Osun: We ‘ll appeal nullification of APC primary – Oyetola’s Aide

Ismail Omipidan, who is one of the aides of the  Osun state governor, Adegboyega Oyetola, has appealed to members of the All Progressives Congress (APC) in the state to remain calm and resolute, following the decision of a Federal High Court that nullified the candidature of the governor in the July 16 gubernatorial election.

Recall that a  Federal High Court sitting in Abuja had on Friday nullified the nomination of the Osun Governor Adegboyega Oyetola and that of his Deputy, Benedict Alabi in their participation in the July 16, Osun gubernatorial.

The Presiding Judge, Justice Emeka Nwite while giving the order in a judgment declared as null and void, the nomination of Governor Adegboyega Oyetola and Benedict Alabi by the APC.

However, Omipidan, made it known through a statement signed and released by him on Friday that the governor’s lawyers were getting set to challenge the decision of the Federal High Court at the Appeal Court.

He assured APC members in the state that the decision will be set aside when it gets to the Court of Appeal.

“The case was instituted by the opposition Peoples Democratic Party (PDP) despite the fact there is a plethora of decisions flowing from the apex court that frowns upon such a decision.

“For the records, the position of the law is that only members of the APC who participated in the primary election can approach the court to challenge the nomination of Oyetola as the candidate of the party.

“All these are part of the antics of the opposition PDP and some of their collaborators from within to distract us. But like every of their plans, this too has fallen flat on their faces.

“They want to distract us from the tribunal case. But we shall remain focused until we take back our mandate. We have confidence in the Tribunal to do justice in the case before it, just as we have implicit confidence in the Appeal Court to set aside this latest decision of the Federal High Court,” Omipidan said.

The decision of the Federal High Court was predicated on the ground that Governor Mai Mala Buni who submitted their names to INEC violated the provisions of Section 183 of the Constitution of the Federal Republic of Nigeria and Section 82(3) of the Electoral Act 2022.

The court also held that Governor Buni holding dual executive positions as the Governor of Yobe State and the Chairman of the National Caretaker Committee of the APC acted in contravention of the provision of Section 183 of the Constitution of the Federal Republic of Nigeria.

The court held that the decisions taken by Governor Mai Mala Buni, including forwarding the names of Governor Isiaka Oyetola and Benedict Alabi to INEC, amounted to a nullity in law.

Governor Oyetola had already approached Election Tribunal to challenge the outcome of the July 16th gubernatorial election which he lost to Ademola Adeleke of the Peoples Democratic Party, (PDP)

BREAKING: Supreme Court upholds Ademola Adeleke’s election

The Supreme Court on Thursday upheld the July 16 People’s Democratic Party (PDP)’s governorship primary election that produced the Osun Governor-elect, Sen. Ademola Adeleke, as its candidate.

The five-member panel, in a judgment delivered by Justice Amina Augie, held that the court lacked jurisdiction to hear the suit after counsel for the appellant, Adebayo Adelodun, SAN, withdrew the earlier notice of appeal that was filed within time.

Upon resumed hearing in the matter Adelodun, who appeared for the appellant and a PDP governorship aspirant, Dotun Babayemi, informed that he sought to withdraw the earlier notice of appeal to replace it with the fresh application he filed.

But the panel held that Section 285(11) of the constitution stipulated that an appeal on a pre-election matter must be filed within 14 days from the day of the decision, and that having filed the second appeal out of time, the apex court lacked jurisdiction to entertain the matter

Justice Augie, therefore, dismissed the appeal for lack of jurisdiction.

Babayemi, had asked the court to invalidate the primary election that produced the governor-elect, citing non-compliance with a court order.

In his judgment on the matter on May 18, Justice Nathaniel Ayo-Emmanuel of a Federal High Court, sitting in Osogbo, had upheld the governorship primary that produced Adeleke.

Also, the Court of Appeal, Akure Division, in its judgment of July 20 on the appeal filed against the decision of the Federal High Court, Osogbo, aligned with the lower court and dismissed Babayemi’s appeal.

2023: Osun NNPP denies endorsing Tinubu

The New Nigeria People’s Party (NNPP) in Osun has denied claim that it has endorsed the presidential candidate of the All Progressives Congress(APC), Sen. Bola Tinubu.

The Caretaker Chairman of the party in the state, Alhaji Abdussalam Abdullateef, who made the rebuttal at a news conference on Saturday in Osogbo, urged Nigerians to disregard the claim.

Abdullateef said four members of the party, who purportedly endorsed the APC presidential candidate, were “on their own.”

According to him, the only presidential candidate known to the NNPP is Sen. Rabiu Kwankwaso, “who has all it takes to give our dear country a new lease of life come May 29, 2023 and beyond”.

“We in the Osun NNPP want to reaffirm our support for His Excellency, Sen. Rabiu Musa Kwankwaso, the Presidential Candidate of NNPP.

“He is the most qualified of all the presidential candidates in Nigeria, in terms of education, work experience,  political maturity and closeness to the grassroots,” he said.

Abdullateef stated that some past leaders of NNPP in the state were in the habit of using the party to trade for personal interest, which he said led to the change of leadership of the party.

“It may interest the world to know that the leadership of NNPP at the National level has decided to put a stop to this betrayal habit, resulting in the change of the State leadership in Osun State.

“The after effect of the change was the show of shame by four candidates of the party, who purportedly endorsed another presidential candidate as witnessed.

“If candidates of a political party endorse the presidential candidate of another party while still holding on to the mandates of NNPP, their action did not come to us as a surprise.

“Once again, we outrightly dissociate Osun NNPP from people of unstable credentials and anti-party characters.

“As for the genuine members of the party in the state, we further affirm that all  candidates of NNPP in Osun State are working towards success at the 2023 polls”, he said.

Four candidates of NNPP in the state in the 2023 elections had on Wednesday declared support for the presidential candidate of APC.

Election Tribunal: Adeleke clears air on issue of over-voting

The Osun State Governor-elect, Senator Ademola Adeleke has dismissed report that he admitted there was over-voting in Osun state during the July 16 governorship election in the state.

Report had emanated in some sections of the media that the governor-elect had admitted to over-voting in some areas of the state before Election Petition Tribunal.

However, Rasheed Olawale, the spokesman of the governor-elect said Adeleke’s defense was being twisted.

Olawale said Adeleke in his defence filed before the Tribunal dismissed Osun State Governor, Adegboyega Oyetola’s claim of over-voting in 750 polling, stressing that the over-voting was created by the incomplete data of BVAS based on the unsynchronised BVAS report that was used by the petitioners.

The statement further affirmed that the alleged over-voting by the petitioners does not represent what was contained on the BVAS machine and the Forms EC8A.

Adeleke explained that there were two aspects to the defence with respect to APC’s claim of over-voting, noting that first aspect was that there was over-voting in 750 polling units.

He said “the over-voting was created by the incomplete data of BVAS based on the unsynchronised BVAS report. This does not represent what is on the BVAS machine itself and the Forms EC8A. The correct result is as captured in the synchronised BVAS report which tallies with the data on the BVAS MACHINE itself”.

“The defence also affirmed further that even if the false over-voting in the unsynchronised BVAS report is unlikely admitted, the PDP will still be leading if votes from the affected six polling units are removed, adding however that “such admission is however impossible because the Tribunal will never rely on the unsynchronised BVAS report because is at variance with what is contained on the BVAS machine itself.

“The statement while clarifying that the digital footprint of the BVAS machine is verifiable, submitting that both Governor-elect and INEC have put the BVAS machines itself before the Tribunal for examination.

“The statement further noted that from the analysis on the BVAS machine itself and the Form EC8A which are the primary source as against BVAS report which is secondary, real over-voting occurred in only six polling units, submitting that if the votes in those six polling units are cancelled, PDP’s score will be 402,000 plus while the APC’s will be 374,000.”
