    Union Trustees Limited appeals vacated ex-parte order freezing the assets of Union Homes Savings and Loans Plc

    Union Trustees Limited has approached the Court of Appeal against to challenge the ruling of Justice Daniel Osiagor of the Federal High Court in Lagos that vacated an ex-parte order freezing the assets of Union Homes Savings and Loans Plc.

     

    Union Trustees Limited also filed an application seeking to stay the execution of the order.

     

    Respondents in the suit are: Union Homes Savings and Loans Plc, Aso Saving and Loan Plc and Union Bank of Nigeria Plc.

     

    The applicant is asking the Appeal Court to set aside the ruling of the Federal High Court delivered on Wednesday, which discharged/varied the interim Mareva Order and Order for the appointment of Receiver /Manager made on February 24, 2022.

     

    The applicant based its application on the ground that the lower court erred in law when it heard and determined the motion on notice dated March 7, 2022, filed by Dr Muiz Banire (SAN) when his competence to represent Union Homes Savings and Loans Plc had been challenged.

     

    It also argued that the hearing and determination of the application filed by Banire was wrong as the court ought to have first resolved the issue of legal representation before proceeding to other substantial issues such as the motion to vary/discharge the interim orders.

     

    Union Trustees, in its motion for stay of execution of the ruling filed before Justice Daniel Osiagor, is asking the judge for an order suspending the effect of the ruling vacating the Mareva injunction pending the determination of its appeal at the Court of Appeal.

     

    It is also seeking an order of injunction pending appeal maintaining status quo and restraining the respondents whether by themselves or their counsel, agents or privies from taking any steps whatsoever to interfere with the orders of February 24, 2022, or the ongoing Receivership of Union Homes Savings and Loans Plc pending the determination of the Applicant’ appeal to the Court of Appeal.

     

    The applicant is further praying the court for an order restraining the Respondents whether by themselves or their counsel, agents or privies from publishing, either by social media, by print or electronic publications, however, described or by making any form of representation to the public in respect of the first and second Respondents as relates to the vacation of the Orders of the court and/or the ongoing Receivership of the 1st Respondent, pending the determination of the Applicant’s appeal to the Court of Appeal.

     

    In an affidavit attached to the application, Union Trustees Limited claimed that it commenced this suit for the recovery of debt owed by the first and second Respondents to the tune of N41.2 billion.

     

    It also stated that to preserve the Respondents’ assets pending the determination of the suit and forestall a dissipation of assets, its applied and obtained an Order of Mareva injunction freezing the funds and assets of the Respondents as well as an Order appointing a Receiver/Manager for the first Respondent its undertakings, businesses and assets for the preservation of same among other orders.

     

    On March 23, the court delivered a ruling vacating the orders notwithstanding that another counsel had filed a notice of preliminary objection dated March 22, 2022, to challenge the authority of counsel representing the first Defendants to act as counsel to the said Respondent in this suit.

  • JUST IN: APC suspends National Legal Adviser, Muiz Banire

    The Executive Committee of the All Progressives Congress in Mushin Local Government has suspended the National Legal Adviser, Dr Muiz Banire from the party citing anti-party activities.

    The suspension follows the recommendation his ward (Ward C, Ilasamaja, Mushin).

    According to the Acting Secretary of the Ward, Taofeek Ajani-Balogun, the decision to suspend Banire from the party was reached during the ward meeting held to review the last Local Government elections in the Ward.

    “After a critical assessment of individual activities and the performance of the party during the last elections, members of the party in Ward C, Ilasamaja, Mushin unanimously voted for the immediate suspension of Banire from participating in party activities in the Ward and his removal from office as National Legal Adviser.

    Speaking further, Ajani- Balogun said the meeting resolved to suspend the Ward and LGA Chairmen and Executives due to the poor results recorded in the last elections and has forwarded the ward’s decision to the LGA for further deliberations and recommendations to the State Chapter.

    Also, the acting Party LGA Chairman (Mushin), Mr Sola Osobajo confirmed that during the last LGA meeting, the party received and reviewed minutes of meeting from Ward C and considered the decisions contained therein.

    He said, “after receiving the minutes of the Ward C meeting, concerned and committed members of our great party, APC in Mushin Local Government deliberated on the resolutions of the ward meeting and having carefully considered the decision of Ward C EXCO, we decided to adopt the resolution for further necessary action at the State and National level. The Party EXCO in Mushin Local Government further recommended to the State Chapter the expulsion of Mr Muiz Banire from the party,” he said.

    It would be recalled that leaders and members of All Progressives Congress APC, last Tuesday held a peaceful protest to demand the expulsion of Banire from the party based on alleged anti-party activities and in accordance with Article 21 of the constitution of the party.

    Some of the grounds for the request are alleged anti-party activities such as causing a Legal Representative to disavow the Party in a Law suit before the elections and working towards the electoral failure of the Party.

    Other anti-party activities which Banire was accused of before and during the last local Government elections include; Inciting the public against the interest of the Party; falsely accusing the party of imposition in public thereby bringing the Party into disrepute; Disobeying and causing others to disobey lawful directives of the Party Causing disaffection within the party.

    The party also accused Banire of causing his supporters to disrupt the peaceful process of efficient organisation of the Party, particularly in respect of the campaigns of candidates of the Party and causing fear and apprehension among Party loyalists during the elections.

    Some members of the All Progressives Congress, APC in the Mushin area of Lagos, on Tuesday protested to the Lagos State House of Assembly in Alausa, Ikeja, demanding the expulsion of the APC National Legal Adviser, Dr. Muiz Banire (SAN), from the party.

    Recall that TheNewsGuru.com had earlier reported that Banire who is dissatisfied with the inner operations of Lagos APC, said the leadership of the party was not allowing popular candidates to represent the APC in Saturday’s local government election.

    Banire in the said report alleged that one Seyi Oladejo, a commissioner in the state, had concluded plans to mobilise a rally against him for his principled stance.

  • Lagos APC crisis: I have been receiving life threatening messages – Banire

    National Legal Adviser of the All Progressives Congress (APC), Muiz Banire has alleged that he has been receiving threat messages over his fight against imposition of candidates in the party.

    Banire had said the leadership of the party was not allowing popular candidates to represent the APC in Saturday’s local government election.

    In a statement on Monday, Banire alleged that Seyi Oladejo, a commissioner in the state, had concluded plans to mobilise a rally against him for his principled stance.

    “It has come to my attention that a rent-a-crowd rally is being organised by one Mr Seye Oladejo, former chairman of Mushin local government and the current commissioner for special duties in Lagos state, with the assistance of some elements to destroy the democratic aspirations of the people. The said rally is being planned to hold on Tuesday the 18th day of July 2017,” he said.

    “It is saddening to note that not satisfied with the several threat to life messages emanating from their quarters and addressed to me to intimidate me, these rudderless agents of anti-democratic practices in Lagos state have perfected plans to carry out a financially-induced protest march against me in order to impose their soulless campaign of imposition of candidates against the people of Lagos state.

    “We use this medium to reiterate that no amount of campaign of calumny or threat to life shall deter me from maintaining my principled position on the need to allow internal democracy in our great party, All Progressives Congress.

    “This is cannot be compromised in order to instil sanity in our democratic experiment and allow progressive development in Nigeria. As the national legal adviser of APC, I am the custodian of the constitution of our great party and the counsellor of the party on legal matters. It would be most destructive to find me lending my weight in favour of imposition of candidates on the members of the party in order to promote a culture of personality cult advancement being nursed and nurtured by the likes of the organisers of this conscienceless rally. “I hereby notify the general members of the public and our progressive members of APC not to be confused by these agents of
