    Court throws out Mailafia’s suit seeking end to police probe, invitations

    A High Court in Jos, Plateau State has thrown out a suit filed by former Deputy Governor of the Central Bank of Nigeria (CBN), Dr Obadiah Mailafia seeking to stop the police from investigating him.

    The court said on Tuesday that the police had the power to investigate anybody.

    The police had invited Mailafia for questioning on criminal matters last month but he turned it down and ran to court to stop the invitation.

    This was after two consecutive invitation and interrogation by the Department of State Services, DSS. The police again invited him for questioning.

    Mailafia went to court asking it to restrain the police from inviting him to appear before the Deputy Inspector-General (DIG) Force Investigation Department, Police Headquarters, Abuja.

    Mailafia’s legal team led by Yakubu Bawa, had said his client would not honour the invitation.

    According to him, “It is sacrosanct to note that the DSS is the only statutory body empowered by law to investigate alleged crime against internal security, not the Nigeria Police. Section 3(a) of the Security Agency Act eloquently stipulated this position. In consonance with the said provision, the DSS had commenced investigation into the matter. For the purpose of clarity and emphasis, the DSS is still investigating Dr Mailafia in respect of the said matter.”

    Year in year out, the Nigerian National Assembly (NASS) conducts investigative hearings that at the end of the day end up in archival dustbins.

    TheNewsGuru.com (TNG) in this report x-rays how the NASS had fared in ensuring its reports on its numerous probes on Ministries, Departments, Agencies and MDAs are implemented.

    But the ugly truth staring Nigerians in the face is the fact that the outcome of probes are not taken seriously by the executive arm of government.

    Between July 2019 and June 2020, the House of Representatives alone conducted more than 30 investigative hearings, Niger Delta Development Commission (NDDC) not inclusive.

    In a document exclusively made available to TNG, the list of investigative hearings within 12 months was 30 from July 2019-June 2, 2020. Out of the 30 only two of the listed investigative hearings had gone beyond Committee stage.

    The two probes include; ‘Need, To Investigate The Circumstances of The Alleged Abscondment by Five Nigerian Soldiers of the Operation Harbin Kunama 111 with large amount of cash’.

    The second has a direct bearing on the House which is entitled: Personal Explanation (Order eight Rule (5) $10 millon Bribery Alleged Against The House of Representatives’, promoted by Hon Idris Ahmed.

    This clearly mirrors the actual situation in both legislative Chambers as what matters most is the issue at stake.

    Some of these investigative hearings have a timeline of between 14 days to 40 days.

    Some of the listed investigative panels were constituted as far back as July 2019 and they are still at the committee stage.

    Giving credence to the fact that the executive arm treats the eventual reports churned out with levity.

    Why Executive Treat NASS Reports With Disdain

    An attempt to extract Information from lawmakers met a brick wall as only a few despite a questionnaire sent over two weeks ago responded.

    One of such Lawmakers who spoke under the condition of anonymity told TNG that “it’s true that our resolutions are always treated with levity by the executive arm of government because they shield the MDAs by sweeping them under the carpet to escape justice.

    “The kind of government in place also determine what happens, remember the case of Aviation minister in Goodluck Jonathan’s administration, she was shoved aside because of our report.

    “If the government had shielded the minister nothing will happen to her, so the bottom line is what executive wants that goes because we do not have powers to prosecute or implement.

    The Peoples Democratic Party, PDP opposition leader in the House of Representatives, Rep Kingsley Ogundu Chinda aptly captured it when he told TNG that:

    “Executive is insincere and present APC government under Buhari say what they don’t mean and don’t mean what they say.

    According to Adams, they are playing politics with serious matters like economy, security, health and education.

    “Most of the outcome of Parliamentary probes are revealing and they can’t enforce the recommendations because it’s against them and their private economic interests.

    “Most of the outcome of the probes is indicting on them. Implementing some will amount to suicide. The situation in this administration has remained a recurring decimal as the National Assembly could only bark but cannot bite”.

    After DSS probe, Mailafia gets fresh Police invitation

    The Nigeria Police Force has formally invited a former Deputy Governor of the Central Bank of Nigeria (CBN), Dr. Obadiah Mailafia, to its Abuja office on Monday.

    The police probe comes despite a separate investigation of the former CBN governor by the Department of State Services.

    The DSS had last week invited Mailafia to its Jos office over comments he made during a radio interview wherein he stated that an unidentified northern governor was a Boko Haram commander.

    Mailafia, who was the Presidential candidate of the African Democratic Congress in the last election, said he got the information from some former Boko Haram fighters.

    In an invitation letter addressed to Mailafia, however, the police did not reveal the reason for the invitation.

    The letter was signed by the Deputy Commissioner of Police (Admin) Umar Sanda, on behalf of the Deputy Inspector-General of Police, Force Criminal Investigation Department, Abuja.

    In the document with reference number 3000/X/FHQ/ABJ/VOl.245/8 dated August 20, 2020, the police asked Mailafia to be at the Force Criminal Investigation Department Complex, Garki Area 10, on Monday, August 24, 2020 by 11am.

    The letter titled, ‘Re: Investigation Activities, Police Investigation’, was marked ‘confidential’.

    The letter stated that we “wish to inform you that this office is investigating a case in which your name featured prominently.

    “In light of the above, you are invited to in an interview with the Deputy Inspector-General of Police, FCID Abuja, through the undersigned on Monday, August 24, 2020 by 11am at Room 407, 3rd Floor, FCID Complex, Area 10, Abuja.

    “Accept the assurances of the Deputy Inspector-General of Police, FCID.”

    I really don’t know when Magu’s probe will end – Justice Salami

    The Chairman of the Judicial Commission of Inquiry set up by President Muhammadu Buhari to probe the suspended acting Chairman of the Economic and Financial Crimes Commission (EFCC), Justice Ayo Salami, the has said he does not know when the probe will end.

    Recall that President Buhari had while inaugurating the seven-man panel on July 3, 2020, given it 45 days to round up its activities and submit its report.

    Buhari listed the seven members of the panel to include Salami (North-Central); Deputy Inspector-General of Police, Michael Ogbezi (South-South); a representative of the Federal Ministry of Justice, Muhammad Babadoko (North-Central); and Hassan Abdullahi from the Department of State Services (North-Central).

    Others are Muhammad Shamsudeen from the Office of the Accountant General of the Federation (North-West), Douglas Egweme from the Nigerian Financial Intelligence Unit (South-East) and Kazeem Atitebi (South-West), who serves as the secretary.

    However, when asked by The Punch Newspapers when the probe will end having exceeded the presidential timeline of 45 days, Salami, who is a former President of the Court of Appeal said: “I really don’t know.”

    Former FIFA chief Joseph Blatter has criticised world football’s governing body after its ethics committee decided to drop a case against current President Gianni Infantino.

    “Nothing surprises me anymore,’’ Blatter, who was forced out in 2015 by the ethics committee, said on Thursday.

    According to him, FIFA’s controlling bodies are no longer independent under Gianni Infantino

    On Wednesday, FIFA said that Infantino will not face sanctions over alleged ethics breaches because no conduct violations had taken place.

    FIFA’s ethics committee had launched preliminary investigations into several alleged transgressions, including a FIFA-booked private flight from Suriname to Geneva, and secret meetings between Infantino and Swiss Attorney General Michael Lauber.

    Report says Infantino is still subject to criminal investigations in Switzerland, based on the suspicion that he instigated top prosecutor Lauber to abuse his office.

    The Attorney-General of the Federation, Abubakar Malami (SAN) has said the probe and subsequent suspension of the former acting chairman of the Economic and Financial Crimes Commission (EFCC) is a plus for the administration of President Muhammadu Buhari.

    Malami said this on NTA’s ‘One-on-One’ programme on Friday night while reacting to questions from the host, Cyril Stober.

    The AGF stated that the probe of the suspended EFCC Chairman, Ibrahim Magu, was evidence that no one was above the law.

    Responding to a question on whether the probe was to settle personal scores, the Minister of Justice said he wasn’t the one probing the EFCC rather it was the Presidency that set up a panel to investigate the commission.

    On whether the probe of the EFCC wasn’t a blow to the anti-corruption war, Malami said, “I wouldn’t like to be pre-emptive of the panel put in place by the President relating to an agency but within the context of the first leg of the question as to whether setting up a panel to look into the activities of an anti-corruption agency is a blow or a plus, I think to my mind, it is indeed a plus.

    “It goes on to establish the tradition which this government is known for; a tradition of no fear or favour as far as investigating corruption cases or allegations are concerned. So, to my mind, it is indeed a plus that reinforces and re-establishes a tradition by which the government of President Muhammadu Buhari is known, re-established to the effect that no allegation of corruption can be swept under the carpet. So, it is indeed a plus and not a blow.”

    Recall that President Buhari recently approved the suspension of the embattled former EFCC boss and about 11 other top officials of the Commission including the Secretary to the Commission, Ola Olukoyede.

    The EFCC under Magu is alleged to have been unable to account for the interest accrued to recovered loot of N550bn.

    Speaker of the House of Representatives, Femi Gbajabiamila’s ultimatum to embattled Minister of Niger Delta Affairs, Senator Godswill Akpabio to expose lawmakers neck-deep in the Niger Delta Development Commission, NDDC alleged contract scams will expire today.

    The TheNewsGuru.com (TNG) in this analysis x-rays the implications and the likely outcome of what will happen if Akpabio dares to expose his former colleagues.

    Already agog in various social media networks is a list of contracts allegedly awarded to Akpabio while serving as a Senator in 2017.

    While announcing the ultimatum on the floor of the House on Tuesday, Gbajabiamila had openly declared that he has never executed any contract in the heavily looted NDDC.

    His announcement is a clear indication that he is going to allow his colleagues to face the music if they are caught napping as Akpabio may first and foremost cut off his own head before descending on his former colleagues.

    But the question is, will Akpabio expose lawmakers when he knows they will ensure that his political career ends?

    In this battle of wits, the House allowed the NDDC Committee proceedings to go smoothly by asking the substantive chairman, Olubunmi Ojo to step aside.

    This development has been a rarity in the House of Representatives in the past sixteen years.

    Akpabio failed to read in between the lines that this singular development was an indication that a battle line has been drawn.

    He went ahead to tell Nigerians that lawmakers were the greatest beneficiaries of the contracts of the commission.

    This action drew the flak from the lawmakers who saw this as an effrontery from an aide to the President.

    If he fails to provide the lists of the beneficiaries today, Akpabio may swim alone in his own stew unless he has conclusive evidence and enough documents to back his sweeping allegations.

    The probe panel may continue to do its work, its recommendations will be passed with the speed of light and the entire House, Senate inclusive will demand for Akpabio’s head.

    President Muhamnadu Buhari will use him as his anti-corruption crusade poster to cleanse the past five years of selective prosecution of individuals.

    In all these, it may just be a win-win situation for the Nigerian parliament as Akpabio may be used as the sacrificial lamb.

    NSITF mismanaged N48bn, awarded N4.448bn contract in one day –Ngige

    Minister for Labour and Employment, Senator Chris Ngige, has claimed the suspended management of the Nigeria Social Insurance Trust Fund (NSITF) awarded 332 contracts worth about N4.448 billion in one day, two days after his exit as a minister in 2019.

    Ngige, who stated this, yesterday, when he appeared before the House of Representatives adhoc Committee, also accused the management of allegedly mismanaging N48 billion without paying workers salary.

    He explained that the NSITF management was suspended for committing about 74 different infractions.

    According to him, some of the infractions included alleged extra-budgetary spending, making payment for unapproved expenditure, overspending on administrative issues, irregular direct payment from the Employees Compensation Act, irregularities in staff group assurance policy and making payment for Assurance policy without a policy cover.

    Ngige also accused the suspended management of allegedly engaging solicitors without the approval of the Attorney General of the Federation and making payment to the tune of N33 million to the solicitors also without the approval of the AGF.

    The minister, while insisting that he did not breach any presidential directive in respect of the NSITF, assured the lawmakers that members of the suspended management will be given fair hearing.

    “In 2018, I put up an implementation committee from the ministry to implement both the Auditor Generals special periodic check and the report of the Administrative Panel of Enquiry headed by the then Permanent Secretary – Mrs. Ibukun Odusote. By the time she was redeployed from the Ministry of Labour and Employment in November 2018 to Ministry of Environment, my instructions on the implementation for the two reports on NSITF, to the best of my knowledge, did not receive attention from the NSITF management. All attempts and directives to NSITF even at the ministry top management with parastatals to get the NSITF respond was futile till we went for the general election and I exited as minister May 29, 2019. Of course, they celebrated the exit but all these were captured in my handover notes to the prospective new minister of labour and employment.

    “To make matters worse, when I came back in August 2019, reappointed as minister of labour and employment, right from the 2020 budget defence and their 2019 budget performance, I realised that instead of making amends from the earlier Auditor General’s report, matters have worsened. I, therefore, sought the help of the Auditor General of the Federation and the DG Public Procurement as there was a bazaar of NSITF contract documents being hawked at Wuse and Maitama Abuja for “prospective contractors” on payment of 25 per cent of contract paper value.”

    NDDC MD, Pondei discharged from hospital after collapsing during probe session

    Acting Managing Director of the Niger Delta Development Commission (NDDC), Professor Kemebradikumo Pondei, has left the hospital.

    Prof Pondei, who slumped early Monday afternoon as the House of Representatives Committee on NDDC grilled him on alleged mismanagement of funds up to the tune of N81.5bn in NDDC, is said to have left the hospital where he was taken, during the evening.

    Pondei was being grilled for over an hour when he slowly slumped over his desk, appearing to have fainted.

    Several people present at the hearing rushed to his aid, propping him up and attempting to stabilize him, while the proceeding was halted.

    Soon after, Pondei appeared to be in a seizure with a man holding open his mouth as others held him upright.

    Afterward, he appeared to regain and lose composure intermittently and had to be moved out of the session held in the Conference Room 231 of the House.

    It later emerged that Prof Pondei shunned medical advice to attend the legislative hearing.

    Reacting in a statement on Monday night, NDDC Director, Corporate Affairs, Charles Odili, said Pondei has been ill for two weeks now.

    The statement titled ‘Prof Pondei has been ill’ partly reads: “The Commission wishes to disclose that Prof Pondei has been ill for the past two weeks. This morning, his condition deteriorated, and his doctors advised against attending the hearing.

    “However, he ignored his doctors’ advice because of the realization that his traducers will use his absence at the hearing to soil his name and reputation. He thought he could make it through the hearing and take care of his health later.

    “As it turned out, his doctors were right. Prof Pondei is in a stable condition at a clinic in Abuja.”

    Pondei became the Acting Managing Director of the commission on February 20, 2020, following the termination of Joy Nunieh’s appointment by President Muhammadu Buhari.
