    BREAKING: Request to extradite Abba Kyari to US dismissed

    A Federal High Court, Abuja, on Monday, refused to grant the extradition application filed by the Federal Government for permission to extradite the suspended DCP Abba Kyari to the United States (US).

    Justice Inyang Ekwo, in a judgment, described the extradition request as “an abuse of court process,” on the grounds that Kyari was already standing a criminal trial before another court.

    Recall that the Federal Government had on March 2, through the Office of the Attorney-General of the Federation (AGF), filed the extradition suit marked: FHC/ABJ/CS/249/2022, praying the court to grant the plea for Kyari to face a criminal charge levelled against him by the U.S. government.

    The U.S. authorities had applied to the Nigerian government for Kyari’s extradition in relation to his alleged link with a suspected international fraudster known as Ramon Abbas, who is popularly known as Hushpuppi.

    In a three-count indictment in case number: 2:21-cr-00203-RGK filed on April 29, 2021 in the U.S. District Court for the Central District of California, Kyari was accused of “conspiracy to commit wire fraud in violation of Title 18 United States Code, Sections 1349; conspiracy to commit money laundering in violation of Title 18, U.S. Code, Sections 1956(h).

    Although there is no death sentence imposed on the offences for which he is being accused, if found guilty, the punishment for the offences as contained in the superseding indictment carries a maximum of 20 years imprisonment for count 1; 20 years imprisonment for count 2 and 2 years imprisonment for count 3 consecutive to any other sentence imposed respectively as contained in the various United States laws.

    Meanwhile, the National Drug Law Enforcement Agency (NDLEA), in an eight-count charge dated Feb. 25 and filed Feb. 28, accused Kyari and six others of allegations bordering on a cocaine deal.

    In a counter affidavit filed by Kyari’s team of lawyers which include Nureni Jimoh, SAN; Hamza Dantani, among others, the suspended DCP had urged the court to dismiss the application on the grounds that he was currently standing trial on offences allegedly committed contrary to and punishable under the NDLEA Act, Cap N30, laws of the Federation of Nigeria, 2004.

    Delivering the judgment, Justice Ekwo held that Kyari’s averment had not been controverted by the AGF. According to the judge, by the role given to the AGF in Section 10 of the NDLEA Act, the NDLEA commences criminal proceedings in court by his (AGF’s) fiat.

    “Indeed, charges under the NDLEA Act, are normally brought in the name of the Attorney-General of the Federation. Therefore, the Attorney-General of the Federation being the applicant in this case cannot say that at the time this application was initiated on 2nd March, 2022, he was not aware of the pendency of the criminal proceedings in Charge No. FHC/ABJ/CR/57/2022, FRN v. DCP Abba Kyari & Ors. (Exh. 2) which was commenced on 28th February, 2022,” he said.

    Ekwo said it was contrary to the provisions of the Extradition Act to surrender Kyari for trial in the U.S. when he was still facing a criminal charge in another court of competent jurisdiction.

    “The position of the law in Section 3(6)(a) of the Extradition Act is that a fugitive criminal who has been charged with an offence under the law of Nigeria or any part thereof, not being the offence which his surrender is sought, shall not be surrendered until such time as he has been discharged whether by acquittal or on expiration of the sentence or otherwise.

    “By the wording of Section 3(6)(a) of the Extradition Act, the law mandatorily estops the court from making an order to surrender a fugitive who has been charged with an offence under the law of Nigeria or any part thereof.

    “This, in my opinion, is plain and easy to understand. The duty of the court is to interpret the words contained in the statute and not to go outside the clear words in searching far an interpretation which is convinient to the court or to the parties in the process of interpretation,” he said.

    Ekwo further stated that by Section 3(2)(a) of the Extradition Act, the court was also empowered not to make an order for surrender where the request though purporting to be made in respect of extradition crime was not made in good faith.

    “The phrase ‘good faith’ has an enlarged scope in its character and transcends limitations,” he said.

    The judge said the applicant, being the AGF, ought to have known that Kyari is standing trial in a sister court and shouldn’t have brought the extradition application in view of the provision of Section 3(6)(a) of the Extradition Act.

    “In the end, I find that this application is not brought in good faith. It is also in breach of the provision of Section 3(6)(a) of the Extradition Act and cannot be allowed.

    “By that fact, it is incompetent. It is equally bereft of merit and ought to be dismissed. I make an order dismissing this application. This is the judgement of this court,” Ekwo declared

    The U.S. Attorney’s Office for Central District of California, Los Angeles, had recently confirmed that  Hushpuppi would be sentenced on Sept. 21.

    The National Drug Law Enforcement Agency (NDLEA) has arrested a cleaner at the Murtala Muhammed International Airport, (MMIA), Ikeja Lagos, Ohiagu Sunday, who allegedly leads a drug syndicate at the international wing of the airport.

    The Director, Media and Advocacy, NDLEA, Mr Femi Babafemi said this in a statement on Sunday in Abuja.

    Babafemi said that the suspect was nabbed on Tuesday following the arrest of an intending passenger on Airpeace flight to Dubai, UAE.

    He said that the passenger named, Obinna Osita, was arrested with three bags, two of which contained eight blocks of cannabis sativa weighing 4.25kg concealed in cassava product, garri and crayfish.

    He also said that one other member of the airport syndicate who worked with Ohiagu had also been arrested, while operatives were trailing another suspect.

    “Investigations revealed that a Dubai-based drug dealer recruited Obinna, a 42-year-old native of Oyi Local Government Area, Anambra, to traffic the drugs.

    ” And equally contracted Ohiagu, a 34-year-old airport cleaner from Orlu West Local Government Area of Imo to create access for the unhindered passage of the trafficker.

    “The drug syndicate bust, which is the first drug arrest at the new terminal of the MMIA comes on the heels of the seizure of a consignment of bottles of viju and fearless energy drinks.

    “They were used to conceal skunk for export to Dubai, UAE through the NAHCO export shed on Monday Aug., 15, ” he said.

    Babafemi said that a freight agent had already been arrested in connection with the seizure and more Investigations were still ongoing.

    NDLEA nabs Sokoto traditional ruler over alleged drug deals

    The National Drugs Law Enforcement Agency (NDLEA), Sokoto State Command, has nabbed a suspected drug dealer, Umar Mohammed, who is also a monarch being the Village Head of Ruga in Shagari Local Government.

    Briefing newsmen on Tuesday in Sokoto, Mr Adamu Iro, the NDLEA Commander in the state, said the suspect was arrested following intelligence-driven investigation by the command.

    Iro said the suspect, who is a traditional title holder has been on the suspects’ list of the command for a long period of time.

    “Earlier, we arrested his wife in possession of large amount of illicit drugs, but we released her following an investigation that the items belonged to the husband.

    “So, Alhamdulillah, on Monday, we have been able to nab him and we found 436.381 kg of Cannabis Sativa and 1 kg of Diazepam at his residence,” he said.

    He added that the suspect had since admitted to the offence and informed the command of being in the business for a long period of time.

    He said that the NDLEA Command in Sokoto would ensure proper, but speedy investigation on the matter in order to charge the monarch to court.

    The Commander further assured the citizens of the NDLEA’s determination to raid all traffickers’ dens and ensure that they are prosecuted accordingly.

    He appealed to the general public to continue to support the agency toward achieving its mandate of ending any form of drug abuse in the society.

    NAFDAC bans herbal aphrodisiacs laced with injurious substance

    The National Agency for Food and Drug Administration and Control (NAFDAC) has banned the production and usage of a herbal mixture known as ‘Kurkura’; herbal aphrodisiacs, and alcoholic bitters in the country.

    Kurkuma used by many in boosting the immune system in readiness for sex  is said to be very common in the Southwestern parts of the country.

    NAFDAC’s  Director-General, Prof. Mojisola Adeyeye, made this known at a press conference in Abuja on Friday.

    According to Adeyeye, the herbal aphrodisiacs, contains dangerous substances like tobacco and cannabis which is risky to one’s health.

    She said that the ‘Kurkura’ herbal mixture discovered in circulations included “Five Minutes Power Herbs Medicine, Haonu Laha Herbal Mixture, Gamzaki Tradomedical Herbal Ventures, Barakallahu Multipurpose Herbal Mixture, and Sabon Karfi Herbal Mixture.”

    She said, while Haonu Laha Herbal Mixture was registered with the agency, it was laced with unapproved substances that were injurious to the body. 

    “Kurkura is an illicit product illegally consumed for the sole aim of getting intoxicated. The substance when abused can be harmful to the body organs such as the brain, kidney, and liver. The damage to the kidney and liver cannot be overemphasised. This substance can cause irrational thinking, and an altered state of mind, which if taken by a driver can lead to a road traffic accident with the attendant fatality consequences or can lead to criminal behaviours such as rape, kidnapping, and murder. 

    “Another herbal preparation that is of concern is aphrodisiac and we have discovered the lacing of it with cannabis. 

    “In our recent operation, we impounded the following dangerous herbal aphrodisiac at some Islamic Herbal Medicines shops in Zaria, Kaduna State – Gagare Man Power, Minister For Man Power, Almenjou For Lazy Men in Bed, Nisan Zango Karfin Maza, Shagalin Ka Man Power, Dakan Jia Man Power enhancement, Wuff Male Sexual Performance, Afafata For Sexual Drive, etc. 

    “So far, one of the illegal factories involved in the production of such unauthorised products has been shut down and the owner arrested. Worthy of note is the discovery of the usage of Hyergra 200 (Sildenafil Citrate tablet), Amafranil tablets (Clomipramine tablet 25mg), and Cannon Extra (Paracetamol 500mg+Caffeine 30mg) in the production room. The owner admitted that he dissolves the Hyergra 200, Cannon Extra, and the Amafranil in a drum and mixes the content with boiled Kanafari, Garlic, Dundu, Marke, Hankufa, Sweetener, and Sodium Benzoate to make up the Man Power preparation. Yet the label on the preparation read 100 per cent herbal. 

    “The effect of such preparation on a person with heart challenges can only be imagined. The makers of these products were arrested and later granted bail. The investigation is ongoing. 

    “An alcoholic bitters product that is of grave concern is Japata Alcoholic bitters which was duly registered by NAFDAC but laced with marijuana or cannabis compared to the registered product that had only ethanol. Through intelligence, NAFDAC was able to shut down the company. This product when tested in the laboratory caused the death of the mice within five minutes. The alcoholic content was doubled compared with the registered product. The retained samples, kept at the point of registration, did not cause any injury to the animals. 

    “The product laced with cannabis was said to cause an altered state of mind and psychological problems to the user. The owner of the company is on the run and the matter has been shared with the NDLEA.”

    The don pledged that the agency will continue with the raid on other illegal production outlets and the perpetrators will be dealt with in line with the extant laws and regulations. 

    “This drives home the fact that the eradication of fake and counterfeit drugs, adulterated and unwholesome processed foods, and other regulated products is a holistic battle that should involve every well-meaning Nigerian. I want to assure Nigerians that NAFDAC is doing everything to ensure that only safe medicine and wholesome food of the right quality are sold to our citizenry,” she said.

    Popular Abuja businessman selling illicit drugs on Jiji arrested

    One Mr Orakwe Chibuike Celestine, a popular businessman based in Abuja, the Federal Capital Territory (FCT) has been arrested for engaging in sales of illicit and controlled drugs on the popular e-commerce platform, Jiji.ng.

    TheNewsGuru.com (TNG) reports Mr Orakwe, the MD/CEO of Marvelrock Pharmaceuticals and Stores Limited, was arrested by the operatives of the National Drug Law Enforcement Agency (NDLEA), following painstaking investigation.

    A graduate of Business Administration from the University of Abuja, Orakwe registered the pharmaceutical company on 16th December 2014 with the certificate and support of a licensed pharmacist, who opted out of the deal in 2017, according to a statement by Femi Babafemi, NDLEA’s Director of Media and Advocacy.

    “The suspect continued running the business and enrolled it on Jiji.ng platform in 2019. He however came under NDLEA’s radar in October 2021 when he advertised many pharmaceutical products such as Tramadol, Ketamine Hydrochloride injection, Hypnox flunitrazepam tablets among others on the Jiji.ng online marketplace.

    “Between 26th October 2021 and 8th August 2022, the team of anti-narcotic officers assigned to investigate Orakwes drug business activities was able to establish the suspect was selling Tramadol 225mg and other illicit/controlled drugs through the e-commerce platform.

    “As a result, the suspect was arrested with some quantities of Tramadol and Swiphnol brand of Rohypnol on Monday 8th August at a drink joint in Jabi area of Abuja where he had gone to make some supplies of orders made through his online channel on Jiji.ng.

    “In his reaction to Orakwes arrest, Chairman/Chief Executive of NDLEA, Brig. Gen. Mohamed Buba Marwa (Retd) said the painstaking investigation and process of arresting the businessman should send a strong message to those hiding behind the internet to engage in marketing and selling of illicit/controlled drugs that the Agency will definitely get them to face the consequences of their action,” the statement reads.

    NDLEA arrests 611 drug traffickers in Kaduna

    The National Drug Law Enforcement Agency (NDLEA), Kaduna State Command, said it had arrested 611 suspected drug traffickers from January to July in the State.

    The agency’s Commander in the state, Mr Umar Adoro disclosed this on Monday in Kaduna.

    Adoro said out of  the 611 suspects, 480 drug users had been counseled, rehabilitated and integrated into the society,

    “131 were charged to court and we secured the conviction of 69 and 62 are still  awaiting trial within the period under review.

    ”Within the period under review, the command also seized illicit drug which included  Cannabis 3,893.189kg , Cocaine 1.309kg, Heroin 0.097kg ,Psychotropic 3,949.63kg, Methamphetamine 0.147kg and Tramadol 1,851.369kg .

    “The total drug seized was 3,898,991.552kg within the period under review,” Adoro said.

    He urged the public to be mindful of suspicious movements of goods in their communities and provide useful information to the agency to enable it to curb influx and consumption of hard drugs.

    The commander also appealed to parents to closely observe their wards’ activities.

    He reassured the public of NDLEA’s commitment to eradicating illegal drugs in the society to the barest minimum

    We have secured 1000 convictions on terrorism – Malami

    The Attorney-General of the Federation and Minister of Justice, Abubakar Malami, says the ministry has secured no fewer than 1000 convictions on terrorism within 18 months.

    Malami disclosed this on Thursday at the 46th session of State House Ministerial Briefing organised by the Presidential Communications Team in Abuja.

    He said that within the period under review, the ministry had been involved in 312 cases ranging from terrorism to maritime offences, armed robbery, cyber-crime and kidnapping, among others.

    The minister said that the justice sector encompassed all institutions of government involved in administration, enforcement and dispensation of justice.

    “This sector extends beyond the federal level and cuts across sub-national entities and the three arms of government—the judiciary, the executive and the legislature.

    “Effective collaboration and coordination is therefore at the crux of the mandate of the Federal Ministry of Justice.”

    Malami said that the briefing highlighted not only the policy initiatives of the ministry, but also extended to critical achievements in the justice sector through policies and initiatives.

    ”They are targeted at improving legislative policies, the judicial system, correctional system, law enforcement, constitutional guarantees and other critical component of the entire justice sector system.

    “All these are fundamental to ensuring access to justice, safety, security and in combating corruption as well economic and financial crimes in Nigeria,’’ he stated.

    Malami said that the justice sector, as with every other sector, had continued to witness some challenges which constituted impediments to justice.

    Malami said that through the instrumentality of the Office of the Attorney General, all justice sector stakeholders had built consensus.

    He added that they had led to the identification of the challenges and resulted in the development and adoption of the first e ever National Justice Policy in 2017.

    Malami said :“Following this landmark achievement of consensus among the justice sector stakeholders, all justice sector institutions across the country have continued to collaborate.

    ”They have also provided frameworks for the realisation of the objectives set out in the National Justice Policy.

    “It is our firm expectation that the full implementation of the proposals in the national policy on justice sector would lead to greater synergy and shared knowledge among all stakeholders involved in the administration of justice.

    “But, whatever successes we are about to unfold under the administration of President Muhammadu Buhari are  the products of that consensus.

    ”We are happy to state for the first time in the history of this nation, we are  doing wonderfully well arising from the consensus that has been built among these stakeholders in the administration of justice.’’

    He said that his focus was on the criminal prosecution by the ministry on the last 18 months.

    Malami said that at a point, the country was confronted with the challenge related to the speedy administration of justice.

    He said that the Federal Ministry of Justice, through a consensus building by legislature, the executive and ministries, came up the Administration of Criminal Justice Act and its implementation to speed up prosecution.

    “We were confronted further with the challenge that high profile anti-corruption cases.

    “Those involved in it were using the proceeds of the crime in question to pose a greater challenge to what we are doing.

    ”This is arising from their movements, arising from the deployment of such resources, we also came up the Executive Order No 6 which restricts their access to funding,” the minister said.

    He said that on the basis of the act and the executive order, the foundation for prosecution was laid.

    The minister said that aside collaborative achievements, the ministry had made exclusive landmark achievements.

    “So, arising therefrom, for example, by way of criminal prosecution, the Federal Ministry of Justice, exclusively, I am not talking about the entire prosecution because other agencies of government—EFCC, NDLEA, ICPC are equally involved in direct prosecution.

    “So, the Federal Ministry of Justice, within the 18 months period, I am talking about, was actively involved in the prosecution of 312 criminal cases.

    ”These were for various offences including terrorism, maritime offences, armed robbery, cyber-crime and kidnapping, among others.

    “We have so far, as a ministry secured over 1000 convictions on terrorism within the period in consideration,’’ he said.

    Popular Akwa Ibom pastor arrested with 3 drums of Mkpuru Mmiri

    Operatives of the National Drug Law Enforcement Agency (NDLEA) have arrested a popular Akwa Ibom State pastor, Pastor Anietie Okon Effiong with three drums of crystal methamphetamine, locally called Mkpuru Mmiri, believed to have been imported from India.

    TheNewsGuru.com (TNG) reports Pastor Effiong was arrested after the consignment weighing 90 kilograms and loaded into a commercial bus with registration number RSH 691XC was intercepted during a stop and search operation along the Umuahia-Ikot Ekpene highway on Saturday.

    According to the NDLEA, Pastor Effiong was arrested at Oron beach in Oron, adding that the consignment, loaded into the commercial bus at Ojuelegba, Lagos State, was meant for onward delivery to the Republic of Cameroon.

    Meanwhile, the drug law enforcement agency disclosed in a statement on Sunday that a female passenger, Jatau Lydia Lami was arrested at the Murtala Muhammed International Airport, Lagos Sunday 31st July for attempting to export 1,700 tablets of Tramadol 225mg concealed in her luggage to Istanbul, Turkey via a Turkish Airline flight.

    The agency disclosed that preliminary investigation revealed that the suspect, a mother of three, hails from Zango Kataf LGA, Kaduna State and lives in Istanbul, Turkey with her family. She blamed her action on pressure to raise N5 million ransom to free her mother from the captivity of bandits who kidnapped her in June.

    How drug baron endangered lives of VGC residents in Lagos

    Residents of Victoria Garden City Lagos state have been put at health risk by exposure to highly toxic and dangerous chemicals from a clandestine methamphetamine laboratory located within the estate, which was run by drug baron Emeka Nzewi.

    Nzewi, his wife and ‘cook’ Sunday Ukah, who produced the drugs, were arrested by officials of the National Drug Law Enforcement Agency (NDLEA) during a sting operation last Saturday.

    The NDLEA said in a statement that Nzewi had exposed all occupants of properties around his residence which doubled as lab, to hazardous chemicals contained in the waste generated from production of crystal meth.

    “In this particular case, aside from the laboratory being close to the kitchen of the main house, the waste from the laboratory was channeled into the septic tank and soakaway in the compound, with a high risk of contamination of the water table of the entire neighbourhood,” Chairman and Chief Executive of NDLEA Mohamed Buba Marwa, disclosed on Tuesday.

    He said as a result, all boreholes, water supply and plants 500 meters away from house K-5A/2 on Road 14 have been contaminated.

    “It is very important to note that the waste from methamphetamine production is dangerous to the ecosystem. The chemicals are toxic and once they seep into the soil, they contaminate the water table from which surrounding wells and boreholes draw their water.

    “Citizens who unwittingly consume the water from such sources are exposed to heart and kidney ailments and other organ diseases,” Marwa added.

    It was gathered that the laboratory set up inside the Boys Quarter of Nzewi’s four-bedroom duplex, produced 50 kilos of methamphetamine every week and there were plans to scale-up production to 100kg per week.

    A total of 258.74 kilograms of crystal methamphetamine and various precursor chemicals used for the production of the toxic drug were recovered from the apartment.

    The Agency is working with the Victoria Garden City Property Owners and Residents Association (VGCPORA) to conduct water tests on properties within the estate.

    Property Owners do not conduct background checks of tenants before lease of properties. Such act exposes other residents to security risk.

    Chairman of the estate Olusegun Ladega said henceforth, VGCPORA will make background checks mandatory for new residents before access cards will be issued or renewed for existing residents.

    “VGCPORA has a longstanding commitment to provide a safe, drug free environment. Alcohol and drug misuse pose a threat to the health and safety of VGC and to the security of the community,” Ladega noted.

    The National Drug Law Enforcement Agency, (NDLEA) has arrested a former women wig and hair attachment seller, Okwo Okechukwu, for ingesting 76 pellets of cocaine.

    The NDLEA Director of Media and Advocacy, Femi Babafemi, in a statement on Sunday.

    According to him, the streaks of arrests and seizures began on Sunday, July 17, when the 52-year-old father of three was arrested upon his arrival from Addis Ababa, Ethiopia, via an Ethiopian airline flight at the Abuja airport.

    The agency also said two ladies and six men were arrested over attempts to import hundreds of cocaine pellets into Nigeria and export thousands of tramadol 255mg tablets, among other illicit drugs, to Europe through the Nnamdi Azikiwe International Airport, Abuja; Akanu Ibiam International Airport, Enugu; and Murtala Muhammed International Airport, Lagos.

    The agency said, “He has since completed excreting all the 76 wraps of the drug he swallowed while under observation at the agency’s facility in Abuja.

    “In the same vein, another father of three, Lawrence Chijioke, 42, was arrested at the Abuja airport the same day in an operational synergy between NDLEA and Nigeria Customs Service at the NAIA.

    “Chijioke was arrested during an inward clearance of an Ethiopian Airline flight from Addis Ababa with 529 pellets of cocaine weighing 11.70kg concealed in his bag. In his statement to anti-narcotic officers, he claimed he was promised N2m, which he planned to use to boost his business upon the successful delivery of the cocaine consignment in Abuja.

    “NDLEA operatives also on Saturday, July 23, arrested 29-year-old Ms Onuorah Caritas Onyinye at the Enugu airport upon arrival on an Ethiopian airline flight from Addis Ababa.

    “A search of her luggage led to the discovery of 2.192kilograms of cocaine concealed in two feminine designer handbags with false linings,” the statement added.

    At least, four freight agents were also arrested in connection with the seizure.

    The agency note that it also frustrated attempts by drug traffickers to export different illicit drugs through the NAHCO export shed at the Lagos airport to Europe and the United Arab Emirates.

    The operatives on Monday, July 18, intercepted some illicit substances concealed in a consolidated cargo going to Dubai, UAE.
