    FG to stop PoS operators from increasing service charge

    The Federal Government through the Federal Competition and Consumer Protection Commission (FCPCC) is set to issue an order to stop Point of Sale agents and operators from increasing service charges across the country.

    This was made known to pressmen by the Executive Vice Chairman/Chief Executive Officer, Babatunde Irukera on Wednesday.

    According to him, the order would be issued in a couple of hours.

    He noted that following its first advisory to the Association of Mobile Money and Bank Agents in Nigeria, which was ignored, it is now ready for more definite enforcement.

    “What we did initially was to issue an advisory, which is part of the process — engagement. After which we would employ other tools of engagement. Other tools of enforcement involve issuing an order. If you hold on a little, you will see it. What we did initially was not an order, but very soon an order is coming.

    “It will get to you in a matter of hours. An order is forthcoming and will be directed specifically at the association and the agents. Now, when there is a subsisting order, the violation of the order is what would precipitate enforcement.”

    Earlier in July, the FCCPC announced that it was investigating price fixing attempts by Point of Sales agents and will sanction them if they are found guilty. It asked AMMBAN to desist from attempts to fix PoS prices.

    Recall that PoS agents under the aegis of the Association of Mobile Money and Bank Agents in Nigeria, announced increments in the prices of their transaction charges.
    The increment in service charge was meant to start on July 17, 2023 but many PoS operators are still operating using the old charges.

    Gov. Babajide Sanwo-Olu of Lagos State has expressed displeasure over the extortive practices by Point of Sale (PoS) operators, as well as petrol station attendants.

    Sanwo-Olu said this while addressing newsmen on the current situation caused by the Naira redesign in the country, on Saturday at the Lagos House, Marina.

    He said that due to the situation, the operators had become extortive.

    Sanwo-Olu appealed to those involved in such behaviour to desist from such sharp practices.

    ”We have noticed with dismay the rampant incidents surrounding some of the players in the financial services value chain (PoS agents/operators); as well as petrol station attendants.

    ”They have taken the current challenges to mean an opportunity to extort hard-working and law-abiding Lagosians with extortionate service charges on funds withdrawal and sale of PMS.

    ”It is especially in difficult times like these that we all need to be our brothers’ and sisters’ keeper and do everything we can to contribute to lessening the hardships faced by our fellow Lagosians.

    ”This is not the period to sacrifice empathy, compassion, and humanity on the altar of profit making,” the governor said.

    He urged Lagos residents to resist the opportunists who sought to take advantage of the anger and frustration that were being felt to hijack the situation and foment trouble.

    Paul Okoye, a member of the previously defunct music group, P-Square has taken to social media to lament about the Naira scarcity, after the purchase of 40k with 70k.

    The Naira scarcity has been plaguing Nigerians for a couple of weeks now, following the introduction of the new notes.

    Taking to his Instagram story, Paul Okoye expressed his shock, as he disclosed that he bought Naira today because he needed to pay for a visa fee and it needed to pay in cash.

    As stated by Rude Boy, he bought N40k with N70k in order to make payments. The father of 3 expressed his displeasure, as he noted that the country keeps breaking new records.

    He wrote: “Omoh!!! I buy money today!! Just because I have to pay for a certain visa fee in an embassy, and it has to be paid in cash. Jokes apart I bought 40k with 70k Aahhhh!!!!!!! Naija breaking new record.”

    TheNewsGuru.com (TNG) reports that it is tough getting money from Automated Teller Machines (ATMs) of banks as well as Point of Sales (PoS), hence the Naira scarcity.

    Buyers and sellers, especially in informal markets, were stranded as some of them were still finding it difficult to agree on cash transfers.

    Currently, many banks do not attend to desperate customers over the counter. On the other hand, PoS terminals that are a critical part of the payment system do not have the new naira notes to give customers.

    Many of the operators said they had to use the “black market” to get both the old and new notes from “unexpected quarters”, hence their resolve to charge a lot of money from people who were willing to withdraw cash.

    Some POS operators, as at February 16, 2023 collected as much as N1,000 to release N5, 000. The total number of POS machines deployed by merchants and individuals across Nigeria hit 1.6 million in November 2022, according to the data released by the Nigeria Inter-Bank Settlement System (NIBSS).

    There are approximately 17 automated teller machines, 147 point-of-sale devices and four bank branches for every 100,000 Nigerians, according to a new report by McKinsey.

    However, most of these facilities, which were meant to facilitate a gradual transition to a cashless economy in Nigeria were somehow strangulated to the extent that they could not offer the needed services.

    According to some bankers, they had been directed and were being closely monitored, to ensure that no old naira note that got to the bank goes out again.

    They also lamented that they were yet to get an adequate supply of the new naira notes to meet up with the increasing demands of their customers.

    The Central Bank of Nigeria (CBN) said over N3 trillion was in circulation but had mopped up over N1.9 trillion so far.

    CASH SWAP: CBN stops Abuja, Lagos PoS operators

    The Central Bank of Nigeria, CBN, has stopped mobile money/Point of Sales agents in Abuja and Lagos from its newly launched cash swap programme.

    The development came as the January 31 deadline for the phasing out of the old N1,000, N500 and N200 notes approaches.

    In a Frequently Asked Questions document released to selected agents and obtained by our correspondent on Monday, the CBN provided some guidelines for the cash swap programme.

    According to the document, only five banks have been approved to engage in the programme. They are: Access Bank Plc, Zenith Bank Plc, United Bank for Africa Plc, First Bank of Nigeria Limited, and First City Monument Bank.

    It read in part, “Not all agents can participate. This is open to only selected agents profiled by the super agent/MMO/bank and submitted to the Central Bank of Nigeria and participating banks (Access, Zenith, UBA, First, FCMB).”

    On the number of states selected for the programme, it read, “Selected agents in all the 36 states (except Lagos state and FCT, Abuja). Lagos and Abuja agents are excluded from this.”

    The PUNCH also learnt that the agents are restricted from using the new notes for their regular transactions, only for the programme.

    On where the agents can get the new notes, the document added, “from one of these designated banks (Zenith, First Bank, Access, UBA, FCMB). However, you must have a bank account with that bank and your operators (super agent/MMO/bank) will have pre-registered you with the bank where you have an account.”

    It added, “you must go to the bank you have informed operator (super agent/MMO/bank) of. That is where your agent details will be submitted to for verification when you get there to collect the new notes.”

    Also, each agent’s name, BVN number, and operator’s name are required before the new notes will be released.

    The document added that the bank would also verify the agent’s picture and finger print.

    The document also noted that an agent is expected to have a record of the customer’s Know-Your-Customer information, which includes name, phone number, bank, account number and amount.

    It was also noted that while there is no restriction on how much a customer can deposit, only N10,000 can be released per customer under the cash swap programme.

    The CBN also urged the agents to open a bank account or wallet for customers with bank accounts.

    TheNewsGuru.com (TNG) reports that an agent can only get up to N500,000 new notes weekly for the programme.

    Also, each agent is expected to record all transactions performed with the new notes and submit the record to the operator (super agent/MMO/bank).

    Regarding what happens if an agent uses the new notes for other purposes other than the new naira initiative, the document noted, “There will be severe sanctions such as de-listing as an agent, withhold of any applicable benefit, de-list from future programmes, negative report to bank & CBN and other such penalties as directed by regulatory authorities.”

    In a memo by Moniepoint to their agents, agents were asked to collect BVN, NIN, or voter’s card details from customers paid new notes.

    The memo read in part, “The Swap should be in the form of PoS withdrawals only of not more than N10,000 per person. Any withdrawal more than N10,000 per person should not be paid with new notes.

    “Agents are also permitted to charge cash-out fees for the cash swap transactions but prohibited from charging any further commissions to customers for this service.

    “You are to collect BVN, NIN or votes card details from customers paid with new notes for weekly submissions to the CBN.

    “The CBN will continue to monitor implementation of the programme and provide further guidance as may be necessary.”

    The National President, Association of Mobile Money and Bank Agents in Nigeria, Mr Victor Olojo, said a proposed meeting with the CBN did not hold.

    He further noted that the agents were still actively involved in the process and a framework had been provided to guide the programme.

    The CBN when announcing the cash swap programme which began on Monday, noted that the initiative was aimed at enabling citizens in rural areas or those with limited access to formal financial services to exchange old naira notes for the redesigned notes. To promote financial inclusion, the CBN said the service was also available to anybody without a bank account.

    It said agents might, on request, instantly open a wallet or account, leveraging the CBN tiered know your customer framework. This, according to the bank, will ensure that this category of the populace (unbanked citizens) is able to exchange or deposit their cash seamlessly without taking unnecessary risks or incurring undue costs.

    The CBN also directed agents to sensitise customers to opening wallets/bank accounts and the various channels for conducting electronic transactions.

    The police in Lagos State on Sunday said that a mob carried out jungle justice on two men, who allegedly robbed a POS attendant at the Igando area of the State.

    The command’s Spokesperson, SP Benjamin Hundeyin, confirmed the incident in his verified Twitter handle on Sunday.

    Hundeyin said the incident happened on Independence Day, stressing that the mob set the victims ablaze and burnt them  beyond recognition.

    ”Police arrived at the scene but the mob had fled. Investigation has commenced,” he said.

    The image maker, however, frowned at the action of the mob, wondering how to put a stop to the archaic and criminal practice.

    Hundeyin said jungle justice was a criminal case in Nigeria, calling on members of the public to stop the crime.

    He said rather, they should hand over the suspect to the police for prosecution.

    Meanwhile, the spokesperson has commended crime reporters for doing fantastic job in reporting the arrest of criminals in Lagos state.

    He, however, urged judiciary correspondents to do more, to update Nigerians on the progress of prosecution of criminal cases in various courts in Lagos.

    “This would halt the fallacy that, Police were collecting money and releasing suspects,” he said.

    POS transactions records 29.3% growth, hit N4.6 trillion in 7 months

    The value of cashless transactions made via Point of Sales, POS in Nigeria recorded a huge leap from January to July 2022 as the figures hit N4.6 trillion.

    According to data from the Nigeria Inter-Bank Settlement System (NIBSS), the figure, when compared to N3.56 trillion recorded in the corresponding period of 2021, represents a 29.3% increase and when compared to the value of POS transactions in 2020 represents a 90.3% increase.

    Also, the volume of transactions rose by 25% year-on-year from N543.7 million to N679.8 million in the same period.

    This increment confirms the gradual acceptance of cashless transactions within the Nigerian commercial sphere.

    POS transactions have been selected as the mode of transferring and sometimes, receiving cash within the last five years as Nigerians have differed in the mode of transaction due to the convenience it offers compared to the time they would have spent in the bank.

    POS usage as a means of financial transactions peaked during the COVID-19 lockdown in 2020 when major financial institutions had completely shut down their services.

    Within the period, data from NIBSS revealed that over 380 million PoS payment platforms were registered in Nigeria, which translated to a total transaction value of N2.8 trillion.

    The locations noted to have the highest share of the PoS transactions were the Federal Capital Territory (FCT), Lagos, Rivers, Oyo and Delta states.

    Apart from making withdrawals, PoS has also served as a means of sending cash as the process has become the closest means to accessing banking products as most customers in rural areas with no access to banking facilities have found the use of the service convenient.

    It has also served as a means of employment as most youths have engaged themselves in the business due to its profitability and very low running costs.

    EFCC arrests man who uses 41 ATM cards, POS for chargeback

    The Economic and Financial Crimes Commission (EFCC) has arrested a 27-year-old suspect who uses 41 automated teller machine (ATM) cards and  a point of sale (POS) machine for chargeback.

    TheNewsGuru.com (TNG) reports chargeback is a credit card charge that is disputed by a customer and is reversed.

    After a chargeback the customer has paid nothing and the seller has received nothing.

    Fraudsters employ it to withdraw money and afterwards call the bank to dispute the transaction and ask for a reversal, when they actually received the money.

    According to the EFCC, the suspect, Nwamannah Chuks Ifeanyi, who is an indigene of Ogba/Egbema/Ndoni Local Government Area of Rivers State, has confessed to the crime.

    He was picked up on Wednesday, June 29, 2022, at the Fruits Market, Wuse Zone II, Abuja, following an intelligence report.

    At the point of arrest, 41 ATM cards of different banks, bearing various names, were found in his possession.

    Other items recovered from him are a Toyota Venza car with Registration Number KUJ -300 MK, one PoS Machine, two Apple Laptop computers, six iPhones, one Nokia torchlight, one Apple wrist watch and one Driver’s license.

    The Benue State University graduate of Political Science and agent to a soccer betting company, claims he uses the ATM cards for Chargeback.

    In a similar development, operatives of the EFCC arrested 18 suspected internet fraudsters in Abuja on July 4, 2022.

    The suspects are: ThankGod Oche, Joshua Olohja, Adamu Abdulkadir,   David Bruno Bidemi, Emmanuel Avoh, Micheal Oche, Francis Abbah, Kayode Itodo, Shedrack Chibuike, Okeowo Elijah.

    Others are: Victor Emmanuel, Emmanuel Edache, Abah Joseph Theophilus, Sunday Agidani, Elijah Adamu, Emmanuel Ahme, Moses Agada and Adacole Michel.

    They were arrested at Trademore Estate, Lugbe, Abuja, following intelligence reports received by the Commission about their alleged involvement in internet-related fraud.

    Items recovered from the suspects include a Lexus car, laptop computers, and mobile phones.

    In recent times, financial service providers and customers alike have been faced with the persistent problem of e-banking fraud.

     

    This was as a Nigerian journalist, Bartholomew Madukwe, called on the Central Bank of Nigeria (CBN) to sanction financial service providers who fail to add value to money debited from people’s accounts.

     

    As technology has evolved, society has become more sophisticated, and fraudsters have gained more dexterity in the act of swindling people of their hard-earned money.

     

    Madukwe explained that on April 1, 2022, he went to a POS at Ilogbo area of Oko-Afo, Lagos State, for withdrawal of N30,400 (N400 as service charge). Unfortunately, the transaction was declined and the operator with GSM 07013789853 returned only his Access Bank ATM card, saying the transaction was declined.

    From skimming to phishing and card swapping, fraudsters have acquired many tactics to cleverly divest unsuspecting customers of their funds.

     

    Madukwe explained that he received an alert indicating that the said N30,400 has been debited from his Access bank account.

     

    “I approached the POS Operator for the N30,400 and he declined, saying the transaction failed.

    “On 5th April, 2022 (4 days later), having not seen a reverse of the N30,400 that was withdrawn from my Access bank account while POS transaction was declined, I went to the nearest Access bank branch at Agbara (near PHCN office at Bank road) to officially register my complaint. I was given a complaint form to fill and return, which I did.

     

    “At 4:35PM, I received a message from Access bank saying, “Dear NWABUISI MADUKWE, your complaint has been received. An update will be sent to you on 4/12/2022 3:30:00 PM. Case number: CAS-11379471-L5Y2H1”.

    The journalist asserted that on the 14th April, 2022, he went back to Access Bank at Agbara and after over three hours of waiting in the bank, the Customer Care attendant said the financial service providers (PAYCOM NIGERIA LIMITED) could not log in to ascertain his claim.

     

    According to him, the Relationship Manager, Victor Nwachukwu, pleaded with him to be more patient since the N30,400 is not in the bank’s possession.

     

    Speaking with Nwachukwu on the development, he pointed out that financial service providers, such as POS have always been causing such issues between account owners and banks.

     

    “If it were a transaction that was done in the bank or through a bank’s ATM, that would have been resolved in no waste of time. But now, we have to wait for the PAYCOM NIGERIA LIMITED to return the money and we will now reverse it to the account it was debited from.

     

    “I know that it will be reversed but I do not know when. Such issues are best dealt with if it were from one bank to another bank, but certainly not POS providers.”

     

    As of the time of publication, Madukwe’s N30,400 was yet to be reversed and PAYCOM NIGERIA LIMITED, through its agent, has requested for another 72hours to enable them to verify his claim.

    A 23-year-old Point Of Service (POS) agent, Musa Bolarinwa who allegedly stole his employer’s N400, 000 same day he was employed and fled Lagos has been arrested in Kwara State.

    He was arrested by detectives attached to the Adeniji Adele Division and brought back to Lagos and charged with stealing.

    The incident, according to the Police, occurred on 11 August, 2021 at Balogun Market, Lagos Island when the complainant, Bashiru Fereirer, a POS operator employed the suspect and sent him to collect the sum of N400, 000 from a customer for POS transactions.

    Police alleged that after the suspect collected the money from the customer, he fled to Kwara State with the money to spend it and switched off his phone instead of taking the money to his employer.

    Following the development, the complainant, after waiting for two days without seeing the suspect, reported the incident to the Divisional Police Officer in charge of Adeniji Adele division, Lagos Island who directed his crack team led by Inspector Abigail Adebo to fish out the suspect anywhere he could be found.

    The Police team tracked the suspect to Kwara State, arrested him and brought him back to Lagos.

    Bolarinwa was charged before the Tinubu Magistrate court, Lagos on one count charge of stealing.

    Police Counsel, Ajaga Agboko informed the court in the charge marked TD/09/2021 that the defendant committed the offence the same day he was employed.

    Agboko told the court that the complainant trusted the defendant and sent him to a customer to collect the sum of N400, 000 for POS transactions, but that the defendant betrayed the trust reposed in him and fled with the money before he was arrested in Kwara State.

    He said the offence committed was punishable under sections 287 of the Criminal law of Lagos State, 2015

    The defendant pleaded not guilty to the charge and Magistrate T.A Idowu granted him N100, 000 bail with two sureties in like sum.

    Idowu adjoined the case till 23 October, 2021 for mention.

    He ordered that the defendant be kept at the Ikoyi Correctional Centre till he perfected the bail conditions

    Ethiope East LG boss denies knowledge of N5,000 POS levy

    Pharm Victor Ofobrukueta, Chairman of Ethiope East Local Government Area (LGA) has denied knowledge of the N5,000 POS levy that has caused a stir.

    TheNewsGuru.com (TNG) reports Pharm Ofobrukueta specifically stated that he never approved the POS levy, nor the notice distributed by the council’s POS Central Sub-Revenue Committee.

    Mr Tega Enakerakpo, Chairman of the POS Central Sub-Revenue Committee of the LGA verbally assaulted a reporter of TNG as a result of the POS levy.

    Our reporter had sought clarification, and provided Mr Enakerakpo the opportunity to address issues arising from the annual levy.

    Operators of POS across the LGA had lamented the N5,000 levy, describing it as draconian, and an effort to further increase the burden of the people.

    “The council just wants us to suffer. How can they say we should pay N5,000 as levy for operating POS. There are other deductions accrue to us in operating POS. At the end of the day, it’s the masses that will suffer it,” one of the POS operators in the LGA, who asked not to be named told TNG.

    TNG reports the Ethiope East Local Government council announced the N5,000 levy in a release on Tuesday, requesting POS operators across the LGA to comply within 27 days.

    The release titled ‘Demand Notice on POS Operation’ was signed and released by Mr Enakerakpo, the Chairman of POS Central Sub-Revenue Committee Ethiope East Local Government, Islokolo.

    A bank account the Ethiope East Central Sub-Revenue Committee operates with Zenith Bank was also attached with the release along with the contact phone number of Mr Enakerakpo.

    The council also threatened legal action against POS operators who will fail to comply with the notice.

    The release reads in part: “As part of the urgent need of Ethiope East Local Government Council to have a proper and approved P. O. S., operators in the Local Government Area, the Local Government has decided to notify you to pay your P. O. S., annual operational levy of Five Thousand Naira (N5,000.00) only.

    “Take note, that you are requested within 27 days to make payment to the account stated below as failure to abide by this demand notice will attract serious legal action against you”.

    When contacted, Mr Enakerakpo shouted, screaming on top of his voice, saying our reporter “should get out of his phone”. He directed our reporter to reach out to other LGAs that sundry and similar levies are also being collected.

    After introducing himself, and the reason for the call, the committee chairman immediately cut in saying: “Bros, other committee dey for other local government. Make una no dey post nonsense wey una no know on Facebook. All the ones wey una dey do since, I dey see am. So, no dey call me to dey ask me. Anything wey dey your mind do. No be only Ethiope East dey charge POS levy. Abeg, get out from my phone”.

    However, Chairman of Ethiope East LGA has denied knowledge of the N5,000 POS levy.

    In a statement released by the Chief Press Secretary of the LGA, Ehwarieme O. A., the LGA Chairman, Ofobrukueta said he never authorized anybody or committee to distribute a demand notice on POS operators in the local Government Area.

    He further said members of the POS Committee have been invited to his office to clarify their stance.

    The statement reads: “It has been brought to the notice of the authority of the Executive Chairman of Ethiope East Local Government Council, Rt Hon Pharm Victor Ofobrukueta and his executives over the unwanted act of some individuals who without the authorization of the Local Government Chairman distributed notifications urging POS Operators/owners to pay the sum of #5,000 ( five thousand naira) as revenue.

    “The Chairman frowned and debunked the allegations in its entirety. “I have not authorized anybody or committee to distribute demand notice on POS operators in the local Government Area. Though we believe that little financial contributions from everyone who renders certain services and earned money within the LGA will contribute to the growth and development of the local government. We would rather do it within the ambits of the law and without putting more burden on our people. We regret the inconvenience such demand notices might have costs our dear citizens and we have therefore put in place necessary steps to correcting them”.

    “The Chairman was taken aback that the committee went ahead to distribute demand notices without his approval.

    “Meanwhile, all contributions, suggestions, and ideas geared towards the growth and development of the Local Government should be channelled to: www.ethiopeeastlga.dl.gov.ng

    “We regret such misleading information as all the members of that Committee are invited to his office to clarify their stance”.
