Hushpuppi: Court throws out group’s petition to stop police, AGF from arresting, extraditing suspended DCP Abba Kyari

A Federal High Court in Abuja on Thursday evening refused to grant an ex-parte application seeking to restrain the Nigeria Police and the Attorney General of the Federation (AGF) from arresting and extraditing suspended Deputy Commissioner of Police Abba Kyari.

Justice Ahmed Ramat Mohammed rejected the application filed by the Incorporated Trustees of Northern Peace Foundation.

The Foundation, through its team of lawyers led by Dr Olukayode Ajulo, had argued an ex-parte application before the judge praying him to grant the temporary order of injunction against the two defendants pending the hearing and final determination of the substantive suit.

The ex-parte application dated August 9 was accomplished with a 21 paragraph affidavit of urgency.

However, after carefully listening to the lawyer, Justice Mohammed refused to grant the request to stop Abba Kyari’s arrest and extradition through ex-parte means.

Rather, Justice Mohammed ordered the counsel to turn the ex-parte motion to motion on notice and serve same on the police and AGF.

The judge also directed the applicant to serve all court processes in respect of the case on the two respondents.

He subsequently fixed September 9 for mention of the case.

DCP Abba Kyari was allegedly indicted by the Federal Bureau of Investigation FBI in an alleged multi-million naira advanced fee fraud said to have been perpetrated by a Nigerian citizen, Ramon Olorunwa Abbass popularly known as Hushpuppi.

  • Nigerians sign petition against release of Baba Ijesha

Nigerians sign petition against release of Baba Ijesha

Some Nigerians have expressed displeasure over the purported release of embattled actor, Olanrewaju James a.k.a Baba Ijesha.

TheNewsGuru reports that about 1,200 Nigerians have signed the petition making rounds on social media to forestall his release after allegedly defiling a minor. The aim is for the signees to reach 1,500.

Baba Ijesha, was arrested last week, after he was reported by the teenager’s foster mother, popular comedienne, Princess that he molested the girl when she was seven years old.

When the actor was apprehended last Tuesday, the Police Public Relations Officer in the state, Muyiwa Adejobi, said there was considerable evidence against the actor as he was caught in the act on Closed Circuit Television.

Amazingly, in a twist of events, a senior police officer said that the actor may be released on Friday. The source said due to the ongoing strike by members of the Judicial Staff Union of Nigeria, courts had ceased from sitting and the suspect could not be detained indefinitely without trial.

The petition drafted by the Aunt Landa’s Bethel Foundation, on behalf of the teenager’s foster mother, Princess, has urged 1,500 Nigerians to sign against the release of the Yoruba actor, Baba Ijesha.

Dr Yolanda N George-David, who signed the petition, said it is embarrassing to know the Nigeria Police Force are trying to grant the actor bail.

“We seek full justice for the young child. It is embarrassing to know Nigeria Police Force are trying to grant Olanrewaju James Omiyinka bail today at Panti Police station, Lagos state, Nigeria.

“I want to remind the Nigeria Police Force that Section 218 of the Criminal Code Act provides that any person who has unlawful carnal knowledge of a girl under the age of thirteen is guilty of a felony and is liable to imprisonment for life with or without caning. This law should be excise and thorough investigation is required with evidence already been submitted by the child guidance,” she wrote.

  • Reps accept petition by Diaspora Tiv indigenes, earlier rejected by Gbajabiamila’s Deputy

Reps accept petition by Diaspora Tiv indigenes, earlier rejected by Gbajabiamila’s Deputy

A petition by a group of Tiv indigenes from Benue State in the diaspora which generated controversy last week has been accepted by the House of Representatives.

The lawmakers received the petition during Tuesday’s plenary at the lower chamber of the National Assembly in Abuja, the nation’s capital.

It was filed by a group – Mzough U Tiv Amerika (MUTA) on the insecurity in Benue, Nasarawa, and Taraba States.

A member of the House representing Gwer East/ Gwer West Constituency of Benue, Mark Gbillah, presented the petition at the plenary presided by the Speaker of the House, Femi Gbajabiamila.

He explained that he was submitting the petition on behalf of the group because Tiv indigenes of the affected states had been sacked from their ancestral lands.

“Without misunderstanding, please go ahead and lay your petition and it will be given proper and due attention,” Gbajabiamila told the lawmaker before he presented the petition.

TheNewsGuru.com, TNG reports that Gbillah brought the petition back to the house about two weeks after the move was rejected by the Deputy Speaker of the House, Idris Wase.

Wase, who presided over the plenary held on March 11 in the absence of the speaker, had declared that Nigerians in the diaspora have no right to send petitions to the House on issues happening in Nigeria.

He has, however, denied his action despite compelling video evidence.

Meanwhile, the lawmakers had since tendered apology for rejecting the petition.

The recent attack on Benue State Governor, Samuel Ortom, at his farm also formed part of issues deliberated during Tuesday’s plenary.

Condemning the incident, the lawmakers described the attack on the governor as an indication of anarchy and full-scale lawlessness in the country.

They, however, commended President Muhammadu Buhari for promptly ordering an investigation into the incident and asked the security agencies to ensure that those involved were brought to justice, to serve as a deterrent to others.

House of Reps tenders apology for rejecting Tiv’s petition

The House of Representatives has tendered an apology for rejecting a petition by a Tiv group on the floor of the House on March 10.

Rep. Tolulope Akande-Sadipe (APC-Oluyole), the Chairperson of the Reps Committee on Diaspora tendered the apology on Wednesday.

She assured that it was working on the petition by the Tiv group against the Federal Government over alleged injustice.

In a statement, media aide to Akande-Sadipe, Mr Olusada Olamilekan stated that the committee had begun investigation on the content of the petition.

“Your numerous petitions and messages have been well received by me and compiled.

“The petition is being investigated by the leadership of the House and Diaspora Committee.

“This issue is of utmost importance to the House and it will be resolved in a matter of days,” she said.

She apologised for alleged rejection of the group’s petition on the floor of the House on March 10.

Earlier, even though there is video evidence, the Deputy Speaker of the House of Representatives, Rep. Ahmed Wase had denied rejecting the petition.

Rather, he defended his refusal to allow Rep. Mark Gbillah to submit the petition by the Mutual Union of Tiv in America (MUTA).

In a statement on Monday, Wase said his refusal was based on legal identity and on the locus of the petitioner and not on whether Nigerians in diaspora have a right to petition the House or not.

In the petition, MUTA had raised concerns over the plight of the Tiv people whose ancestral lands had been taken over by killer herdsmen and have been in Internally Displaced Persons (IDP) camps for years.

But the deputy speaker insisted that the petitioners must follow laid down rules and procedures in presenting the petition to the House.

“As a rule, every petition must be presented by a sponsor on behalf of an identifiable petitioner who can either be an individual/groups of individuals or registered corporate entity.

“In the current incident, the sponsor of the petition read the petitioners as ‘Association of Tivs Resident in the United States.

“For any experienced parliamentarian, this very coinage raises a lot of technical questions; are the petitioners represented here in Nigeria via a Nigerian Office or a Legal Practitioner or are they totally absent from the scene?

“Are they registered as an Association with the Corporate Affairs Commission? If they are absent and a hearing were to be organized, who would the members of the Committee on Public Petition be addressing, questioning or interrogating?

“Would the petitioners be able to give first hand witness testimony as to the issues raised in their petition? These and other technical complications were what I tried to interrogate, to which sufficient answers were not provided thus stalling the presentation of the petition,” he said.

Wase said that he did nothing but brought to bear his experience in guiding the sponsor of the petition on the proper procedure to adopt in presenting the said petition.

The deputy speaker explained that the House has over the years entertained petitions from Nigerians in diaspora.

“However, those petitions were properly presented before the House without any ambiguity as to the identity of the petitioners or as to their locus and availability to speak to the issues raised in such petitions,” he said.

The deputy speaker reiterated the commitment of the 9th House of Representatives to promote freedom of speech and associations.

According to him, the House will continue to provide platforms for all Nigerians, irrespective of their religion, tribe, or residence.

Wase noted that media report of the matter had been doctored, slanted and bent to give political and ethnic coloration to an event that was otherwise strictly based on Rules of Parliamentary Procedures.

“The House of Representatives belongs to all Nigerians and can be accessed by all Nigerians wherever they may reside,” Wase said in the statement.

  • FG petitions CNN, threatens legal action over #EndSARS report

FG petitions CNN, threatens legal action over #EndSARS report

In the petition addressed to Mr. Jonathan Hawkins VP, Communications, CNN Centre Atlanta, Georgia U.S, the government said if the international media organisation failed to carry out its demand, it will “take any action within its laws’’ to prevent CNN from aggravating the #EndSARS crisis.

The petition dated Nov. 23 and personally signed by the Minister of Information and Culture, Alhaji Lai Mohammed was made available to the News Agency of Nigeria in Abuja.

The CNN in the “investigative’’ report had alleged that it ”uncovered that Nigerian security forces opened fire on unarmed protesters” at the Lekki Toll Gate in Lagos, during the #EndSARS protest.

The report entitled ‘How a Bloody Night of Bullets Quashed a Young Protest Movement’ was aired on Nov. 18 by the international news organisation.

“We write to put on record that the report did not just fall short of journalistic standards; it reinforces the disinformation that is going around on the issue.

“It is blatantly irresponsible and it is a poor piece of journalistic work by a reputable international news
    organization.

“In the first instance, the report did not live up to the most basic of the core principles of journalism – balance and fairness,’’ the minister wrote in the petition.

Mohammed said the CNN failed to exhibit the journalism ethic of balance and fairness in the report but slanted the story to favour the reporter’s desired conclusion.

“Rushing to air such a momentous story without presenting the government’s side is inexcusable and indefensible.

“CNN said it contacted over 100 protesters and family members, but did not speak to one official of Nigeria’s federal government.

“While CNN said there was no response from the army and that officials of Lagos State would not speak in view of the Judicial Panel that is investigating the matter, it did not say what effort it made to speak with any official of the federal government.

“The truth is that CNN did not even attempt to reach the federal government.

“Nima Elbagir, who presented the report and most probably led the investigation, is conversant with the Minister of Information and Culture, who is also the Spokesman for the Federal Government of Nigeria, yet did not say that she even tried to reach the Minister.

“It is therefore strange, to say the least, that she would rush to air such an important ‘investigation’ report without getting the government’s side,’’ he said.

The minister said the CNN was not present at the Lekki Toll Gate on the night of the incident but relied heavily on unverified footages it harvested from social media.

“Unlike CNN, a reporter from the British Broadcasting Corporation (BBC) Pidgin Service, Damilola Banjo, was at the Lekki Toll Gate on the night in question.

“She was quoted as saying soldiers shot sporadically into the air and not at the protesters – a direct contradiction of the position taken by CNN who relied on second and third-hand information,’’ he said.

The minister contended that while CNN obtained footage showing when the vehicles carrying soldiers left their barracks and arrived at the Lekki Toll Gate, it could not obtain any footage showing the bodies of those supposedly killed in the ‘massacre’.

He said the government was baffled by the CNN position that it stood by its story and ”our reporting was carefully and meticulously researched” despite all evidence to the contrary.

Mohammed said DJ Switch; one of CNN’s star eyewitnesses in its ‘investigative’ reporting is not credible because her story on the Lekki Toll Gate shooting has changed several times.

“From claiming she counted 78 bodies of protesters who were supposedly killed by soldiers on the night of the Lekki Toll Gate incident, she has twice, at least, changed the casualty figure from 78 to 15 and then to 7, without a shred of evidence.

“In one of social media videos of DJ Switch that was used by CNN (see attached link 1), the lady (DJ Switch) claimed she and some unnamed persons carried dead bodies and dropped them at the feet of the soldiers.

“She also claimed she spoke to their Commander before the soldiers threw the bodies into the vans.

“Curiously, for someone who was streaming live on Instagram during the Lekki Toll Gate incident, there was not a single video or picture of the dead bodies.

“CNN cannot pretend not to know that for anyone to act as a witness, his or her credibility must be unimpeachable.

The minister also faulted another CNN star witness, Godson (Uyi), whose video was also used by the network.

Mohammed said it was shocking that all through its ‘investigation’, CNN did not for once mention the fact that six soldiers and 37 policemen were killed during the #EndSARS crisis, which also left 196 policemen
    injured.

He added that with the monumental destruction of government and private properties across the country, thenetwork is fixated on the massacre that never happened.

The minister said it was not the first time that CNN had carried an inaccurate or hoax story about Nigeria.

“In February 2007, Nigeria accused CNN of staging one of its reports from the country’s Niger Delta region, showing gunmen holding 24 Filipinos hostage.

“Of course, CNN and its then Africa Correspondent Jeff Koinange flatly denied the charge, saying the network did not pay for any part of the report.

“Later, in an email reportedly sent to a friend, Mr. Koinange was quoted as saying: “Of course we had to pay certain people to get the story… You do not get such a story without bribing.” So much for denials!

It would be recalled that the Minister at a media briefing on Nov 19, 2020 (NAN) called for sanction against CNN over its report on the hoax Lekki Toll Gate killings.

  • Petition seeking to ban El-Rufai from EU, UK garners 7,000 signatures in 24 hours

Petition seeking to ban El-Rufai from EU, UK garners 7,000 signatures in 24 hours

A petition seeking to ban Kaduna State Governor, Nasir El-Rufai from entering the United Kingdom and European Union (EU) nations has gathered over 7,000 signatures in 24 hours of setting up.

This is coming after reports that the governor was among those on the list of Nigerian politicians banned by the United States from entering its territory.

The petition, which was initiated by a former Presidential aide, Reno Omokri, on Tuesday, was addressed to the UK Parliament, the UK Prime Minister, Boris Johnson; Council of the European Union and the European Parliament.

Checks on Change.Org showed that the petition had hit 7,000 as of 11.15 am on Wednesday.

Omokri, who initiated the petition, accused El-Rufai of being a threat to the peace and security of Nigeria for many reasons.

He noted that on December 3, 2016, the governor admitted that he paid herdsmen who had been accused of killing several persons.

“Since that admission, there has been an intense escalation of the killings of mostly Christians in Kaduna, and on August 25, 2020, suspected herdsmen abducted seven schoolchildren and their teacher from Prince Academy, in Kaduna. They have not been seen or heard of since then,” Omokri said.

Omokri, who was a social media aide to former President Goodluck Jonathan, said el-Rufai on January 27, 2013, insulted Jesus Christ on Twitter

The petition further read, “On February 6, 2019, he threatened foreign observers, including observers from the EU and UK with death, warning that they would return in body bags should they intervene in Nigeria.

“On July 15, 2012, Nasir El-Rufai said, and I quote ‘We will write this for all to read. Anyone, soldier or not that kills the Fulani takes a loan repayable one day no matter how long it takes.’ This threat has been carried out in Southern Kaduna where there is an ongoing genocide of Christians under el-Rufai’s watch.”

Omokri said on August 23, 2019, the governor charged the Anglican Bishop of Zaria province of Kaduna, Abiodun Ogunyemi, for defamation.

“On April 24, 2019, another of his sons, Bashir el-Rufai, described the pogrom against Igbos as sweet.

“It is for this reason that Nigerian citizens call on the government of the United Kingdom and the European Union Presidency to follow the lead of the United States and place a visa ban on Nasir El-Rufai, who is scheming to become Nigeria’s President, to prevent a Rwandan style genocide in Nigeria,” he said.

Meanwhile, the Kaduna State Government is yet to respond to the latest development.

Alleged money laundering: Over 7,000 Nigerians sign petition, demand EFCC investigate Tinubu’s bullion van saga

Over ten thousand Nigerians have signed a petition calling for the Economic and Financial Crimes Commission (EFCC) to investigate Bola Tinubu for contravening the Money Laundering (Prohibition) Act of 2011, by having bullion vans ferry alleged large sums of money into his house on the eve of the 2019 Presidential election.

The petition which was opened on change.org by Reno Omokri, a former aide of President Goodluck Jonathan has attracted over 7,360 signatures as at the time TheNewsGuru (TNG) filed this report.

The brief of the petition reads: “Dear citizens of Nigeria, Let’s take our country back by signing this petition to compel the EFCC to investigate and prosecute Bola Tinubu for contravening the Money Laundering Act, by ferrying bullion vans into his house.

“Don’t say ‘na today’, or ‘leave matter’. We as Nigerians must stop confusing cynicism for wisdom. If we do not fight for our country, who will? George Floyd’s death sparked a revolution in America and we joined.

“We did not say ‘na today’, or ‘leave matter’. You and I can make a difference with this petition.#EFCCMustInvestigateTinubu”

Recall EFCC had received a similar petition asking it to investigate Tinubu, on the aforesaid money laundering allegation.

In October 2019, the foremost petition against Tinubu on the ‘bullion van’ saga was written by Concerned Nigerians. The petition was submitted and acknowledged at the reception desk of the Executive Chairman’s office.

In the wake of criticism that trailed the issue at the said time, the ousted Chairman of the EFCC, Ibrahim Magu, had earlier assured Nigerians the Commission would investigate Tinubu anytime it receives a petition to do so but he (Magu) never attended to the case after receiving the petition raised by Concerned Nigerians.
