    APC will takeover Delta in 2023 – Omo-Agege

    Deputy Senate President, Ovie Omo-Agege, says All Progressives Congress (APC) will takeover Delta in 2023, going by recent developments.

    Omo-Agege said this on Wednesday in Asaba, at the inauguration of the state APC executives, at the party secreteriat in Asaba.

    “Let me start by saying that am full of excitement with what is happening here today.

    “This inuaguration of our state executives is a major milestone in our battle to sack the PDP occupation of the government house, Asaba.

    “Our goal now is to defeat Okowa and whoever he is planning to impose on the people of Delta.

    “However, as we celebrate, let me remind us that we have a lot of work to do. My chairman, I want to implore you to hit the ground running,” he said.

    Omo-Agege advised the new executives to extend a hand of fellowship to all party members, irrespective of their lineage.

    “If the APC must win the battle ahead, there must be no victor and no vanquish within the party’s fold in the state,” he said.

    The senator reminded the new executives that all members of the party have a common goal, urging them to close ranks and work in unity.

    “As we move forward, let us forgive and forget our differences, because if we must win, then we must be united in battle.

    “Finally, as we go back home, let us preach the gospel to our people in our various communities on why the APC must occupy the seat of government in Delta.

    “Our people have suffered enough, the truth must be told, so let the people we are coming to wipe away their sufferings,” Omo-Agege said.

    Sen. Peter Nwaoboshi (APC-Delta) who represents Delta North at the National Assembly, lauded the inauguration of the new executives.

    He said that with the successful inauguration of the executives, the APC family had shamed its detractors.

    “Those who have been praying for trouble in APC will be so dissapointed with what is happening here today.

    “We are ready for them. There is nothing they think they know that we don’t know.

    “From today on, the battle has started. We are not fighting with arms, but if they try us, we will match them strenght to strenght,” he said.

    Nwaoboshi dismissed insinuations that he was working to return to the PDP ahead of the 2023 elections.

    “I heard some people said that am planning to go back to the PDP, but hear me now, I am not someone who vomits and goes back to lick his vomit.

    “I don’t have the intention of going back to the PDP, but I have the intention of defeating the PDP at the election,” he said.

    Mr Omeni Sobotie, the state APC chairman expressed the appreciation for the support and encouragement from party members.

    He promised to work with all stakeholders in the party to chart a new course for the party by ensuring unity, enduring peace and most importantly, victory in 2023.

    “Let me on behalf of the new executives of our great party, the APC in Delta, thank each and every member of our party, including party leaders for their support and encouragement.

    “Our goal now is to work in unity of purpose and put our candidate on the seat as governor of Delta, come 2023. It is a task we much achieve,” Sobotie said.

    Constitution Review: Don’t work for regional interest of Nigeria – Omo-Agege, Idris urge lawmakers

    After the collation of proposed bills from 12 centres across the six geopolitical zones of Nigeria in line with the ongoing constitution review, lawmakers have been advised to work in the interest of the country rather than sectional interest.

    This came to fore from a separate address by the Deputy Senate President Ovie Omo-Agege and Deputy Speaker, House of Representatives, Ahmed Idris who were the presiding officers of a retreat organised on Friday in Abuja by a joint Adhoc Committee on the review of the 1999 Constitution.

    Omo-Agege while commending lawmakers of their tremendous dedication and sacrifices in the review of the 1999 Constitution, reminded them that the success of the process largely depends on their support and partnership.

    According to the Deputy Senate President, going forward, after passage of the proposals by the National Assembly in a fortnight, you will be the pillar on which this work will be anchored. That is why it is prudent to meet with you today and update you on the progress we have made after the public hearings that held in 12 centres across the six geo-political zones of the country, of which you fully participated.

    “The proposed amendments in the bills we have shared with you set out institutional and legal reforms, which together with sufficient political will, will help to strengthen institutions of governance, provide for accountability and transparency in governance; and create an independent judicial system that would ensure effective administration of justice in Nigeria.

    The overarching rationale for the amendments contained in these bills are thus predicated on the need to amongst others: strengthen the legislature’s authority to enable it to serve as an effective pillar of checks and balance to the executive; strengthen independent constitutional bodies; create and strengthen a culture of good governance; address the issues of corruption, revenue leakages and unbridled government spending”.

    “I assure you most sincerely that our work up to this point has been guided strictly by best legislative practice, integrity, open mindedness, and patriotism. I therefore encourage you, irrespective of political leanings and other affiliations to abide by the same standards while making your contributions. I know it is the desire of every Nigerian that this process will bring positive transformations to our country. Therefore, we should all leverage this retreat to bequeath to our nation a constitution that speaks to the yearnings and aspirations of every Nigerian, he concluded.

    On his part, Deputy Speaker of the House of Representatives, Ahmed Idris said during the hearings as organised between May and June 2021 some of the issues canvassed by Nigerians were aggregated into thematic areas and Members sponsored bills in line with peoples’ aspirations.

    These thematic areas according to Idris, include issues bothering on Local Government Administration and Autonomy, the Legislature, Judicial Reform, State Creation, State Police, Devolution of Powers, Women and Vulnerable Groups, Strengthening of Institutions, Good Governance, Political Parties and Electoral Matters, Traditional Institution, Federal Capital Territory Administration, Fundamental Human Rights and National Security.

    “During this first batch of the review exercise, the Committee in the House of Representatives considered sixty-two (62) Bills out of which twenty-six (26) Bills were recommended for harmonization with the Senate. Of the 62 bills, eight (8) bills were rejected, twenty-five (25) Bills were retained with modifications and the consideration of 3 bills were deferred”.

    “We have worked tirelessly to engage, negotiate, debate, lobby, review and persuade in order to reflect the various competing and contrasting aspirations of Nigerians of different leanings and backgrounds. One thing we are sure of is that no one has been left behind. We have aggregated all manners of proposals, sorted them out to meet the constitutional guidelines and criteria and have ultimately harmonized positions after lengthy debates and majority votes on several critical issues”,he said.

    Speaking further, he explained that the committee have no preconceived positions on anything but believe that they must do whatever is necessary to provide a platform for Nigerians to air their views, give their positions and canvass whatever they feel would make the country better, and make governance more efficient and successful.

    “We also are cognizant of the fact that we cannot work in isolation if we must achieve concrete result and deliver on the promises we have made to Nigerians. Whatever we have done will still go through the State Houses of Assembly for their own input and vote. Hence the need for this collaborative synergy which will give us the opportunity to engage, consult and harmonize for a smoother, tidier and more efficient Constitutional review”he said.

    To this end, he urged all to remember that they act as representatives of Nigerians. As such, as a rule of engagement, they should put Nigeria at the front burner and not personal interest or sectional interest.

    While commending lawmakers and stakeholders involved in the constitution review of their efforts, representative of conference of Speakers of state legislatures in the country, Abubakar Suleiman said no doubt that the retreat will offer a better platform for effective and efficient engagement with the stakeholders with the view of giving to our people and nation the constitution that can stand the test of time.

    ‘We have a onerous responsible of altering the constitution to meet the yearnings and needs of our people, and these we must do to the admiration of the citizens”, Suleiman said.

    He therefore advised that the executive arm of government should not be left behind to ensure smooth assent of the constitution when fully reviewed.

    Deputy President of the Senate, Senator Ovie Omo-Agege has charged Christians to imbibe the spirit of love, humility, peace, selfless service and all other positive attributes that the birth of Jesus Christ symbolises for the world.

    In his Christmas message, Senator Omo-Agege called on Nigerians to remain steadfast in their prayers for peace and the unity of the country.

    He stressed the need for citizens to reflect on the virtues of love, peace and tolerance as exemplified by Jesus Christ in order to build a new Nigeria.

    “The birth of Christ signifies the love of God for mankind, triumph of good over evil and victory of light over darkness.

    “I urge Christian faithful to use the opportunity of the season to reflect on the reasons for the birth of Christ and keep hope alive.

    “Notwithstanding the difficult circumstances of the birth of Jesus Christ, his life remains today a perfect example of the triumph of hope for mankind,” he stated.

     

    Emulate essence of the season – Atiku tells Nigerians

    As the world celebrates Christmas Day today (December 25) which showcases the birth of Jesus Christ, Nigerians have been urged to embrace peace and unity at this period, and to love one another for the sake of progress and growth in the country.

    This call was made by the former Vice President of Nigeria and Waziri Adamawa, Atiku Abubakar, in a Christmas message released by his Media Office in Abuja.

    It reads: “I felicitate with all Nigerians, particularly the Christian faithful on the birth anniversary of Jesus Christ.

    “Christmas is a time of love, therefore, I call on all Nigerians to emulate the essence of this season and unite for the greater good of our dear country.

    “Christmas is the season of love, joy, generosity and forgiveness and while we celebrate with family and friends, we should also spend time to pray for a more peaceful and prosperous nation as it is important for Nigerians to inject the healing and unifying serum of love for our neighbours into the nation’s consciousness, this Yuletide.

    “As a nation, we can achieve more if we stay united, extend hands of fellowship to one another and be law abiding. We must also rededicate ourselves to the virtues of faith in God, love for one another and make these virtues more evident and practical in our daily living.

    “As we also look ahead to a better 2022, let us not relent in praying to God to restore peace and all-round development and progress in our country Nigeria,” added the Wazirin Adamawa.

    Atiku reminded Nigerians that the revival of the country’s glory is everyone’s responsibility and urged citizens to be intentional in thinking good thoughts and sowing better seeds of harmony and unity in diversity; actions that would make Nigeria greater today and in the future.

    “We cannot move forward as a country until we all realise that we are first Nigerians, before our religious beliefs, ethnic identities, political leanings and cultural affiliations and as such, we must show respect for one another by living in peace.

    “As we celebrate, we should continue to extend hands of love and fellowship to our neighbours and live as one big family, irrespective of our social, political and religious leanings and continue to trust God for a better tomorrow and a greater country,” he said.

    Dowen College: Omo-Agege tasks security agencies to fish out killers of Oronomi

    Deputy President of the Senate, Senator Ovie Omo-Agege has tasked security agencies to fish out killers of Sylvester Oronomi Junior, a student of Dowen College, Lagos.

    The 12-year-old, who hailed from Delta State, was alleged to have been attacked by some of his senior colleagues for refusing to join a cult group.

    While sharing in the grief of the family, the Deputy President of the Senate noted that the pain of losing a child will always linger in the mind of every parent.

    The Delta Central lawmaker tasked security agencies to get to the root of the matter and bring the perpetrators to book.

    He also commended the Lagos State Government for closing the school indefinitely. This, he noted, would allow thorough investigation. He tasked them to leave no stone unturned in getting to the root of the matter.

    “Closure of the school will help children who are back home to share their experiences with their parents and guardians. They are in the safety of their homes where they fear no immediate reprisals of the revelations.

    “The incident is one too many, as it reminds us of how children in schools are subjected to dehumanising treatments, with some losing their lives in the process.

    “My profound condolences to the Oromoni family and it is my prayer that God will give the family the fortitude to bear this irreparable loss,” he said.

    Omo-Agege to constituents: Don’t pay for electricity transformers

    The Deputy President of the Senate, Senator Ovie Omo-Agege has urged his constituents not to pay for electricity transformers installed in their communities by the Federal Government through his intervention.

    According to the Delta Central lawmaker, the warning became necessary as some fraudsters are already swindling unsuspecting constituents to pay for transformers in their areas, dropping his name.

    The statement cautioned those engaged in the fraudulent act to desist forthwith or face the wrath of the law.

    “It has come to the attention of the Office of the Deputy President of the Senate, His Excellency, Senator Ovie Omo-Agege, that some persons are compelling or tricking his constituents across some communities to pay various sums of monies or levies for electricity transformers installed in these communities by the Federal Government as a result of the purposeful intervention of the DSP. This is wrong, fraudulent, and totally unacceptable.

    “Therefore, we implore our people not to pay any money whatsoever to anybody in respect of these transformers installed for their benefit. Your DSP understands that you need electricity for your homes and business hence his continuing strong intervention in this regard. Every transformer is installed at no cost to our people. They are free.

    “We also strongly advise whoever that may be involved in any fraudulent scheme to extort monies from our people in relation to the transformers to stop forthwith. The DSP’s Office will not sit idly by and watch our people being fleeced of their hard-earned resources. Strong measures will be taken under the law to ensure that our people freely enjoy the DSP’s initiative to light up our communities without illegal burdens such as reported financial extortion,” the statement reads.

    2022 Budget ready before December 16 – Omo-Agege

    The Deputy President of the Senate, Senator Ovie Omo-Agege has assured that the National Assembly is determined to pass the 2022 budget before the year runs out.

    Senator Omo-Agege stated this when he hosted his former classmates from the Nigerian Law School, Class of ’86 (The Centennial Class) in Abuja, led by ‘Class Captain’ Oladipo Okpeseyi SAN.

    President Muhammadu Buhari had last Thursday presented the 2022 budget of N16.3 trillion to a joint session of the National Assembly.

    According to the Deputy President of the Senate, early approval and signing of the appropriation bill into law will ensure planning, bring about enhanced productivity and efficiency in the management and application of the nation’s resources.

    He explained that Nigerians are the ultimate beneficiaries of the return to the January to December budget cycle, stressing that this will guarantee full implementation of the economic, infrastructural, social investments and other developmental programmes contained in the budget.

    “The budget process is ongoing. In the next 30 days, we will conclude it and pass it before we go on Christmas break, sometime in December 16,” he said.

    On the request for the completion of a moot court at the Nigerian Law School Headquarters, Bwari, Abuja by the Class, the Delta Central lawmaker promised to assist in completing the project. He was excited that his class has taken on such a laudable project.

    Speaking on a bill sponsored by his colleague that seeks to increase the number of law school campuses in Nigeria from six to 12, the federal legislator emphasised the need to reach out to all stakeholders to determine its acceptability or otherwise.

    His words: “I want to thank you for the initiative you have taken on this moot court. It’s a great idea, especially for trained advocates. I really don’t see how you can hone your skills if you are not given the opportunity and privilege to have facilities like that.

    “I am not surprised that this initiative is coming from ’86 Class. We are the most innovative in every respect. I appreciate what you have done. I have your back. Any assistance I can render, I will be available. I am also here in case of any legislative intervention that the Class believes ought to be made.

    “We have stepped in so many times to assist the Judiciary as much as we are able to by way of improvement in their welfare, especially with the FCT courts, trying to provide adequate funding to expand the court and provide facilities. And for most of us who come from the judicial family, I know what my own Dad went through using long-hand to do most of the work as opposed to what obtains abroad. I keep telling the judges who come before us here for confirmation that I am sure that if people like my Dad had such benefit, it would have added 10 years to his lifespan. Any assistance you need, you can always count on us”.

    Earlier, ‘Class Captain’ Oladipo Okpeseyi (SAN) said the visit was aimed at briefing the lawmaker on the activities of the Class, especially as it relates to her legacy project of building a moot court at the Nigerian Law School Headquarters, Bwari, Abuja as well as the forthcoming Annual General Meeting of the Class holding in Port Harcourt, Rivers State

    He added that deserving members of the Class would be given awards at the event.

    President Muhammadu Buhari has felicitated with Deputy Senate President Ovie Omo-Agege as he celebrates his 58th year anniversary.

    In a statement by his Special Adviser on Media and Publicity, Mr. Femi Adesina, Buhari acknowledged the Deputy Senate President’s contributions to the harmonious executive-legislature relations.

    “President Muhammadu Buhari felicitates with Deputy Senate President, Ovie Omo-Agege, on his 58th birthday, August 3, 2021, joining All Progressives Congress (APC) leadership and members to celebrate with the party chieftain whose dedication to good governance and democratic growth remains outstanding.

    “President Buhari congratulates the Deputy Senate President of the 9th National Assembly on another milestone, measured out by God’s grace, saluting his commitment to development of Delta State and the country, serving variously as Commissioner of Special Duties and Secretary to the State Government before his election to the Senate in 2015.

    He described Omo-Agege as a worthy son of Urhobo and great representative of the Delta Central Senatorial District.

    Ward Congresses: Omo-Agege, Erue, Nwaoboshi, 20 other Delta APC caucus members pass ‘vote of implicit confidence’ on Gov Buni-led caretaker committee

    The Delta State Caucus of the All Progressives Congress (APC) has passed a vote of ‘vote of implicit confidence’ on the Governor Mai Mala Buni-chaired Caretaker/Extra-Ordinary Convention Planning Committee (CECPC) of the party.

     

    A VOTE OF IMPLICIT CONFIDENCE ON OUR CECPC

    The attention of the Delta State Caucus of the All Progressives Congress (APC) has been drawn to yet another unnecessary attack on leadership of our great Party by mischief-makers operating under the false and lawless style of ‘Delta State APC Leaders Council’. Few but noisy, they are bent on derailing the broadly successful Governor Mai Mala Buni-chaired Caretaker/Extra-Ordinary Convention Planning Committee (CECPC), but it will never happen on our watch.

    2. Mainly, the grouse of this ‘Axis of Artificial Troubles’ against the CECPC is its total support for an all-inclusive growth strategy for our Party in Delta State. A strategy that is working miracles everywhere in Delta, as the APC continues to take new grounds, thanks to the purposeful leadership of the Deputy President of the Senate, His Excellency, Senator Ovie Omo-Agege, the commitment of the State Caretaker Committee ably led by Prophet Jones Erue and the commitment of this Caucus. We are pleased with the CECPC’s preference for pragmatic, result-driven politics instead of narrow, selfish and unproductive politics.

    3. Following the recent decision of the Supreme Court in JEGEDE v. AKEREDOLU, some hastily wrote and released supposedly “confidential” memos to the public to threaten, blackmail and stampede the CECPC from carrying out its hugely important assignment as delegated by our NEC – the highest organ of our Party.

    4. However, the futility of that scheme was smartly exposed and buried by many, including the Attorney-General of the Federation and Minister of Justice Abubakar Malami and our own Deputy President of the Senate. Confused about their dead-on-arrival plot to sabotage our Party from within, they have chosen to insult leaders who rallied our members to respect the directive of our Party to participate in the hugely successful Ward Congress of yesterday, Saturday, 31st July, 2021.

    5. In further rebuttal of the fake flag raised again on the CECPC, we note that the CECPC is a Congress and Convention Planning Committee’ with responsibility to conduct our Congresses and National Convention and bring in executives from the Ward right up to the National level. This power was duly delegated to the CECPC by NEC presided over by Victor Giadom pursuant to a court order. Therefore, the CECPC’s ad-hoc duty to organise congresses/convention is distinct and unchallengeable.Indeed, serving Governors often head similar ad-hoc committees constituted by their parties to conduct congresses and primaries. That, unquestionably, is not an ‘executive’ or ‘salaried’ role under the 1999 Constitution (section 183). So, it is political naiveté and mischief to question the validity of our hugely successful Ward Congress using a clearly flawed premise.

    7. Furthermore, it is deeply embarrassing to wildly allege that responsible and committed grassroots leaders of our Party obtained congress forms “though no payments were made to the bank” for the said forms. This is so condescending. Did the Party report any official complaint of missing forms or that forms for the Ward Congress were not paid for in Delta State? Why label over 7,000 Ward Congress contestants across all 270 Wards in the State as criminals? Attempting to destroy the character of those in charge of our grassroots politics is dishonourable and condemnable. This extreme disrespect for the grassroots may partly explain why everyone in this blackmail league “ leadership council”except only one, lost all elections in their polling units during the 2019 General Elections.

    8. Finally, may we remind those fanning embers of disunity that political leadership is about capacity, not noisemaking, blackmail and empty threats. We advise again that it is better for the broom to sweep together. No scheme will taint the massive success recorded by the CECPC at the just concluded Ward Congress nationwide, including Delta State. We are satisfied with the conduct of the Ward Congress exercise which was duly monitored by the Independent National Electoral Commission (INEC), and congratulate our new Ward Executives in the 270 Wards of Delta State.

    9. Accordingly, we pass a vote of implicit confidence on the national leadership of the APC under the guidance of His Excellency, Hon. Mai- Malam Buni and all members of the CECPC for steadying the sailing of our great Party with great results to show for it. The CECPC deserves our full support, not vilification.

    Jegede v Akeredolu: Omo-Agege, Magnus Abe puncture Keyamo’s submission, say APC breached no law appointing Yobe Gov APC Caretaker Committee Chairman

    The submission by the Minister of State for Labour and Productivity, Festus Keyamo (SAN) on the Supreme Court judgement of Wednesday, July 28, 2021 that narrowly upheld the election of Ondo governor, Rotimi Akeredolu (SAN) in a suit filed by candidate of the Peoples Democratic Party (PDP) and his major opponent in the 2020 governorship election in the state, Eyitayo Jegede (SAN) and how such might might affect the APC especially it regards the scheduled nationwide congresses has elucidated counter submissions from Deputy Senate President, Senator Ovie Omo-Agege and former representative of Rivers South-East Senatorial District at the National Assembly, Senator Magnus Ngei Abe.

    TheNewsGuru.com, TNG reports that Minister of State for Labour and Productivity, Festus Keyamo (SAN) had in a statement on Wednesday urged the party to shelve its planned congresses and national convention to avoid a ‘top to bottom’ destruction from the judiciary.

    However, the party in a statement on Thursday said the congresses will go as scheduled.

    In their separate reactions on Thursday, Omo-Agege and Abe explained that the Supreme Court judgement Jegede vs Akeredolu’s case have does not in anyway implied that a Governor cannot serve as Chairman of any Committee in a political party of which he is a member.

    They both urged the party to go ahead with the nationwide congresses as scheduled without fear of legal battles as implied in some quarters.

    LEGAL OPINION ON THE JUDGMENT OF THE SUPREME COURT OF NIGERIA IN JEGEDE V. AKEREDOLU AND THE PROVISIONS OF SECTION 183 OF THE CONSTITUTION OF THE FEDERAL REPUBLIC OF NIGERIA AS IT AFFECTS THE APC SCHEDULED CONGRESSES NATIONWIDE

    Yesterday, Wednesday 28th, July, 2021, the Supreme Court delivered its judgment dismissing the appeal initiated by Eyitayo Jegede against the election of Governor Rotimi Akeredolu. Surprisingly, mischief makers for obviously nefarious intensions, resort to misinterpret the said judgment vis-a-vis the purport of section 183 of the 1999 Constitution (as amended), as it affects the APC Congresses scheduled for Saturday.

    Without much ado, it is important to state that the majority decision of the Supreme Court in Jegede’s case, emphatically dismissed the appeal and did not consider the issue of the provisions of Section 183 of the 1999 Constitution, neither did the majority decision make any comments on the competence of Governor Mai Mala Bumi as the Chairman of the APC Caretaker Committee. The appeal was dismissed on the ground of competence or lack thereof for the non-joinder of a necessary party to the suit at the lower court.

    It is therefore disingenuous, unsound and mischievous to attempt to misinform the reading public of what was not the ratio decidendi of the judgment of the court. Even if the apex court had considered the provisions of Section 183 of the 1999 Constitution, the majority panel would still have dismissed the appeal.

    Having established the above point, it is necessary to proceed to clear the gross misconception of the provisions of section 183 of the 1999 Constitution.

    The sole question that begs for consideration is whether the appointment of Governor Mai Mala Bumi as the APC Caretaker Committee Chairman offends the provisions of Section 183 of the 1999 Constitution (as amended)?

    In answering the above question, it is pertinent to reproduce the provisions of Section 183 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) as follows:

    “The governor shall not, during the period when he holds office, hold any other executive office or paid employment in any capacity whatsoever.”

    In view of the foregoing constitutional provisions, the question becomes: Is the appointment of a Governor to Chair a Caretaker COMMITTEE of his political party, same not being an ‘Executive Office’ in respect of which he is to be paid remuneration, incompetent? Can it be said that a State Governor who is the Chairman of the Governors Forum of Nigeria is occupying an “Executive office”? Can it also be argued that the President cannot be appointed as the Chairman of Africa Union?

    From the explicit provision of Section 183 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), it is absolutely impossible and untenable to argue that the provisions of Section 183 bars a Governor from being a Chairman or member of a Caretaker Committee set up by his or her political party. More so, the position of the Chairman of a Caretaker Committee cannot by any sense of imagination, logic or simple common sense be classified as a being a salaried Executive office.

    It is important at this point to restate the fact, that the Caretaker Committee was duly constituted by the NEC of the party and given a specific mandate to put necessary measures in place to conduct a seamless elective National Convention.

    There is no law under our legal jurisprudence that bars or prohibits a Governor who is a member of a political party and won elections under the political party from carrying out specific assignments on-behalf of his party. How this will amount to holding an Executive office is beyond every stretch of human comprehension.

    In the light of the foregoing exposition, it is humbly and firmly stated that *Section 183 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) only bars a Governor from holding Executive positions like being a Minister, or any other executive positions for which he shall be paid for. It does not by any scintilla of imagination, render the appointment of Governor Bumi as APC Caretaker Committee Chairman incompetent and will not in anyway, affect the legality or competence of the APC scheduled Congresses.

    JEGEDE VS. AKEREDOLU: LET’S THREAD CAUTIOUSLY, ABE TELLS KEYAMO, OTHERS

    …As self-immolation is not an option for APC

    Former representative of Rivers South-East Senatorial District at the National Assembly, Senator Magnus Ngei Abe, has appealed to Barrister Festus Keyamo, SAN, and APC party faithful to thread carefully and cautiously as there is nothing in the Supreme Court Judgement in Jegede Vs. Akeredolu that implies that a Governor cannot serve as Chairman of any Committee in a political party of which he is a member.

    Abe, in a statement he personally signed and posted on his Facebook account titled: “NO KEYAMO: SELF IMMOLATION IS NOT THE OPTION FOR APC,” stated that the Buni-led caretaker committee in the determined effort to reposition the party has adjusted the seating arrangements in a lot of states and this may explain the stand that some party leaders will take on this issue. But it is important that we deal with facts and the law.

    The statement reads in parts: “I was taken aback when my attention was drawn to a statement making the rounds on social media credited to my learned friend, Festus Keyamo, SAN, the Hon. Minister of State for Labour, demanding that our party the, All Progressives Congress (APC) must immediately halt all preparations for the forthcoming congresses and disband the Governor Mai Mala Buni – led National Caretaker/Extraordinary Convention Planning Committee (CECPC).

    “Keyamo’s argument is premised on his interpretation of the judgement of the Supreme Court of Nigeria in Jegede Vs Akeredolu.

    Most members of the APC accepted the reality of the CECPC as a decision of the National Executive Committee (NEC) of the APC with Mr. President as leader of the party in attendance.

    Party leaders who had reservations about the constitution of the CECPC were informed that the decision to establish the committee was reached only after extensive legal examination of the issues confronting the APC at that time by a body of eminent lawyers in leadership positions in the APC. Barrister Festus Keyamo, I am given to understand, was one of those legal luminaries whose stand swayed the President in support of the CECPC option as the only means to save our party from imminent self-destruction. That is why I was taken aback by the quick and sudden volte-face of Mr. Keyamo in the face o fJegede vs. Akeredolu.

    There is a popular saying that sometimes “where you stand on an issue is determined by where you sit”.

    The Buni-led caretaker committee in the determined effort to reposition the party and carry out its difficult assignment, has adjusted the seating arrangements in a lot of States and this may explain the stand that some party leaders will take on this issue. But it is important that we deal with facts and the law.

    The Supreme Court (according to Keyamo’s write-up) held that Buni was not a party to the case and so his status was not determined in the case of Jegede Vs. Akeredolu.

    It is therefore shocking that any legal practitioner will on the basis of that judgement reach the conclusion that the Supreme Court has already decided that chairmanship of a committee constituted by the National Executive Committee of a political party constitutes paid employment or an executive position as stated in section 183 of the constitution.

    Almost every convention committee or caretaker committee of every political party in this country that is privileged to have a governor in its fold has been chaired by a Governor, almost every primary election that produced our governorship candidates have been chaired by a Governor.

    A decision by the Supreme Court that chairmanship of a committee constituted by NEC for a particular purpose can constitute an executive position or paid employment as envisaged by the constitution of Nigeria must be a matter of evidence, and it will have grave consequences not only for the APC but the entire polity.

    The convention planning committee is a committee of NEC. Buni was not appointed as executive chairman of the APC, he is our Convention Committee Chairman but because the Working Committee of the party was dissolved by NEC, the caretaker members are to take care of the affairs of the party on behalf of NEC until an Executive Chairman is elected by convention.

    This was carefully spelt out in the NEC resolutions that gave birth to CECPC.

    These documents and others pertaining to Buni, and his lack of remuneration and activities will be evidence before any judicial proceedings to determine the status of the Buni-led Caretaker Committee.

    Any member of the party who is emboldened by Barrister Keyamo’s interpretation of Jegede Vs. Akeredolu to challenge the legality of the caretaker arrangement of our party on that basis may do so, but the litigant will of course bear the burden of proof, and the party should be ready to defend its own position based on the evidence.

    With all due respect to my learned friend, Festus Keyamo, SAN, he was merely second guessing the Supreme Court when he gave the impression or suggested, based on his understanding and interpretation of the said judgement, that any legal challenge against Buni, must succeed, no matter the circumstances of the challenge, insisting that mere joining Governor Buni will be enough for any litigation against the APC to succeed.

    This is simply incorrect. No two cases are the same. The Supreme Court itself wisely declined to make a pronouncement against Buni on the ground that he was not joined and not heard.

    To now conclude that whatever he would say when heard would not amount to anything as judgement must be passed against him is to overlook the age-long admonition of the same Supreme Court itself in the 1987 case of Lawrence V. Nnaife that “justice and fairness demand that the ratio of any case should not be pulled by the hair of the head and made Willy-nilly to apply where the surrounding circumstances are different”.

    Since the surrounding circumstances have not been made known to the Supreme Court for which it rightly declined to condemn Buni unheard, it’s preposterous to second-guess the Supreme Court on that.

    Let’s tread carefully, cautiously. Instead of throwing away the baby with the bathwater, and causing a stampede, let’s all support the Caretaker to the point that it births a proper executive council to prepare us for the future, especially the 2023 elections.

    In the meantime we must consider our position carefully. We are less than two years away from the 2023 general elections, we have dissolved all our party structures across the States, we are less than a week away from the beginning of congresses to usher in our new Working Committee.

    It has taken us almost a year to get to this point, there is no guarantee that an attempt to start a new experiment at this point will not result in a political or legal quagmire that will lead to an implosion in the APC.

    There is no perfect arrangement in politics. The best course open to the APC is for our leaders to give full support and cooperation to the CECPC to conclude its assignment and usher in a new elected executive for the party.

    Let me add for the record that there are issues in the party. Even the registration and revalidation exercise promised by the party in Rivers State has not been carried out and once again members of the APC in Rivers State are being denied forms for participation in our congresses, but problems within the party need to be dealt with”.

    To this end, Abe maintained that to throw out the CECPC at this point may amount to self-immolation from which we may not recover as a political party”.

    In conclusion, the Senator added: “we must be steadfast and stay the course, there is nothing in the Supreme Court Judgement in Jegede Vs. Akeredolu that implies that a Governor cannot serve as Chairman of any committee in a political party of which he is a member. The APC CECPC remains on firm ground”.
