Edo 2020: Election riggers will ‘receive’ COVID-19, Melaye prays at Obaseki’s campaign rally

Former Kogi-West senator Dino Melaye stole the show Saturday at the start of the re-election campaign of Governor Godwin Obaseki in Benin.

TheNewsGuru.com, TNG reports that Nyesom Wike, Chairman of the People’s Democratic Party (PDP) Edo State Governorship Election National Campaign Council and Governor of Rivers State, and Prince Uche Secondus, National Chairman of the PDP were also present at the flag-off of Obaseki’s campaign for re-election in the September 19 poll.

Called to address the physically distanced crowd at the Samuel Ogbemudia Stadium, Melaye warned all those who plan on rigging the September election to shelve the idea.

To the surprise of his audience, he said anyone contemplating such plan will ‘Receive COVID-19.”

He chanted the curse, like a prayer warrior, repeatedly: “Receive COVID, Receive COVID, Receive COVID”.

He directed his curse at Governor of Kogi state, Yahaya Bello and Kano governor, Abdullahi Ganduje, who he referenced by innuendo as ‘those who put dollars in pocket’.

The Obaseki campaign has reportedly mounted billboards in Benin, attacking the Kano governor.

Obaseki is campaigning for a second term in office on the platform of the Peoples Democratic Party, after he defected from his original platform, the All Progressives Congress.

“When I was thrown out in the rain, and the political storm, you gave me the umbrella to shield me,” the governor said at the campaign while thanking the PDP.

He also urged supporters to shun all forms of misconduct during the election, slated for September 19.

“We do not want bloodshed,” he said.

Atiku, Saraki, Dogara, Melaye, other PDP leaders with ‘links’ to Hushpuppi must be investigated – APC

The ruling All Progressives Congress (APC) has called on anti-graft agencies to investigate the link between some notable leaders of the opposition Peoples Democratic Party (PDP) and the leader of the Dubai based international e-fraudster Ramon Olorunwa Abbas popularly known as “Hushpuppi”.

The party said the media space has been awashed with reports of criminal conspiracy linking some top echelon of the PDP with the fraudster who is currently facing criminal charges on cyber-enabled fraud in the United States of America.

The party through it’s Deputy National Publicity Secretary of the governing party, Mr. Yekini Nabena in a statement in Abuja on Saturday demanded for an investigation by the country’s anti-graft agencies of money laundering allegedly linking some PDP leaders and financiers to the Dubai-based international criminal ring.

The statement reads in part: “Reports of the criminal conspiracy linking the top echelon of the opposition Peoples Democratic Party (PDP) with Ramon Olorunwa Abbas also known as “Ray Hushpuppi” who was recently arrested along with associate(s) in Dubai, United Arab Emirates and extradited to the United States of America to face trial over cyber-enabled fraud and Business Email Compromise (BEC) schemes should be a matter of serious interest to relevant authorities in Nigeria.

“We note that the Economic and Financial Crimes Commission (EFCC) has already declared the arraigned Instagram celebrity wanted over fraud allegations. However, the EFCC, Nigerian Financial Intelligence Unit (NFIU) and other sister agencies must investigate money laundering reports linking some PDP leaders and financiers to the Dubai-based international criminal ring”.

The party said the call for investigation became necessary in order to unravel the choice of Dubai for the pre-2019 general election “strategic” meetings of the opposition party and the reported relationship of “Hushpuppi and some leaders including the opposition Presidential candidate.

According to Nabena, “PDP leadership turned Dubai into their “Strategic” meeting place ahead of the 2019 general elections in Nigeria and “Hushpuppi’s” affinity with the PDP leadership is not mere coincidence.

“At different times, “Hushpuppi” was seen photographed in Dubai meeting with the PDP’s 2019 presidential candidate, Alh. Atiku Abubakar; former Senate President, Bukola Saraki; former Speaker, House of Representatives, Yakubu Dogara; Senator Dino Melaye among other PDP stalwarts.

“While relevant authorities investigate the nature of their relationship and business partnership, we also challenge the PDP leadership to do same by opening up on the nature of the relationship, particularly the kind of services the arrested “Hushpuppi” provided them”.

Ahead of Edo and Ondo governorship elections, the ruling party in the statement renewed it’s call against monetised elections and vote buying schemes which the PDP has serially deployed in past elections.

The party then urged relevant authorities to “up their guard to prevent this practices that threaten the sanctity of our elections. The people’s will and votes should determine elections, not illicit money used to buy votes.”

  • Court rejects Melaye’s suit against Infectious Disease Bill

A Federal High Court in Abuja has rejected a suit by Senator Dino Melaye, challenging some provisions of the controversial Control of Infectious Diseases Bill 2020, also referred to as the National Centre for Disease Control (NCDC) Bill.

In a judgment on Tuesday, Justice Ijeoma Ojukwu held that her court lacked the jurisdiction to hear and determine issues raised in the suit by Melaye, who represented Kogi South Senatorial District in the Eight Senate.

Justice Ojukwu upheld the preliminary objection filed against the suit by the respondent.

The judge was of the view that the issues raised in suit were not justifiable as a Bill could not be a subject of litigation until it becomes law.

Listed as respondents to the suit are the Clerk of the National Assembly, the Clerk of the House of Representatives, the Speaker of the House of Representatives, the Attorney-General of the Federation (AGF) and the Inspector-General of Police (IGP).

Justice Ojukwu struck out the name of the IGP as a party to the case, on the grounds that the plaintiff failed to disclose any cause of action against him.

Melaye had on May 5, 2020, filed the suit marked FHC/ABJ/CS/463/2020, urging the court to delete sections 5, 8, 15, 16 and 17 of the bill which he said constituted a violation or would likely violate his rights under the Nigerian Constitution, the African Charter on Human and Peoples’ Rights as well the United Nations Declaration of Human Rights.

The plaintiff had faulted provisions of the Bill seeking to empower the Director-General of the NCDC to compel anyone to take medical examination or treatment and also collect the blood sample of such person in the case of a public health emergency.

He queried the provision to empower the NCDC to take over any premises and turn them into isolation centres without compensation for the owner.

  • Alleged falsehood: Court strikes out suit, discharges Dino Melaye

Justice Olasumbo Goodluck of an FCT High Court, Maitama on Tuesday discharged Sen. Dino Melaye who was accused of providing false information to the police.

The Attorney-General of the Federation (AGF) charged Melaye with two counts of giving false information to the police.

Delivering a ruling in a no-case -submission filed Melaye, Justice Goodluck held that on count one, there is no evidence that the defendant gave false information to any person in public service.

She also described the evidence given by PW1 (Onoja) as “vague”.

The judge said:” neither of the two witnesses elicited evidence on the status of Mohammed Abubaker Audu.”

“Hence, there is lack of evidence on the nature of the status of employment or if at all he is employed not to talk of him being engaged in public service,” she said.

“I am also inclined to allude to the submissions of the defence counsel that there is no statement before the court allegedly made by the defendant to one who is in the public service.

“This being the case, the first ingredients of the offence upon which count one is predicated has not been proved to the court.

“Similarly, the second element of the count has not been proven by the prosecution”.

Goodluck held that the prosecution failed to present the audio recording of the conversation between the former Maleye and Audu, nor was an audio expert engaged to the ascertain the identities of the persons in phone conversation.

She further held that no staff of Sahara reporters, the online medium which allegedly released the audio conversation, was called to testify.

The judge also held that no investigative police officer was called to prove that indeed a report was lodged against the defendant.

“It is no longer uncertain that a court does not rely on speculations and suspicions from any material evidence.

“No audio recording of the telephone conversation between the defendant and Mohammed Abubakar was presented at trial.

“All we are left with is the hearsay evidence of the existence of the statement as recounted by the witnesses.

“Besides, the prosecution failed to call in evidence, the Sahara reporter to establish through his staff that the Sahara Reporters recorded a telephone conversation involving the defendant and another.

“In effect, there is no credible and cogent evidence of any Sahara Report’s recording before this court.

“In the light of the fore going consequences, I am of the view and will so hold that the defendant ought to be discharged as there is no reason to convict him in the circumstances.

“He is accordingly discharged on account of the fact that the no-case-submission succeeds” Goodluck held

NAN reports that Melaye’s Counsel Mr Olusegun Jolaawo, SAN, filed a no-case-submission when the prosecution closed their case.

Melaye was alleged to have in April, 2017, deliberately given false information to police to incriminate David Onoja, then Chief of Staff to Kogi State governor, as masterminding an assassination attempt on him.

He was also alleged to have given false statement of facts in a phone conversation with Mr Mohammed Abubakar, son of former governor of the state, Abubakar Audu, with the intention of harming the reputation of Onoja.

He, however, denied committing the offence punishable under Sections 140 and 393 of the Penal Code Law, Cap. 89, Laws of Northern Nigeria, 1963.

Melaye counters Kogi Government, says reported cases of COVID-19 cases real

Reports of coronavirus in Kogi are real and authentic, Senator Dino Melaye has stated.

He spoke on the heels of brickbats between Kogi State Government and the Nigeria Centre for Disease Control (NCDC) over the latter’s announcement of two cases of coronavirus in the state.

Commissioner for Information and Strategy, Kingsley Fanwo, however disagreed with the centre’s report, insisting Kogi remains COVID-19 free.

Melaye, in a statement on Saturday, affirmed one of the cases is from Kabba and the patient personally known to him.

The statement reads: “I want to announce that the Covid-19 case in Kogi is real and authentic and cannot understand why any responsible government will want to deny and invariably kill her citizens.

“One of the cases is from Kabba and the victim is personally known to me. I cannot be part of those who will play politics with the lives of my people.

“COVID-19 is real but not a death sentence, if handled early enough. Family members of the Kabba victim who got referral to Abuja from Federal Medical Center in Lokoja and all those who had contact with him should please surrender themselves for test so as to curtail the spread.

“Kogi State government must come down from her imaginary high horse and start contact tracing to help curtail the spread. It is illogical to think we will be free with our proximity to affected states. God will hear our cry and heal our land. God bless Okunland! God bless Kogi West! God blesss Kogi State.”

  • JUST IN: Court declines Melaye’s request to stop Reps from acting on NCDC Bill

A Federal High Court in Abuja has declined a request by ex-Senator, Dino Melaye for a restraining order against the House of Representatives in relation to its planned consideration of the controversial Control of Infectious Diseases Bill 2020, otherwise known as the Nigeria Centre for Disease Control (NCDC) Bill.

In a ruling on Wednesday, Justice Ijeoma Ojukwu said she could not issue such an order as sought by Melaye’s lawyer, Nkem Okoro because the plaintiff was yet to effect service on the Speaker of the House of Representatives (the third respondent) as earlier directed by the court.

Okoro had, at the commencement of proceedings on Wednesday, noted that none of the respondents complied with the court’s earlier order for them to show cause why similar restraining order sought ex-parte by the plaintiff should not be granted.

He argued that, in view of the obvious failure of the respondents to show cause, the court should order parties to maintain status quo, protect the res (subject matter) and prevent a situation where a “fait accompli” would be foisted on the court.

Lawyers, who represented some of the respondents, faulted Okoro’s argument and urged the court to hold otherwise.

In her ruling, Justice Ojukwu rejected Okoro’s request, on the grounds that the court’s order made on May 13, 2020 for the respondents to show cause why they should not be restrained from further considering the Bill (as prayed by Melaye in his ex-parte motion), was predicated on the service of court processes (documents) on all the respondents.

She added: “Since the condition precedent has not been met, I would rather hold that the matter proceeds to hearing.”

Justice Ojukwu proceeded to order that the processes meant for the Speaker should be served on him through the lawyer representing him in court – Kayode Ajulo.

She directed parties to file all the necessary processes and adjourned till June 1 for hearing.

Melaye is, by the suit marked FHC/ABJ/CS/463/2020, filed on May 5, 2020 is claiming that the provisions of the Bill violate his fundamental rights, among which are rights to the dignity of person, personal liberty, right to private and family life, right to freedom of movement and right to own immovable property in Nigeria.

At the last hearing in the case on May13, Justice Ojukwu declined a similar prayer for a restraining order against the respondents, as contained in ex parte motion argued by Melaye’s lawyer.

Instead, the judge ordered Melaye to serve the processes on the respondents, for them to attend court and show cause why the orders sought ex-parte by the plaintiff should not be granted, and adjourned till May 20.

It was in response to the service of the court processes on them that some of the respondents attended court on Wednesday.

Listed as respondents to the suit are the Clerk of the National Assembly, the Clerk of the House of Representatives, the Speaker of the House of Representatives, the Attorney-General of the Federation (AGF) and the Inspector-General of Police (IGP).

Clerks of both the National Assembly and the House of Representatives and the AGF were absent on Wednesday. They were also not represented by lawyers.

It was only the Speaker of the House of Representatives and the IGP that were represented by Ajulo and Kehinde Oluwole.

Dino Melaye reveals ‘cure’ to Coronavirus, rules out masks, sanitisers

Controversial former Senator, Dino Melaye has said the cure for Coronavirus is for the people to go back to God through repentance.

He said it is not by ramping up measures to curtail the spread of the disease, but that the cure is in the Bible.

According to him, it is not by wearing a nose mask or hand sanitiser, but through repentance.

He said the cure for Coronavirus was in 2 Chronicles 7: 13-15, citing specifically verse 13 to back his claims.

Verses, which Melaye quoted read: “If I shut up heaven that there be no rain, or if I command the locusts to devour the land, or if I send pestilence among my people; If my people, which are called by my name, shall humble themselves, and pray, and seek my face, and turn from their wicked ways; then will I hear from heaven, and will forgive their sin, and will heal their land. Now mine eyes shall be open, and mine ears attent, unto the prayer that is made in this place.”

Congratulating Adeyemi will amount to congratulating an armed robber after operation- Melaye

Embattled Senator Dino Melaye has refused to congratulate his conqueror, Senator Smart Adeyemi, saying doing so amounted to congratulating an armed robber.

Melaye lost the Kogi West Senatorial District election to Adeyemi of the All Progressives Congress, APC.

INEC’s Returning Officer of the election, Professor Olajide Lawal, had said Adeyemi, who represented Kogi West Senatorial District from 2007-2015, polled 88,373 votes to beat Senator Dino Melaye of the Peoples Democratic Party (PDP) who scored 62,133 votes.

Melaye has rejected the result and vowed to challenge the outcome in court.
In series of tweets on Sunday night, Melaye said “Congratulating Smart Adeyemi will amount to congratulating an armed robber after successful operation.”
He said no lover of democracy would “celebrate the shameful and temporary removal of the ‘Voice of the Voiceless,’ Senator Dino Melaye from the Nigerian Senate by the APC ‘gun-ment.’ Dino will never die!”

Melaye also tweeted that Adeyemi just lied on national TV that 10 of his bills was signed into law.

“I challenge him to name 6 bills he sponsored talk less of being assented to. How many bills did President Jonathan signed into law that he alone got 10. Egbami ooo he lied about FOI too,” he said.
