    Nigeria to end foreign shipping waivers

    The Minister of Marine and Blue Economy, Adegboyega Oyetola, has announced plans to end the issuance of waivers under the Coastal and Inland Shipping Act 2003.

    Oyetola made this known on Sunday in a statement by his spokesperson, Dr Bolaji Akinola, following a meeting with a delegation from NNPC Shipping, Stena Bulk, and Caverton Offshore.

    The meeting took place at the Ministry in Abuja and reaffirmed Oyetola’s commitment to reversing the over-reliance on waivers for foreign vessels in Nigerian waters.

    The visit coincided with the official unveiling of Unity Shipping World (USW), a new joint venture by NNPC Shipping, Stena Bulk, and Caverton Offshore Support Group.

    The joint venture seeks to develop a strong tanker operation capable of transporting crude oil, refined products, and LNG across Nigeria, West Africa, and internationally.

    NAN reports that the Cabotage Act restricts coastal shipping to Nigerian-owned, Nigerian-crewed, and Nigerian-built or -flagged vessels.

    However, due to limited local capacity, waivers have frequently been granted to foreign vessels, undermining domestic shipping growth and competitiveness.

    Oyetola criticised this long-standing trend, stating it had hindered the development of local shipping firms and reduced opportunities for Nigerian maritime professionals.

    He said the decision was aimed at strengthening the maritime sector, creating jobs, and increasing indigenous participation in the nation’s shipping industry.

    “The era of indiscriminate waivers is ending. We can’t keep weakening local capacity under the guise of temporary foreign assistance.

    “It is time to build Nigerian tonnage, support local employment, and give indigenous operators a fair chance to succeed,” Oyetola said.

    To support this policy shift, the Minister instructed NIMASA to begin the disbursement process for the Cabotage Vessel Financing Fund (CVFF).

    The fund, generated through cabotage levies, is designed to help Nigerian shipowners acquire vessels and expand their operational capabilities.

    Oyetola emphasised the urgency of disbursing the fund, calling it vital for empowering local operators in the face of reduced foreign waivers.

    “As the waiver era ends, supporting indigenous shipowners becomes even more crucial,” he stated.

    He also reaffirmed the government’s plan to launch a national shipping carrier through a Public-Private Partnership, enhancing Nigeria’s maritime influence regionally.

    Caverton Offshore’s CEO, Bode Makanjuola, described the new joint venture as transformative for Nigeria’s maritime industry.

    He said Unity Shipping World (USW) would provide efficient, reliable, and sustainable marine transport services for the country’s growing energy needs.

    According to him, the company plans to build a modern fleet by acquiring new and existing vessels while focusing on cost and operational efficiency.

    Makanjuola noted that the fleet would primarily support NNPC’s logistics but also serve other oil producers and energy traders.

    He stressed USW’s commitment to sustainability, safety, and training for Nigerian seafarers to ensure long-term industry growth.

    “This partnership reflects careful planning and a shared vision. It combines local expertise with global standards for real impact.

    “Unity Shipping World will proudly fly the Nigerian flag and help train the next generation of seafarers,” Makanjuola said.

    Panos Gliatis, Managing Director of NNPC Shipping, said the alliance would enhance domestic refining and support Nigeria’s global energy logistics role.

    Stena Bulk President and CEO, Erik Hånell, echoed this, highlighting the alignment of the venture with his company’s global strategy.

    “We are committed to operational excellence and growth in key energy markets. This partnership boosts Nigeria’s shipping and energy sectors,” Hånell said.

    Why Nigeria needs National Coast Guard – Minister

    The Minister of Marine and Blue Economy, Adegboyega Oyetola, says there is need to strengthen the collaboration between the ministry and the Nigerian navy in safeguarding Nigerian maritime space as it is done in other climes.

    Oyetola made this submission on Thursday in Abuja at the Senate public hearing on the Nigerian Coast Guard Establishment Bill 2024.

    NAN reports that a bill to establish Nigerian Coast Guard recently scaled second reading in the Senate.

    The minister said it was important to give credit to the Nigerian Navy for its achievements in safeguarding the Nigerian maritime space and giving Nigeria a good image worldwide.

    Oyetola said the collaborative effort between with the ministry and its agency–the Nigerian Maritime Administration and Safety Agency (NIMASA) in the Deep Blue Project had shown great result with zero piracy in Nigeria territorial water in the last three years.

    “However, there is a need to further complement the efforts of our Navy as it is done in other climes.

    “According to a 2009 publication by the Africa Centre for Strategic Studies, 15 out of the 21 independent maritime nations in sub-Saharan Africa have dedicated coast guards, that identify themselves as such and none has our population and many of these countries do not have the length of our inland waterways or coastline.

    “Also, a 2015 publication by the Institute for Security Studies of the National Defence College of Nigeria highlighted the impact of activities such as illegal, unregulated and unreported fishing in the inland waters, coastal and marine fishing zone in sub-Saharan Africa.

    “These illegal activities are estimated to cost the region approximately between 3 billion dollars to 5 billion dollars a year in lost revenue.

    “The Lagos – Calabar Coastal Highway development is a major game changer for the entire coastline of the country.

    “The project is expected to unlock the regions blue economy potential– hotels, beach resorts, water parks, eco-parks, ferry services, hospitality industries, industrial parks and more are soon to spring up along the coastline.’’

    The minister said that such increase in economic activities would require a dedicated institution that would be responsible for ensuring maritime safety, search and rescue, environmental protection and the enforcement of civil maritime laws.

    According to him, the spate of boats mishap within the nation’s inland waterways is also a strong justification for the need to strengthen our maritime safety and the enforcement of maritime laws and regulations in the inland waterways.

    “This is necessary to boost maritime trade and trans-shipment in Nigeria.

    “Also, considering Nigeria’s critical position in the maritime domain on the continent and globally, the establishment of a National Coast Guard will further increase our standing in the comity of maritime nations. This will no doubt attract foreign support and assistance.”

    Oyetola said that the establishment of the Coast Guard was aimed at maritime safety–by establishing clear protocols, enforcing safety regulations, and overseeing navigation routes in our inland water ways.

    He said the Coast Guard would play a critical role in safeguarding lives, property and trade within Nigeria’s coastal and inland waterways.

    The minister said that the Coast Guard would respond rapidly to maritime emergencies, conducting timely and efficient search and rescue operations.

    “The Coast Guard will actively work in collaboration with other relevant government agencies to prevent pollution and enforce environmental regulations within Nigeria’s waters.

    “Through initiatives focused on conservation and the protection of marine ecosystems, the Coast Guard will support Nigeria’s commitment to environmental stewardship, safeguarding marine biodiversity for future generations.

    “Enforcement of Civil Maritime Laws–tasked with upholding laws that govern civil maritime activities, the Coast Guard will enforce fishing laws and regulations, conventions on pollution and other civil maritime offences.

    “This function will support sustainable resource management, protect Nigeria’s waters from illegal exploitation and align with international best practices for civil maritime governance.’’

    He also spoke on inter-agency collaboration with military/paramilitary agencies

    According to him, the ministry is cognisant of the traditional but important roles being played, especially by the Nigerian Navy and the armed forces to protect our waterways and maritime assets through their operations.

    He said that National Coast Guard would ensure effective collaboration with other military and paramilitary agencies.

    “To this end, we advocate the setting up of effective and coordinated machinery for seamless collaboration with the Nigerian Navy and other armed forces, as well as key agencies in the country, to further enhance the protection of our maritime resources.

    “This will include technology and resource sharing, joint maritime exercises, missions and training to enhance maritime safety and foster cooperation.’’

    Oyetola urged the Senate and the National Assembly to lend their full support to the bill.

    He said that Nigerian Coast Guard would act as a vital complement to the Navy, fostering a safe and sustainable maritime environment that was aligned with international best practices.

    According to him, the initiative will strengthen Nigeria’s blue economy, protect Nigeria’s natural resources and ensure prosperity for future generations.

    “A flexible, adaptive implementation strategy should be evolved to midwife its establishment.

    “We also encourage those with reservations to see the pressing need for this institution and rally in support of this historic endeavour,’’ he said.

    Mr Adegboyega Oyetola, the immediate past governor of Osun and the new Minister of Marine and Blue Economy, says his appointment is a call to service.

    He spoke on Monday night in Abuja on the sidelines of the reception organised for him by the Osun chapter of the APC and other stakeholders.

    The minister, who also said he was challenged to be appointed to head a new ministry, gave an assurance that he would excel in the presidential mandate given him.

    Oyetola thanked President Bola Tinubu for considering him worthy of a ministerial appointment.

    He also expressed gratitude to the organisers of the event, saying the level of solidarity displayed was encouraging and would propel him to do even more in the interest of Nigerians.

    The minister added that he would need the cooperation and support of all stakeholders to succeed in the new ministry.

    “I thank almighty God for this wonderful opportunity to serve and the people of Osun for coming all the way from the state to celebrate with me here.

    “I am indeed happy seeing people from all walks of life, including traditional rulers, coming to celebrate with me.

    “I feel challenged to be made a minister of the Federal Republic of Nigeria because it comes with a lot of responsibilities.

    ”I pray that the Almighty will see me through.

    “Being a new ministry, I will have to start from the scratch, and I trust God Almighty to succeed and deliver on my new mandate,” he said.

    Also speaking at the event, Sen. Iyiola Omisore, the immediate past National Secretary of the APC, described Oyetola’s appointment as ” a round peg in a round hole.”

    He expressed optimism that Oyetola would deliver on his new mandate.

    Chief Bisi Akande, former Interim National Chairman of APC, said Oyetola’s appointment was well deserved, adding that it was an honour for the people of Osun.

    Akande, also a former governor of Osun, said the appointment had rekindled the hope of the people of the state in the Nigerian project and in the Tinubu-led administration.

    The APC leader, who wished Oyetola a successful tenure in office, thanked the president for the appointment.

    The News Agency of Nigeria (NAN) reports that Oyetola had earlier on assumption of duty outlined his vision for a thriving blue economy sector that prioritises sustainability, innovation and economic growth.

    The minister, while speaking at his maiden news conference at the Ministry of Transportation on Monday, acknowledged the abundant marine resources existing in the country’s coastal region.

    He stressed the need to fully harness the country’s marine resources.

    The minister also said he would promote better inter-agency cooperation and coordination between the Nigerian Maritime Administration and Safety Agency, Nigerian Ports Authority and Nigerian Inland Waterways Authority.

    “As someone with a strong private sector background, we shall promote greater private sector inclusion while fostering greater efficiency through specialisation and the effective delineation of core duties between the units.

    “We must seize this opportunity to create positive change, leaving a lasting legacy for generations to come,” the minister had said.

    The reception was attended by Gov. Babajide Sanwo-Olu of Lagos State, traditional rulers, members of the Osun House of Assembly and diplomats among others.

    BREAKING: Appeal Court affirms Adeleke winner of Osun gov election

    The Court of Appeal sitting in Abuja has affirmed the election of Gov.  Ademola Adeleke of Osun.

    The appelate court set aside the verdict of the Osun State Governorship Election Petition Tribunal, which sacked him from office.

    Delivering judgment in the appeal filed by Adeleke on Friday, a three-member panel of Justices led by Justice Mohammed Shuaibu, held that the Tribunal erred when it ruled that the 1st and 2nd respondents (Gboyega Oyetola and the All Progressives Congress) proved their allegation of over-voting in the July 2022 election.

    The Osun Governorship Election Petition Tribunal in January held that Oyetola was able to prove that there was over-voting in some of the polling units.

    Consequently, the majority judgment of the Tribunal ordered INEC to withdraw the certificate of return issued to Adeleke and issue a fresh one to Oyetola as the duly elected governor of Osun instead.

    Oyetola asks Appeal Court to declare Adeleke unqualified over alleged certificate forgery

    Mr. Gboyega Oyetola of the All Progressives Congress (APC), on Monday, asked the Court of Appeal, Abuja to declared Gov. Ademola Adeleke of Osun unqualified to have contested the July 16, 2022  poll in which he emerged as winner over alleged certificate forgery.

    Oyetola, whose candidacy in the poll was affirmed by a tribunal, made the prayer in a cross appeal marked: CA/AK/EPT/GOV/03/2023 filed before the three-member panel headed by Justice Mohammed Shuaibu.

    The 1st and 2nd cross appellants in the case are Oyetola and the APC respectively.

    In the matter, the Independent National Electoral Commission (INEC), Adeleke, and the PDP are the 1st to 3rd cross respondents respectively.

    NAN also reports that Adeleke had, in an appeal marked: CA/AK/EPT/GOV/01/2023, prayed the court to set aside the judgment of the Osun tribunal delivered on Jan. 27 which upturned his victory at the poll.

    Adeleke, who dragged Oyetola, APC, and INEC before the appellate court as 1st to 3rd respondents respectively, urged the panel to dismiss the tribunal’s judgment.

    Onyechi Ikpeazu, SAN, who was counsel to Adeleke, challenged the decision of the tribunal which nullified the victory of his client in the governorship election.

    Ikpeazu, argued that a member of the tribunal, who was also a chief magistrate, did not air her opinion during the judgement delivery.

    Rather, he said she only appended her signature and the constitution mandated her to have aired her views about the suit.

    But Oyetola’s counsel, Lateef Fagbemi, SAN, disagreed with Ikpeazu.

    The senior lawyer submitted that mere signing of the judgment, and not making any comment could not have rendered the judgment invalid.

    He further argued that Justice Terste Kume, who headed the tribunal, in the open court, made a pronouncement while delivering the judgment using the expression, “We, members of the tribunal…,” to imply that the decision was unanimous.

    He also argued that there was over-voting in 744 polling units across the state.

    Fagbemi urged the court to dismiss Adeleke’s appeal.

    Arguing the cross appeal, Akin Olujimi, SAN, who appeared for Oyetola, prayed the court to declare Adeleke unqualified to have contested the election, in the first instance, over allegations bordering on certificate forgery.

    INEC had, on July 17, 2022, declared Adeleke the winner of the governorship election conducted on July 16, 2022 after polling a total of 403,371 votes.

    He was said to have won in 17 of the 30 local government areas in the state.

    But Oyetola and his party, the APC, approached the court to challenge the victory on the grounds that there was over-voting and that Adeleke was not eligible to run at the time.

    The Osun State Governorship Election Petition Tribunal had, on Jan.  27, voided the July 16, 2022 election that produced Adeleke of PDP as the elected governor.

    The panel led by Justice Kume, in its judgment, invalidated the election and declared Mr Gboyega Oyetola of APC as the valid winner of the poll.

    The tribunal directed INEC to withdraw the certificate of return issued to Adeleke and his deputy, Kola Adewusi, both of whom had been sworn in.

    It, however, directed that the certificate of return should instead be issued to Oyetola.

    Justice Kume held that the governorship election was not held in compliance with Nigeria’s Electoral Act.

    The tribunal also held that the governorship election was characterised by over-voting.

    The tribunal, thus, ordered that Oyetola should be returned as governor of Osun State.

    Olujimi, in his argument on Monday, said that that they were able to prove a case of forgery against Adeleke but the tribunal failed to make a consequential order in that regard.

    He said the development led to the filing of the cross appeal.

    He said Adeleke, who vied for the governorship position, submitted a forged certificate to INEC.

    He stated that besides the issue of over-voting established by the tribunal, the cross respondents erroneously thought Adeleke was eligible to contest in the poll even with the controversy surrounding the certificate forgery.

    Olujimi argued that having found that the case of forgery was proved by the petitioners (Oyetola and APC) against the 2nd cross respondent (Adeleke) in regard to his Exhibit EC9 and FILE D, the tribunal ought to have held pursuant to Section 182(1)(j) that Adeleke was not qualified to have vied for the July 16, 2022 Osun governorship election.

    He also submitted that Adeleke failed to call evidence to disprove a case of forgery against him, saying that “an evidence tendered in one case cannot be relied on in another case.”

    He urged the court to uphold the cross appeal.

    Counsel to INEC, Paul Ananaba, SAN, said the cross appeal was hollow, praying the court to dismiss it

    Also, Adeleke’s lawyer, Ikpeazu, urged the court to dismiss the cross appeal.

    He argued that since Oyetola and APC were the petitioners before the tribunal, they ought to have called evidence to prove their case, and not the respondents.

    Alex Iziyon, SAN, lawyer to the PDP, also aligned with Ikpeazu’s submission.

    After taking arguments from counsel to the parties, Justice Shuaibu reserved judgment in the case.

    APC Presidential Candidate, Bola Tinubu says the election tribunal judgment that upturned the election of Sen. Ademola Adeleke of the PDP in favour of Alhaji Gboyega Oyetola, is triumph of light over forces of darkness.

    Tinubu, in a congratulatory message to Oyetola through his spokesperson, Tunde Rahman on Friday, also said the victory of Oyetola was a reward for perseverance that was well deserved,

    The two-term governor of Lagos state also described the victory as a triumph of courage over forces that sought to arrest the progressive good governance the APC administration delivered to the people of Osun,  under the leadership of Oyetola.

    “I heartily rejoice with  Oyetola on his much deserved victory at the election tribunal today.

    “It is a  triumph of perseverance, courage, and justice over electoral fraud and democratic perversion.

    “The forces of darkness plotted to extinguish the able leadership and progressive good governance that improved the quality of life of our people under your leadership.

    “The tribunal delivered justice and restored the mandate freely given to you and our great party,” he said.

    The APC presidential candidate, expressed confidence that the good work Oyetola championed that was momentarily paused, would soon resume and Osun people would be happy again.

    “Together we can renew their hope of a shared prosperity.”

    A 3-man election tribunal, chaired by Justice Tertsea Kume on Friday, in Osogbo, ruled that Oyetola was the duly elected governor of Osun.

    Kume ordered the Independent National Electoral Commission to issue Certificate of Return to Oyetola, while declaring as null and void, the results that produced Ademola Adeleke as governor.

    There is palpable fear in the camps of the Peoples Democratic Party (PDP) and All Progressives Congress (APC) in Osun State are both hopefuls of favourable judgment in the dispute over the July 16, 2022 governorship election to be determined on Friday (today) by the governorship election petitions tribunal.

    It was earlier reported that the Osun State Governorship Election Petition Tribunal sitting in Osogbo fixed Friday, January 27 for delivering judgment on the July 16 2022 governorship election.

    The tribunal communicated the date to the parties in the matter three days ago.

    Gboyega Oyetola, the All Progressives Congress (APC), had filed a petition against the winner of the election, Ademola Adeleke of the Peoples Democratic Party (PDP), alleging that Adeleke presented fake certificates to INEC.
    The counsel representing Oyetola, Lateef Fagbemi (SAN), and Akin Olujinmi (SAN), insisted that Adeleke did not win the majority of lawful votes and should not have been declared the winner of the election.

    They also said there were inconsistencies in the certificates presented by Adeleke.

    Justice Tetse Kume-led’s three-man panel will rule today over the governorship election.

    The Osun State Police Command has warned against the breakdown of law in the state as the Governorship Election Petition Tribunal delivers its judgment today (Friday).

    According to the state command necessary security measures have been put in place to guide against the breakdown of law and order.

    The spokesperson of the command, Yemisi Opalola said the police is working with other security agencies in the state.

    The statement reads, “Osun State Police Command wishes to assure the general public, especially the good people of the state, of adequate security before, during, and beyond the judgment.

    The Police, in collaboration with other security agencies in the state, have put all necessary security measures in place to deal decisively within the ambit of the law with anyone, group of persons who might attempt to foment trouble.

    “Therefore, Osun State Police Command is using this medium to appeal to parents and guardians to warn their children and wards to stay out of trouble/violence. They should not allow themselves to be used by any vicious politicians to cause a crisis in the state, as the command will not tolerate any kind of thuggery or hooliganism.”

    Osun 2022: Appeal Court validates Oyetola’s nomination, dismisses PDP’s case

    The Court of Appeal in Abuja has affirmed the candidature and nomination of the governorship candidate of APC in the July 16 governorship election in Osun, Adegboyega Oyetola, and his running mate, Benedict Alabi.

    Oyetola and Alabi are the immediate past governor and deputy governor of Osun.

    The court set aside the ruling of the Federal High Court, Abuja, delivered by Justice Emeka Nwite, nullifying the nomination of Oyetola and Alabi as the APC governorship and deputy governorship candidates.

    A Federal High Court sitting in Abuja had on Sept. 30 nullified the nomination of Oyetola and his running mate, Alabi.

    The nullification was on the grounds that Gov. Mai Mala Buni of Yobe, who submitted their names to INEC, violated the provisions of Section 183 of the Constitution and Section 82 (3) of the Electoral Act, 2022.

    In his judgment, Justice Emeka Nwite agreed with the submissions of the Plaintiff’s counsel and declared as null and void the nomination of Oyetola and Alabi by the APC.

    The PDP through its counsel, Kehinde Ogunwumiju, had in the suit dragged Buni and four others before the court challenging the nomination and sponsorship of Oyetola and his running mate as the duly nominated candidates of the APC.

    But the Appeal Court in Abuja, on Friday, in appeal no: CA/ABJ/CV/1099/2022 between Isiaka Adegboyega Oyetola & Anor v PDP & Ors, authenticated the nomination of the duo.

    In allowing the appeal filed by Oyetola and his party, APC, the Court of Appeal held that the outcome of a governorship primary is a collective decision of a party through its congress.

    It said constitutional challenge or deformity of any officer of the party cannot render it illegal.

    The court, therefore, held that notwithstanding the defects in the letter forwarding the nomination and sponsorship of Oyetola and his running mate to INEC, the fact that they emerged from a valid primary cannot be ruled out.

    It maintained that the defect of Buni signing the letter conveying the nomination of the appellants cannot be a ground to reject the results and desire of the party’s primary election.

    Regarding the question of immunity of Buni, who submitted the nomination of the appellants to INEC, the court equally held that Buni cannot be sued because the immunity enjoyed by him protected him against civil and criminal suits.

    The court questioned Nwite for his failure not to consider a classical precedent judgment delivered by the Supreme Court of Nigeria in Jegede v INEC before he arrived at his judgment.

    It also awarded the cost of N200,000 in favour of the appellants.

    Gov. Ademola Adeleke of Osun, on Monday, issued six executive orders reversing appointments made by former governor Gboyega Oyetola, including appointments of workers and installation of traditional rulers.

    This is contained in a statement by his Spokesperson, Malam Olawale Rasheed.

    The governor signed the executive orders on Monday, including an order freezing all the State Government accounts in all banks and other financial institutions.

    “The six executive orders to take immediate effect.

    “The orders cover chieftaincy matters, appointments issues, setting up of review panel, staff audit and employment matters.” he said.

    Others he said are for the immediate freezing of all the state government accounts in all banks and other financial institutions, order on Staff Audit – All Heads of Ministries, Departments, Agencies, Commissions, Boards and Parastatals of Osun State Government are directed to carry out immediate staff audit of the actual number of workers in their establishments as at July 17, 2022.

    The governor said all heads of agencies and parastatals are to file a report to the Office of the Chief of Staff to the Governor stating the full details and position/designation of each of the staff on the forwarded list, within seven working days from the date of the Executive order, using the Oath of Fidelity Template.

    The governor also nullified all employments in the service of Osun State Government made in any capacity into any capacity in all the Ministries, Departments, Agencies, Commissions, Boards and Parastatals after July 17.

    “In the case of Ikirun, Iree, and Igbajo, to avoid further breakdown of law and order, the appointments of Akinrun of Ikinrun, Aree of Ire, and Owa of Igbajo are hereby put on hold pending review.
