  • Demolition of Kpokpogri’s mansion: Court fixes date to hear preliminary objection

Demolition of Kpokpogri’s mansion: Court fixes date to hear preliminary objection

FCT Minister, Alhaji Muhammad Bello, and the Federal Housing Authority have asked a High Court to dismiss a suit challenging the demolition of the residence of Abuja socialite, Joseph Kpokpogri.

Other Defendants in the suit are the Federal Capital Territory Administration and the Federal Capital Development Authority, Abuja Metropolitan Management Council and the Attorney-General of the Federation.

The Minister, alongside the Federal Housing Authority, FHA, through their lawyer, Dr Mubarak Adekilekan, maintained that the court was bereft of the jurisdiction to entertain the suit.

The defendants contended that the suit was filed “by a lawyer not known to law”.

According to them, Ozekhome, was the name on the seal of the Nigerian Bar Association, NBA, that was affixed on all the court processes, a search at the Supreme Court disclosed that such name does not exist in the nominal roll of lawyers.

Besides, the defendants, contended that the plaintiff, Kpokpogri, whose house was demolished, failed to disclose any reasonable cause of action to warrant the exercise of the court’s discretion in his favour.

Consequently, they prayed the court to dismiss the suit.

However, counsel for the plaintiff, Dr Benson Igbanoi, noted that the suit was originally fixed for the court to hear a motion his client filed for interlocutory injunctions against the defendants.

Igbanoi said he was surprised that though the defendants filed the objection since August 12, they waited till last Friday to serve same on his client.

He alleged that the defendants are deliberately frustrating the hearing of the suit, the plaintiff’s lawyer, urged the court to proceed with the business of the day.

In a ruling, Justice Charles Agbaza held that once a preliminary objection is raised to challenge the jurisdiction of the court, such motion must be heard and determined first before any further step could be taken in the matter.

He, therefore, adjourned the matter until Oct 12 for hearing of the preliminary objection.

The court had on July 15, extended its order that restrained the FCT Minister from completely demolishing Kpokpogri’s residence.

The injunctive order followed an ex-parte application the plaintiff who is a former lover of popular Nollywood actress, Tonto Dikeh, filed through his team of lawyers led by Ozekhome.

Justice Agbaza held that the order would subsist until the hearing and determination of the suit before the court.

Ozekhome, had told the court that some persons from the Federal Capital Development Authority, FCDA, had on May 14, invaded his client’s residence, “accompanied by a multitude of heavily armed policemen and bulldozers and excavators”, and commenced the demolition of his house, beginning with the boys quarters.

He told the court that agents of the FCDA threatened to return for total demolition of Kpokpogri’s house, even though they failed to give any reason for their action.

Ozekhome, SAN, begged the court to intervene in the matter, in the interest of justice.

Specifically, the court, issued an order of interim injunction restraining the defendants from trespassing on or further trespassing on, demolishing, or further demolishing the property known as Plots 203 and 204, 27 Road, Gusape District, Apo Estate, Abuja.

The plot is said to be covered by letters of allocation issued by the Federal Housing Authority with Ref. No. FHA/BD/ES/APO/P.203 and Ref. No. FHA/BD/ES/APO/P.204.

The order also restrained the defendants from evicting the occupants of the said property or in any way interfering with the plaintiff’s exclusive right of possession of the said property pending the determination of the suit.

The plaintiff, in the suit is asking the court to the order the defendants to pay him aggravated and general damages to the tune of over N2 billion.

Kpokpogri, in an affidavit deposed to in support of the motion said that he was the owner of all the property covered by letters of allocation issued by FHA with reference No. FHA/BD/ES/APO/P.203 and reference No. FHA/BD/ES/APO/P.204.

He averred that he was entitled to the statutory right of occupancy and exclusive possession of the said plots having been lawfully acquired from two separate individuals, Mr Muyideen Obans and Mrs Alaba Akindele, who were the original allottees of the lands from the (AGF) 6th defendant.

“The letters of allocation of the land to the original allottees dated Jan. 14, 2015 with No. FHA/BD/ES/APO/P.203 and FHA/BD/ES/APO/P.204, issued by FHA Abuja are hereby exhibits A and Al.” he claimed.

  • REVEALED: How Osun Gov. Oyetola bought Tinubu’s mansion in London from Diezani’s associate

REVEALED: How Osun Gov. Oyetola bought Tinubu’s mansion in London from Diezani’s associate

Pandora Papers, an investigation led by the International Consortium of Investigative Journalists (ICIJ), has exposed the secrets behind the London mansion of Asiwaju Bola Ahmed Tinubu.

PREMIUM TIMES is the only Nigerian newspaper among 150 news organisations that have direct access to a trove of almost 12 million confidential files on the illicit wealth of some of the most powerful persons on earth.

In previous reports, PREMIUM TIMES exposed how some influential Nigerians, including former Governor Peter Obi, Senator Stella Oduah, and Governor Atiku Bagudu hid stolen wealth overseas.

In the latest investigation, the secret tax haven of Tinubu, National Leader of the All Progressives Congress (APC), and Governor Gboyega Oyetola of Osun State, who is a relation of Tinubu, were exposed.

According to the report, the mansion where Tinubu, who is currently in London, has been receiving top politicians and high-profile personalities, is embroiled in a multi-billion fraud scandal.

The report said the government of President Muhammadu Buhari had actually secured a freezing order on the property from a Federal High Court before the previous owner, who is now an international fugitive, sold it at a huge discount to an offshore company owned Oyetola.

The expanse 6,975 sq ft property is situated at 32 Grove End Road, in the wealthy Westminster neighbourhood of London.

According to an advert brochure of the property released by popular United Kingdom real estate company, Savills, the estate is made up of two buildings – a five-bedroom property with a formal reception, a study, a master bedroom with an en suite dressing room, bathroom and a cinema suite with a balcony overlooking the rear garden.

Two of the other four bedrooms in the property are en suite. The second building on the estate is a self-contained two-bedroom flat which is built above the property’s double length garage. The property has a gym, two guest cloakrooms, a carriage driveway that can park up to eight cars, and front and rear gardens, and an electric gate.

“Documents obtained from the UK property register revealed that in July 2013, the property with title number 340992, was bought for £11.95 million by Zavlil Holdings Ltd, a shell company incorporated in the British Virgin Islands, a notorious tax haven,” PREMIUM TIMES said in its report.

“Documents revealed that Zavlil Holdings Limited is owned by Kolawole Aluko, an international fugitive wanted by law enforcement agencies in Nigeria and the United States for money laundering.

“Kola Aluko and his associate, Jide Omokore, were indicted in the U.S. and Nigeria for multi-million-dollar fraud and money laundering violations allegedly in collusion with a former Minister of Petroleum Resources, Diezani Alison-Madueke.

“In 2016, the Federal Government of Nigeria filed a Mareva injunction at a Federal High Court in Lagos seeking to confiscate a list of properties belonging to Messrs Aluko and Omokore valued at $1.8 billion.

“A Mareva injunction is a Court order which freezes the assets of a defendant pending the outcome of a litigation.

“In the suit against Messrs Omokore and Aluko, alongside their companies, Atlantic Energy Drilling Concepts Nigeria Limited and Atlantic Energy Brass Development Limited, the Nigerian Government asked the court to grant it seven orders to prevent the accused from disposing the assets. The government alleged they were acquired through fraudulent means.

“The court granted the government all its prayers. In October 2017, an attempt by the defendants to dismiss the Mareva injunction granted on the properties was subsequently dismissed by Oluremi Oguntoyinbo, the trial judge.”

The report said shortly after the court granted the order, Aluko sold the house for £9 million to Aranda Overseas Corporation, an offshore company incorporated in the British Virgins Island by two of Mr Tinubu’s most trusted surrogates – Oyetola, formerly chair of Paragon Group of Companies, and Elusanmi Eludoyin, who succeeded Oyetola at Paragon.

“The huge discount at which the property was sold is curious and raised questions of whether Mr Aluko desperately needed to sell the property even while a court of law had placed a freeze order on it,” the report read.

“The United Kingdom, especially the greater London area, is noted for rapid increase in the value of properties.”

How public photos were used to confirm Identity of the London villa

In the application filed by the Nigerian government, the house number of the property on Grove End Road was omitted. However, PREMIUM TIMES’ extensive investigation in Nigeria and the U.K., including a detailed analysis of photographs of visits to Tinubu, has shown that the APC leader is staying at the same property the Nigerian government wants forfeited.

“We were also able to determine that it was at the same property that Mr Tinubu welcomed Mr Buhari on August 12 as well as other politicians who visited him.

“Our reporters carefully analysed some of the photos of these visits. Sources close to Mr Tinubu also confirmed that he stays and welcomes guests, including Mr Buhari, at the property.

Federal lawmakers with Tinubu at his London Mansion

“Two photos of the visit of Mr Abiodun, the governor of Ogun State, were particularly helpful in making the initial connections,” the report read.

PREMIUM TIMES said it put its findings to Tunde Rahman, spokesperson of Tinubu, but he promised to get back within 24 hours, however, he had not done so as of the time the story was published.

Garba Shehu, Presidential spokesman, was also contacted, according to the newspaper, but he promised to respond, just like Rahman did but he never fulfilled his words.

  • AGF Malami reacts to reports of buying N300m mansion for newly wedded son in Abuja

AGF Malami reacts to reports of buying N300m mansion for newly wedded son in Abuja

The Attorney General of the Federation (AGF) and Minister of Justice, Abubakar Malami on Saturday denied reports of buying a N300 million house for his newly wedded son, Abdulazeez in Abuja.

Sahara Reporters had reported that Malami purchased a house worth N300 million for his son in Abuja.

Malami, in a statement by his media aide, Umar Gwandu, said his attention had been drawn to a mischievous, deceitful and perfidious publication by the notorious factory of fake news in Nigeria, the Sahara Reporters with an intent to spread lies.

The statement said it was regrettable that the information communication technology tools had been hijacked by disgruntled elements in spreading fake news and blatant lies and that the report by the media was a clear violation of ethical journalism practices on verification of facts and authentication of claims.

“It evinces lack of professionalism and exposes rash and reckless presentation of figment of imaginations shrouded with bigotry and bundled with sentiments of unscrupulous questions. For instance, who is the vendor of the purported house bought for the son of the Minister in Abuja at N300m? Where is the so-called mansion located in Abuja? Where are the title documents?”

“God knows that I did not purchase any house for him in Abuja. Not even a rented house was secured for my son in Abuja, because he has no plan to live in Abuja,’ while refuting the claim that he bought a house for his son in Abuja. The allegation of hiring private jets for the marriage was preposterous.

“It is common knowledge that the Attorney-General of the Federation and Minister of Justice had neither a father nor mother anywhere in Nigeria to be conveyed to Kano for the wedding. Who then. is the Attorney-General using the chartered flight to convey? Which jets are chartered? Who paid for the charter? Through which means was the money paid?

“It is one of such libelous publications of which Sahara Reporters is commonly known for targeted at selected few for unsubstantiated fabricated allegations while overlooking more serious reasonable allegations visibly open against its favoured sectional kinsmen,” the statement said.

The statement said the wedding of Fatiha, the eldest son of Malami took place under strict observance of the protocols and guidelines of the Presidential Taskforce on COVID-19.

  • N748m SP’s Mansion: David Mark presents health excuse certificate, to resume interrogation January

Former Senate President, David Mark has presented the health excuse certificate to the Economic and Financial Crimes Commission (EFCC) to allow him attend to his health before appearing for interrogations in the ongoing probe of the purchase of a N748million Senate President’s official mansion in Abuja.

He also said his health was not stable enough to enable him write a statement on issues connected with the purchase of the official residence of Senate President.

He asked the anti-graft agency to allow him to attend to his health and return on or before January 11 for interrogation on the said property.

But he told the EFCC detectives that he bought the quarters with a loan and promised to present relevant documents next year.

These claims are contained in a fact-sheet by the EFCC on the investigation of the ex-Senate President.

According to the document, Mark has three cases before the EFCC which are being handled by separate teams of detectives.

The other cases are N550m arms procurement cash from ONSA and N2.9billion curious payment into the account of the National Assembly’s account and shared to Senators during Mark’s tenure; and his role in about N2billion campaign funds meant for Benue State.

The document said Mark was expected to respond to the following issues:

    • The property was unlawfully acquired in 2011.
    • Didn’t the buying of the house amount to an abuse of office?
    • Whether or not the purchase of the property was not a violation of Part 11 (b) of the Certain Political, Public and Judicial Office Holders (Salaries and Allowances, Etc.) (Amendment) Act, 2008 otherwise known as the Remuneration Act, 2008
    • Did the process of acquisition of the house comply with Section 15 (1) of the Procurement Act, 2007;
    • Was the sale of the house gazetted by the Federal Government?

A top source, privy to the investigation, said: “When Mark met with our team of detectives on the N748million, he only presented a health excuse certificate.

Later he said he could not write any statement to respond to issues isolated for him because he said he was unstable. We accorded him enough respect befitting of his status.

He told our team verbally that he bought the house with a loan and pleaded with the EFCC to allow him to return on or before January 11, 2018 to come for grilling on the property.

Having asked him to deposit his passports, we are expecting him to come for interrogation in January.”
