Speakership position: Court ruling excites Obasa

The Speaker of the Lagos State House of Assembly, Mudashiru Obasa, has hailed a court ruling overturning his removal as “illegal, unconstitutional and null and void.”

Obasa expressed this in a statement issued in Lagos on Wednesday, shortly after the judgement was delivered.

Justice Yetunde Pinheiro of the Lagos State High Court, Ikeja, gave the ruling on Wednesday.

The court declared Obasa’s removal during an official trip to the United States illegal, unconstitutional, and without legal standing.

It also nullified all proceedings and resolutions made by the Assembly on Jan. 13, the day of his removal.

Reacting, Obasa said the judgement would encourage Assembly members to move forward with unity and renewed purpose.

He said: “This is a victory for the Lagos State House of Assembly as an institution, and for both present and future members.

“The court’s decision today further strengthens our resolve to advance together in unity as lawmakers.

“We remain committed to working in harmony, for the benefit of our constituents, Lagos State, and Nigeria as a whole,” he said.

The Speaker urged fellow lawmakers to move past the events and embrace peace, unity, and collaboration.

Recall that Obasa filed a suit on Feb. 12 through his lawyer, Chief Afolabi Fashanu (SAN), challenging the legality of his removal.

He argued the Assembly was on recess and he was abroad, making the session used to remove him invalid and unauthorised.

Obasa maintained that the session lacked proper authority or a formal delegation of power from the Speaker’s office.

He listed the House of Assembly and Deputy Speaker, Mojisola Meranda, as defendants in the suit.

His legal challenge was based on nine grounds, citing the 1999 Constitution (as amended) and Assembly Standing Orders.

The court’s decision voids all actions taken during the Assembly session held on Jan. 13.

Lagos: Court declares Obasa’s removal as Speaker illegal

An Ikeja High Court on Wednesday declared that the removal of the reinstated Speaker of the House of Assembly, Mudashiru Obasa was illegal and unconstitutional.

Delivering judgment, Justice Justice Yetunde Pinheiro, held that  the members of the house of assembly erred in the removal of Obasa as  speaker.

The court further awarded N500,000 in damages for the unlawful and illegal removal of Obasa and for the psychological embarrassment caused to him.

Pinheiro, also said that the plenary session which was held by the house in the absence of Obasa was invalid.

She maintained that the session was convened without Obasa’s authority or a formal delegation of power, in violation of the House’s procedures.

Pinheiro held that only the leaders of the House of Assembly had the authority to write to the Speaker to convene a meeting, and that the Chief Whip was not considered a leader for this purpose.

The court noted that under Order 7 of the House Rules, there was a defined hierarchy, and Rule 30, which related to the authority of the Chief Whip, did not confer such powers on him.

Accordingly, the court held that all steps taken toward reconvening the meeting were invalid, and that the fact a majority of members voted was inconsequential.

“The defendant cannot validly remove the Speaker without complying with Order 2, Rule 9 of the Lagos State House of Assembly Rules.

“The purported sitting of the members of the Lagos State House of Assembly, the purported removal of the claimant as Speaker, and the purported installation of the second defendant is illegal, null and void,” Pinheiro said.

Earlier, while dismissing the preliminary objections for lacking in merit, Pinheiro held that a court of law could intervene where the provisions of the constitution had not been met during any proceedings of the House of Assembly.

The court relied on Usman vs Kaduna State House of Assembly and held that “it must be noted that in cases where the constitution provides a procedure for the removal of a speaker and there is a lacuna, the court will intervene.”

The court also relied on Agbaso vs Imo State House of Assembly and the recent Supreme Court decision involving the Rivers State House of Assembly and the Government of Rivers State.

The court agreed with the claimant that the facts of the case raised justiciable issues that the court could adjudicate upon.

Consequently,  the court  dismissed both preliminary objections.

Obasa had on Feb. 12 filed a suit against the House of Assembly and the newly appointed Speaker, Mojisola Meranda, challenging the legality of his removal.

Obasa’s Counsel, Chief Afolabi Fashanu (SAN), contended that the speaker’s unlawful removal by 36 lawmakers occurred while the Assembly was on recess and while he was out of the country.

Fashanu urged the court to declare the process unlawful, arguing that the sitting was invalid as it was convened without the Speaker’s authority or any formal delegation of power.

His legal challenge was based on nine grounds, drawing on the interpretation of various provisions of the 1999 Constitution (as amended), as well as the Rules and Standing Orders governing the Lagos State House of Assembly.

Assembly crisis: How Obasa re-emerged Speaker after removal from office

Members of the Lagos State House of Assembly have reinstated Mudashiru Obasa as the Speaker, ending 49 days of the speakership crisis.

Obasa returns as the Speaker following the resignation of the former speaker, Mojisola Meranda, during Monday’s plenary.

The  former Majority Leader, Noheem Adams, moved a motion to nominate Obasa while Nureni Akinsanya seconded the motion, with no other member nominated for the speakership.

Obasa was subsequently sworn in as the new speaker by the Head of the Legal Department of the House.

Meranda returned to her role as Deputy Speaker of the Assembly.

The speaker, however, promised to listen to his colleagues, thanking the staff and the media for projecting the House well.

Recall that Obasa was removed on Jan. 13 by  32 out of the 40 lawmakers, over financial impropriety, high-handedness and gross misconduct.

Crisis: Speaker Meranda resigns to pave way for Obasa

TheNewsGuru.com (TNG) reports incumbent Speaker Meranda resigned from office to pave way for the emergence of Obasa as Speaker again.

Meranda announced her resignation at   plenary on Monday in Ikeja.

Meranda  became the first female speaker after Mr Mudashiru Obasa, the former speaker, was impeached by his colleagues for alleged misconduct.

The impeachment of Obasa and subsequent election of Meranda had plunged the State Assembly in crisis.

Obasa returned to the Assembly complex last Thursday for the first time since he was impeached in January ,claiming he was never removed. Before then, he had challenged his impeachment in court.

Earlier on Monday, Mr Cornelius Ojelabi, the All Progressives Congress(APC) Chairman in the state , met with Meranda and Obasa on how to put an end to the festering crisis.

Both pro -Obasa lawmakers and those who had pledged support for Meranda attended the meeting.

Announcing her resignation ,Meranda said she was not a quilter ,but  took the decision to end in the crisis in the House and save the Assembly embarrassment.

She said: It is with every sense of responsibility that I hereby give you notice of my decision to resign as the Speaker of the Lagos State House of Assembly with effect from today, 3rd of March, 2025.

“I did not arrive at this decision lightly, Indeed, I took into careful consideration all the integral circumstances that related with my election as Speaker on Jan. 13 2025.

“I have to make this selfless sacrifice to resign in order to protect this institution. With your unflinching support.

”I made history as the first female Speaker of Lagos State House of Assembly and I value and cherish the solidarity freely given to me.

“I am not a quitter, however, I took thedecision in order to save this legislative institution from further unnecessary conflicts and embarrassment,” she said.

I am entranced by the dialogue of personal messages, phone calls, public shows of support and groundswell of solidarity from a broad spectrum of our society.”

Meranda said the nation was blessed with great men and women of honour, adding that it was her earnest hope that the leadership of the great party would continue to provide guidance and support for the aspiration of the people.

She  thanked the people of Lagos for their understanding and support.

Shortly after the announcement, lawmakers took turns to praise Meranda for her leadership role for the 49 days of her speakership.

The lawmakers described Meranda as a hero of democracy.

The impeached Speaker of Lagos State House of Assembly, Mudashiru Obasa has been re-elected as Speaker of the State House of Assembly.

“I didn’t take this decision lightly. I am not a quitter. I took this decision to save this house from further embarrassment.

“I am making a personal sacrifice by stepping down as Speaker,” Meranda said.

Following her resignation, Meranda was nominated again for the position of Deputy Speaker.

This is coming after Obasa held a meeting with Meranda and 34 other lawmakers at the assembly complex on Monday.

A thrilled Tinubu watches Obasa live above the law – By Ikeddy Isiguzo

    By Ikeddy Isiguzo

WHAT does Mudashiru Obasa know about President Ahmed Bola Tinubu that makes him act with such affront to constituted authority? Why does Tinubu pander to Obasa? Is Obasa untouchable, above the law with the backing of the law?

Only those who know can tell us. We can only believe them at our own peril. If I am to speculate, I would say nothing.

In politics, they say things are so possible, that “impossible” means that though something has never happened it can still happen. Obasa, three-term Speaker of the Lagos State House of Assembly, could be exploring the generosities of the uncharted courses of politics to his causes.

He had long announced that his eyes were on being the next Governor of Lagos. It was apparently his reaction to signals that the First Son was being made to be interested in the governorship of Lagos State.

Such behaviour when the President’s son has been openly mentioned should not be recorded as politeness. A quick retort is that Obasa opposing the President’s son without consequences meant Tinubu is democratic to the point of not siding his son in a race.

Those who claim they know say that all these swing to Tinubu’s favour. After the fierce battle for the ticket, Seyi, the First Son would get it. Obasa would have had his say, and the President his way. If the Lagos contest distracts Tinubu’s second-term dream, Seyi could step down. What a great sacrifice!

Obasa has been Speaker for almost 10 years. The contest for longest-serving Speaker would be between him and Hon. Sabit Adeyemi Ikuforiji who served from December 2005-June 2015. Obasa has been Speaker since 2015. His status is currently indeterminate with the legal tussle over the office.

Tinubu is a great beneficiary of the Lagos House troubles. The distraction is one that serves Tinubu as his government wobbles without direction. Who is Obasa to sit at plenary with four legislators when 36 have impeached him? The President reportedly asked Obasa to resign as the Speaker. He has ignored Tinubu. Who would he not ignore?

Police personnel attached to Hon. Mojisola Miranda, the Speaker, were withdrawn because of an on-going police personnel audit, according to State Commissioner of Police, Moshood Jimoh. Friday, when Obasa stormed the State House of Assembly as Speaker he had enough police personnel who I suspect had been audited but unavailable to Hon. Miranda. Was the President unaware?

House spokesman Olukayode Ogundipe, lamented, “We are shocked to see what is happening today. We won’t take laws into our hands, just like I told the staff members.

“We are not happy and we are already demystified. We’ve been law-abiding, we’ve not gone out of our ways, we’ve not done anything against the state or anybody but we also want to be respected, to be given our dignity, to be shown that we were elected. So, I’m appealing to the leadership of our party that we cannot continue this way”.

Some of the good things about democracy are that the rights to be shocked, and unhappy, are unhindered and in this instance, they were enhanced. Hon. Ogundipe and his colleagues were dismayed at the lawlessness at the State Assembly.

“I remain the Speaker of the Assembly. I’m not against removal, it’s constitutional, but you must comply with the provisions of the Constitution and rules of the House,” Obasa said.

Tinubu has seen Gen Ibrahim Babangida’s controversial book help him ride through the previous week. He can squeeze more distractions from the strong ripples of the book as more people pick out more issues that hold the public interest.

While we wrangle and tangle over major and minor beneficiaries of Babangida’s autobiography, lives of Nigerians are getting worse. Insecurity, hunger, diseases, a declivitous economy assault Nigerians daily. No remedy is in sight.

Tinubu has signed the 2025 Appropriation of over N54.99 trillion. Should we discuss Obasa, IBB, the budget or our individual daily challenges?

The 41.9% increase on the 2024 budget, and theming the 2025 money law, ‘The Restoration Budget: Securing Peace, Rebuilding Prosperity’ could be its salient points.

Next we would be talking about the President’s next trip – predictably to France – and why the new presidential jet could do with some repairs or outright purchase of a new one. There would be trite debates on the importance of loans to the economy.

The President would be glad that he would get a breather before our worries overwhelm him.

Distractions are critical to the survival of the government. No effort would spared in harnessing distractions.

Tinubu should conclude the Obasa script quickly. He needs to explore his other strategies. There are many months left in 2025.

Obasa resorting to self-help when the matter is in court is not a behaviour that should be associated with the President. If it is not checked, others could imitate Obasa.

The abusive use of the police heightens insecurity in the State. Other States are learning. Tension mounts everytime the Lagos Assembly meets.

Obasa is nothing without Tinubu. Obasa has done enough to be called to order. Or has he not?

The silence and inaction suggest that there is no “exit strategy” or the puppeteer finds the puppet’s performance enthralling. None of these reasons is a great idea on how to stabilise Nigeria to gain the peace it requires to improve her people.

    Finally…

SENATOR Natasha Akpoti-Uduaghan Friday alleged on Arise TV that her troubles in the Senate were from her refusal to engage in inappropriate relationship with Senate President Dr. Godswill Akpabio. Most people would not have known that the Akpabios and Uduaghans were family friends until Akpabio’s wife, Unoma, rose in stout defence of her husband. Aside of this matter is in court. Unoma threatens a suit too.

IMMEDIATE past President Muhammadu Buhari has relocated from his native Funtua to Kaduna. Some of his followers celebrated the move. Many in Katsina State placed their hope in his presence keeping bandits at bay. They have been disappointed. His departure to safer Kaduna is an illustration of the intensity of the security situation in Katsina.

KIDNAPPING for ransom is at the stage where most forests in Nigeria are unsafe. Geographical location makes no difference. The difference, and it is major, is that the crimes are under reported in some cases. Our forests are on fire from the type of crimes those who occupy them commit. Have these ungoverned territories been conceded to criminals?

DEATHS on the roads keep increasing in number of incidents, frequency, and number of lives lost. In the more recent cases, tankers distributing fuels are involved. If a fraction of the deaths on the roads are by air mishaps, the uproar would unsettle tne country. Governments, please act fast.

ELECTRICITY supply to Abuja has been more noticeably chaotic. We are told that some parts of the presidential villa are also affected. When would these insults stop? Are ordinary Nigerians “presidential villa”? Do we use public funds to fuel our generators? If government is unconcerned about our flight, no surprise though, it should confirm so.

BREAKING: Meranda to resign as Lagos Assembly sets to elect new Speaker

Barring any last-minute interventions, the Lagos State House of Assembly will, by Wednesday, elect a new Speaker, who is expected to come from the Lagos West Senatorial District.

TheNewsGuru.com (TNG) reports the current Speaker of the State House of Assembly, Mojisola Meranda is expected to resign from her position on Monday to pave way for a new Speaker to emerge.

These far-reaching decisions are the outcome of a meeting the Lagos Governance Advisory Council (GAC) held with members of the State House of Assembly on Sunday.

This is expected to put an end to the current controversy rocking the State House of Assembly following the removal of Mudashiru Obasa as Speaker.

Recall that on January 13, a speakership crisis erupted in the Lagos Assembly following Obasa’s removal over alleged financial misconduct and gross impropriety.

Obasa was immediately replaced by his Deputy, Mojisola Meranda, while Fatai Mojeed was appointed as the new Deputy Speaker.

However, the leadership crisis took a new dimension last Thursday when the ousted Speaker stormed the Assembly and insisted that he was never removed.

Obasa subsequently dragged members of the State Assembly and the current Speaker to court, challenging his removal as Speaker.

During the meeting of the GAC with members of the State assembly, the warring parties agreed that Meranda will resign and Obasa will return as Speaker and also resign officially.

By Wednesday, both resignation letters are expected to have gotten to the GAC and the council expected to advise the Assembly of who to elect as the new Speaker from Lagos West Senatorial District.

    This is a developing story…

  • Lagos GAC opens up on Obasa’s removal, return

Lagos GAC opens up on Obasa’s removal, return

Prince Tajudeen Olusi, the Chairman, Governance Advisory Council (GAC) in Lagos State says council was not consulted before impeaching Mr Mudashiru Obasa as the Speaker of the Lagos State House of Assembly.

Olusi, speaking with newsmen in an interview at his residence on Friday, said that lawmakers neither consulted the party nor the council.

He said that the council should not be dragged into the leadership crisis that saw the removal of Obasa and his replacement by the Deputy Speaker, Mrs Mojisola Meranda.

“Members of the GAC are not members of the Lagos State House of Assembly to allegedly be behind the removal of Obasa. It can’t be true.

“We read it also that morning. The lawmakers carried it out without consulting the party and those of us in the GAC. That is our position.

“We invited all of them and insisted that all of them are products of the party. They lodged their complaints and we listened to them.

“I blamed them for one thing and that is for not lodging the complaints earlier before the party.

“It is for the party to decide, they (lawmakers) have no absolute power to remove and install their leaders.

“Nobody can become a member of the House of Assembly unless sponsors by a political party and the sponsors are the inspectors,” Olusi said.

The APC apex leader said that the speakership crisis in the House remained a problem between Obasa and his colleagues in the House.

“The problem is the speaker (Obasa) and his colleagues which had led to his removal. It is a disputer among them,” he added.

He said no organ of government was totally independent of the other, adding that the party, GAC and another high powered committee set up was working tirelessly to resolve the dispute.

“Currently, there is a high powered committee of the party led by Chief Bisi Akande and members, including Aremo Olusegun Osoba, and former APC National Vice Chairman, South-west, Chief Pius Akinyelure and others,

“They are working and making efforts to resolve the matter. I know they are in consultation with the House of Assembly, Obasa and the other Speaker, Mrs Mojisola Lasbat Meranda.

“Those of us in the GAC and the Chairman of the Party, Pastor Cornelius Ojelabi are doing all within our power to assist the committee,” he added.

Speaking on dissenting views expressed by some members of the GAC, Olusi said that those who spoke expressed their individual views, which they were entitled to, not the GAC’s.

“One day, and very soon the matter will be settled. Dispute and differences are fact of life and dispute resolution and party mechanisms are also there.

“You leave us alone, as a party we are conscious of our responsibility and that of the House of Assembly; we are going to do all within our powers to resolve the dispute, The overall responsibility is on the party,” he added.

Recall that the leadership crisis took a new dimension on Thursday when the impeached speaker stormed the Assembly and insisted that he was never removed

Obasa, who spoke with reporters shortly after he arrived the assembly complex with some security personnel, said that he had returned to the assembly to take charge.

The visit was Obasa’s first appearance at the complex after he was impeached by his colleagues in January over alleged misconduct and financial impropriety.

The impeached speaker returned on a day the security details of Mrs Mojisola Meranda, were withdrawn.

Lagos Assembly affirms Meranda as Speaker as lawmakers gather in court for Obasa’s case

Members of the Lagos State House of Assembly have insisted that Mrs Mojisola Meranda remains Speaker of the parliament and has not resigned.

The Chairman of the House Committee on Information, Strategy and Security, Stephen Ogundipe, made this declaration in Lagos on Friday.

Recall that the ousted Speaker Mudashiru Obasa declared on Thursday that he had returned as Speaker of the parliament.

Obasa told reporters, shortly after arriving at the Assembly complex with heavy security, that he had not been removed from office.

Obasa also stated that he was back at the Assembly to take charge.

This was Obasa’s first appearance at the complex since his removal in January over alleged misconduct and financial impropriety.

His return coincided with the alleged withdrawal of security details assigned to Mrs Mojisola Meranda, who was elected Speaker immediately after his removal.

Ogundipe, in a statement, dismissed any speculation about Meranda’s resignation, stressing that she remains in office with the support of 36 colleagues.

The Assembly spokesperson reaffirmed the lawmakers’ unwavering support for Meranda, praising her dedication to serving the people of Lagos.

Ogundipe also alerted Nigerians and the global community to an unsanctioned attempt by the former Speaker and three members to convene a plenary session.

He emphasised that a valid sitting requires formal notice to members, a quorum, an approved agenda, and the mace—an essential symbol of legislative authority.

According to him, none of these conditions were met, as only five out of 40 members were present, rendering the session unconstitutional and without effect.

He said: “The Lagos State House of Assembly remains steadfast in upholding legislative integrity and maintaining the highest parliamentary standards.

“As an institution dedicated to the state’s progress, we will continue to act within the law to protect and preserve democratic governance.

“Furthermore, we reaffirm our unwavering support for the Speaker, Mojisola Lasbat Meranda, who remains committed to serving Lagos residents.

“Any speculation suggesting her resignation is entirely unfounded. She remains firmly in office with the confidence and support of 36 colleagues.”

Ogundipe said the House acknowledges the importance of party unity and aligns with the APC leadership in resolving internal misunderstandings.

He assured that, in the meantime, lawmakers remain focused on their legislative duties and committed to the welfare of the people.

Ogundipe urged all stakeholders to disregard misinformation and trust that the Assembly will continue to uphold democracy and good governance.

Lagos lawmakers gather in court for Obasa’s case

Meanwhile, twenty-nine lawmakers of the Lagos State House of Assembly have arrived at the Lagos State High Court for the hearing filed by ousted Speaker, Mudashiru Obasa.

Obasa went to court on Feb. 14 to challenge his removal by at least 35 colleagues on Jan. 13.

A correspondent observed that Obasa was not present at the hearing.

In an application dated 12 Feb. 12, 2025, his lawyer, Chief Afolabi Fashanu (SAN), claimed Obasa was removed on Jan. 13 while he was abroad.

The lead counsel representing Speaker Mojisola Meranda is Mr Tayo Oyetibo (SAN).

Other lawyers for the lawmakers include Mr Olu Daramola (SAN), Mr Femi Falana (SAN), Dr Muiz Banire (SAN), and Mrs Abimbola Akeredolu (SAN).

Also present are Dr Dada Awosika (SAN), Prof. Dayo Amokaye (SAN), Mr Mofe Oyetibo (SAN), Mr Olumide Oyewole, and Mr Wunmi Okeremi.

At the time of filing this report, Obasa was absent, while the other lawmakers, including the speaker, had taken their seats for the hearing.

Why I ‘stormed’ Lagos Assembly today – Obasa

The ousted Speaker of the Lagos State House of Assembly, Mr Mudashiru Obasa has opened up on the drama that transpired at the assembly complex today.

TheNewsGuru.com (TNG) reports drama ensued when Mr Obasa stormed the Lagos State House of Assembly on Thursday surrounded by security personnel.

Obasa arrived at the Lagos Assembly complex at about 12:05 pm accompanied by some lawmakers loyal to him.

He went straight into the Speaker’s office while other lawmakers, loyal to Mojisola Meranda, watched as the drama unfolded.

Addressing assembly correspondents at the complex, Obasa argued that he was never removed, adding that he had returned to  the assembly to take charge.

“I have resumed and I still remain the speaker of the Assembly. I was never removed.

“Impeachment or removal is democratic and constitutional, but in doing that, you must follow the due process.

“I am not against my removal. I am a democrat, but if the process had been fair, then I would not have gone against it,” Obasa said.

When asked why he was returning to the assembly when he had filed a suit challenging his removal in court, Obasa said there was no such suit in court.

Obasa said he was  back at the assembly not to take revenge or victimise any lawmaker.

He described Lagos  lawmakers as great colleagues, committed to the progress of the state.

TNG reports the  visit was Obasa’s  first appearance at the complex after he was removed by his colleagues  in January over  alleged misconduct and financial impropriety.

The ousted Speaker returned on a day the security details of Meranda, who was elected by the lawmakers immediately after Obasa’s removal, were withdrawn.

Victor Ganzalo, Meranda’s media aide, who confirmed the withdrawal of his  principal’s security aides in a statement, also said all personnel providing security at the assembly complex had been withdrawn.

Obasa told assembly correspondents that his security details had been restored and that he was back to his position as Speaker.

Just In: Drama as Obasa storms Lagos Assembly with armed security men

The impeached Speaker of the Lagos State House of Assembly, Mudashiru Obasa on Thursday made a dramatic return after arriving at the Assembly Complex with security operatives.

TheNewsGuru learnt that Obasa came with more than 11 Police officers and headed straight to the Speaker’s Office amidst reports of the withdrawal of the new speaker’s security operatives.

Recall that security aides attached to Obasa were on Thursday restored, while those assigned to the current Speaker, Mojisola Meranda, had been withdrawn with immediate effect.

A source close to Obasa’s camp confirmed the development, revealing that his security aides were reinstated earlier in the morning.

“They have restored all Obasa’s security aides as of this morning,” the source disclosed in an interview with the Punch.

The restoration of Obasa’s security personnel comes just hours after all police escorts assigned to Speaker Meranda and those securing the legislative complex were withdrawn, sparking serious safety concerns.

Confirming the withdrawal of Meranda’s security details, her Special Adviser on Information, Victor Ganzallo, expressed deep concern, warning that the decision leaves the Speaker and the Assembly complex exposed to potential threats.

“As we speak, all security has been withdrawn from the Speaker, and she is now on her own,” Ganzallo stated
