  • Analysis: A’Court judgement on Zamfara APC primaries and implication for party’s win

    It is no longer news that the Court of Appeal sitting in Sokoto on Monday led by Justice Tom Yakubu, has set aside the judgement of a Zamfara High Court on the All Progressives Congress (APC) primaries that produced the party’s candidates for governorship, National and State Assembly elections.

    However, what is not clear to many is the implication of the judgement on APC’s win in the Governorship and House of Assembly seats in the state.

    A Zamfara State High Court had earlier recognised the primaries held by the APC and directed the Independent National Electoral Commission to accept the party’s candidates for the elections.

    But the Chairman of the Senate Committee on Petroleum (Downstream), Kabiru Marafa, and 129 others through their counsel, Mike Ozhekome( SAN), appealed the judgement.

    Respondents are Kabiru Liman-Danalhaji and 139 others represented by Mr Mahmud Magaji as the lead counsel.

    Marafa and others had approached the appellant court and argued that the state high court lacked the jurisdiction to entertain the suit and that its judgement should be declared null and void.

    In the judgement, which was adopted by the two other judges in the panel, Tijjani Abubakar and Jamilu Tukur, Justice Tom Yakubu held that the lower court failed to perform its duty to properly evaluate the evidence before it.

    “The Appeal is hereby allowed. The judgement of the lower court delivered on the 25th, January 2019 by Shankafi in suit No ZMS/GS/52/2018 is hereby set aside. Parties shall bear their costs.”

    In the judgements and court order obtained exclusively by TheNewsGuru (TNG), the judge stated clearly that the party had made two unsuccessful attempts to conduct primaries in the state and list of candidates were not duly submitted to the Independent National Electoral Commission, INEC, by the national headquarter of the party as promised by the national chairman of APC, Adams Oshiomole.

    “I hereby, set aside the judgement of the lower court which allowed the party to field candidates in the last general elections,” he said.

    He added: “I believe this will serve as a very bitter lesson for political parties to learn. They must abide by the provision of the electoral act which provide level play ground for all aspirants,” the judge ruled.

    Except another competent court (in this case the Supreme Court) issues an opposing judgement, the implication of the judgement is that the ruling APC in the state will automatically vacate their elected seats to the opposition, Peoples Democratic Party (PDP). This includes the state assembly, national assembly and the governorship elections conducted by INEC on February 23 and March 9 respectively.

    INEC will have to issue Certificates of Return to the PDP candidates instead of those of the APC.

    Confirming this development in an exclusive interview with TNG, a participant at the party’s (APC) governorship primary said: “The implication of the judgement is that the second runner up takes it. The result is both side looses being the consequence of impunity,” he said.

    Zamfara Government rubbishes judgement, says party’s victory intact

    The governor of Zamfara State, Abdul’aziz Yari, has called on members of the All Progressive Congress (APC) and residents of the state to remain calm and be law-abiding after the Court of Appeal nullified the primaries of the party in the state.

    Following the decision by the Sokoto Division of the Court of appeal this morning, setting aside, the rulling by Justice Bello Shinkafi led Zamfara State High Court on the APC Governorship and state assembly Primaries conducted on the 3rd and 7th October last year across the nooks and crannies of Zamfara state.

    His Excellency the Executive Gov of Zamfara state Hon (Dr) Abdulaziz Yari Abubakar appeals to all the law abiding members of the APC and indeed all the citizenry of Zamfara state including members of all political parties to remain calm and law-abiding, pending the release of the judgement which is currently being prepared for presentation to the public.

    However, unlike the rumours now awash all social media platforms that the Court of appeal Sokoto Division has nullified our elections, is not true. The statement is incorrect. Those circulating the rumours are doing so to cause mayhem in our state to satisfy the ego of their masters. You may recall that they have been doing so to mislead the public.

    What the Court of appeal Sokoto Division division did this morning was setting aside the judgement by the Zamfara State High Court on the ground of ” EXAMINATION OF PROOFS OF EVIDENCE “. This has nothing to do with our elections.

    Recall that in February, the court of appeal sitting in Abuja set aside the judgment of the Federal High Court, Abuja, which barred the APC from fielding candidates, in consonance with the earlier decision of the Independent National Electoral Commission (INEC).

    The Court has not in anyway tempered with our elections, as only Tribunal has the right to listen to issues arising from election matters. Again, the Court of appeal Sokoto Division has not in anyway tempered with the processes of the primary elections. It only faulted the examination of the proofs of evidence.

    Furthermore, the processes of filing the appeal were done after the expiration of period within which to do so. For these reasons, His Excellency the Executive governor of Zamfara state and Chairman Nigeria Governors Forum and Senator- elect, Abdulaziz Yari Abubakar is appealing to all members of the APC and it’s supporters to remain calm and law-abiding.

    While awaiting the release of the judgement by the Sokoto Division of the Court of appeal, before taking it to the ” Next Level,” Gov Yari thanks and appreciates the concern by all party members and supporters.

    Meanwhile, the the National Commissioner and chairman of Information and Education Committee of INEC, Festus Okoye, in a reaction said the commission would not do anything until the judgment was given to the electoral body.

    He said, “We have not yet seen the judgment delivered by the Court of Appeal, Sokoto Judicial Division. When the commission receives a copy of the judgment, INEC will study the judgment and be sure that it emanated from a properly constituted court of law. We will study it and look at the prescribed order given by the court and see if the court made any consequential order.

    “The commission will then take a position in relation to what should be done. But you have to also bear in mind that elections have been conducted, declarations and returns have been made in relation to all the elective offices in Zamfara State.

    “For members of the Senate and House of Representatives, the commission has issued Certificates of Return to them. The only Certificates of Return that have yet to be issued relate to the governor and the deputy governor as well as members of the state House of Assembly.”

    PDP hails judgement, says APC participated illegally in the elections

    The main opposition, the Peoples Democratic Party (PDP) in a reaction to the development said that the APC participated illegally in the Zamfara State governorship election.

    It said this was evident in the ruling of the Court of Appeal that nullified the primary that produced the governorship candidate of the APC who participated in the election.

    The National Chairman of the PDP, Prince Uche Secondus applauded the court for the judgment, saying that the “night ruling that INEC relied on to allow the APC participate in the election was suspicious.”

    Secondus, who said the PDP knew that the APC was smuggled into the ballot, wondered how INEC was able to print fresh ballot papers and distribute them overnight during the March 9 governorship election in the state.

    He said, “The Court of Appeal judgment has vindicated us. The judiciary is alive and we are happy for that. Though the judges are facing a lot of challenges from the intimidating government, we are however happy that the judges are strong and telling the truth to power.”

    A member of the National Assembly , Senator Kabiru Marafa (APC Zamfara Central), on Monday said he had been vindicated by the judgement of the Court of Appeal setting aside the ruling of Zamfara state High court on the APC primaries in the state.

    Marafa, who is Chairman of Senate Committee on Petroleum (Downstream) , in a reaction hailed the judgement of the Sokoto division of the Appeal Court which set aside the ruling of the high court on the party’s primaries in the state.

    Marafa, a former governorship aspirant in the state, said the judgement had shown that truth will always prevail over falsehood.

    Hailing the Appeal Court judges for standing by the truth, the Senator said: “I have always believed that the Zamfara State High Court ruling was nothing but a black market judgement that can never stand legal scrutiny.

    ” The Appeal Court judgement has rekindled the fact the judiciary is the last hope of the common man. We are all living witnesses to the fact that the APC in Zamfara was unable to conduct primaries and couldn’t reach consensus due to the attitude of Governor Abdulaziz Yari, but the Zamfara state High Court judge ruled against the truth. The Appeal Court has today done justice by throwing the judgment of the Zamfara High Court to the trash bin, where it rightly belongs.”

    The ranking lawmaker, while commending the million of his supporters for their support, cooperation and patience, urged them to discountenance the press release from the Zamfara Government House, claiming that today’s judgement has no effect on their election.

    ” The statement by the Zamfara Government House on the Appeal Court judgement is the last kick of dying pigs, not even horses. You cant build on nothing, APC didn’t conduct primaries, they don’t therefore have candidates in the just concluded elections,” he further said.

    President Muhammadu Buhari says he believes in the will of the people and cannot put pressure on voters to elect leaders they do not like.

    Buhari in a statement by his Senior Special Assistant on Media and Publicity, Malam Garba Shehu, in Abuja on Friday, dismissed insinuations that he was forcing voters to elect candidates other than those they preferred during the supplementary elections scheduled for 17 states on March 23.

    The president said at no time did he give instructions that the electorate should vote particular candidates.

    The President assured Nigerians that he was ready to work with elected representatives of the people regardless of party platforms on which they were elected.

    President Buhari said he would work in the best interest of the country and democracy.

    President Buhari, who thanked voters for re-electing him for a second term in office, said he would never forget their sacrifices in defying harsh weather conditions to vote for him.

    He said: ‘‘I was deeply overwhelmed by your show of incredible confidence in me, and I will never let you down.

    Thank you for your sincere show of support for me.’’

    President Buhari, however, appealed to voters not to get tired of coming out to vote in the supplementary elections, adding ‘‘these elections are no less important than others before them.’’

    He appealed to voters to vote for the candidates they believed would deliver on promises because “it is your constitutionally guaranteed democratic rights.

    President Buhari also called on INEC and security agencies to ensure that the supplementary elections are conducted peacefully and in accordance with the law and constitution.

    He, therefore, called on the electorate to come out and participate in the supplementary elections.

    Dr Obiageli Ezekwesili, the Presidential Candidate of Allied Congress Party of Nigeria (ACPN). has described allegation by the National Chairman of the party, Alhaji Abdul-Ganiyu Galadima that she was never really serious about her presidential ambition as baseless.

    In an interview with News Agency of Nigeria, her media aide, Mr Uzoma Ubabukoh, in Lagos, on Thursday, said Galadima’s claim that she was contesting to negotiate to be Minister of Finance was a figment of his imagination.

    Galadima was Ezekwesili’s running-mate until she announced her withdrawal from the race early on Thursday.

    She claimed she withdrew from the race after due consultations with Nigerians at home and in the Diaspora.

    Ezekwesili added that her decision to quit the race was informed by the need to help and build a coalition to stop the All Progressives Congress (APC) and the Peoples Democratic Party (PDP) from winning.

    She said neither APC nor PDP could provide the kind of governance needed to reposition the country.

    Few hours after Ezekwesili’s withdrawal from the race, Galadima called a news conference, saying Ezekwesili had not shown the commitment to be President from the beginning.

    He alleged that the former minister was just in the race to negotiate to be Minister of Finance and that she had kept the party in the dark about her real intention.

    Galadima added that the candidate had used the platform of the party to get funds from donors, which she had not spent to show commitment to her ambition.

    The ACPN chairman said having realised that Ezekwesili did not represent the interest of the party, the party was endorsing President Muhammadu Buhari for re-election.

    Reacting to the allegations, Ubabukoh said Galadima’s claims were baseless.

    He said the candidate’s decision to withdraw from the race was taken to sacrifice her personal interests for the country’s interest.

    All these allegations are figment of his imagination. They are baseless. The decision to withdraw from the race is in the interest of the nation. It should be the nation first before anything,” Ubabukoh said.

    56 political parties ready for 2019 general elections – INEC

    The Independent National Electoral Commission (INEC) says 56 political parties out of the 91 registered parties in the country are set to participate in the 2019 general elections.

    The Resident Electoral Commissioner (REC) in charge of Rivers, Mr Obo Effanga, said this during a media briefing on Friday in Port Harcourt.

    He said that INEC was interested in all the 91 registered political parties, adding that the commission would only deal with political parties that registered for the election in 2019.

    The REC assured Rivers people that the commission was ready to ensure free, fair and credible elections in 2019, stressing that “we assure you that on the day of the elections, every material needed for the elections would be ready to ensure free, fair and credible process.”

    Effanga noted that the Card Readers would be used for the 2019 general elections.

    He pointed out that any voter who was not accredited by the Card Reader would not cast his or her vote.

    He explained that provisions would be made if the Card Reader developed any hitch in the process.

    He, therefore, called on community leaders to advise their youths against disrupting the elections, emphasising that any community that could not advise its youths to be of good conduct, INEC would not conduct elections there.

    The REC urged stakeholders to play their part properly, saying that security agencies, the political class, among others, should ensure that the 2019 general elections were successful.

    He stressed that any politician who would have objections of any kind concerning the 2019 general elections should go to court to seek redress.

    He called on the electorate to pick up their Permanent Voter Cards at their areas of registration to enable them to exercise their franchise on the day of the election.

  • 2019: Ezekwesili joins presidential race, unveils party today

    A former Minister of Education, Obiageli Ezekwesili on Saturday made public her intention to run for the office of the President of the Federal Republic of Nigeria in 2019.

    Ezekwesili was also a former Vice President of the World Bank for Africa made the declaration in a statement released to the media on Saturday.

    She promised to announce her political party of choice on Sunday (today), vowing to build an army of patriots willing to pull down the stronghold, “that is, the two failed dominant political parties in Nigeria – the All Progressives Congress and the Peoples Democratic Party.”

    According to her, it is way past time for Nigerians to unify and mobilise nationwide to rescue Nigeria from mediocrity and enthrone excellence as the guiding standard.

    Ezekwesili said, “The pain of seeing us become a country where the worth of life is trending down to zero, sadness that we are now known as the world poverty capital with 87 million extremely poor Nigerians, and anguish at the increase in the number of out-of-school children constitute a driving force for seeking the office of the President.

    Trust in public officials completely waned, angst knowing that only 10 per cent out of three to four million young people entering the employment market every year will likely find jobs, and concern about the future of Nigeria as a strong indivisible nation are the issues that have also compelled me.

    I have fully persuaded myself to lead a people’s movement that will permanently terminate bad leadership, ethnic and religious divisions, mediocrity, and failures in governance. We, the people of Nigeria, shall run together and win.”

    While stating her rationale for taking the step, she said, “Our political class continues with self-absorbed attitude of seeing power as an end in itself, thereby producing no material improvement in the lives of citizens. This compelled a change of direction for me.

    It is time to make citizens’ wellbeing the core focus of political leadership. It is time to reclaim our values that have become distorted and reduced Nigeria and Nigerians to ridicule by the rest of the world. It is time for leaders to offer exemplary and sacrificial service that will mobilise our people to build a cohesive, stable, and prosperous society in which every Nigerian has a stake.

    I want to run for, and win the 2019 presidential election to serve and put the citizens first by mobilising and taking decisive actions on a number of big ideas that will help all of us build an exceptional nation that our future generation will be proud to call their own.”

    According to the statement, Ezekwesili, who recently made the shortlist for the Nobel Peace Prize by the Peace Research Institute, Oslo, Norway, owing to her “efforts in making the world more transparent and less corrupt,” plans to run an all-inclusive campaign that will change the direction and dynamics of politics in Nigeria.

    The former minister of education stated that she had no choice at this stage but to subordinate her feelings against politics to her stronger passion for ending the old order political ways, “which have entrenched bad leadership and governance failure in the country.”

    Ezekwesili, until recently, led the #BringBackOurGirls pressure group as co-convener.

     

  • 2019: APC writes INEC, releases dates for party primaries

    Barring any last minute change of plans, the ruling All Progressives Congress (APC) will, on Wednesday, September 19, elect its flag bearer in next year’s elections.

    The choice will be through either direct or indirect primary, party chair Adams Oshiomhole said in an August 17,2018 letter to the Independent National Electoral Commission (INEC).

    Also to be elected on September 19 are the party’s candidates for the House of Representatives election, Oshiomhole said in the letter.

    The letter shows that the national convention to elect the presidential candidate will be preceded on Saturday, September 8 by nationwide congresses to elect delegates to the convention.

    On September 20 party members will elect candidates for the senatorial election to be followed on Monday, September 24 by the nomination of governorship candidates and on Saturday, September 29 by the nomination of candidates for House of Assembly election.

    All dates are subject to ratification by the National Executive Committee of the party.

    Oshiomhole said: “This serves as a formal notification pursuant to the provisions of section 85 of the Electoral Act 2010 as amended. Kindly arrange for your officials to monitor the exercise accordingly”.

    Recall that the party had earlier accused INEC of leaking its letter on its primaries to the media.

    To guard against a repeat of such development,the party’s acting National Publicity Secretary, Yekini Nabena asked INEC to look into its internal handling of official correspondence and go all out to stop leakages.

    Nabena said the National Executive Committee of the party needs to approve the time table for it to become authentic and asked Nigerians and the media to wait for an official announcement from the party as the leaked dates are subject to changes if necessary.

    Nabena said: “Our attention has been drawn to a leaked letter the National Chairman of the All Progressives Congress (APC), Comrade Adams Oshiomhole wrote to the Chairman, Independent National Electoral Chairman, Prof. Mahmood Yakubu informing the Commission of the schedule of the Congresses and Primaries to elect Party candidates for the 2019 General Elections.

    These leaks of our sensitive and confidential correspondence to INEC is becoming commonplace and totally unacceptable. We strongly request that INEC looks into its internal handling of official correspondence and put a stop to these leaks.

    While the leaked formal notification to INEC has been done by the APC pursuant to the provisions of Section 85 of the 2010 Electoral Act (as amended), we advise the general public particularly the media to wait for an official announcement from the Party as the leaked dates are subject to changes, if necessary.”

    Information gathered by TNG revealed that the party plans to hold its NEC meeting on Wednesday, 29th August to approve the party’s programme for the 2019 general elections, including whether to use direct or indirect primaries for the selection of its candidates and the fresh membership registration.

    Under INEC timetable and schedule of activities for the 2019 elections, party primaries for the Presidential, Governorship, Federal and State Elections are to run between August 18 and October 7, 2018, while that of the FCT Area Council Elections will commence on September 4 to end on October 27, 2018.

    The 2019 elections will take off on Saturday, February 16 with the Presidential and National Assembly elections.

    It will be the turn of Governorship and State Assembly/Federal Capital Territory (FCT) Council elections on Saturday, 2nd March 2019.

    A presidential aspirant on the platform of National Conscience Party (NCP), Thomas-Wilson Ikubese, on Monday renounced his membership of the party.

    Mr Ikubese told journalists in Akure, the Ondo State capital, that he was renouncing his membership as well as presidential aspiration on the platform of NCP, alleging unconstitutional acts on the part of the party’s leadership.

    He said the national chairman and secretary of the party were demanding N7.4 million from each aspirant, which according to him contradict its constitution.

    NCP was founded by the late legal luminary, Gani Fawehinmi.

    I am no longer NCP presidential aspirant due to the action of the national chairman and secretary of the party who mandated each aspirant to pay a sum of N7.4 million to secure the party’s ticket.

    This is totally contradictory to the party’s constitution which stipulates that intending candidates of the party should run without paying a dime.

    Majority are not happy with the way the party is being run. It is a total deviation from the dreams of the founding members,” he said.

    Mr Ikubese said no fewer than 12 different political parties have approached him to form a coalition in order to oust the ruling party from power.

    The 47- year-old politician said that the planned coalition would be able to create the dream of a new Nigeria.

    He added that Nigeria has enough resources to depend on for its optimal growth and development.

    However, the National Chairman of the party, Yunusa Tanko, in an interview denied the aspirant’s claim.

    Tanko said the party never asked any aspirant to pay for nomination or expression of interest forms.

    He said the party was merely raising money to sustain itself.

    The national chairman said Mr Ikubese had only contributed N2000.00 to the party since he became a member.

    President Muhammadu Buhari has arrived his hometown, Daura ahead of the All Progressives Congress (APC) ward congress on May 5.

    The president arrived Daura at about 5:30 pm on Friday.

    He is expected to participate in the ward congress at Sarkin Yara A ward in Daura.

    The APC ward chairman, Malam Ali Mani said all arrangements have been completed for a smooth congress and urged party members to be law abiding.

    The Sarkin Yara A consists of 15 polling stations and 26 party executives.

    Gov. Muhammadu Bindow of Adamawa has urged stakeholders and other members of All Progressives Congress (APC) in the state to forgive him, if he wronged them.

    Bindow made the plea Monday at a stakeholders meeting in Yola to discuss the upcoming party congress.

    “If I offended any of you here please forgive me. I didn’t do that deliberately,” Bindow said.

    The governor assured all the stakeholders that he has no candidate for the coming party congresses, and urged all those seeking positions to go and mobilize support.

    “My administration is ready to work with all those elected in the congresses,” he stressed.

    Bindow expressed satisfaction with the turnout of stakeholders from various interest groups in the state and urged for more unity in the party.

    Speaking at the occasion, the Secretary to the Government of the Federation (SGF), Mr Boss Mustafa stressed the need to abide by the party guidelines for hitch free congresses.

    “We are one family and must not allow internal political bickering to affects our party in the state.

    “We won in 2015 general election and shall win in 2019, but we need to create a situation that would make it much easier for us to win again,” Mustafa said.

    In his remarks, the APC National Vice Chairman North East, Alhaji Mustafa Salihu, lauded the stakeholders for putting aside their differences to attend the meeting and urged contestants to show sportsmanship.

    “We must work to retain government at all levels; we need to put all our personal interests aside for our party,” Salihu said.

    The News Agency of Nigeria (NAN) reports that former SGF, Babacir Lawan. who also attended the meeting however criticized the meeting for not discussing the issue of zoning ahead of the congresses.

    According to him, the APC constitution promotes zoning of positions particularly in diverse states like Adamawa and wonder why the issue was not discussed.

    …Vows to name verifiable corrupt officials in Buhari’s administration

    The Peoples Democratic Party (PDP) has described the list of alleged “looters” published by the federal government as a justification of the fact that the party is free of corruption.

    Recall that the Minister of Information, Alhaji Lai Mohammed had on Friday mentioned the PDP chairman, Uche Secondus, and five others as having benefitted from corruption of the immediate past Goodluck Jonathan administration.

    The PDP, however, dismissed the list in a statement issued by its National Publicity Secretary, Kola Ologbondiyan, on Friday in Abuja.

    It described the list as an extension of federal government’s media trial and challenged it to come up with names of its members against whom the government had secured convictions.

    Ologbondiyan stated that the list put forward by the federal government as purported looters amounts to a cheap blackmail, saying that none of those listed have been indicted or convicted by any court of competent jurisdiction or any panel of enquiry in the country.

    The PDP said the list only revealed that the All Progressives Congress (APC) and the presidency have no proof of corruption against the PDP.

    The party added that in its “frenzy and desperation”, the federal government even included names of individuals who were not standing trial or under investigation for any act of corruption, as well as people not even PDP members.

    The APC Federal Government has manifested its frenzy by going after matters that are in court and in which none of the persons have been convicted.”

    The party said the APC government did so to divert attention from the heavy looting involving its members.

    We are not in doubt that the individuals he has mentioned will take their legitimate stride and pursue appropriate action in the court.

    However, attacks on individuals, who are members of our party, does not in anyway detract from the fact that the PDP, as a political platform, is not a party of corruption.”

    Ologbondiyan added that it was unfortunate that the APC and its government under whose watch horrendous sleazes were happening on daily basis.

    He noted that the APC led government which had failed to fulfill the littlest of its campaign promises, could spend a wholesome three years searching for flimsy allegations to discredit PDP and its members.

    This is a government that is yet to account for $26 billion (N9 trillion) stolen through corrupt oil contracts in the NNPC, N1.1 trillion worth of crude diverted to service APC interests, N18 billion Internally Displaced Persons (IDP) intervention fund stolen by APC officials.

    This include the former Secretary to the Government of the Federation (SGF), Babachir Lawal, the N10 billion National Health Insurance Scheme (NHIS) for which members of the Buhari cabal were indicted.

    This includes the Mainagate, where the APC government recalled and reinstated an individual indicted for scam running into billions of naira.

    This is in addition to cover provided for serving ministers indicted for corrupt enrichment, among whom is a prominent former APC governor from the South South, who was indicted by his state for stealing billions of naira to fund President Buhari’s campaign in 2015.”

    He emphasised that the PDP was on a rebound, saying allegations by the APC could not stop it from challenging the federal government to fulfill its campaign promises.

    Earlier, the federal government through the information minister Lai Mohammed, had released a list of persons who allegedly looted Nigeria’s economy under PDP watch, describing the list as just a tip of the iceberg.
