    BREAKING: Court orders NIS to release ex-Rivers gov, Peter Odili’s passport within five days

    A Federal High Court in Abuja has ordered the Nigeria Immigration Service (NIS) and its Comptroller General, Idris Isah Jere to release the impounded international passports of a former governor of Rivers State, Peter Odili within five days.

    Justice Inyang Ekwo handed out the order as a condition for the hearing of an application, filed by the NIS and its Comptroller General, for a stay of the court’s October 18, 2021 judgment, ordering them to release Odili’s passport and offer him a written apology.

    Lawyer to the NIS and its Comptroller General, Ibrahim Etsu had told the court on Tuesday that his clients have filed an application seeking an order staying the execution of the judgment pending the determination of their appeal.

    After listening to Etsu, Justice Ekwo said he would hear the application on the condition that the applicants first release Odili’s passport and deposit it with the Deputy Chief Registrar of the court within five days.

    The judge then adjourned till January 13 for the hearing of the application.

    Odili had earlier this year, sued the NIS and its Comptroller General, accusing them of unlawfully impounding his passport.

    In a judgment on October 18, in the fundamental rights enforcement suit marked: FHC/ABJ/CS/965/2021, Justice Ekwo held among others, that the respondents (NIS and its Comptroller General breached Odili’s rights by impounding his passport without an order of court empowering them to so act.

    The judge proceeded to order the respondents to offer the applicant an apology in written form.

    In their notice of appeal filed on November 19 by their lawyer, Jimoh Adamu, the NIS and its Comptroller General want the Court of Appeal to set aside the October 18 judgment on the grounds that the judge erred in his interpretation of the law.

    They raised two grounds of appeal, the first being that the trial judge was in error in assuming jurisdiction over the case despite its glaring defects.

    Part of the defects, they argued, was that the applicant’s names on the suit were different from the names contained in the passport to which he was laying claim.

    “The failure to comply with the provision of Section 109 of the Immigration Act 2015 rob the court below of the jurisdiction to hear and adjudicate on the suit,” they added.

    On the second ground, the NIS and its Comptroller General argued that Justice Ekwo erred in law when he ordered them to “immediately release and return the applicant’s international passport, with number B50031305 to him, and to write an apology to the applicant for the embarrassment occasioned by the unlawful seizure of his international passport.”

    They argued that since Odili’s name as reflected on the court documents were different from the name on the passport, it was impossible for them to hand the said passport to him.

    “The respondent’s (Odili’s) names on record are different from the names on the international passport, accordingly the suit is incompetent.

    “The respondent cannot be issued with the international passport which is bearing a different name from the name on the record.

    “The appellants had lawful reason for the withdrawal and seizure of the respondent’s international passport. The appellants had justifiable reason to withdraw the respondent’s international passport,” NIS and its Comptroller General said.

    The International Passport Office in Ikeja, Lagos, has begun operations on Saturdays and Sundays to meet rising demand by applicants.

    Mrs Rose Bukar, its new Passport Control Officer, told the News Agency of Nigeria (NAN) in Lagos on Saturday that the extra duty was to speed-up service delivery to applicants.

    “We want to ensure that applicants spend lesser time in processing passports.

    We shall also continue to initiate measures that will enhance smooth and fast service to Nigerians,” she said.

    “This weekend, we witnessed an unexpected turn-up of applicants, but we paid special attention to the vulnerable one.

    “The Nigerian Immigration Service has introduced some special compassionate measures for the vulnerable, especially those with health challenges, the elderly, the heavily pregnant, and those living with disabilities.

    “In the last seven days, about 800 passports were produced.

    “I am optimistic that with more capturing devices, the queue will gradually diminish,” she said.

    On the backlog of passport applications, she said that the office was getting to “a state of equilibrium”.

    “The office has cleared passport applications up to those submitted in September.

    “But, I want Nigerians to understand that applying for a fresh passport requires a minimum of six weeks; those seeking to refresh will have to give us three weeks,” she said.

    Bukar implored Nigerians to always permit the service to carry out necessary investigation on the application anytime they came to apply.

    “The Nigerian Passport is the security architecture of the person holding it; there is no shortcut to these security checks. All Nigerians should take note of this,” she declared.

    Obi Cubana spends second day with EFCC, passport allegedly seized

    The Economic and Financial Crimes Commission has allegedly confiscated the passport of a popular club owner and businessman, Obinna Iyiegbu, aka Obi Cubana, who was detained on Monday for alleged money laundering and tax fraud.

    It was gathered that the seizure of his travel document was to stop him from leaving the country while under investigation.

    Checks revealed that the anti-graft agency questioned the Anambra-born social media influencer for the second day on Tuesday at its Abuja, Jabi headquarters.

    A source stated, “Obi Cubana has not been released, he is still having quality sessions with investigators over alleged money laundering running into millions of naira and tax fraud.

    “He will be released when he has satisfactorily responded to all questions relating to his involvement in various illegal deals. As part of investigation, his travel document has been temporarily seized pending the conclusion of investigations.”

    The EFCC spokesman, Wilson Uwujaren, who confirmed that the suspect is still in custody, however, said he has no information on the seizure of his passport.

    Justice Inyang Ekwo of the Federal High Court in Abuja, has ordered the Nigerian Immigration Service (NIS) to immediately release the international passport of the former governor of Rivers State Peter Odili.

    Delivering the Judgement on Monday, the ruling judge declared the seizure by the service as illegal, unconstitutional and an infringement of his fundamental rights.

    He further ordered the service, to tender an apology to the former governor, and restrained the NIS from harassing and intimidating him from leaving the country or moving freely within the country.

    Justice Ekwo added that the seizure of the former governor’s passport, was a punitive act and no citizen should be treated in such a manner, irrespective of status.

    The former governor had filed a suit against the immigration service challenging the seizure of his passport at the Nnamdi Azikiwe International Airport, Abuja on 20 June 2021, upon his arrival into the country.

    The service, however, told the court that it acted based on Mr Odili’s presence on a EFCC corruption watchlist.

    Leader of the Islamic Movement in Nigeria, Sheikh Ibrahim El-Zakzaky and his wife, Zeenat, have filed a suit at the Federal High Court Abuja, challenging the seizure of their international passports by the Department of State Services (DSS) and the Attorney General of the Federation, Abubakar Malami.

    In their separate suits filed by the Femi Falana Chambers on October 14, they told the court that their passports were last seen in the possession of the National Intelligence Agency (NIA), which has officially denied that it was in their possession.

    On attempting to renew their passports through the Immigration Service, it was revealed that the passports have been flagged by the DSS. They add that all requests to remove the restriction have been ignored by the secret agency.

    The duo asked the court to compel the DSS and the AGF to release their passports and lift the red flag restrictions.

    They are also asking the court to declare that the seizure of their passports since May 2019, as illegal and unconstitutional because it violates their fundamental rights to freedom of movement.

    They asked the court to mandate the defendants to pay the sum of N2 billion each, as general and exemplary damages, for the violation of their rights to freedom of movement.

    The reliefs sought include by the plaintiffs include:

    “A declaration that the seizure of the Applicants Passport No A50578740 since May 2019 is illegal and unconstitutional as it violates his fundamental right to freedom of movement guaranteed by Section 41 of the Constitution of the Federal Republic of Nigeria, 1999 (As Amended) and Article 12 of the African Charter on Human and Peoples Rights Act (CAP A9) Laws of the Federation of Nigeria, 2004.

    “A declaration that the Red Flag Travelling Restrictions placed on the Applicants Passport and land borders by the Respondents without a court order is illegal and unconstitutional as it violates his right to fair hearing guaranteed by Section 36 of the Constitution of the Federal Republic of Nigeria, 1999 (As Amended) and Article 7 of the African Charter on Human and Peoples Rights Act (CAP A9) Laws of the Federation of Nigeria, 2004.

    “A declaration that the refusal of the Respondents to allow the Applicant to travel abroad for medical treatment constitutes a threat to his life guaranteed by Section 33 of the Constitution of the Federal Republic of Nigeria, 1999 (As Amended) and Article 4 of the African Charter on Human and Peoples Rights Act (CAP A9) Laws of the Federation of Nigeria, 2004.

    “An order of this Honourable Court mandating the Respondents to release the Applicant’s international passport number A50578740 to him in order to enable him to access prompt and adequate medical attention as recommended by his physicians.

    “An order of this Honourable Court mandating the Respondents to lift the Red Flag Restrictions (and all or every form of restriction howsoever) placed on the International Passport number A50578740 of the Applicant by agents of the Respondents forthwith.

    “An order of this Honourable Court mandating the Respondents to pay over to the applicant the sum of Two Billion Naira (N2,000,000,000.00) as general and exemplary damages for the violation of the Applicant’s rights to freedom of movement, fair hearing and property.

    “An order of perpetual injunction restraining the Respondents from further violating the Applicants fundamental rights in any manner whatsoever and howsoever without lawful justification.”

    El-Zakzaky and his wife added that the seizure of their passports, and an absence of a court order, amounts to a threat to their lives since they have been denied the opportunity to seek urgent medical attention outside the country as recommended by their doctors.

    Passport racketeering: Immigration sends serious warning to offenders

    The Nigeria Immigration Service (NIS) has sent a serious warning to everyone involved in spoiling the image of the service, especially those involved in passport racketeering.

    TheNewsGuru.com (TNG) reports the NIS sent out this warning following a report by this medium on how officials of the service collude with officials of National Identity Management Commission (NIMC) to extort passport applicants.

    Mr Ibrahim Liman, the Passport Control Officer (PCO) at the office of NIS in Ikoyi, Lagos State, gave the warning, stressing that the service was inundated by a deluge of complaints regarding passport racketeering and cases of uncleared backlogs of passports among others.

    He vowed that his office would fish out and sanctioned offenders appropriately.

    Speaking during an interview on Sunday in Lagos, revealed that the NIS has extended its working days to include Saturdays and Sundays to meet the demands of its applicants.

    Liman, a Deputy Controller of Immigration (DCI), added that the office also had issued no less than 15,000 passports to qualified applicants since his assumption of office in June 2021.

    According to him, the office has extended its operational days to include Saturdays and Sundays in order to meet the demands of thousands of applicants who trooped in , into the office to obtain the documents

    He urged Nigerians to see beyond the fact that the passport is just a travelling document ,saying it should be seen as a security document that would help them in many ways.

    He stressed that his office was fully committed to efficient service delivery and it would not relent in justifying its operational mandate.

    Liman also warned those who were always indulging in passport racketeering to desist from the act or face severe consequences.

    The PCO emphasised that his department had been working unrelentingly to meet the demands of applicants and adhering to due process required in obtaining it.

    He explained that some challenges might hinder the timely release of some international passports to prospective applicants.

    He said that this would be due to the need for discreet investigation to be conducted by the department on such applicants to determine their elligibility.

    Liman , however, stressed that NIS would not hesitate to discipline anyone found to be involved in defrauding or shortchanging any applicants found to be engaging either in sharp practices or any illicit acts capable of spoiling the name of the department.

    He said that the Nigeria Immigration Service would continue to remain one of the best passport issuers globally.

    “The service has recently introduced additional sophiscticated measures toward checking attitudes inimical to the conduct of its official duties, especially, issues to do with corruption” he added.

    He appealed to applicants to always endeavour to visit the NIS Servicom department in all passport offices to make enquiries.

    “NIS has reiterated that all qualified prospective seekers of the travel document should apply online,” he added.

    He lamented that some applicants used to be impatient and were always in a hurry to push their ways to get the document in few hours and finally get things messed up.

    “Can this be done in advanced countries?

    “I specially appeal to prospective applicants to visit : immigration.gov.ng, which serves as the service website to apply and make payments for their passports” he added.

    Former Governor of Rivers State, Dr Peter Odili, has dragged the Nigeria Immigration Service, before a Federal High Court in Abuja, challenging the seizure of his passport at the Nnamdi Azikiwe International Airport, Abuja.

    In the fundamental rights enforcement suit on Wednesday, he claimed that the international passport was seized from him on June 20, by operatives of the service and has been withheld since then.

    Odili prayed the presiding judge, Justice Ahmed Mohammed, to compel the service to release the passport and order a perpetual injunction against the respondents, from harassing him any further and interfering with his fundamental rights of movement.

    However, the immigration service revealed that the former governor’s passport was seized because he was on the watchlist of the Economic and Financial Crimes Commission.

    The affidavit by the service also indicated that Mr Odili had never cared to know why his passport was seized, or demand its release.

    Justice Mohammed subsequently fixed September 28, 2021 for hearing.

    The Nigeria Immigration Service (NIS) has announced the reopening of its passport application and payment portal.

    This is contained in a statement by NIS Spokesman, Mr Amos Okpu, in Abuja on Tuesday.

    The Comptroller-General of the service, Mr Muhammad Babandede, said the portal became effective from 12 midnight on Tuesday.

    Babandede said the portal would allow eligible applicants to apply and make payments for the various categories of passports of their choice.

    The passport portal was closed on May 17, following a directive by the Minister of Interior, Rauf Aregbesola.

    The minister had directed the closure of the portal to enable the service to clear the backlog of applications in issuing centres across the country in the past few months.

    Babandede further explained that with the reopening of the portal, a new passport application and payment regime had begun.

    He said: “Applications and payments for passport services shall be made through the service website, www.immigration.gov.ng.

    “Applicants are expected to visit the portal to apply and upload their support documents for vetting and processing.

    “A chat room facility to guide applicants through the application and payment process has been provided on the portal.

    “Upon successful applications, applicants shall make their online booking interview/enrollment appointment on any day, time and location they consider convenient.

    “The new timeline for passport production and issuance after a successful enrollment at the selected issuing centre shall be six weeks for fresh applications and three weeks for re-issue (renewal applications).”

    According to him, no applicant who has yet to make online application and payment shall be allowed into any of the issuing centres for passport processing.

    The comptroller-general added that pplicants would be contacted through the email addresses and phone numbers they provided during application when their passports were ready.

    He, however, cautioned Nigerians to avoid patronising touts as the entire process had been made seamless for effective and efficient service delivery.

    Babandede warned passport racketeers to desist from acts capable of undermining the NIS reform efforts to avoid very strict sanctions.

    The Comptroller-General, Nigeria Immigration Service (NIS), Mr Muhammad Babandede, has extended the commencement of the new Passport regime earlier scheduled for June 1 by one week.

    Spokesperson for the agency, Mr Amos Okpu, made this known in a statement in Abuja on Tuesday.

    The service had announced the suspension of receiving and processing of all fresh passport applications nationwide until June 1.

    The suspension was to allow for clearance of backlog of all passport applications received before May 17, as all backlogs were expected to be cleared by May 31.

    “Babandede wishes to inform the public, especially Passport applicants that the Service had made significant progress in the clearance exercise of backlog of Passport applications.

    “So far, a total number of 230,500 applications have been cleared and the Passports produced. Out of the number, a total of 43,350 are yet to be collected.

    “Passport Control Officers have been directed to continue to send out short message notifications for collection to all applicants,” Okpu added.

    The Immigration boss further directed that details of all Passports that were yet to be collected be uploaded on the service website www.immigration.gov.ng for the attention of the public.

    “The extension is to clear up all backlog of Passport applications across Issuing Centres.

    “A huge number of applicants are already turning up to collect their Passports across Issuing Centres and this is causing some forms of congestion.

    “ This situation will not allow the Service to accommodate new applications especially considering our desire to ensure that people who come to our offices comply with all the COVID-19 Protocols.

    “This period shall be used to attend to applicants for collection, clear all the remaining backlogs as well as improve systems automation for the takeoff of the new Passport regime which will commenced by June 8,” he said.

    Babandede assured the public of full commitment to improve service delivery to all Passport applicants and others.

    The Comptroller-General, Nigeria Immigration Service (NIS), Mr Muhammad Babandede, says the service has increased its production capacity to beat the May 31 deadline set to clear backlog of passport applications.

    Babandede announced this while briefing newsmen on the NIS passport reforms and recruitment exercise on Thursday in Abuja.

    He said that the passport production centres across the country were working round the clock to clear the backlogs before the commencement of the new passport regime on June 1.

    NIS boss also gave assurance that the service had enough booklet, adding that a total of 23,903 passports were currently awaiting collection by the applicants.

    According to him, more than 35,000 passports had been produced in the last few days, with about 22,840 collected, 23,903 not collected and 28 damaged.

    He, however, urged all applicants to be on alert as text messages were being sent to their registered phone numbers, adding that those that had turned off their Do not Disturb button on their phones to reactivate.

    Babandede assured applicants that the more than 100,000 pending applications would be attended to before the deadline of May 31.

    “The major challenge we have now is not booklet but production capacity and we have added two production lines to Ikoyi and Ibadan centres,” he said.

    He also said that all passport collection centres would be opened from 6:00 a.m. to 6:00 p.m. daily for applicants.

    He warned that the any officer involved in passports racketeering would be dealt with going forward, adding that the erring officers were partly responsible for the uncollected passports.

    On recruitment, NIS boss said that the current recruitment exercise was the best ever in immigration and assured all applicants of transparency and fairness.

    He said that the exercise was being carried out in the six geopolitical zones of the country to take 4,000 applicants out of 6,005 applicants invited.

    He added that the service had been fair by ensuring federal character principle.
