    Ohanaeze berates Buhari over S/East Killings

    Igbo apex socio-cultural organisation, Ohanaeze Ndigbo, has berated the President Muhammad Buhari for his recent reaction to the killings in the South East, saying they are victims.

    This is contained in a statement issued on Monday, titled, ‘Insecurity in the South East: Buhari is blaming the victim,” and made available by Ohanaeze President General, Worldwide, Ambassador Professor George Obiozor.

    The statement condemned the killings and violence imposed on the South East, saying the situation was caused by President Buhari’s administration, and that he cannot turn around to blame the victim.

    The statement which was issued through Ohanaeze National Publicity Secretary, Dr. Alex Ogbonnia, said that to appropriate national problems to the South East of Nigeria was an ethnic prejudice taken too far.

    “Ohanaeze Ndigbo Worldwide joins the Presidency and indeed the good people of Nigeria in condemning this dastardly act that occurred at Imo State, South East of Nigeria.

    “Ohanaeze has repeatedly explained that amongst the Igbo, human life is very sacred. The sanctity of life is so elevated that killing a human being in whatever circumstance is considered an abomination. In fact, it is not in the character of the Igbo to kill in whatever disguise.

    “These recent developments are indeed very much alien to the reflexes, culture, and norms of the South East. And we have often called on the Nigerian security operatives to ensure that the perpetrators of such acts are brought to book as a deterrent to others.”

    “The apex Igbo body, however, noted that the failure of the Nigerian security agents to fish out the criminals cannot be blamed on the Igbo.

    “Ohaneaeze Ndigbo, however, frowns at the statement by the Presidency, which is nuanced against the South East as a haven for terrorists that attack non-indigenes and law enforcement officials, implying that the insecurity persists because the leaders have not forcefully spoken.

    “This is very unfair to the Igbo, especially when the presidency knows the root cause and the nature of the insecurity in the South East. It needs to be added that the solution to the insecurity in the South East lies in the enormous powers of the presidency.

    While it condemned the security situation in the South East, the highest Igbo body said that the utterances of the Commander-in-Chief of the Armed Forces of the Federal Republic of Nigeria are not only very uncharitable but mischievous to poison undiscerning minds by insinuating that non-indigenes and security officials are killed by the terrorists in the South East.

    TheNewsaguru reports that the Special Assistant to the President on Media, Mallam Garba Shehu had on Sunday said in a statement that President Muhammadu Buhari condemned in strong terms the recent attacks against non-indigenes and law enforcement officials by terrorists in the South East.

    Buhari then called on the community and religious leaders to speak more forcefully against the killings and stand up and defend the ethos of the nation’s cultural and religious heritage.

    Referring to the statement, Ohanaeze said the remarks by the presidency appear to have ignored the prolonged open war with the Boko Haram in the North East; the Banditry in the North West, especially in Katsina State; the Fulani Herdsmen invasion of several communities in the Middle Belt region; the Church massacre at Owo; the daily kidnappings on our highways; the Kaduna-Abuja train abduction, etc,.

    “Paradoxically, when the district head of Daura, the hometown of Mr President, was kidnapped and was freed after two months, Mallam Garba Shehu was quoted as saying that the “incident was evidence that Duara was not receiving preferential treatment and that insecurity was a national problem.

    “In other words, when insecurity manifests in the North West, it is a national problem; but when, on the other hand, it occurs in the South East, it is blamed on the inability of the ‘community and religious leaders to speak more forcefully against the killings and to stand up and defend the ethos of the nation’s cultural and religious heritage’.

    “The Igbo possess the greatest wanderlust as well as the most hospitable dispositions amongst the various ethnicities in the world. The non-indigenes in the South East enjoy untrammeled friendliness, inter-ethnic assimilation and a conducive business environment; what happened to the non-indigenes in the South East is most regrettable as part of the current national calamity.

    “One would think that the inevitable consequences of the orchestrated mendacious propaganda, dubiety, subterfuge, sabotage, and serial alienation against the South East of Nigeria are already staring us in the face.”

    “How do we fight insecurity by appointment of service chiefs based on ethnocentric and religious considerations as against the best global practices of military competence?

    “Put differently, how can the South East be excluded among the over 16 service chiefs in the Nigerian armed and paramilitary forces and expect insecurity not to fester? And how; and how; and how…..? And when the chickens have come home to roost, we resort to blaming the victim.

    “The famous psychologist, William Ryan, espoused that blaming the victim is an atrocious ideology that tries to justify social injustice against a group. The oppressor deliberately creates an unjust chaotic environment for the oppressed; and blames the victims for the inevitable crises that flow therefrom.

    “In conclusion, it is very uncharitable, if not mischievous, to poison undiscerning minds by insinuating that non-indigenes and security officials are killed by the terrorists in the South East.

    “On the other hand, to appropriate national problem to the South East of Nigeria is an ethnic prejudice taken too far. Invariably, banditry in the North Central persists because their leaders have not forcefully spoken. Rather, they are publicly celebrated and turbaned or still offered the Sheik Gumi option.

    “Both history and current events in the country must have shown that unjust policy against the just shall ultimately vindicate the just.”

  • Nigerian govt intends to imprison Kanu without trial, US lawyer alleges

    United States-based lawyer, Bruce Fein has said Nigerian government w to imprison Nnamdi Kanu without trial.

    He said this about the leader of the Indigenous Peoples of Biafra in a letter to Ohanaeze Ndigbo.

    Fein warned the group not to sit on the legal fence, noting that Nigeria plans to imprison Kanu indefinitely without trial.
    The letter dated May 31, 2022 was addressed to the President General of Ohanaeze Ndigbo, George Obiozor, and made available to newsmen by Kanu’s Special Counsel, Aloy Ejimakor, on Tuesday.

    In the letter, Bruce Fein of Bruce Fein Law Firms, Washington DC exposed alleged plans by the Federal Government to imprison Nnamdi Kanu indefinitely without a trial praying for either for his death.

    “It has become obvious beyond a reasonable doubt that the Fulani zealots have no incriminating evidence against him. They aim to imprison Nnamdi Kanu indefinitely without a trial praying for either for his death or handing his fraudulent prosecution to the next administration and wash their hand like Pontius Pilate,” part of the read.

    Part of the letter read, “For nearly a year, Nnamdi Kanu has been punished by indefinite detention in solitary confinement and denied access to needed nutrition, medical care, and counsel of choice in violation of international human rights law and the Nigerian Constitution. (The Fulani government notoriously honors the Constitution in the breach rather than in the observance). Nnamdi Kanu has also been denied his rights to a public, prompt, and fair trial before an impartial judge.

    “The Fulani have amended the charges against Nnamdi Kanu three times. They remain infinitely vague. They trespass on the universally recognized international law right of every people to self-determination exalted in Article 1 of the International Covenant on Civil and Political Rights and Article 3 of United Nations General Assembly Resolution 61/295, Declaration on the Rights of Indigenous Peoples (2007). Notwithstanding armies of lawyers and investigators, the Fulani remain unprepared for trial after the elapse of more than 11 months since Nnamdi Kanu’s detention in Abuja. There still is no trial date.”

    Fein, who is Nnamdi Kanu’s international lawyer and spokesperson further warned Ohanaeze, “Face up to your legal and moral responsibilities as professed Biafran leaders. Do not show your heels when danger appears.

    “To whom much is given, much will be required. Luke 12:48. All that is necessary for the triumph of evil is for good men and women to do nothing.

    “Nnamdi Kanu is one of you – born on the same soil, raised on the same food, buoyed by the same music and dances, and nurtured by the same culture, inspired by the same flag. He has risked that last full measure of devotion (including dodging bullets of would-be assassins) to deliver the Biafran people from the cruel oppressions and genocide of the Fulani-controlled Government of Nigeria like Moses and Pharaoh in the Old Testament.”

    Fein said the prosecution climbed to a new level of farce on May 25, 2022, adding, “A bail hearing had been set by Justice Binta Nyako for May 26. Bail has been denied on the preposterous theory that Nnamdi Kanu previously jumped bail in September 2017 when he barely escaped an assassination attempt by exercising his unalienable right to self-preservation when Nigerian security forces riddled his residence with bullets murdering many others. An Abia High Court has awarded Nnamdi Kanu 5 billion naira for that flagrant and notorious violation of fundamental rights.

    “The day before the bail hearing, Justice Nyako announced through the court Registrar that she had become “indisposed” and had adjourned the case another month to June 28, 2022. Couldn’t the Justice concoct a better excuse, like affliction with Covid? “Indisposed” means a mild illness that passes in days. A more likely explanation is that Attorney General Abubakar Malami, acting on the instructions of President Muhammadu Buhari, ordered Nyako to again postpone the proceedings because the prosecution has no case.

    “Depend upon it. Without public denunciation of Nnamdi Kanu’s continued political persecution thundering like a hammer on an anvil demanding his release and a dismissal of the manufactured charges with prejudice, the June 28 bail hearing will also be postponed ad infinitum. Nnamdi Kanu’s cruel punishment without trial will persist in notorious violation of the Nigerian Constitution and international law.

    “You collectively, have a legal and moral duty to speak out publicly against this travesty of justice that daily inflicts great misery on the Biafran people. Do not become traitors to the noble cause. Risk a tiny fraction of what Nnamdi Kanu has risked to regain Biafran sovereignty. It was stolen by the British over a century ago and the Fulani have refused to restore it by resorting to genocide.

    “Silence is not acceptable. Neutrality between the firefighter and the fire is not an option. You cannot escape the judgment of history. Show you are made of sterner stuff than quislings.”

    Recall that last June, Nnamdi Kanu was kidnapped, tortured for several days, and extraordinarily renditioned from Nairobi to Abuja in a criminal conspiracy between Nigeria and Kenya.

    Fein advised, “The conspiracy was part of an ongoing Nigerian genocide of Biafrans prohibited by the Genocide Convention. The aim is to exterminate them through killings, rape, plunder, starvation, theft of real and personal property, and a collective denial of livelihood.”

    Ohanaeze Ndigbo Worldwide has warned that it would not forgive River State Governor, Nyesom Wike, if he does not back down on Ebonyi State Governor, David Umahi, travails.

     

    In a statement issued on Sunday by its Secretary-General, Mazi Okechukwu Isiguzoro, the group decried what it described as the constant negative comments of Wike, saying they could wreck his political career.

     

    Ohanaeze comments followed its disagreement with Wike’s recent verbal assault against Governor Obaseki of Edo State.

     

    It also insinuated that Wike was somehow involved in the recent judicial travails of Umahi, but provided no proof for the allegation.

     

    Umahi was recently sacked by an Abuja High Court but has since appealed the decision, while an Ebonyi High Court ordered the governor to stay put.

     

    It claimed that there is a “grand scheme and conspiracy” to remove the Umahi, describing it as ”a subversive and provocative invasion aimed at distracting the South East from the 2023 presidential election.

     

    “The verbal diarrhoea of Governor Nyesom Wike of Rivers State in all national issues is worrisome, and that will likely wreck his political career to a disastrous end.

     

    “Any governor who is instrumental to displacing a fellow governor will be assessed by Nigerians at the end of 2023. How can anyone derive happiness from other people’s agonies and tragedies?”

    The Ohanaeze Ndigbo Worldwide has claimed that the current security challenges facing the South-East is as a result of Igbo loyalty to Atiku Abubakar in 2019.

    The Igbo group warned the former Vice President and other politicians that any promotion of the northern continuation in power after 8 years of President Muhammadu Buhari would be seen as callous, voracious and selfish.

    Ohanaeze was reacting to Atiku’s recent boastful stance of winning the 2023 PDP Presidential ticket again, describing such belief as nostalgic.

    The apex Igbo socio-cultural organisation said that Atiku was only presenting himself as a desperate politician and is swimming against the political currents and tides of the moment.

    “Atiku has misread the mood of the nation ahead of 2023, and this miscalculation may retire him from partisan politics in 2023,” Ohanaeze said in a statement signed by its Secretary-General, Okechukwu Isiguzoro.

    He said, “Atiku has the constitutional rights to aspire to the office of President in 2023, but one had expected him not to rock the boat now that the odds are against him based on his age and his region.

    “He should not fight dirty or appear desperate for the presidency, rather it’s time for him to voluntarily quit partisan politics and take his rightful place in history as an elder statesman without being dishonored and disgraced.

    “Ndigbo had expected that Atiku Abubakar should support a younger person, for 2023, especially after the Rivers State Governor, Nyesom Wike openly denounced Atiku’s proposal for him to be his running mate in 2023. It is enough message and signal to him that 2023 is exclusively reserved for a Southern President.

    “Atiku should search his conscience and support an Igbo in the PDP primaries to avert a disgraceful end of his political career. The Southern Nigerian leaders and Governors have vowed that it’s unhealthy for another northerner to succeed President Muhammadu Buhari in 2023.

    “In 2019, Ndigbo showed enough loyalty to the PDP and Atiku Abubakar, and the present predicaments and penalties facing the Southeast today, was as a result of the support Ndigbo gave to Atiku and the PDP, but in 2023, Igbos will dump PDP if Atiku wins the PDP ticket.

    “Ohanaeze Ndigbo in alliance with other ethnic groups will ensure that any political party that refuses to zone their presidential ticket to the South will suffer in the 2023 presidential election, If Atiku continues, he will surely taste the venom of Nigerians in the PDP primaries and disgrace awaits him.”

    Apex Igbo sociocultural group, Ohanaeze Ndigbo, has warned the Peoples Democratic Party (PDP) that its attempts to zone the presidential ticket to the north will lead to its ugly end.

    Ohanaeze was reacting to the resolution by the Northern States Governors’ Forum with Northern Emirs and Chiefs on Monday in Kaduna which vehemently rejected the clamour for power shift.

    Spokesman of Ohanaeze Alex Ogbonnia, in a statement, said the PDP can as well consider itself dead forever if it proceeds to zone the presidential ticket to the north.

    It recalled there was a gentleman’s agreement between the north and south in 1998 to rotate power, an arrangement the body has been kept to the letters until now.

    Ohanaeze berated northern leaders to plotting to retain power at a time the region was consumed by banditry, terrorism and insecurity.

    It pointed out the north despite producing most of the nation’s leaders has remained underdeveloped and retarded, an issue it said should have been the focus of northern leaders as against seeking political power at all time.

    Parts of the statement read: “A gentleman agreement was reached at the NUC Conference Centre, Abuja in 1998 between the North and the South. The Late Dr. Chuba Okadigbo spoke for the entire South and Alh. Abubakar Rimi, also of blessed memory spoke for the North.

    “It was agreed that after Gen. Abdulsalam Abubakar as the Head of State, that the presidency should shift to the South. That accounted for the emergence of the presidential flag bearers of the mainstream political parties from the South West. Chief Olusegun Obasanjo respected the agreement and handed over to the North in the person of Musa Yar’Adua. Again, Goodluck Jonathan, a Southerner, respected the gentleman agreement and handed over to the North in the person of President Muhammadu Buhari.

    “Therefore, the least that is expected from the North is a show of profound gratitude to the entire South for their large heart, equanimity and sportsmanship.

    “Furthermore, it is in the interest of every Nigerian that there should be a paradigm shift to governance techniques. Ohanaeze Ndigbo Worldwide unequivocally stands with the 17 Southern Governors and any black leg among them will incur the wrath of history.”

    Warning against the north’s agenda to remain in power beyond 2023, the body added: “The exponents of this agenda, in their jaundiced calculations, believe that it is a sure way of regaining power from the All Peoples Congress (APC).

    “Experience would have taught them that to zone their presidential position to the North is an orchestrated requiem for the party; because more PDP Governors and grassroots will surely desert them.

    “May we remind the PDP that the Southeast has made unquantifiable sacrifices for PDP beginning from the time of Dr. Alex Ekwueme.

    “If by way of politics without principles the Southerners in PDP place their personal narrow interests over the interest of their people, the verdict of history will surely be harsh on them.

    “Ohanaeze Ndigbo led by Ambassador Professor George Obiozor reiterates that the bane of Nigeria is raw injustice especially targeted against the Igbo and until we begin to wean ourselves of the Igbophobia and rather harness individual and group resourcefulness, creativity, ingenuity and initiatives wherever they are found, Nigeria will remain on the downward spiral”.

    Ohanaeze warned that the remarks by the northern leaders were indicative of a bleak future for Nigeria.

    The body added: “It is most regrettable that the North are undisturbed that Nigeria is fast collapsing under its leadership. The Forum failed to recognize that at the moment, Nigeria is confronted with the most precarious omens full of uncertainty, doubts, insecurity and bloodshed.

    “The chairman of the Northern States Governors Forum, Governor Simon Lalong can attest that the people of Plateau State had never in history witnessed the number of deaths as has taken place under his watch as governor.

    “The banditry in Zamfara, Katsina, Kaduna and Jigawa States is terrifying. Benue State has turned into a killing field. The states of Yobe and Borno are worst hit by the menace of Boko Haram; etc. Several schools in the North could not open because of kidnappers and millions of children are on the street as beggars.

    “The Nigerian currency has lost its value. Unemployment has skyrocketed; and Nigeria has become the poverty capital of the world…..and the Northern Governors, the Sultan and the Emirs instead of seeking solution to Nigerian problems were busy strategizing on how to retain power in 2023. This is most unconscionable, to say the least.

    “Let it be made abundantly clear that if Presidency is a panacea to people’s problems, the North would have become the Netherlands of Africa.

    “This is because the North had Abubakar Tafawa Balewa, Yakubu Gowon, Murtala Mohammed, Shehu Shagari, Muhammadu Buhari, Ibrahim Babangida, Sani Abacha, Abdulsalam Abubakar, Musa Yaradua, Muhammadu Buhari, yet the problems of the North are on the increase”.

    Attorney General of the Federation (AGF) and Minister of Justice, Abubakar Malami, SAN has welcomed the formation of a legal team by Ohanaeze Ndigbo to monitor the proceedings at the trial of the self-acclaimed IPOB leader, Nnamdi Kanu, a move which is in line with the doctrine of the right of fair hearing rooted in Section 36 of the Constitution of the Federal Republic of Nigeria.

    “Inherent in the position of the Ohanaeze Ndigbo on the matter was the demonstration of their recognition of belonging to Nigeria and succumbing to the rule of law while maintaining their stance that they were not averse to the trial of Nnamdi Kanu,” a communique by the AGF’s spokesman, Dr. Umar Jibrilu Gwandu reads in part.

    It further noted that the group showed a mature departure from the mindset of the proscribed Indigenous People of Biafra (IPOB), and quoted the Ohanaeze as saying they “do not support the use of any form of violence” while channeling concerns and presenting demands.

    According to Malami, by urging the youths to be law-abiding and sheath their sword as well as asking them to try to obtain voter’s card to enable them to contribute to national development, the position of Ohanaeze becomes glaringly constitutional and commendable.

    “Let it be made abundantly clear that President Muhammadu Buhari-led Federal Government respects the rule of law and does not advocate for the breach of law. Hence, with or without the so-called monitoring group, justice will be adequately served to Nnamdi Kanu in compliance with the enshrined provisions of the law,” the minister’s communique further reads.

    The AGF said he hoped that the unnecessary legal monitoring group will come with an open mind and be guided by nothing but the rule of law in the process so as to convey the judgment of the Court as may eventually be delivered to their people in various languages and dialects of the members of the Ohanaeze Ndigbo communities and the entire Nigerians.

    The apex Igbo socio-political organisation, Ohanaeze Ndigbo said the re-arrest of Nnamdi Kanu, the leader of IPOB is the beginning of the end of violent agitations in southeastern Nigeria and a lesson to others.

    The Igbo group also urged the Federal Government to handle his trial with caution and due legal procedure.

    Ohanaeze cautioned Igbos to desist from any form of protest that will endanger the Southeast and Nigeria.

    Mazi Okechukwu Isiguzoro, the organisation’s Secretary-General made the call in reaction to the rearrest of the IPOB’s leader.

    In a statement he issued, Isiguzoro said: “Ohanaeze Ndigbo calls for calm and cautions Igbos to desist from any form of protests and processions that will bring more catastrophe for Southeastern Nigeria.

    “The re-arrest of Nnamdi Kanu the leader of IPOB is the beginning of the end of violent agitations in southeastern Nigeria and a lesson to others.

    “Deviation from non-violent agitations contradicted what Igbos are known for. Self-determination should not be used for purposes of fortune and fame-seeking.

    “Nnamdi Kanu’s refusal to adhere to the advice of Igbo leaders, elders and political leaders is the outcome of what had befallen him, he made a lot of enemies, especially those that would have saved him and the Federal Government will never lose grip on him again.

    “We don’t think that any Igbo leader will stick out his/her neck for him, his re-arrest will eventually bring peace and stability to the region and avert another civil war that was raging on.

    “The Federal Government should handle the situation carefully because of his large followers, his trial should be strictly based on the laws of the land, they shouldn’t kill him because it will destabilize the entire country.”

    The apex Igbo socio-cultural organisation, Ohanaeze Ndigbo in Lagos has refuted claims by Joe Igbokwe, the Special Adviser Drainage and Water Resources to Governor Babajide Sanwo-Olu that members of the proscribed Indigenous People of Biafra (IPOB) are planning to attack Lagos.

    The group in a statement on Monday by its Director of Communication and Strategy, Prince Tony Eze said Igbokwe’s claims are mischievous,
    false, baseless and inciting.

    it therefore advised security agencies to invite Igbokwe for questioning since he has an inner information and also clarify his source which he (Igbokwe) said is credible.

    NDIGBO LAGOS REFUTAL TO JOE IGBOKWE’S INCENDIARY FALSE CLAIMS

    We at Ndigbo Lagos have just listened to the video making the rounds in the Social Media today 9th May 2021. In the said video Mr. Joe Igbokwe, a Political appointee of Lagos State Government and Special Adviser Drainage and Water Resources claimed insider knowledge of a clandestine plot by some Igbo youths who he believes are IPOB members, to kill, to burn down police stations and public infrastructure in Lagos.

    NDIGBO LAGOS the umbrella body of all Igbo organizations in Lagos, wish to state as follows:

    1.That we are saddened by the claims of Mr. Igbokwe, which we believe are mischievous, false, baseless and inciting.

    2. That the governments of the South Eastern States of Nigeria and various security agencies in the country have initiated investigations to unravel the persons behind the killings and destruction of properties in the South East, and we believe strongly in their competence and ability to unravel the masterminds and bring them to justice.

    3.That as usual with such serious investigations the Police and other Security Agencies expect support through information from responsible citizens of which Joe Igbokwe being a government insider is very much aware of and in
    a good position to comply with.

     

    4.That rather than do this, Mr. Igbokwe
    irresponsibly went to town with his personal conclusions on who these perpetrators are and what evil they are planning for Lagos, notwithstanding the ongoing official investigations. This probably goes to suggest that Mr. Igbokwe knows more than the ordinary eyes could see, and should be invited by the relevant security agency to clarify his source which he claims is credible.

    5.That the Lagos State government had initiated and conducted investigation on what happened during the EndSars protest, and are well equipped with relevant information on the perpetrators of that heinous act.

    6.That the Igbos were not the cause of the Biafran war, and have no intention to engage into any acts as may suggest any intention of such in the foregoing circumstance.

    7.That we condemn in clear terms the killings going on all over the country, including in the South East, and sympathize with the families of officers
    and civilians, who have had to endure the loss of their dear ones. We pray their soul to rest perfect in the bossom of our Lord!

    8.We wish to reiterate that Igbo youths are NOT killers, neither are they arsonists, but are positively recognized as hardworking
    contributors to the development of our country. We have been victims rather than perpetrators of killings, burnings and looting in Nigeria.

    9.That it has become expedient for us to issue this rebuttal, in the light of the hightened tension in the country, being convinced that some malevolent minds may take advantage of Mr. Joe Igbokwe’s
    recklessness with unsubstantiated rethorics to spread mistrust, cause disunity and escalate mischief in such manner and disguise, as may cause fingers to be wrongly pointed at the Igbos
    in Lagos. We therefore call on Mr. Joe Igbokwe to desist from reaching hasty conclusions, and spreading of falsehood.

    10. We enjoin Ndigbo across Lagos to go about their normal buisness. And should not engage in any unlawful acts that would endanger the good relationship we enjoy with the people of Lagos State.

    11. Finally, we want to remind Mr. Igbokwe that respect for the elderly is one of the cornerstone of Igbo values and civilized behavior. Hence, we call upon him to retrace his steps and apologize to Chief Mbazulike Amechi for the unconscionable remarks he made against him.

    Court dismisses suit seeking arrest, trial of Ohanaeze Ndigbo leaders

    A Federal High Court in Abuja presided over by Justice Inyang Ekwo has dismissed a suit seeking the arrest, probe and prosecution of the President General of Ohanaeze Ndigbo, Professor George Obiozor and other leaders of the group over alleged contempt.

    The Judge in a ruling held that the applicant -The Registered Trustees of Ohanaeze Ndigbo General Assembly, led by Barrister Onuorah Onyeachonam failed to show that Obiozor and others committed any offence known to law to warrant their arrest, investigation and prosecution.

    Justice Ekwo said, after a thorough evaluation of the processes filed by the applicant, he found that it failed to establish a prima facie case to warrant the grant of the reliefs sought.

    The Onyeachonam-led Ohanaeze Indigbo General Assembly had, in the suit claimed that Obiozor and other leaders of Ohanaeze Ndigbo, who emerged from the recently conducted election, were in contempt by allegedly running an illegal organisation.

    The applicant, in the suit which had the Inspector General of Police (IGP) and Attorney General of the Federation (AGF) as respondents, claimed that while it was duly registered with the Corporate Affairs Commission (CAC), the group with a similar name, led by Obiozor and others was unregistered.

    It then filed an ex-parte application for leave to apply for the issuance of an order of mandamus, compelling the IGP and the AGF “to arrest, investigate and commence criminal proceedings” against Obiozor and others for allegedly running an illegal and/or unregistered association known as Ohanaeze Ndigbo.

    The applicant said its resort to the court was because of the failure of the respondents to act on its letters to them on January 15, 2021 for the arrest and prosecution of Obiozor and others.

    In the ruling, Justice Ekwo said: “The prayer here is for leave to compel the first and second respondents (IGP and AGF) to arrest, investigate and commence criminal proceedings against Prof. George Obiozor, Obi Nwali, Okey Egbuche, Beatrice Eze, Bartholomew Okeke and Ogbonna for running an illegal and/or unregistered association known as Ohanaeze Ndigbo similar to that of the Applicant which has been registered under Part C of the CAMA by the CAC.

    “In my opinion, where such prayer is sought, it must be demonstrated with concrete evidence that those sought to be arrested, investigated and prosecuted have committed criminal offence(s) known to law.

    “This is the because the power given to the Attorney-General of the Federation in Section 174 (1) of the 1999 Constitution and the power given to the Inspector General of the Police in Section 4 of the Police Act are to not intended to be used in vacuo or without a cause.

    “The onus is on the applicant to show that the statute underlying their allegation creates a criminal offence which the first and second respondents are obligated to enforce by the power of arrest, investigation and prosecution.

    “In the end, I am unable to see any justifiable cause in this application. I think this application, without more, is frivolous and I am unable to lend the judicial powers of this court to encourage such litigations.

    “I make an order dismissing this case for lacking in merit. This is the order of the court.”

    The Ohanaeze Ndigbo has lauded President Muhammadu Buhari over the recent sack and appointment of new service chiefs.

    The apex South East organisation in a letter by its president, Amb. Prof. George Obiozor on Wednesday said the change in the security architecture will go a long way to address the nation’s lingering security challenges.

    While appreciating the president for the appointment, especially, that of Major General Lucky Irabor who hails from Delta State, the group however berated the president for excluding the South East zone in the appointments.
