and Financial Crimes Commission (EFCC).

Justice Nwite had, on July 5, ordered the management of the Nigerian Correctional Service (NCoS) to release the medical certificate of Gambaryan on or before July 16 (today).

The judge gave the order following an application by Mordi.

Mordi had prayed the court to summon Ehizojie to explain why he had allegedly refused to make available his client’s medical report despite earlier court order.

Gambaryan had, on May 23, collapsed in the open court over alleged ill-health.

The defence law firm, Aluko & Oyebode, had also, on May 27, raised alarms that the cryptocurrency firm’s executive, might die in Kuje Correctional Centre over his alleged deteriorating health.

At the resumed hearing on Tuesday, Mordi said in open court that the judge’s order had not been complied with.

The judge then asked a prison official who brought Gambaryan to court about the development.

The prison official said he got the court order and delivered the order to the doctor on July 9 (Tuesday).

“He is not here and I expected him to be here,” he added.

The EFCC counsel, Ekene Iheanacho, told the judge that he thought that the medical officer would be in court today.

Mordi then prayed the court to issue a bench warrant against the medical officer of the correctional centre to be produced in court in the next adjourned date.

The lawyer also asked the court to make an order for his client to be given hospital remand immediately so that thorough medical examination could be carried on him to know his true state of health.

“My client came in here on a wheelchair.  He has been complaining of back pain.

“We need to be careful of the life in our hands,” Mordi said.

Iheanacho, who did not dispute the fact that the defendant should be given adequate treatment, disagreed that Gambaryan should be placed in hospital remand.

After listening to counsel’s submissions, Nwite said it was unfortunate that a government institution would be treating a court order with levity.

“I hereby make an order of bench arrant on the medical doctor at the Kuje Correctional Service, to appear before this court,” he said.

He also ordered that Gambaryan be taken to the Nizamiye Hospital for medicare for 24 hours, at any time of his choice but under full security surveillance.

The judge adjourned the matter until Oct. 11 and Oct. 18 for continuation of trial.

Earlier, Dr. Olubukola Akinwunmi, Head, Payment Policy and Regulation Division at the Central Bank of Nigeria (CBN), gave evidence and was cross-examined by Babatunde Fagbohunlu, SAN, counsel for Binance, the 1st defendant in the criminal charge.

UNICAL: Court remands suspended Law professor in Kuje Prison

A Federal High Court on Monday ordered that Prof. Cyril Ndifon, the suspended Dean of Faculty of Law, University of Calabar (UNICAL), charged with alleged sexual harassment be remanded in Kuje prison.

Ndifon, who is being prosecuted by the Independent Corrupt Practices and Other Related Offences Commission (ICPC) before Justice James Omotosho, however pleaded not guilty to the four-count charge.

The ICPC, though its counsel, Ebenezer Shogunle, had filed the charge marked: FHC/ABJ/CR/511/23 on Oct. 30, 2023 against Ndifon.

In count one, the defendant was alleged to have, between June and September 2023, used his office and position to gratify himself by soliciting for nude photographs and videos from a year 2 diploma female student of the university through Whatsapp chats on his telephone number: 08037066222, contrary to and punishable under Section 19 of the Corrupt Practices And Other Related Offences Act, 2000.

In count two, he was alleged to have corruptly requested for nude photographs and videos from a 400level female student of the Faculty of Law with the plan of changing her project supervisor to himself in order to guarantee favourable grades for her and offence was contrary to and punishable under Section 8(1)(a) (il) of the agency’s Act.

in count three, he was alleged to have corruptly requested to see photographs of a 16-year-old prospective post UTME female student, as an inducement to consider her for admission into the Faculty of Law contrary to and punishable under Section 18(d) of the Act.

Count four accused him of causing a female student to send pornographic, indecent and obscene photographs of herself to him through Whatsapp chats on his telephone number: 08037066222 between May and September 2023, contrary to and punishable under Section 24 of the Cybercrime (Prohibition & Prevention) Act, 2015.

These, Ndifon was alleged to have committed while being a public officer charged with responsibility for the certification of students as fit in learning and character as a prerequisite for the award of Bachelor’s degree in Law and admission into the Nigeria Law School.

After the charge was read to him, the embattled lecturer pleaded not guilty to the counts.

Ndifon’s counsel, Okon Efut, SAN, took his bail application dated Jan. 2 and filed Jan. 3.

Efut prayed the court to admit his client to bail, particularly on health grounds.

Besides, he informed the court that there were four other grounds why Ndifon should be granted bail.

Speaking from the dock, Ndifon said: “My lord, I was supposed to have an eye surgery on Glaucoma.”

Efut told the court that it was on the basis of his health condition that the magistrate court in Calabar admitted him to bail on Oct. 27, 2023, after being in detention for about 22 days.

He said based on the medical report, the surgery was expected to be carried out on Jan. 11.

ICPC Lawyer, Osuobeni Akponimisingha, opposed the application for bail.

He said on receipt of the process, the commission filed a counter affidavit dated and filed Jan. 5.

The lawyer, who alleged that one of the counsel to Ndifon threatened the commission’s star witness on phone, said they were in possession of the call logs.

Akponimisingha argued that one of the cardinal reasons for granting bail was the assurance that a defendant would not interfer with the case.

He further alleged that the lawyer’s name was in the bail application filed by Efut and that he was also at the court sitting.

Justice Omotosho then asked the lawyer to come forward.

“What is your name?” he asked.

“Sunny Anyanwu is my name my lord,” he replied.

The judge then asked him if he would wish to respond to the allegation by filing affidavit of facts and he responded in affirmative.

Anyanwu, who admitted calling Tochi Kanu on phone, said the person he called was different from the names of the four witnesses in the charge and proof of evidence.

“Tochi Kanu called me. When she called me, I was at Federal High Court here and I said I will call you later through a message.

“It was much hours later I remembered somebody called me and put a call through.

“At that point, there was a network issue and I was saying hello, hello and the call was cut off.

“And that name they (ICPC) called was not in the proof of evidence. They have four witnesses,” he said.

When the judge asked him his interest in the matter, he said Ndifon was his lecturer and that he came as counsel to defend him or support the defence.

Justice Omotosho then asked Akponimisingha the name of the person that was alleged to have been called.

“The name is Tochi Kanu Jane,” he said.

The judge therefore directed Anyanwu to file his affidavit of facts for the court to decide on the issue.

But Omotosho wondered why Ndifon had not gone for the surgery since Oct. 27, 2023, when the magistrate court granted him bail.

Akponimisingha told the court that the medical report was served on them late and they were still verifying its genuineness.

Justice Omotosho, who ordered Ndifon to be remanded in Kuje Correctional Centre, adjourned the matter until Jan. 10 for hearing of the bail application and to enable Anyanwu filed the affidavit of facts.

I did not visit Kuje prison to see Emefiele – Ooni of Ife clarifies

Ooni of Ife, Oba Adeyeye Ogunwusi, Ojaja II, says his visit to Kuje Custodial Centre in the FCT was part of advocacy to commemorate his 8th-year ascension to the throne.

He said in his palace on Thursday that his visit to the centre was not to visit embattled former CBN governor, Mr Godwin Emefiele, as reported by some sections of the media.

Ooni clarified while receiving two vehicles and three motorcycles presented to him by an indigenous vehicles manufacturing company, Innoson Vehicle Manufacturing Company Ltd.

“I don’t understand why people just misread things in this country. A letter was written to the Nigeria Correctional Service and to the custodial centre in Ile-Ife about my visits.

“I had an assignment in Abuja and Kuje Correctional Centre happened to be nearby. Then, as part of my coronation anniversary, I visited the custodial centre.

“The Hope Alive Initiative, a pet project of one of my queens had a programme in Abuja and I joined to give hope to the hopeless,’’ the Ooni said.

He stressed that he decided to give hope to people in custodial centres regardless of their statuses and it was a humbling experience.

The traditional ruler expressed consternation that some sections of the media misrepresented and misconstrued his visit.

Oba Ogunwusi called on Nigerians to focus on positive issues and on how the country would improve, rather than dwelling on inanities.

The Ooni expressed appreciation of Innoson Vehicles Manufacturing Company Ltd. and appealed to leaders and Nigerians to embrace the use of Made-in-Nigeria products instead of promoting foreign goods.

“We should not allow our local industries to die. We don’t need to benchmark our economy on the dollar.

“I am using this anniversary to appeal to our leaders to stop promoting foreign products. We are the ones killing our industries in this country.

“We must continue to support local companies to grow our economy. It is time we looked inwards in the area of manufacturing.

“Our leaders must promote the local economy through indigenous companies. Let our leaders support local industries to allow our unemployed youths to be gainfully employed,’’ the Ooni admonished.

The paramount ruler charged the National Assembly to make laws to ensure that 70 per cent of goods consumed in the country are locally-made.

“If we consistently patronise Made-in-Nigeria goods, standardisation will set in and the country will develop the more.

“Most of the products I use are locally-made. I want this nation to grow,’’ he stressed.

Ooni Ogunwusi also enjoined Nigerians to support the administration of President Bola Tinubu so it could deliver the dividends of democracy to the citizenry.

  • Again, court sends EFCC boss, Bawa to prison for contempt

Again, court sends EFCC boss, Bawa to prison for contempt

Justice R. O. Ayoola of the Kogi State High Court on Monday committed the Chairman of the Economic and Financial Crimes Commission (EFCC), Abdulrasheed Bawa to prison for alleged contempt.

The judge, who awarded N10 million against EFCC, ordered the Inspector-General of Police (IG) to arrest Bawa forthwith wherever he is and send him to the Kuje correctional Centre for two weeks without any delay until he purges himself of the contempt.

The judge gave the order while delivering his judgement on an application brought before him by one Ali Bello, through his Counsel, S. A. Abass, who prayed the court to commit the EFCC boss for disobeying a court ordered earlier granted by him (Ayoola).

Ayoola had on December 12, 2022 delivered a ruling, in favour of Bello, who had dragged EFCC to court for arresting and detaining him illegally.

But three days after his freedom as ordered by the court, the EFCC went ahead and rearrested and rearraigned him for alleged money laundering.

To justify its action, the anti-agency had filed a fresh application for setting aside and stay of execution of the ruling earlier issued by the court for lack of merit.

Consequently, Justice Ayoola, in Form 49, Order IX, Rule 13, marked: “HCL/697M/2022” and titled: “Notice to Show Cause Why Order of Committal Should not be Made,” on the EFCC boss for disobeying his order.

The judge ordered Bawa to appear before him on Jan. 18, to explain why he should not be jailed for flouting the order given on Dec. 12, 2022 in a case filed by Ali Bello against EFCC and Bawa, as the 1st and 2nd respondents, respectively.

Ayoola ordered that the EFCC and Bawa be served the motion of notice together with Form 49 by substituted means.

“Your arrest and detention of the applicant (Bello) in the face of a subsisting Court order made by this honourable Court of competent jurisdiction and without a warrant of arrest “or being informed of the offence for which he was arrested.

“Your action is unlawful, unconstitutional and in contravention of the personal liberty and dignity of human person guaranteed under Chapter IV of the Constitution of the Federal Republic of Nigeria 1999 (as amended), ” the judge declared.

He also ordered the respondents in the matter to tender an apology to the Bello in a national newspaper and awarded N10 million compensation for him.

ISWAP commander behind Kogi bomb blast, Kuje prison attack arrested by DSS

An Islamic State West Africa Province (ISWAP) member responsible for the blast near the Palace of Ohinoyi of Ebiraland in Okene, Kogi State and the Kuje prison attack  has been arrested by men of the Department of State Services (DSS).

The Vehicle-Borne Improvised Explosive Device (VBIED) attack occurred on 29th December during the visit of President Muhammadu Buhari to commission some projects.

Acoording to a statement signed and released by Peter Afunanya , the Spokesman for the Department of State Services, Abdulmumin Ibrahim Otaru (a.k.a. Abu Mikdad) was fingered as the mastermind of the attacks.

Otaru, described as “a high commander” of the terrorist organization, either coordinated or was involved in several other attacks.

The DSS mentioned the 24th June, 2022, attack on Police Area Command in Eika-Ohizenyi, Okehi LGA of Kogi. Inspector Idris Musa was killed and two AK-47 rifles carted away.

Otaru participated in the 5th July, 2022 breach of the Kuje Medium Security Custodial Centre in Kuje Area Council, Abuja.

On 5th August, 2022, he took part in the attack on West African Ceramics Ltd (WACL) in Ajaokuta LGA, Kogi. Three Indians were kidnapped.

The security agency also announced the arrest of one of the ISWAP topshot’s associates, Saidu Suleiman on 3rd January.

Afunanya disclosed that Otaru sustained a gunshot injury on his left foot while attempting to escape and is receiving treatment at a health facility.

“Otaru operated terrorist cells in and around Kogi State. Similarly, he and his gang had staged several kidnap operations in Kogi and Ondo States”, the PRO added.

The DSS has now appealed to the citizens of the country to always cooperate with the agency by being helpful with information  in their quest to rid the country of criminal activities,

Recall that the Kogi government  accused disgruntled politicians of being responsible in the explosion where few persons lost their lives.
