    BREAKING! Court dismisses Elumelu’s victory, upholds LP’s candidate election win

    The Court of Appeal in Abuja reversed the judgment of the National and State Assembly Elections Petitions Court in Asaba which declared Ndudi Elumelu as winner of the Aniocha Oshimili Federal Constituency.

    TheNewsGuru.com, (TNG) reports that Elumelu of the Peoples Democratic Party (PDP) was declared winner of the February 25 election by the tribunal after it avoided the victory of Ngozi Okolie of the Labour Party.

    Delivering judgment on Thursday, the Appeal Court faulted the tribunal for voiding Okolie’s election and proceeded to dismiss the petition filed by Elumelu.

    The Court of Appeal agreed with lawyer to the Labour Party, Mahmud Magaji (SAN) that contrary to the finding of the tribunal, Okolie was duly nominated and sponsored by his party and that he resigned his appointment as a Senior Special Assistant (SSA) to Delta State Government as required by the Constitution.

    Mr Ngozi Okolie, member representing Aniocha-Oshimili Federal Constituency in the House of Representatives, under Labour Party says he will appeal the tribunal judgment annulling his election.

    Okolie made this known while addressing a news conference in Abuja on Tuesday.

    The tribunal, in a judgment on Monday, nullified the declaration of the Labour Party (LP) candidate, Ngozi Okolie, by the Independent National Electoral Commission (INEC) as the winner of that election.

    However, Okolie said that the judgment had no legal basis and pledged readiness to appeal the judgment.

    Okolie refuted the court judgement that he contested the election while in office as against the constitution, stressing that he resigned before thirty days to the election as enshrined in the constitution.

    He noted that a recent court verdict in the Atiku vs Tinubu, APC, ruled that issues of candidacy were the internal affairs of political parties.

    “Before I contested the Feb. 25th election, the People’s Democratic Party Government in Delta state which I served had stopped my salary which followed my resignation.

    Okolie emphasised that the election that brought him into office was the most credible in the state since the nation returned to a Democratic Government.

    “I didn’t rig any election, God is my witness, people came out enmass to vote for me, I’ll beat my chest and say I am the only person in that constituency that have won without rigging” Okolie stated.

    Okolie expressed dissatisfaction with the judgment and noted that time was getting closer when Nigerians would resort to native shrines to seek for justice because people no longer believed in the Judiciary.

    Okolie explained that he defected from the Peoples Democratic Party (PDP), to the Labour Party (LP), to find opportunity in assisting people from his constituency to boost their standard of living.

    “I have a lot of friends in PDP, my aim of joining politics is not to become a member of PDP but to help my community.

    “So if I see any opening to help my community I will jump into it, I wasn’t born PDP, a lot of people have left the party to other political parties and came back and they are more like stakeholders in the party than others.

    “Those shouting in Asaba  I am more a stakeholder than them,” he added.

    Meanwhile, the Labour Party has expressed shock over the judgment by the National Assembly Election Petition Tribunal sitting in Asaba, Delta State, where it sacked Labour Party’s Ngozi Okolie.

    A statement signed by the National Publicity Secretary of the party, Mr Obiora Ifoh in Abuja, says the issue of nomination of candidates as well as membership are internal affairs of the party beyond the jurisdiction of courts.

    Ifoh added that it was only a political party that could determine who its members were and who their flag bearer is in an election.

    “However, it is a notorious principle of law that courts have no right whatsoever to dabble into the internal affairs of political parties as to choose their candidates for them” or decide the status of their membership” Ifoh adds.

    The National Assembly Election Petition Tribunal sitting in Asaba, Delta State, declared Ndudi Elumelu of the Peoples Democratic Party (PDP) as the winner of the 2023 House of Representatives election for the constituency.

    The tribunal held that Okolie was not duly sponsored by the Labour Party since he was not a member of the party as of May 28, 2022, when the party’s primary was held and therefore, declared the runner-up in the Feb. 25, 2023 National Assembly, Ndudi Elumelu of the PDP as the winner.

    The absence of result sheets and insufficient ballot papers stalled the voting process in the hometown of Mr. Ndudi Elumelu, Minority Leader, House of Representatives, in Delta.

    Elumelu is the member representing Aniocha/Oshimili Federal Constituency of Delta and he seeks a return to the House of Representatives in the 2023 general elections.

    Elumelu, disclosed this to newsmen at Saturday’s Presidential and National Assembly elections at Ward 1, units 1 to 6, Kandinma Primary School, Onicha-Uku, Aniocha North Local Government Area of Delta.

    He noted that the Bimodal Voters Accreditation System (BVAS) was working perfectly and the process going on smoothly at the early hours before it was discovered that the ballots were insufficient and there was no result sheets for the ward.

    According to Elumelu, the INEC was contacted and the election process has to stop till all the issues were resolved.

    The News Agency of Nigeria (NAN) reports the INEC representative brought the result sheets at about 1.00 p.m. when the voting resumed in the area.

    The situation was, however, not the same at Ward 4, units 5, 6, 7, 8, and 17 at Ugba Primary School,  Onicha-Olona,  also in Aniocha North LGA.

    As at the time of reporting, voters were seen filled out orderly members on queue to cast their votes after been accredited.

    According to Mr Austin Modungwo, voting commenced peacefully and the BVAS working perfectly.

    On his part, Mr Patrick Ochei, a Chieftain of All Progressive Party (APC) lauded the process, adding that Mr President has done the country proud by ensuring an election process that works.

    “I must say that I am very proud to have from a country where we can go out and see our votes count.

    “From what I have seen today, it is fantastic, I think Mr. President had delivered on his mandate of promising free, fair, and credible elections in Nigeria and that has happens before everybody’s presence.

    ”The BVAS worked fantastically, and unlike before, their is no voters apathy, even people defiled the rains to vote.

    He, however, said that the chance of APC was high, adding that the party will emerge victorious, particularly the presidential election.

    On his part, the Director for Labour Party (LP) Aniocha/Oshimili Federal Constituency, Mr. Emeka Okolo, lauded the process of election at Onicha-Olana.

    He also expressed hope that his party would emerge victorious in the elections.

    Peeved by the outbursts of the PDP over his capabilities as a politician, Dr. Tony Felix Nwaka, the All Progressives Congress (APC) House of Representatives candidate for Aniocha/Oshimili Federal Constituency in Delta state has fired back at the People’s Democratic Party (PDP) to let its candidate Hon. Ndudi Elumelu presents his records of service.

    Nwaka, a former local government chairman, two-term commissioner under Governor Emmanuel Uduaghan boasts of a good past record in service after serving as commissioner for eight years in the different ministries of Agriculture, Special Duties, Local Government Affairs, and was appointed twice as Commissioner for Education in the state.

    The PDP had called Nwaka a candidate without a political background and cautioned him against tarnishing the image of Hon. Ndudi Elumelu, the Minority Leader of the House of Representatives.

    Speaking in an exclusive interview with TNG, Nwaka said he’ll allow the voters to be the judge rather than tarnish the image of other party candidates.

    “Those who know me would agree that it’s not in my character to demean the personality of anybody. I focus on issues. I simply cited the key achievements of previous occupants of the office, who were there for just a term of four years each, and I averred that our people expect more glowing achievements from Hon. Ndudi Elumelu who has been in the same office for three terms of 12 years and now gunning for 16 years.”

    “Incidentally, that obvious fact did not sit quite comfortably with some people. Instead of them to respond to the basic matters I raised, they left all that to dwell on an amorphous broad-brush. Things that were of no instructive accord with my submissions. Although I have moved on and refused to be detained by trivialities, I must confess that such approach to political engagement is not only manifestly troubling but frankly lamentable. That’s not the way to deepen our democracy. Let us all present our records of service and allow the voters to be the judge,” he said.

    Responding to allegations from the opposition party that he knows nothing about politics and has no idea, Nwaka replied: “Hahaha! And they expect any sensible person to believe that? A man who had contested and won election to become a local government chairman.

    He did not only serve out his full term as a council chairman with evident accomplishments, he also contested and won another election at that time to become the Delta State ALGON Chairman (Chairman of Chairmen). The same man later served as commissioner for eight years in the different ministries of Agriculture, Special Duties, Local Government Affairs, and was appointed twice as Commissioner for Education, with notable footprints in every position. Same man also went ahead to contest and win the highly competitive primary of the APC to secure the ticket of the party for the 2023 elections into the Federal House of Representatives”.

    “A man that was honored by Independent Newspaper as the best Council Chairman in Nigeria on Poverty Alleviation, and also by Guardian Newspaper as one of 50 Nigerians of Integrity and Distinction. My dear, that’s the man they say he knows nothing about politics and has nothing to offer. I believe by now you are already wondering what could their definition of politics be! Is it now that I left the PDP to join the APC that I suddenly became ignorant of politics and generally bereft of ideas? Isn’t that ridiculous”?

    UPDATE: Cash withdrawal limits too sudden, harsh on Nigerians – Reps tell CBN

    The House of Representatives on Thursday asked the Central Bank of Nigeria (CBN) to immediately suspend its latest policy on revised cash withdrawal limits.

    The House also invited the Governor of the CBN, Mr Godwin Emefiele, to appear before lawmakers on Thursday, next week, to answer questions on the series of policies the apex bank had churned out lately.

    The House resolution, which was taken during plenary presided over by the Speaker, Rep. Femi Gbajabiamila, directed that the cash policy should be suspended pending the outcome of Emefiele’s appearance before lawmakers.

    The new cash policy puts total over-the-counter (OTC) withdrawals per week for individuals at N100,000 and N500,000 for corporate organisations.

    However, withdrawals above the limits attract a 5% processing fee for individuals and a 10% fee for organisations.

    The policy also pegs third-party cheque payment over the counter at N50,000, the maximum Automated Teller Machine (ATM)/Point of Sale (PoS) daily withdrawal at N20,000 and total weekly withdrawal at N100,000.

    In addition, banks shall only load denominations of N200 and below into their ATMs.

    The policy further provides that it’s only in “compelling circumstances” for “legitimate purposes” that individuals can withdraw up to N5 million and N10m for corporate organisations “once a month.”

    But, on Thursday, following a motion on urgent national importance moved by Rep. Aliyu Magaji, most lawmakers kicked against the policy saying it was too harsh and sudden for Nigerians, especially the poor majority residing in the rural areas.

    They argued that the majority of small businesses would go under, while inflation might worsen in the long run, altogether defeating any gains expected from the policy.

    However, House Minority Leader, Rep. Ndudi Godwin Elumelu, vehemently opposed the motion, describing the CBN’s policy as the best step taken so far to tackle banditry, kidnapping, and other crimes that involved the payment of ransoms in cash.

    A majority voice vote eventually passed the resolution, asking the CBN to suspend the policy and inviting Emefiele to appear before members on the floor on Thursday, next week.

    The People’s Democratic Party (PDP) in Delta State has cautioned Tony Nwaka, candidate of the All Progressives Congress (APC) seeking to represent the Aniocha/Oshimili Federal constituency in the House of Representatives in 2023.

    TheNewsGuru.com (TNG) reports Nwaka was cautioned against tarnishing the image of Rt. Hon. Ndudi Elumelu, the Minority Leader of the House of Representatives in a statement released by Dr. Ifeanyi M. Osuoza, Deputy Director/Secretary, Media and Publicity Committee, Delta State PDP Campaign Council.

    According to the statement, the party would have ignored the “childishly silly and excessive boastfulness of Tony Nwaka about his personal abilities and achievements”, but thought it necessary to respond for the sake of those who may have been taken in by the error and false presentation.

    The statement added: “The intervention is also to deflate the puerile assertions and invectives thrown against the person of Rt. Hon. Ndudi Elumelu, the effective Minority Leader of the House of Representatives, the pride of Aniocha/Oshimili and PDP in the Green Chambers, and the party’s candidate for Aniocha/Oshimili Federal Constituency in the House of Representatives in the 2023 elections.

    “It is important to let Tony Nwaka know that nobody is against his right to seek to contest for the election to represent the people of Aniocha/Oshimili in the House of Representatives. Of course, he is already the candidate of the lackluster and wicked APC, otherwise referred to as the proverbial ‘Bad Drug” that has thrown this nation into negativities in all ramifications from which the PDP seeks to rescue and reset Nigeria. But we ask him to go out there and campaign, rather than indulge in an exercise of vainglory, deceptively woven to goodwill the people.

    “The Delta PDP calls on Tony Nwaka to back down from his high horse of futile academic exercise that is not a prerequisite for winning elections. It is mindless of him to want to destroy Ndudi Elumelu, whose good works remain sweet-smelling savour before the good people of Aniocha/Oshimili by pandering to base and irresponsible sentiments.

    “Which ideas does Tony Nwaka of APC have that he wants to offer? Is it the idea of one from a political party that has been acknowledged by Nigerians and Deltans in particular, as a party of liars and political deceits? Or is it an idea of one from a political party that has set Nigeria on a downward spin? Where was Tony Nwaka when his ruling party unsettled the good people of Nigeria by afflicting them with poverty, so much so that the nation has now become the poverty capital of the world? Through unmitigated cluelessness, the economic prosperity of Nigeria has been thrown overboard by the APC Federal Government, and here is someone claiming he has ideas to give to the people of Aniocha/Oshimili when he could not give his ill-informed party the idea to stimulate this country and put her on the path of economic growth?

    “Let’s ask Tony Nwaka what idea has he given to his ruling party to ease the insecurity situation in the country, as well as make the farms less harmful a place to go to by farmers?

    “Nigerians have rejected APC and all its candidates, beginning with the sick Presidential candidate, Tony Nwaka for their cluelessness. So, have the good people of Aniocha/Oshimili Federal Constituency rejected Tony Nwaka.

    “For the good people of Aniocha/Oshimili Federal Constituency, Rt. Hon. Ndudi Elumelu, the PDP candidate for the 2023 election, like the good wine, he does not need to be bushed. His antecedents in good representation over the years, with tangible and verifiable results speaks volumes about his acceptability by the people.

    “Tony Nwaka should not seek to hypnotize the people with his unproductive sweet tongue; we challenge him to go to the polls, where Ndudi Elumelu, his Achilles’ heel is waiting to give him a resounding defeat and fall”.

    How I will end incessant strikes by ASUU – Atiku Abubakar

    The Presidential Candidate of the Peoples Democratic Party (PDP), Atiku Abubakar, has pledged to work with government and lecturers to end incessant strike in Nigeria universities.

    Abubakar stated this at a youths programme with the theme “Intergenerational Synergy on Government”, organised by PDP to commemorate the 2022 International Youth Day celebration in Abuja on Friday.

    Abubakar, who narrated how his father was arrested for never wanting him to go to school, described education as fundamental right of any citizen, especially the children and youths.

    He decried the inability of the government to resolve lingering strike by the Academic Staff Union of Universities (ASUU), saying such would not happen under a PDP or his led administration when elected as president.

    “I want to pledge that I will work with university authorities and government to make sure we end this incessant strikes by ASUU.

    “This is because education is fundamental to your growth. It doesn’t matter whether you are in politics, business or any sector. The fundamental right of every youth or every citizen is to be educated.

    “Therefore it is the responsibility of any responsible government to make sure that right is given to every Nigerian, every youth in this country,” Abubakar said.

    The former vice president who reiterated his pledge for youth inclusive government, promised to provide youths with the opportunities to acquire the training and experience to take over from the older generations.

    Abubakar urged the youth to support the PDP to take over government in 2023 to rescue the youth and the nation.

    “I believe that the PDP provides the best platform for you to actualise your individual’s collective and national aspirations,” he said.

    Abubakar encouraged youths who wanted to go into politics, either as part-time or full time career, to be patient and courageous in building their ways to the top.

    The PDP National Chairman, Sen. Iyorchia Ayu, said that the party would take care of all when it comes back to power by 2023.

    He said that there would be sufficient representation for youths in the government, both in elected or appointed positions.

    “PDP is the only party that has done it in the past. I will do it again.

    “We will rebuild this country and you will have a better country. Power belongs to you; power does not belong to we the old generation. We are only rebuilding to hand over to you,” he said.

    The Minority Leader of the House, Sen. Ndudi Elumelu, the acting Chairman of the occasion, who passed a vote of confidence on Ayu and his executive, urged members to join the party leaders to rescue it.

    Elumelu said those calling for the dissolution of Ayu’s National Working Committee (NWC) did not mean well for the party and the nation.

    “What they should be thinking about is how to join us together to unite this party, unite Nigerians that are looking forward to PDP to rescue them and of course, come back to power come 2023.”

    Elumelu urged the youth not to be deterred by what they were going through, but work with PDP to return to power.

    “Let me charge youth to note that not only the future, but the present belongs to you. It is your time and you must make good use of it,” Ayu said.

    The PDP National Youth Leader, Muhammed Suleiman, advised youths not to see leadership as an entitlement, but a process that involved all stakeholders in every aspect of the society.

    Suleiman said that the youth must be prepared to have the right mindset and humility to deal with the challenges that come with leadership.

    He said that the PDP NWC, led by Ayu, was fully youth-oriented and ready to support the youth in any endeavour.

    “Our presidential candidate Abubakar has shown over the years that he is a true believer in the capacity of the youth.”

    Mr Daniel Bwala, a former diehard member of the ruling All Progressives Congress (APC) has joined the opposition People’s Democratic Party (PDP).

    TheNewsGuru.com (TNG) reports Mr Bwala, a popular lawyer who recently resigned from the ruling party, said his decision was based on principles and conviction.

    Joining the PDP on Friday, Bwala said the party presents a clear vision for one Nigeria, adding that the PDP is the party with a realistic chance of defeating the APC in the 2023 presidential election.

    He also opined that the presidential candidate of the PDP, Atiku Abubakar is the only candidate with superior experience to lead Nigeria out of the woods.

    TNG recalls that the PDP House of Representatives caucus had on Wednesday wooed the former chieftain of the APC to join its fold.

    The House Minority Leader, Mr Ndudi Elumelu led the representatives of PDP lawmakers in the green chamber of the National Assembly to Bwala office in Guzape, Abuja.

    Elumelu said the visit was the first time the parliamentarians would be visiting a Nigerian to woo him to a party.

    TNG reports Bwala was Special Adviser to the Deputy Senate President, Senator Ovie Omo-Agege on Legal Matters until he resigned from the APC.

    Mr Ndudi Elumelu, Minority Leader, House of Representatives, has secured a return ticket as the candidate of the Peoples Democratic Party (PDP) for a third term to represent the Aniocha/Oshimili Federal Constituency of Delta.

    Elumelu on Sunday polled a total of 80 votes out of the total votes cast by 132 delegates at the House of Representatives primary election held in Asaba.

    His closest rival, Princess Pat Ajudua, polled 35 votes while Mr Kanyinebi Mobushi got 17 votes.

    The Returning Officer, Chief Funkekeme Solomon, declared Elumelu the winner of the contest for polling the highest number of votes in what he described as free, fair and transparent election.

    According to Solomon, at the close of voting, 132 delegates were accredited, no void votes and all the votes were counted.

    “At the end, Mr Kanyinebi Mobushi, scored 17 votes; Mrs Pat Ajudua, scored 35 votes while Mr Ndudi Elumelu, scored 80 votes.

    ” Elumelu, having scored the highest votes, is hereby declared winner and returned as the candidate of the PDP for the Aniocha/Oshimili Federal Constituency in the 2023 general election,” Solomon said.

    Speaking after his declaration as the winner, Elumelu assured his constituents of more robust representation and dividends of democracy.

    He said though he emerged top in the primaries, there was no loser as it was a family affair and not a contest.

    Elumelu thanked the governor, the PDP and the people of the constituency for giving him the platform to serve.

    He expressed confidence that PDP would win the general elections without hitch in the state and at the centre.

    The election was closely monitored by a combined team of security agencies, the media and other stakeholders.
