    Video: Drama as two Nigerian lawyers fight with chairs, exchange hot words in court

    Two Enugu based lawyers  were captured verbally and physically assaulting  themselves in a court premises on Thursday in the state.

    Litigants and court officials were shocked seeing both legal practitioners engaging in hot exchange of words.

    The reason for the guagmire between both legal practitioners cannot be ascertained as of the time of filing this report but video show court officials made frantic efforts to put situation under control..

    A viral video also showed the two lawyers lifting chairs and shouting on top of their voices.

    As they fight on, one of the lawyers was heard saying, “He is a very small boy… He is a mad man.”

    The second lawyer warned, “Touch me again…”

    “Who touched you. Look at this mad man,” the first lawyer said.

    ”You lost the case at the appeal and you are here talking”He continued

    ”Who is Pushing You, you should control yourself” Second lawyer

    ”If you touch me again, i will defend myself” First lawyer

    “Look at you. You have bleached yourself like a fool. You have bleached yourself like a woman,” the second lawyer said to his colleague’s retreating figure.

    Keep your opinion on Tinubu’s certificate saga – Agbakoba tells lawyers

    The former chairman of the Nigerian Bar Association, NBA, Olisa Agbakoba, SAN, has warned lawyers to keep their opinions on President Bola Tinubu’s Chicago State University controversy.

    He advised the legal experts to await the Supreme Court judgment before making any comment.

    The senior lawyer expressed displeasure with what he described as the cacophony of discordant voices on Tinubu and former Vice President Atiku Abubakar surrounding the controversy over the CSU records.

    In a post on his social media platform, X, on Monday, the legal expert urged people to keep their opinions and views to themselves while awaiting a decision from the Supreme Court.

    He said, “The cacophony of discordant voices on Tinubu/Atiku over the certificate matter is completely out of hand. This utter nonsense from armchair lawyers is heating up Nigeria dangerously.

    “Please, can we keep our opinions and views to ourselves, awaiting a decision of the Supreme Court?

    “I am so ashamed to see lawyers on television arguing one way or the other on the merits or demerits of the Chicago State University matter. This is most unhelpful!

    “I call out all media that tolerate this nonsense of adjudicating the CSU matter on TV and newspapers.

    “I urge the President of the Nigerian Bar Association to call out lawyers that breach rules of ethics by turning the media into a Court of Law.

    “Can we please stop heating up our country!!! Let us allow the Supreme Court of Nigeria to make a judicial pronouncement which is binding on us all!!!! This public nonsense must stop.”

    A group known as the Coalition of Nigerian Civil Society on Tuesday prayed a Federal High Court to allow it hold a watching brief in the arraignment of immediate past Governor of Central Bank of Nigeria Godwin Emefiele charged with illegal possession of firearms

    The group represented by five senior lawyers stormed the court and took their seats at the back saying they are lawyers in defence of democracy.

    The court has granted them permission to watch.

    Emefiele was arraigned on two-counts bordering on illegal possession of firearms

    Lawyers with disabilities lament discrimination at work, society

    Lawyers with Disabilities have expressed dissatisfaction against the continued discrimination towards them thereby calling on all stakeholders to treat everyone with physical disability same as those without disability.

    The lawyers under the aegis of the Nigerian Bar Association ( NBA) lawyers with Disabilities Forum, however decried the ill- treatment during a one day summit held in Asaba, Delta State on Tuesday with the title:” The Criminality of Disability Discrimination:” Evaluating the Preparedness of law Enforcement Agencies and Relevant Stakeholders”

    According to the Chairperson, Ashia Ahmad El- Rufai, the essence of the Summit was to explore the law as it affects people with disabilities, adding that efforts were geared towards ensuring that the Nigerian Bar Association NBA continues to take into Consideration members that have one Challenge or the other, noting that the NBA President, Yakubu Choname of the Forum, had severally addressed to the discriminating act of persons against lawyers with disabilities. She said” The current president of the NBA, is not happy and I will call on the Nigerian Bar Association at the next NEC meeting to bring up the issue of Changing the name from Lawyers with Disabilities Forum”

    Keynote speaker at the event, Maiz Adam Osigwe ( SAN) represented by Oyinka Badejo, noted that the disabled should be granted the same access as the abled adding that” The need for egalitarian society where everyone regardless of the society standing or physical appearance has access to everything without being subjected to any form of discrimination. This disability may be blindness, deafness and even loss of an essential body part , and this has necessitated the need for a legal system that guarantees freedom from discrimination for these individuals with special needs”

    She added that the Section 1of the Discrimination Against Persons with Disabilities ( Prohibition) Act, expands the rights of the persons with disabilities, noting that abusers will be penalized according to the Act. Also Speaking, the Commissioner of Police, Delta State, represented by Richard Ishiguzo, said that whatever he the request of the forum, it will be made available, adding that reported cases will be attended to at no cost. In a panel of discussion, the Panelists highlighted ares which the government has structured their framework to accommodate persons with disabilities including the Provision of elevators to aid movement to office, allocation of 5percent , allocation of 5percent employment offer for individuals with special needs, among others

    60 Lawyers sue DSS over refusal to release Emefiele

    No fewer than 60 legal practitioners on Monday, approached a High Court of the Federal Capital Territory to begin committal proceedings against the Department of State Services (DSS).

    The lawyers said the suit was hinged on what they described as violation of multiple judgments and orders of court directing the agency to release former Central Bank Governor, Mr Godwin Emefiele.

    The lawyers led by Mr Maxwell Opara and Mr Ahmed Tijani, prayed the court to commit the DSS to prison so the department clears itself of the contempt.

    The lawyers filed a motion before the court for the issuance of Form 48 and Form 49, which are the forms used to commence proceedings to commit a contemnor to prison.

    The lawyers said that by the judgments and orders of Justice M. A. Hassan, Justice Hamza Muazu and Justice Bello Kawu, the DSS Director-General ought to have released  Emefiele from detention.

    In an affidavit in support of the application, the lawyers deposed to the fact Justice  Hassan restrained the respondents, particularly, the DSS from arresting, detaining, or interrogating Emefiele.

    This was with regards to offences connected to terrorism financing, money laundering, round tripping, and financial crimes of national security dimension.

    They also deposed that despite the clear and positive orders of the court, the DSS  went ahead to arrest and detain Emefiele and detained him for over a month while shopping for evidence, which did not exist.

    Addressing newsmen after filing their processes, Opara said the group would pursue the matter to its logical conclusion and ensure that Bichi was sent to prison.

    He said this was to serve as a deterrent to other heads of security agencies that disobedience of court orders would no longer be tolerated.

    Opara also said it was preposterous that the DSS had accused  Emefiele of having committed heinous crimes against the state only for it to now file a charge of possession of a validly registered pump action rifle against him.

    “Is it not clear enough to Nigerians that the DSS is persecuting  Emefiele if after holding him for five weeks they can only file a ridiculous charge of possessing a validly registered pump action gun?”

    “This clearly shows  that the travail of Emefiele is more for political reasons than for any other.”

    Avoid technicalities, focus on substance, PEPC panel tells lawyers

    The Presidential Election Petition Court (PEPC), sitting in Abuja, has asked lawyers representing all those who filed petitions before the court to avoid unnecessary technicalities and address the substance of their petitions.

    The five-member panel with Justice Haruna Tsammani as Chairman, said this at the inaugural sitting of the panel.

    Newsmen reports that the panel started sitting on Monday to hear petitions filed by aggrieved presidential aspirants against the declaration of Sen. Bola Tinubu and the All Progressives Congress (APC) as winners of the disputed 2023 Presidential Election.

    NAN also reports that other members of the panel are Justice Stephen Adah, Justice Misitura Bolaji-Yusuf,
    Justice Boloukuoromo Ugo and Justice Abbah Mohammed.

    In his opening speech, Justice Tsammani urged the lawyers not to engage in unnecessary technicalities as such could cause delays in the expeditious hearing of the petitions.

    “Election is time bound, let us not waste unnecessary time, let us cooperate with each other so that everyone will leave here satisfied.

    “Avoid unnecessary technicalities, we are determined to look at all the matters brought before us.

    “Let us look at what is good for our country and avoid time wasting applications,” he said.

    He said that there were five petitions and the first three petitions would be heard on Monday while the last two would be heard on Tuesday.

    Responding, Mr Wole Olanipekun, SAN, said that as lawyers, they were bound by the law abiding and would adhere strictly to the rule of law throughout the proceedings.

    Olanipekun gave the assurance that the lawyers would give their full support to the cause.

    Other senior advocates also agreed with Olanipekun.

    NAN also reports that shortly after the judges recessed after the opening to prepare to hear the petitions, the Presidential Candidate of the Labour Party, Mr Peter Obi, walked into the courtroom and exchanged pleasantries with lawyers and litigants in court.

    NAN recalls that Chairman of Independent National Electoral Commission, (INEC), Prof. Mahmood Yakubu, had declared Tinubu winner of the Feb. 25 Presidential Election.

    Dissatisfied with the announcement, the candidates of the Labour Party, the Peoples Democratic Party (PDP) and others dragged the commission, the APC and Tinubu to court challenging his victory.

    Members of the Presidential Election Petition Court (PEPC) would adjudicate on all petitions filed against the declaration of Tinubu and the APC as winners of the disputed 2023 Presidential Election.

    The Nigerian Bar Association (NBA) has demanded the arrest and prosecution of electoral offenders identified during the just-concluded General Elections.

    The association made the call in a communique by its National Publicity Secretary, Akorede Habeeb-Lawal at the end of its National Executive Council (NEC) quarterly meeting held in Kebbi on March 23.

    TheNewsGuru.com (TNG) reports that the association condemned what it described as tribal and ethnic bigotry, violence and intimidation of voters recorded during the elections, particularly in Lagos State.

    “NEC calls for the prosecution of identified electoral offenders,” it said.

    NBA also called for a live broadcast of the election petition proceedings, particularly the presidential election petition by volunteering media houses.

    The association said this would go a long way in boosting the confidence of the public in the judiciary, which was currently at an all-time low.

    “This will give citizens the opportunity to follow the proceedings, have better knowledge of the facts and an understanding of the reasoning behind decisions of the courts in those matters, particularly how the Electoral Act and other applicable laws are applied to election petition matters,’’ the association said.

    The NBA said that the NEC of the association, as part of efforts to stem quackery within the profession, adopted and approved the NBA General Secretary’s proposal for the introduction of a new NBA Stamp.

    It explained that the new stamp will have improved security features and car stickers with QR codes for lawyers.

    “The essence of the stickers, which will be produced, owned, and distributed by the NBA, is to tackle the inadequacy of the current sticker that is available on the streets and used by non-lawyers, including commercial motorists,” communiqué noted.

    The association also said that NEC resolved that NBA should sponsor a preferred nominee of the bar to represent the association as the Vice Chairman.

    This, according to the document, was because of the expiration of the tenure of the current Chairman of the Body of Benchers, Wole Olanipekun, SAN, and the fact that the Vice Chairman of the body shall be nominated from the bar.

    Consequently, Funke Adekoya, SAN, was unanimously nominated and adopted as the nominee of the NBA for the position of Vice Chairman of the Body of Benchers.

    It was further resolved that, if Adekoya declined the nomination, Olisa Agbakoba, SAN, would step in as the alternate nominee of the NBA.

    The NBA-NEC also considered the budget of the Annual General Conference Planning Committee (AGCPC) and approved same alongside the proposed 2023 Annual General Conference Fees.

    This would see senior citizens, lawyers of 70 years and above, attend the conference for the first time, free of charge, and lawyers of one to five years call pay an early bird fee of N15,000.

    The All Progressives Congress (APC) has advised Alhaji Atiku Abubakar, Peoples Democratic Party (PDP) presidential candidate to get his lawyers to plead his case in court rather than leading a street protest.

    Mr Bayo Onanuga, Director, Media and Publicity, APC Presidential Campaign Council (PCC), gave the advice in a statement on Monday in Abuja.

    The statement was the APC PCC’s reaction to an Atiku-led protest organised by PDP members against the outcome of the Feb. 25 Presidential and National Assembly election.

    Onanuga also advised Abubakar to respect his age and the high office of the Vice-Presidency of Nigeria he once occupied.

    “When the defeated Atiku Abubakar told the whole world last week that he would seek redress in court over the outcome of election, little did we know that he did not plan to be guided by his own promise.

    “Going by his political antecedents, it was rather not surprising that Atiku, days later, led a band of protesters, nay jesters in Abuja, to the Headquarters of Independent National Electoral Commission (INEC).

    “What was on display today by Alhaji Atiku and his motley crowd was a new low from the perennial election loser.

    “With Atiku staging a theatre of the absurd, we fail to see how a march to INEC by a scanty crowd will provide any victory window for him and his fragmented PDP,” Onanuga said.

    He added that the only recourse open to Atiku after the electoral umpire declared Sen. Bola Tinubu, a former two-term Governor of Lagos State as President-elect, was the Election Petition Tribunal.

    Onanuga further added that instead of Atiku and his party to wisely spend their time to gather the so-called evidences they hope to present before the courts,  they were busy dancing on the streets.

    He said they were also causing traffic nuisance to residents of the Federal Capital Territory (FCT)who were going to work on a Monday morning.

    Onanuga added that the APC PCC does not expect a former Vice-President of Nigeria, a statesman and a presidential candidate to be so jobless as to have time to disturb public peace.

    This, he said, was especially over an electoral outcome he had already said he would challenge in court.

    “We want to admonish Alhaji Atiku to respect his age and the high office of the Vice-Presidency of Nigeria he once occupied.

    “He should  stop being teleguided by Dino Melaye, who disclosed scandalously that N400 billion was wasted on the election, which was clear at the outset that Atiku was bound to lose.

    “Atiku should avoid being  misdirected by other court jesters in his party, who continued to campaign after the election, still spewing their inanities against the President-elect,” Onanuga said.

    He described such persons as mere comic characters in a travelling theatre group, saying that INEC headquarters was not a court where the prayers of Atiku could be answered.

    Onanuga stressed that no amount of theatrical display would give Atiku and his party succour, adding that the honourable and lawful path to take was for him to get his lawyers to plead his case in court.

    “He should stop throwing tantrums like a baby whose candy was taken away over an election he clearly lost due to his own poor judgment.

    “Mismanagement of his own party and violation of power rotational arrangement between the North and the South.

    “The PDP presidential candidate dug his own grave, in his last election and, absurdly, he is trying to rewrite the script of his own utter failure,” Onanuga said.

    He wondered how Atiku and his party hoped to win, when he had admitted that Peter Obi, the Labour Party President candidate, his running mate in 2019, ran away  with traditional PDP votes from the South-East and South-South.

    The APC PCC Director of Media and Publicity said it was preposterous that while Atiku was disturbing public peace, chanting phantom electoral victory, Obi was making same claim.

    “We think both men have embarrassed themselves enough and it is high time they both resolved who between them is the supposed winner that will challenge our party’s victory in court.

    “We advise Atiku to retire honourably from politics and move to his abode in Dubai. At 77 in November, Atiku does not have age on his side again.

    “He had participated in his last election and hopefully, he had learnt worthy lessons, never to place his selfish interest above party and established principles in his party and the polity,” Onanuga said

    Lawyers applying for the 2023 award of the rank of Senior Advocate of Nigeria (SAN) would pay N1 million as a fee.

    This was disclosed in a notice by the Legal Practitioners’ Privileges Committee (LPPC).

    According to the notice by its Secretary/Chief Registrar of the Supreme Court, Hajo Sarki Bello, the application began on January 1 and closes on March 31, 2023.

    The notice stated that the invitation was in accordance with Section 5(2) of the Legal Practitioners Act, 2004, and Regulation 10 (1) (4) of the Guidelines for the Conferment of the Rank of SAN 2022.

    It reads: “The Legal Practitioners’ Privileges Committee (‘the LPPC’ or ‘the Committee’) hereby makes a formal call for applications preparatory to the award of the rank for the Year 2023.

    “Commencing with this year’s exercise, applications shall only be made online and prospective applicants are directed to visit www.lppconline.com to make their applications.”

    TheNewsGuru.com (TNG) reports that prospective applicants are notified that each person “must pay a non-refundable processing fee of N1 million only to any of the following accounts held in the name of the ‘Legal Practitioners Privileges Committee (SAN)’: Account Number: 1014103141, at Zenith Bank PLC and Account No. 0213662834 at GTBank PLC.

    “Upon conclusion of payment, an applicant should upload a copy of the evidence of payment on the application portal. The applicant will receive an email notification from the LPPC Secretariat confirming the applicant’s payment and clearing the applicant to proceed with the application process online,” the notice stated.

    The LPPC warned that any submission made after the deadlines “shall be treated as a non-submission”.

    Senior Advocate of Nigeria (SAN) is a title that may be conferred on legal practitioners in Nigeria of not less than ten years of standing and who have distinguished themselves in the legal profession.

    Lawyers must ensure Bolanle Raheem does not die like others – Falana

    Senior lawyer and human rights activist, Mr. Femi Falana, has urged Nigerian lawyers to ensure that the death of the Lagos-based legal practitioner, Mrs Bolanle Raheem is not in vain.

    Raheem was shot dead on December 25 2022 in the Ajah area of the state sparking outrage from many Nigerians.

    The Police Service Commission has suspended an Assistant Superintendent of Police, Drambi Vandi, named as the officer responsible for the killing.

    In a statement on Friday,  December 30, Falana condemned the murder and asked the Nigerian Bar Association to mobilise the masses against police brutality in Nigeria.

    “Nigerian lawyers must ensure that Mrs Bolanle Raheem does not die in vain like others who were dispatched to their untimely graves before her,” he stated.

    “Indeed, the best tribute that the NBA can pay to the deceased is to use her cold-blooded murder to mobilise the Nigerian people to end police brutality in Nigeria.

    “To start with, police checkpoints must be removed from Nigerian roads. The roads should be patrolled by combined teams of officers from the police and road safety commission.”
