Just in: Court quashes EFCC’s case against Okorocha

A Federal Capital Territory High Court has dismissed the case against former governor of Imo State, Senator Rochas Okorocha, by the Economic and Financial Crimes Commission (EFCC).

The court described the EFCC’s charges of fraud and abuse of office as an abuse of judicial process.

The presiding judge, Justice Yusuf Halilu, premised his judgment on the fact that the EFCC had filed a similar charge against the former Imo State governor at the Federal high court, which case was decided upon in favour of the former governor in December last year.

Valedictory session outbursts: Teach me how you came back to Senate without contesting – Okorocha asks Lawan

Senator Rochas Okorocha, representing the lmo West senatorial District asked Senate President Ahmad Lawan to teach him how to return to the senate without participating in primary election during the valedictory session of the 9th Senate on Saturday, June 10.

While Lawan and Okorocha contested the presidential primary election of the APC in which they were defeated by President Bola Ahmed Tinubu, the senate president was able to return to the national assembly following a supreme court judgement.

    Okorocha who spoke at the valedictory session, wondered how Lawan was able to stage a return to the senate. He said;

“I did not contest for the senate this period. I only contested for the office of the president. You are a very smart politician. How you came back to the senate is another chapter in our political history that we need to discuss.

“I was there in the field with you running for president, I never knew how you were able to meander, leaving some of us. Next time you must teach me how to do that.”

    Responding to this, Lawan said;

“It was easy. I was there with you in the field and after our defeat, my constituents thought they needed me again. They asked for me to come back and it was a tortious journey because we had to go through the courts.

“I didn’t even appeal the judgement that did not give me the contest. The party and the stakeholders appealed on my behalf up to the supreme court, so there is nothing critical or remarkable. In fact, you have nothing to learn from it.”

Rochas Okorocha speaks on joining opposition party, PDP

Senator Rochas Okorocha, representing the lmo West senatorial District, has debunked reports of dumping the ruling All Progressives Congress (APC) to join the People’s Democratic Party (PDP).

In a statement issued Thursday by his Special Adviser on Media, Sam Onwuemeodo, Okorocha said he has not joined the opposition party, PDP.

Okorocha explained that on Friday, December 30, 2022, Kingsley Uju, representing Ohaji-Egbema/Oguta/Oru West Federal Constituency, buried his mother at Egbema and he only attended the event.

He noted that a burial ceremony could not have become a political declaration rally, insisting he was still in the APC.

Okorocha said: “Our attention had been drawn to a story, claiming that the former governor of lmo State has joined the Peoples Democratic Party (PDP).

“We appeal that the general public disregard the story of Okorocha joining the PDP. lt is not true. The photographs attached to the false story are not evil since politics is not war. Nor a do-or-die venture.

“Our only concern was the virus some mischief makers tried to inject into the innocent photographs, taken at Uju’s mother’s burial, without malice or those involved being conscious of which political parties all those at the burial in question, belong.”

“Those behind this false story deliberately failed or refused to mention the venue and title of the event, where the photographs were taken. They could not also quote a portion of Okorocha’s speech that he must have made at the so-called event.”

Court grants Okorocha permission to travel abroad for medical attention

A Federal High Court, Abuja, on Wednesday, granted an application filed by Sen. Rochas Okorocha, seeking an order granting him leave to travel to the U.S. for medical treatment.

Justice Inyang Ekwo, while granting the order after Okorocha’s counsel, Ola Olanipekun, SAN, moved the motion to the effect, however, warned the lawmaker against failure to appear on the next adjourned date.

Newsmen report that Okorocha, who represents Imo West Senatorial District, had, on Thursday, approached the court with the motion.

Okorocha had, through his lawyer, Daniel Alumun, made this known when the matter came up before Justice Ekwo.

Alumun, however, informed the court, shortly when the case was called, that he was unable to serve the Economic and Financial Crimes Commission (EFCC), the complainant/respondent, with the motion.
Justice Ekwo consequently adjourned the matter until today for a hearing of the motion.

Upon resumed hearing, Okorocha’s counsel, Olanipekun, told the court that he had a motion on notice marked: FHC /ABJ/CS/28/2022 dated June 22 and filed June 27.

The lawyer said the motion sought for an order granting the applicant (Okorocha) leave to travel outside Nigeria for medical treatment; and return before Nov. 7, the next adjourned date for his trial.

But the EFCC’s lawyer, Chile Okoroma, who is the Director of Legal Services for the agency, opposed the request.
He explained how the applicant flouted the earlier administrative bail granted him by the anti-corruption agency.

He said he took the agency about six months after the matter was filed to bring the applicant before the court.

Okoroma, who said Okorocha is a flight risk, said if allowed to travel abroad, the lawmaker would jump bail.

The judge, however, said that since Okorocha had appeared in court, arraigned and the trial commenced, everyone should look forward to the future development.

“I am going to grant this application. But if I grant this application and the defendant fails to appear in the next adjourned date, I will make an order declaring him wanted,” the judge said.

Okoroma, who said he was satisfied with Justice Ekwo’s intervention, withdrew all his initial grounds for opposing the application.

Ruling, Justice Ekwo said that he was of the opinion that the application be granted because it was on medical grounds.

He held that this would afford the applicant the opportunity to stand his trial
“Upon perusing the prayers sought by the applicant and the averments in the counter affidavit of the respondent, I am of the opinion that this application be granted because it is of medical grounds.
“Prayers 1, 2, 3 and 4 are hereby granted as prayed,” he said.

He ordered Okorocha to return his travel documents to the court registry no later than three days upon his return.

“There shall be consequences if the 1st defendant (Okorocha) fails to appear on the next adjourned date,” Ekwo ruled.

The judge adjourned the matter until Nov. 7, Nov. 8, Nov. 9, Nov. 10 and Nov. 11 for trial continuation.
newsmen reports that the lawmaker also sought a consequential order for the release of his Nigerian international travel passport booklet, which was deposited with the court registrar in partial fulfilment of the conditions for bail granted to him.

He further sought for “a consequential order that reliefs(1} and (2) above be communicated by the registrar of this honourable court to the Nigerian Immigration Service, to facilitate the passage of the applicant.

“An order directing the 1st defendant/applicant to return his international passport to the registrar of the honourable court upon his return to Nigeria.”

The lawmaker, who gave three grounds why the reliefs sought should be granted, said he was admitted to bail pending trial in charge number: FHC/ABJ/28/2022.

He said he has duly complied with all the terms of the bail including depositing his travel documents with the registrar of the court.

He said prior to his arraignment, he underwent surgery at the Ambulatory Surgery Centre, Texas, the U.S. for distal femur fracture, which he sustained in an accident.”

According to Okorocha, he has been on regular/scheduled care and treatment at the same Ambulatory Surgery Centre, where he has been scheduled for further medical tests, observation and treatment on July 19, 2022, or immediately thereafter.

He was alleged to have laundered the funds while serving as governor of Imo.

Others arraigned are Anyim Chinenye, Naphtali International Limited, Perfect Finish Multi Projects Limited, Console Projects Consulting Limited, Pramif International Limited, and Legend World Concepts Limited as 2nd to 7th defendants respectively.

2023: At last, Okorocha screened to run in APC presidential race

Embattled former governor of Imo State, Senator Rochas Okorocha, is being screened right now by the screening committee of the All Progressives Congress (APC) headed by former governor of Edo State and former national chairman of the ruling party, Odigie John Oyegun.

The APC listed him for screening Tuesday despite his appearance at the Federal High Court, Abuja earlier in the day, in continuation of his alleged N2.9 billion fraud trial.

There was anxiety that the senator will miss the screening. He is one of the 28 aspirants that bought APC presidential form at the cost of N100 million.

Apparently, he beat the deadline, having met his bail conditions.

Temporary respite came Okorocha’s way on Tuesday when the Federal High Court sitting in Abuja granted him bail to the tune of N500 million with one surety in like sum.

Trial Justice Inyang Ekwo ruled that Okorocha should be released on bail after he dismissed a counter-affidavit the Economic and Financial Crimes Commission (EFCC) filed against him.

  • EFCC set to arraign Okorocha in court for 2.9bn fraud case

The Economic and Financial Crimes Commission (EFCC) has finalized arrangements to arraign ex-Imo State Governor, Rochas Okorocha in court on Monday , with the service of the criminal charges on his person in the detention facility.

Okorocha was said to have been handed a copy of the charge on Sunday evening preparatory for his appearance in court on Monday, May 30 to take his plea.

EFCC made the ex-Imo governor who currently represents Imo west district at the senate was forced to personally sign for the charge to clear the legal hurdle for the arraignment.

It was gathered that immediately the former governor acknowledged receipt of the charge, he was permitted to phone about five lawyers on the development and to decide the next line of action.

Okorocha who  had absented himself  in court twice for arraignment on the excuse that the charge was not personally served to him as required by law.

Meanwhile the anti-graft agency through its lawyer alleged at the Federal High Court in Abuja that Okorocha, upon the administrative bail granted him refused to pick phone calls from the agency while text messages sent to him to report in court were not honoured.

EFCC’S counsel, Mr Cosmos Ugwu could not be reached for comments on the latest development but a source said it was a good development for the agency.

“All we are after is to move him to court on May 30 for the arraignment and we have substantially achieved that with the service of charge on him.

“You will recall that the challenge of EFCC has been on how to get him served and we have crossed that hurdle now. I can confirm to you that Okorocha will be made to appear in court. We will help him to court”, the source said.

Recall that Okorocha was forcefully arrested on Tuesday in his Abuja residence when a video showed the EFCC operatives forcing themselves into his apartment to effect his arrest

It will be recalled that Justice Inyang Ekwo of the Federal High Court, Abuja had on Monday, March 28, issued a threat to strike out the N2.9 billion money laundering charges against Okorocha should the Federal Government fail again to cause his appearance in court.

The judge had threatened to throw out the charges following the inability of the Federal Government to serve charges on Okorocha as required by law.

At the March 28 proceedings, the Federal Government, for the second time through its counsel, Mr Cosmos Ugwu, had told Justice Ekwo that he has not been able to see Okorocha and serve him with the charges.

The Federal Government’s charges against Okorocha dated January 24, 2022, was signed by one A.O Ikota on behalf of the Economic and Financial Crimes Commission, EFCC.

Okorocha,  is to face trial alongside six others in the N2.9 billion money laundering criminal charges.

The senator is being put on trial by the Federal Government on 17-count charges involving criminal diversion of public funds and properties.

Alleged fraud: Court rejects Rochas Okorocha’s bail plea

A Federal High Court, Abuja, on Friday, refused to admit Sen. Rocha’s Okorocha, who is currently in the EFCC’s custody, to a bail.

Justice Inyang Ekwo, instead, ordered Okorocha, through his lawyer, Ola Olanipekun, SAN, to put the anti-graft agency on notice.

Olanipekun had, in an ex-parte motion marked FHC/ABJ/CR/28/2022, prayed the court to grant Okorocha bail on liberal terms pending the hearing and determination of the motion on notice filed on May 25.

The ex-parte motion was dated and filed on May 26.

But Justice Ekwo held that since the matter would be coming up on Monday, May 30, making an order for the release of the lawmaker on bail would be unnecessary.

The senior lawyer also hinted that he had also filed a motion on notice, seeking his client’s bail.

The judge, who fixed May 30 for the hearing of the motions, directed the lawyer to put the EFCC on notice.

Ekwo had, in the last adjourned date, given the anti-corruption commission May 30 as the last time the matter would be adjourned following the EFCC’s complaint that it had been unable to serve Okorocha despite several efforts.

The judge had threatened to strike out the case if the EFCC failed to produce the senator on the next adjourned date, after two adjournments for his arraignment.

Operatives of the EFCC were said to have invaded Okorocha’s residence on Wednesday following his refusal to honour the anti-corruption commission’s invitation after he was alleged to have jumped the administrative bail earlier granted to him.

Okorocha was whisked away after some hours and remanded in the EFCC’s custody.

Okorocha, an APC presidential aspirant, is standing trial alongside others on allegations bordering on money laundering while he served as governor of Imo.

He and others were expected to be arraigned before Justice Ekwo on Monday.
