Osun Tribunal: PDP, INEC to file responses before 0ctober 4

The Osun Election Petition Tribunal hearing the petition of the incumbent Governor over the loss of the July 16 governorship polls to Ademola Adeleke has been postponed till October 4 for the proper commencement of the matter.

The postponement is also to avail the respondents to file their responses to the issues raised for determination.

Justice Tertsea Kume presided over the panel on Monday in Osogbo, Osun state and was also attended by other members of the panel; Justices Benedict Amaugbe and Bashiru Rabi.

Addressing the panel, Prof. Kayode Olatoke, who represented the petitioners, Mr. Adegboyega Oyetola and the All Progressives Congress,  (APC) informed the panel that he had filed the pre-trial form containing his responses to issues listed for determination.

Olatoke noted that the respondents,  the Independent National Electoral Commission, (INEC) Senator Ademola Adeleke and the Peoples Democratic Party, had been  duly served

He appealed to the tribunal to stand down the matter for two hours, so that the respondents can also file their pre-trial form for the matter to proceed to hearing.

But lead counsel for the respondents, Prof. Paul Ananaba, who appeared with Oluwole Jimi-Bada, Mubarak Adekilekun and Nurudeen Kareem, said he had not seen copy of the petitioners’ pre-trial form.

Ananaba then insisted that the respondents should be allowed seven-day window stipulated in the second schedule of the Electoral Act for them to respond appropriately.

In his ruling, the chairman of the panel, Justice Kume, adjourned the matter to Tuesday, October 4, before which the respondents must have filed their pre-trial forms.

Meanwhile, In a statement by the Chief Press Secretary to Governor Oyetola, Mr. Ismail Omipidan, the adjournment followed the decision of the tribunal to grant the Independent National Electoral Commission (INEC), the Peoples Democratic Party (PDP), and Adeleke seven days to respond to the pre-hearing form served on them by the tribunal.

According to him, at the tribunal’s sitting counsel for the All Progressives Congress (APC), Professor Kayode Olagoke, (SAN), had informed the court of his readiness to continue with pre-hearing session, having filed his form TF008, where issues for determination were raised.

The statement further added that on the request of the tribunal for advice, Olagoke suggested that the matter should be stood down for a few hours for the respondents to also respond to the tribunal pre-hearing form.

“Counsel for INEC, Paul Ananaba, (SAN), pleaded with the Tribunal to give him seven days to respond to the pre-hearing form as he had just been served at the sitting.

“Counsel for Adeleke, Bamidele Abolarin, and counsel representing the PDP, Nathaniel Oke, (SAN), also requested the tribunal to give them the required seven days to respond,” the statement said.

“In his ruling, the Chairman of the tribunal, Justice Tertsea Kume, adjourned the matter till Tuesday, October 4, for proper commencement of hearing.

“Addressing journalists after the sitting, Professor Olagoke said the adjournment was not out of place and that the tribunal has the power to abridge the days required for any of the parties to respond,” he further said.

Election Tribunal: Davido knocks Oyetola over alleged over-voting in Osun polls

Nigerian Music artiste, David Adeleke, popularly known as Davido, has berated Osun State governor, Adegboyega Oyetola, for his claims of over-voting during the July 16 governorship elections in the state.

Davido made his grievances known with a tweet on his Twitter page on Monday morning.

He added that governor Oyetola is spreading lies thereby destroying his legacy as the governor of the state.

His Tweet reads in part: “You’re actually just a bad human being @GboyegaOyetola; no other way to put it. Spreading lies everywhere, destroying your legacy (not like you even have).

“It’s done and dusted. @inecnigeria, please, is there any such thing as over-voting with your new BVAS Machine? NOV 27th WE MOVE!!”.

TheNewsGuru.com reports that Osun state governor-elect, Ademola Adeleke has dismissed reports circulating that he admitted to Over-voting in some parts of the state.

Adeleke’s Spokesperson Rasheed Olawale had released a statement on Sunday evening on behalf of the governor-elect debunking the report, adding that Ademola’s defense was being twisted.

Olawale said the defence filed before the Tribunal dismissed Osun State Governor, Adegboyega Oyetola’s claim of over-voting in 750 polling, stressing that the over-voting was created by the incomplete data of Bimodal Voter Accreditation System based on the unsynchronised BVAS report that was used by the petitioners.

  • Osun Guber Poll: Aregbesola’s camp reveals preferred candidate

Osun Guber Poll: Aregbesola’s camp reveals preferred candidate

A faction of the ruling All Progressives Congress, (APC) loyal to the Minister of Interior Affairs, Rauf Aregbesola, in Osun state, has pledged their allegiance and loyalty to APC despite their principal having unsettled issues with the governor of the state.

The TOP’s position was made known on Friday in a post shared by a former commissioner in the state, Sikiru Ayedun.

The group reiterated that it remains a part of the APC despite the alleged maltreatment of its members by Governor Gboyega Oyetola’s administration.

There were initial speculations that the group may work against the governor in the 2022 gubernatorial election.

TOP’s statement reads in part, “As the Osun Governorship Election comes up tomorrow, we The Osun Progressives (TOP) have been inundated with calls, questions, and demands for our position by the media and our supporters and enthusiasts.

“Fundamentally, we are unabashedly democrats of the progressive hue. We live its credo and our entire being is in it.

“Our association, a caucus within the State of Osun All Progressives Congress (APC), was founded last year when we alarmingly saw the direction our party was going. It was like the falcon could no longer hear the falconer. We were filled with trepidation on the tempest long foretold.

“We were at this junction before, in the run-off to the 2003 General election. We feared that history might tragically repeat itself except we acted selflessly and forthrightly. Like-minded members and leaders of the party, therefore, came together to form the group.

“The administration of our leader, Ogbeni Rauf Aregbesola, produced a successor in Alhaji Gboyega Oyetola, against all odds, by snatching victory from the jaws of defeat. We worked hard on the mantra of continuity, the continuation of the giant development strides of the Aregbesola administration, which endeared the party to the people of the state, producing the victory that brought Governor Oyetola into office.

“As a caucus within the party, we have consistently made strident efforts at peace and reconciliation within our party. For this, we have only asked for one condition, which is inclusiveness.

“The State Governor and his henchmen, most regrettably, have turned his office and our party into a zero-sum game. You are either with them or against them. They rejected any idea of inclusiveness. They rebuffed all propositions for peace and reconciliation and not even a Councillorship position was ceded to any other section of the party outside of the Ileri-Oluwa caucus.

“Any party member that is not publicly demonstrating obscene loyalty to the governor and attacking Ogbeni Aregbesola or anyone remotely or directly associated with him is branded an enemy and marked for alienation from government and party offices. Worse still, the independent-minded party members not praise singing the Governor are subject to insidious and malevolent attacks.

“The policy of exclusion in OSUN APC is so deep that Ogbeni Rauf Aregbesola who is the immediate past Governor of the state and the current minister from the state was neither consulted, invited nor included in any party matter, the most recent of which is the APC’s Osun Campaign Council for this election. This posturing has riven the party.

“Nevertheless, we remain unflinching members of our party, the All Progressives Congress, and stand by its ideals, irrespective of our travails or even the outcome of tomorrow’s election. We are long-distance runners and will not abandon the ship of our party, in calm or stormy waters.”
