    We conducted autopsies on 99 bodies including Lekki Tollgate victims – Pathologist

    Professor John Obafunwa, a forensic pathologist, has told the Lagos State Judicial Panel on restitution for victims of SARS related abuses and other matters, that post mortem autopsies were conducted on 99 bodies after the #EndSARS protests.

    In October, aggrieved protesters trooped to the streets across the country to demand an end to police brutality.Twitter suspension:

    The government had disbanded SARS and promised to look into their demands but the protesters refused to back down until they were forcefully dispersed on October 20, 2020.

    Soldiers had stormed the Lekki tollgate in Lagos, where the protesters had barricaded for close to three weeks, and forced them off the roads.

    There were allegations and counter allegations on the number of persons killed during the incident but the military authorities and the Federal Government denied that there were deaths.

    While dismissing reports on the Lekki tollgate shootings, Alhaji Lai Mohammed, Minister of Information, had taunted government critics by describing the Lekki incident as a massacre without dead bodies.

    But while testifying before the panel on Saturday, the pathologist said officers of the Lagos State Environmental Health Monitoring Unit (LASEHMU) picked up 99 bodies from different locations.

    He confirmed that three of the bodies were those of victims of the Lekki shootings.

    According to him, the first body of an unknown victim was brought in from Lekki bridge, on October 24.

    He said the body showed a fracture, a laceration on the left side of the skull.

    The pathologist gave the cause of death as bleeding into the chest cavity, following a blunt force trauma to the chest.

    He added that the second body was that of an unidentified individual who died at about 1.45am on October 21 and was taken to Reddington Hospital, Lekki.

    He said the victim was taken to the hospital in an unconscious state as a result of open skull fracture.

    “X-ray conducted prior to touching the body showed no bullet or pellets in the body. The x-ray revealed multiple skull fracture. Autopsy showed there was a ragged laceration running from the left side to the right side of the skull, further exploration of the wound showed bleeding into the scalp, multiple fracture of the skull, bleeding into the brain tissue. In the chest, there was bruises of the anterior, fracture of the left rib.

    “Generally the internal organs were pale and it suggested there was severe blood loss. Hypertensive heart disease, upon examination under the microscope and samples for DNA, death was as a result of skull and brain injury which was due to blunt force trauma.”

    The third case was said to have died at Lekki tollgate and taken to the General Hospital, Yaba, where an autopsy was conducted on November 2.

    The cause of death was said to be severe blood loss as a result of disruption of major blood vessel, caused as a result of gun shot injury.

    The panel, which adjourned till June 19, ordered the pathologist to produce the records and autopsy reports of the remaining 96 bodies.

    DJ Switch, Nigerian disc jockey and activist is in the news again over the veracity of her claims on losses recorded during last year’s shooting of #EndSARS protesters at Lekki, Lagos.

    The new development follows a recent report by the US Department of State that there was no accurate information on the actual casualty figures recorded during the Lekki shooting.

    TheNewsGuru recalls that hours before a curfew was scheduled to begin on October 20, soldiers had stormed the Lekki tollgate where youths protesting against police brutality had gathered and started shooting.

    Switch, who captured the incident had stated that at least 15 persons were shot dead while several others sustained injuries of varying degrees.

    Amnesty International had also insisted that about 10 people died of gunshot injuries during the incident.

    However, Lai Mohammed, minister of information, had debunked the claims while the army also said it did not use live bullets on the protesters as alleged by a CNN investigation.

    But a new report released on Tuesday, by the US said the inconsistencies in the various reports made it difficult to determine the actual fatalities of the Lekki incident.

    The development has since sparked intense reactions on Twitter .

    “I can’t believe what I’m reading this morning about Dj Switch. I’m seriously disappointed in my country people, don’t know you people are this daft. So because USA said some shit, you all come to a conclusion that the video (live video for that) was fake and staged,” a user wrote.

    The Nigerian Army has again failed to appear before the Lagos State Judicial Panel on Restitution for victims of SARS and other related matters.

    It’s the third time they’ve failed to honour the summons of the panel for officers involved in the shooting to explain what happened at the Lekki toll gate on the 20th of October 2020.

    At today’s proceedings, Counsel to the panel, Jonathan Ogunsanya confirmed that summons were sent to three army officers.

    “Summons was sent to Colonel Bello. The second summons was served on Major General Godwin Umelo, the General Officer Commanding 81 Division, Lagos and Ogun State of the Nigerian Army, Victoria Island.
    The third summon was issued and served on Brigadier General Francis Ogbaje Omata of the Nigerian Army, Obalende Barracks”.

    The counsel then tendered the summons for the panel to view.

    Counsel to the #ENDSARS protesters, Adesina Ogunlana has asked the panel to summon the counsel on record for the Nigerian Army, Akinlolu Kehinde (SAN) to respond to the summons and the failure of the army officers to appear.

    But the counsel to the panel, Jonathan Ogunsanya told the panel that Mr Akinlolu Kehinde (SAN) has said that he is no longer representing the Nigerian Army and any effort to get him to appear before the panel may not have legal backing.

    The Chairman of the panel, Justice Doris Okuwobi has ordered that a letter should be issued to the counsel on record for the army, Mr Akinlolu Kehinde (SAN) to appear before the panel at the next adjourned date to explain why he would not conclude the case of the Nigerian Army.

    “I must reiterate and state that this is a fact-finding panel and not the regular courts where counsel can decide the choice of witnesses they want to present in their case. The summons to those military officers had become necessary for other parties to hear their evidence and cross-examine them if necessary. It behoves on Mr Kehinde to assist the panel to achieve this task in the course of the investigation of the Lekki incident. He is needed to conclude this part of his brief. For the other victim-related petitions which are 14 against the Army, I implore the military authority to appear and present their defence so that no issue of denial of fair hearing will arise when the panel’s report is submitted to government”.

    All matters involving the Nigerian Army were then adjourned till the 30th Jan, 2021.

    JUST IN: CNN rejects Lagos Panel summon on Lekki shootings

    American based Cable News Network, Inc.(CNN) has objected to a Witness Summons by the Lagos Judicial Panel of Inquiry and Restitution of Victims of SARS Related Abuses for its Team of Reporters to appear before it today (Saturday), December 12, to give evidence on their reportage of the #EndSARS Lekki shooting.

    The international news outfit said the Panel lacks jurisdiction to summon its staff since they are not in Nigeria.

    CNN’s Lawyers, Messrs. Olumide Babalola LP, filed the objection dated 4th December 2020 at the Tribunal on December 9, 2020.

    In the letter, Mr Olumide Babalola said: “Since the Objectors are not “persons in Nigeria” as envisaged by the provision of section 5(c) (of Tribunals Of Inquiry Law Of Lagos State, Cap. T6), then this Honourable Tribunal is, with respect, bereft of territorial jurisdiction to compel their attendance to give evidence before it.”

    According to Babalola, the panel invited him into its Private Hearing Room Saturday morning and subsequently excused CNN from further proceedings or appearing before the Panel.

    CNN’s invitation followed its two-part report which claimed that soldiers shot at and killed peaceful #EndSARS protesters on the night of October 20 at the Lekki Toll Gate.

    BREAKING (Video): 15 Lekki shooting victims storm Lagos Panel

    15 protesters who suffered gunshot wounds during the #EndSARS protests in Lagos have visited the Lagos State Court of Arbitration and Mediation in Lekki, venue of the Lagos State Judicial Panel of Enquiry and Restitution for Victims of SARS related abuses and other matters.

    14 of them were said to have been shot at Lekki Toll Gate on the evening of October 20, while one was said to have been shot Ojodu Berger.

    In their entourage was Mr Nathaniel Solomon, whose younger brother Abouta Solomon was said to have been shot dead at the toll gate.

    The deceased has since been buried in his hometown in Mubi Local Government Area of Adamawa State, and Aiyedungbe Olufunmi Grace, whose brother died at LASUTH after suffering gunshot wounds to the head.

    Grace told The Nation that after her brother’s death, the hospital authorities changed the story and said he died of COVID-19.

    The Nigerian Army has denied allegations that it shot at peaceful protesters, saying it merely fired blanks into the air to disperse stone throwers.

    The Lagos State Judicial Panel of Judicial Inquiry investigating the alleged killing of #EndSARS protesters by soldiers at the Lekki tollgate on the night of October 20 on Saturday resumed the viewing of a CCTV tape submitted by the Lekki Concession Company, operators of the tollgate.

    The clip showed that the scene was calm until about 6.43pm when people could be seen running towards the tollgate from the Oriental Hotel end.

    Two minutes later, at 6.45pm, military trucks with flashing headlights arrived the scene. There were no fewer than seven of them.

    At 6.53pm, about 10 minutes after the arrival of the military vehicles, the tollgate went into a blackout.

    Two minutes later, at 6.55pm, one of the military vehicles drove through the tollgate to the other end where the crowd of protesters was gathered.

    BREAKING: Seven ‘Lekki shootings victims’ appear before Lagos panel

    Seven alleged victims of the October 20 Lekki shootings have ‘surfaced’ at the Lagos State Judicial Panel of Enquiry and Restitution for Victims of SARS related abuses and other matters.

    Their lawyer, Adeyinka Olumide-Fusika SAN, told the panel he had a petition on their behalf against the Nigerian Army.

    Olumide-Fusika sought directions from Justice Doris Okuwobi (Rtd)-led a panel on how to proceed with the petitions.

    The panel, which rose briefly, has just returned.

    After a week’s break, the Lagos State Judicial Panel of Inquiry probing the alleged shooting of #EndSARS protesters at the Lekki tollgate on October 20 resumed sitting on Saturday.

    Meanwhile, the two youth panel members, Rinu Oduala and Temitope Majekodunmi, who abstained last week in protest against the freezing of bank accounts of #EndSARS promoters by the Federal Government through the Central Bank of Nigeria (CBN) have now joined the panel.

    The retired Justice Doris Okuwobi-led panel had adjourned on November 7 when its proceedings were frustrated over the inability to form quorum due to the boycott of the sitting by the two youth panel members

    The panel fixed Saturday for the Nigerian Army to return to give its testimony.

    The Nigerian Army has listed three Brigadier Generals and one Lieutenant Colonel, who will testify before the panel

    The top military officers, whose statements on oath have already been submitted to the panel are the Commander of 81 Military Intelligence Brigade, Victoria Island, Lagos, Brig. Gen. Ahmed Taiwo; Chief of Staff, 81 Division, Nigerian Army, VI, Lagos, Brig. Gen. Nsikak Edet; Commander, 81 Division Garrison, VI, Brig. Gen. Francis Omata; Commander, 9 Brigade, Ikeja, Brig. Gen. Musa Etsu-Ndagi; and Commanding Officer, 65 Battalion, Bonny Camp, VI, Lt. Col. Salisu Bello.

    Military and legal teams already seated and proceedings are underway.

    Knocks for Buhari over speedy congratulatory message to Biden, silence on Lekki shootings

    President Muhammadu Buhari has come under criticism in the social media space over his speedy congratulatory message to the president-elect of United States, Joe Biden while he has contined to ward off the responsibility of addressing Nigerians on the ugly incident of shootings of protesters at Lekki Toll Gate on October 20, 2020.

    Most of the netizens who criticised Buhari on Twitter are of the opinion that he (Buhari) pays less attention to governance at home but acts promptly and quick to make remarks on international affairs.

    Buhari in his congratulatory message, said Biden was coming “at a time of uncertainty and fear in world affairs…With your election, we look forward to greater cooperation between Nigeria and the United States, especially at economic, diplomatic and political levels, including the war against terrorism,” Buhari said in a press statement issued by his media office.

    “Your election is a significant reminder that democracy is the best form of government because it offers the people the opportunity to change their government by peaceful means,” he said, adding that “the most powerful group are not the politicians, but voters who can decide the fate of the politicians at the polling booth”

    The message, however, elicited condemnations from some Nigerians who have been demanding end to police brutality as well as pressuring the Buhari-led government to answer questions on the shootings of unarmed #ENDSARS protesters at Lekki toll gate in Lagos.

    The absence of the two youth representatives serving in the Lagos Judicial Panel on EndSARS protest on Saturday stalled proceedings as the panel could not form a quorum.

    TheNewsGuru.com, TNG reports that the Nigerian Army had agreed to appear before the panel on Saturday (today) after initially rejecting the panel’s invitation.

    As at the time of filing this report, Brig.-Gen. A. I. Taiwo was already on hand to give Nigerian Army’s testimony on the alleged shooting of peaceful protesters at Lekki on Oct. 20 but the panel failed to form a quorum.

    TNG reports that the two youth representatives – Mr Temitope Majekodunmi and Ms Olorunrinu Oduala – did not make an appearance at the panel on Saturday in protest against the freezing of Oduala’s First Bank account by Central Bank of Nigeria.

    TNG reports that Oduala’s bank account and 19 others were allegedly frozen on Nov. 6 over alleged sponsorship of the #EndSARS protests.

    Justice Doris Okuwobi (retired), Chairperson of nine-member panel, said that due to the absence of Oduala and Majekodunmi, proceedings will not hold because the panel could form a quorum.

    She said: “We are confronted with a situation which prevented her from coming. We do not know if the two youth representatives will eventually pull out.

    “We do not want a situation where proceedings will go on and it is impugned that with controversy due to a lack of quorum.

    Justice Okuwobi stressed the importance of all the panel’s sitting being in accordance with the law.

    “In all matters, we have to wait for them to join us, without them we are handicapped,” the retired judge said.

    Reacting, Mr Akinlolu Kehinde (SAN), counsel the Nigerian Army, noted that the military were at the panel in response to a summons dated Oct. 28 and asked the panel when the military should return to give evidence.

    Mr Kayode Enitan (SAN), counsel for the Lagos State Government, aligned with the submission of the counsel for the Nigerian military. He however noted the importance of a quorum.

    “The issue of quorum is of utmost importance as to the competence of the panel to proceed and as to the integrity of recommendations to be made at the end of proceedings.

    “Therefore, the directive that the panel should adjourn is quite appropriate,” the LASG counsel said.

    Justice Okuwobi adjourned the panel’s proceedings to Nov. 14.

    The Judicial Panel of Inquiry set up by the Lagos State Government to probe the Lekki shootings as well as complaints of human rights abuses against members of the now disbanded Special Anti-Robbery Squad on Friday began viewing the CCTV footage submitted by the Lekki Concession Company (LCC), operators of the Lekki toll gate.

    Recall that the Managing Director of LCC, Abayomi Omomuwa, had submitted the video footage on Tuesday.

    The video has no sound and Omowuwa had told the panel that the surveillance camera stopped working at 8pm on October 20 when the incident happened.

    According to the LCC MD, the footage was retrieved from the surveillance camera mounted by the firm on a mast at the tollgate.

    Counsel for the Lagos State Government, Mr Jelili Owonikoko (SAN), had suggested that the panel only view some portion of the footage to save time, but counsel for #EndSARS protesters, Mr Adesina Ogunlana, insisted that the entire footage be viewed on the grounds that “we should not sacrifice quality for speed.”

    But the retired Justice Doris Okuwobi-led panel ruled that the entire footage would be viewed.
