Lawyers for Manchester United captain Harry Maguire have appealed against Greek court convictions on multiple charges following a brawl on the island of Mykonos last week, according to sources.

Two of the sources close to the process told Reuters that the appeal was filed on Wednesday morning.

They added that the case would be retried within the next two years by a court on the nearby island of Syros.

The 27-year-old England and Manchester United defender was found guilty of repeated bodily harm, attempted bribery, violence against public employees and insult.

This was after his arrest in a brawl in which two police officers were assaulted.

He was handed a suspended prison sentence of 21 months and 10 days.

Following the verdict, Maguire, who was not present at the trial, said in a statement: “I remain strong and confident regarding our innocence in this matter —- if anything myself, family and friends are the victims.”

Maguire’s brother Joe and friend Christopher Sharman were also found guilty of offences related to the incident and received suspended prison sentences.

    They denied any wrongdoing.

England coach Gareth Southgate withdrew Maguire from his squad for next month’s UEFA Nations League matches against Iceland and Denmark.

Ioannis Iakovos Paradisis, the lawyer who represented the police officers on Tuesday, confirmed an appeal had been filed on behalf of all three men.

He said that since the case would be heard again, the defendants would have the opportunity to appear in court this time and provide explanations.

“Even if they believe that they are innocent, they could have said they are sorry,” Paradisis said.

  • Babatunde Ajibade: Behold, a silent, goal-getter, quintessential Lawyer from the South West

Babatunde Ajibade: Behold, a silent, goal-getter, quintessential Lawyer from the South West

The South West region of Nigeria is home to several successful legal luminaries both living and dead. The region can successfully tackle head-for-head other parts of the country and indeed the African continent in terms of the creme de la creme of the law profession.
Aside from late heavyweight lawyers such as Adeyemo Alakija, Bode Thomas, Samuel Akintola, Obafemi Awolowo, Fredrick Rotimi Williams, Bola Ige, Gani Fawehinmi and a host of others who have made indelible marks on the sands of time, the judicial system in Nigeria still parades seasoned, quality and unrivaled lawyers who have raised the bar of the profession higher than they met it.

One of such fine lawyers from the South West doing the nation proud is Dr. Babatunde Ajibade. With a career spanning over 30 years, Ajibade is a perfect description of the ‘let your achievements speak for you’ kind of person. Humble, resilient and unassuming, Ajibade’s career is unarguably one of the few that stands tall amidst several noisy, controversial and corruption stained lawyers in the country.

    Education

Ajibade graduated from the Obafemi Awolowo University (OAU), Ife in 1988 and was admitted to the Nigerian Bar in 1989. He obtained an LLM degree in corporate and commercial law from King’s College London in 1990 and a PhD in private international law from the same university in 1996.

    Sterling Achievements

In 2007, he became the first member of the 1989 call set to be conferred with the prestigious rank of Senior Advocate of Nigeria (SAN). He was awarded the International Practice Fellowship of the International Bar Association in Madrid in October 2009 and became a Fellow of the Chartered Institute of Arbitrators UK (Nigeria Chapter) in January 2015.

    Interest in NBA Presidency

Dr. Ajibade’s interest in the foremost leadership position of the Nigeria Bar Association (NBA) is hinged on his passion and commitment to reposition and realign the association to its pivotal role of promotion and protection of human rights, the rule of law and good governance in Nigeria. The unassuming legal luminary while sharing his motive for seeking the NBA presidency with select journalists recently in his Lagos residence said: I became qualified as a lawyer in 1989. I joined this profession with great aspirations for myself and the profession. But over time, I have seen a consistent decline; decline such that lawyers are now treated with utmost disrespect in society. I have seen a situation where our justice sector has become dysfunctional and our clients are beginning to query the utility of using our services because we are incapable of delivering a service, either at all or within a reasonable time. We are incapable of delivering a service that is predictable. We are now in a situation where you tell your client that this is definitely the position, only for you to recant and say the judge decided otherwise, even though the law appeared to be clear. I have consistently maintained over the years that something is fundamentally wrong with our justice system and it must be fixed for the good of our society. Fortunately, I am not a lone voice on this subject matter. I strongly believe that it is no longer productive to grumble on the sidelines, it is now time for us as lawyers to reform our sector and protect our society.

Driving home the point on why he should be trusted with the mandate, Ajibade told fellow lawyers: We are fighting for the soul of our nation because if you don’t fix the justice sector, you cannot fix anything in Nigeria. So, I am confident and optimistic that lawyers of like minds across the country will find my candidacy appealing and together we can reform our sector.

    Humility and integrity

Dr. Ajibade is reputed for his integrity and character. He epitomizes humility and believes that there should be mutual respect among lawyers as professional colleagues regardless of rank or seniority. He is a great advocate for professionalism and strict adherence to the Rules of Professional Conduct for the legal profession. It is therefore not surprising that he was appointed Chairman of Panel B of the Legal Practitioners’ Disciplinary Committee for Lagos on 11 July 2017.

Dr Ajibade SAN’s practice straddles both corporate/commercial practice and litigation. He is a Senior Advocate of Nigeria, but he has also chaired the Capital Markets Solicitors’ Association (CMSA). His significant experience in corporate/commercial practice and litigation means that he occupies that peculiar position that enables him to understand the challenges that corporate/commercial lawyers and litigators face in their areas of practice.
Dr Babatunde Ajibade, SAN is very passionate about the legal profession and is eager to play a major role in finding lasting solutions to the challenges that plague it. The law firm which he leads as Managing Partner (i.e. S. P. A. Ajibade & Co.) has for the past 12 years been organising an annual business luncheon. These events to which the firm commits significant resources every year, present opportunities for lawyers and other stakeholders in the justice delivery system to come together to discuss issues that affect the legal profession.

Meritorious service to the legal profession

Dr Babatunde Ajibade, SAN’s career has been characterised by quiet and efficient service to the legal profession. He is a founding member of the Nigerian Bar Association (NBA) Section on Business Law (SBL) and played a significant role in setting the SBL on the course on which it is today. Following the dissolution of the leadership of the SBL by the NBA leadership at the National Executive Committee which held in Gombe in November 2010, Dr Ajibade, SAN was a member of the Council “appointed” by the NBA to run the SBL. Working together with other members of the Council and in particular, its Chairman, Mr. Yemi Candide-Johnson SAN, Dr. Ajibade worked tirelessly to ensure that this NBA appointed Council was short lived. It was in recognition of this effort that he was appointed to Chair the nominations committee that conducted elections in which Mr. Gbenga Oyebode, MFR was “elected” Chairman of the SBL in January 2012. He chaired the Committee that planned and executed the hugely successful SBL Conference which was held in Abuja in 2016. Dr Ajibade, SAN was a member of the Governing Council of the SBL between 2014 and 2018.
Dr Ajibade’s service to the NBA extends well beyond the SBL. He was a member of the National Executive Committee (NEC) of the NBA between 2016 to 2018. He is also currently a member of the NBA NEC having been so appointed by the President of the NBA, Mr. Paul Usoro, SAN. Between 12 to 15 October 2009, Dr Ajibade, SAN was a member of the NBA Legal Services Trade Mission to the United Kingdom. On 30 November 2012, he was appointed a member of the Liberalisation of Legal Services Working Group by the then President of the NBA, Mr. Okey Wali, SAN. This group was tasked with the responsibility of advising the NBA on the merits and demerits of liberalising access to the Nigerian legal services market by allowing foreign qualified legal practitioners practice law in Nigeria.

Dr Ajibade’s service to the NBA also extends to the branch level of the NBA. In 2008, he was the lead presenter at the Law Week of the NBA Akure Branch. On 27 October 2011, he was the speaker at the NBA Ibadan Law Week Dinner. He chaired the Committee that planned the 2014 Law Week of the NBA, Lagos Branch. He sponsored the 9th Law Week of the NBA Ikorodu Branch which held on 12 May 2015. He also sponsored the meeting of the NBA NEC that took place in Ado-Ekiti, Ekiti State between 5 – 7 June 2014.

Dr Ajibade SAN’s passion for the legal profession led him and other lawyers under the auspices of CRID-Law Net (which is an initiative of the Lagos Chamber of Commerce) to draft an “Administration of Civil Justice Bill” which it is hoped will completely revolutionize administration of civil justice in Nigeria when passed into law. Through the effort of Dr Ajibade, SAN and his colleagues in CRID-LawNet, Ekiti State has enacted the Bill into law and discussions are at an advanced stage with the Lagos, Ogun and Oyo State Ministries of Justice on the possible enactment of the Bill into law.

Dr Ajibade, SAN is a strong advocate of a united Bar. He is of the strong persuasion that to solve the many challenges facing the profession, we must be united. According to Dr Ajibade, SAN, the dividing lines we draw between corporate/commercial lawyers and advocates, between law officers and the traditional Bar, between in-house counsel and external counsel, between young lawyers and senior lawyers and even the divisions across nationalities and ethnicities hamper rather than aid the course of the legal profession in Nigeria. While different segments of the profession have peculiar challenges, Dr Ajibade, SAN believes that to successfully fight off threats to the rule of law, encroachment into our profession by foreign lawyers and other professions in Nigeria, and a myriad of other problems the legal profession faces, we must take steps to unite the Bar.

Presidential Aircraft: Lawyer sues Buhari’s last daughter, Hanan

One of the daughters of President Muhammadu Buhari, Hanan has been sued before the High Court of the Federal Capital Territory (FCT) over her alleged unlawful use of one of the aircraft in the Presidential fleet for her private assignment.

The court, in the suit marked: CV/1023/2020, filed February 6, 2020 by Oluwatosin Ojaomo, is asked to among others, declare as unlawful, Hanan’s alleged use of the aircraft for her private engagement in Buachi State on January 10 this year.

The plaintiff, in a statement of claim, that not being a public officer, the President’s daughter was not entitle to fly in any of the presidential aircraft at a cost to the state.

Ojaomo said: “I know for a fact that the presidential fleet with the Nigeria Air Force is not a property of the defendant (Hanan) or Major General Muhammadu Buhari, the President and Commander in Chief of the Armed Forces of the Federal Republic of Nigeria, but rather, the property of the people of Nigeria, which is provided only for the President to perform his official functions and nothing more.

“I know for a fact that a huge sum of money has been spent, from public purse, to offset the flight fuelling and other logistics to fly the aircraft to Bauchi State. by the Federal Government of Nigeria.

“The defendant is bound to pay for the said cost to the Federal Government, since she has decided to commercialise one of the aircraft in the presidential fleet of the Nigeria Air Force for her private function.”

He is praying the court to among others, declare that “the defendant has no statutory right to privatise the usage of the presidential aircraft. which is provided for the President of the Federal Republic of Nigeria and other public officers for official functions.”

The plaintiff, who wants the court to compel the defendant to refund what it cost to ferry her to Bauchi on the presidential aircraft, equally wants the court to issue a perpetual injunction to restrain the defendant from further deploying the presidential aircraft for her private use, not being a public officer.
The case is yet to be assigned for hearing.

  • Lawyer sues Buhari’s daughter, DSS for N500m

Tope Akinyode, lawyer to Mr Anthony Okolie, an Asaba-based businessman detained for 10 weeks by the DSS for owning a SIM card previously registered in Hanan Buhari’s name, has made good his threat to sue all the parties involved in Okolie’s ordeal.

A suit has now been filed in which Okolie is asking President Buhari’s daughter, the Department of State Services (DSS) and MTN, to pay him N500 million compensation.

Mr Okolie, 33, was arrested on July 19, 2019 in Asaba.

The suit, with number FHC/ASB/CS/3/2020, is seeking an order to “compel the respondents (DSS, Hanan and MTN) jointly or severally to pay the applicant the sum of N500,000,000 only as general and aggravated damages for the gross and unlawful violation of the applicant’s right to acquire moveable properties, freedom of movement and self-dignity.”

Okolie said in the suit that he was detained with handcuffs until September 22, 2019, as the DSS waited for Hanan, who was schooling in the United Kingdom, to come and clear him but she never did.

The trader also attached the receipt he was issued after purchasing the SIM card as well as the SIM certificate.

According to the affidavit, he bought the SIM card on December 8, 2018, with phone number, 09035666662, for the sum of N1,000.

Okolie asked the court to declare that his long detention was an abuse of his fundamental human rights and that the actions of the DSS contravened sections 35 and 34 of the 1999 Constitution.

  • Court merges Atiku’s lawyer’s, son-in-law’s ‘money laundering’ cases

Court merges Atiku’s lawyer’s, son-in-law’s ‘money laundering’ cases

The Federal High Court in Lagos has consolidated the alleged $2 million money laundering trial of former Vice-President Atiku Abubakar’s lawyer, Uyiekpen Giwa-Osagie, with the alleged $140,000 laundering case of his son-in-law, Abdullahi Babalele.

Both cases will now be prosecuted by the Economic and Financial Crimes Commission (EFCC) before the same judge, Justice Chukwujekwu Aneke.

Uyiepken and his younger brother, Erhunse Giwa-Osagie, were arraigned before a vacation judge, Justice Nicholas Oweibo, on August 14, 2019, on a three-count charge of conspiracy and laundering of $2 million. They pleaded not guilty to the charge. Upon resumption from the court’s long vacation, the EFCC re-arraigned both men before Justice Chuka Obiozor, on the same charge.

Before their pleas were taken, the defendants, through their counsel, Ahmed Raji and Norrison Quakers, both SANs, brought applications seeking a consolidation of their charge with that of Babalele.

Babalele is standing trial before Justice Aneke for allegedly laundering $140,000 in the build-up to the 2019 presidential election.

The Giwa-Osagies told Justice Obiozor that they had written a letter to the Federal High Court’s Chief Registrar for a consolidation of the charge with Babalele’s.

After taking their pleas, Justice Obiozor granted them bail and returned the case file to the court’s registry. The Chief Registrar has now reassigned the case to Justice Aneke.

The Giwa-Osagies will now be arraigned – a third time – on January 14, 2020, before Justice Aneke.

The EFCC alleged that Uyiekpen and Erhunse, on February 12, 2019, allegedly conspired and made cash payments totalling $2 million without going through financial institutions. Uyiekpen was alleged to have procured Erhunse to make the payment.

The offences, according to the commission, contravenes sections 18(c), 18(a), 1(a), 16(1)(d) of the Money Laundering (Prohibition) Act, 2011, as amended, and are punishable under Section 16, 16(2)(b)16(2)(b) of the same Act.

  • Alleged invasion: Nnamdi Kanu’s lawyer sues police, demands N2bn damages

A lawyer to Nnamdi Kanu, leader of the outlawed of the group – Indigenous People of Biafra (IPOB) – Ifeanyi Ejiofor has sued the Nigerian Police Force before the Federal High Court.

Ejiofor, who has since been declared wanted by the police over his alleged complicity in the murder of some policemen, is accusing the security agency, in the fundamental rights enforcement suit, of invading his house and killing of four occupants.

Ejiofor, in the suit marked: FHC/ABJ/CS/135/19, filed by a lawyer, Maxwell Okpara, is seeking, among others, an order to compelling the defendants to pay him N2 billion as compensation and damages for the burning of his house and shooting of his aged mother by the police at his Oraifite hometown in Anambra State on December 2 this year.

Listed as defendants in the suit are the Inspector General of Police, Commissioner of Police, Area Commander, Divisional Police (DPO) in Anambra State, the Nigerian Army, Chief of Army Staff, Federal Republic of Nigeria and the Attorney General of the Federation (AGF).

Ejiofor claimed to have been called to bar over 17 years ago and wants the court to restrain the respondents, their agents and privies from further harassing, intimidating, threatening his life and destroying his house and other properties.

He is also seeking an order of the court stopping the respondents from threatening him with arrest and torture and to compel them to retract the public notice made on December 3, which declared him wanted and to also tender apology to him in five major newspapers and any other form of reparation.

Ejiofor, in a supporting affidavit, claimed that he was in his Oraifite hometown in Anambra State between November 25 and December 1, for the burial of his late brother, Reverend Louis Ejiofor.

He stated that on December 2, his house was still filled with relatives, friends and well-wishers, helping him to evacuate tents, chairs and other materials used for the burial ceremony, when a group of 16 policemen allegedly invaded his house.

His senior brother, who described himself as Evangelist Emeka Ejiofor, further stated, in the affidavit, that the police claimed to be looking for suspects involved in an alleged communal clash and that he spoke on phone with the Area Commander promising that he would make himself available on same day by 11am.

He stated that by 10.15am, the same police squad led by the Area Commander, came ahead of the appointed time and violently invaded his ancestral home with sporadic shooting at every living object.

“In the confusion that ensued, the plaintiff said that four young men were instantly shot dead while his aged mother sustained gunshot injury from the trigger happy officers .

“The dead bodies were evacuated from his house to a market place and burnt there,” he said and referred photographs and video clips, which he claimed showed “the wanton destruction of” the plaintiff’s house by the police .

Ejiofor, who promised to tender the photographs and video clips during trial, added that on December 3 this year, the Commissioner of Police, Anambra State caused a public notice through television stations and other news media that he had been declared wanted without been given adequate time and opportunity to respond to any allegation against him if any.

He, therefore, wants the court to declare the alleged invasion of his house and subsequent shootings and killing of unarmed civilians as barbaric, wicked, illegal, oppressive and a gross violation of his rights to life, dignity of human person, personal liberty, fair hearing and right to private and family life as guaranteed by the 1999 Constitution.

Ejiofor is equally praying the court to declare that the setting ablaze of all buildings and properties in his Oraifite ancestral home in Ekwusigo Local Government of Anambra State by the police is illegal, barbaric, oppressive, unlawful and amounted to a gross violation of his rights to property as guaranteed by the constitution.

He also wants the court to declare that the December 3, 2019 public notice by the police, declaring him wanted, without giving him opportunity to respond to any allegation against him, if any, is illegal, unconstitutional, unreasonable, null and void as the action violates his right to fair hearing as guaranteed by law.

The case is yet to be assigned to any judge for hearing.
